OVERVIEW
The unique dynamics of domestic violence cases create significant challenges for the judiciary. At all stages
of the case – bail, pre-trial, the trial itself and sentencing – judges are faced with difficult questions involving the role of the judge, the limits of judicial intervention, the use of judicial notice and expert evidence,
credibility assessments, cultural considerations and the particular social context of the alleged crime.
This three-and-a-half day skills-based program will bring together judges from across Canada as well as
academics and other experts to work through problems at every stage of a domestic violence case. Using
live simulations, videotaped exercises, feedback from experts and plenary discussions, judges will be given
the opportunity to develop their skills in order to deal with these complex cases effectively.
This program is limited to approximately 40 judges so that all participants will be able to practice the skills
that are taught. Each of the key stages in a domestic violence proceeding will be simulated and the judges
will be asked to manage the case, with feedback from expert facilitators. This is the first offering of a course
that, in whole or in parts, will be added to the permanent NJI curriculum.
Participants will be given the opportunity to deal with the following issues:
The judge’s role in the adversarial process;
The limits of the judge’s role;
When and how the judge should intervene;
Deciding whether the accused should be released or remanded in custody;
Assessing risk in bail proceedings;
The judge’s role in judicial pre-trial discussions;
The recanting complainant;
Resolving the unique evidence issues in these proceedings: judicial notice, expert evidence, how
to deal with the knowledge of context the judge has acquired;
The interaction between criminal and family law proceedings;
Determining credibility in the face of conflicting testimony from complainant and accused;
Managing the court process;
Communicating effectively;
Unexpected events within the trial;
The self-represented accused;
Crafting and delivering an oral judgement; and
Sentencing the domestic violence offender.

APERÇU
Les caractéristiques uniques aux affaires en matière de violence familiale posent d’importants défis à la
magistrature. À toutes les étapes de l’affaire – cautionnement, procès et détermination de la peine – les
juges font face à de difficiles questions relatives à leurs rôles, les limites d’intervention judiciaire, l’utilisation
de la connaissance d’office et de la preuve d’expert, évaluations de la crédibilité, connaissances culturelles et
le contexte social dans lequel s’est produit le présumé crime.
Ce programme basé sur les compétences s’étendra sur trois jours et demi et réunira des juges de partout au
Canada ainsi que des universitaires et autres experts. Ensemble, ils débattront de problèmes simulés qui ont
trait à la violence familiale. Avec l’aide de simulations, d’exercices, de la rétroaction des experts et de discussions en plénière, les juges pourront accroître leurs compétences et ainsi être mieux préparés à faire face aux
affaires complexes dans ce domaine.
Ce programme est limité à environ 40 juges pour que tous les participants puissent mettre les compétences
enseignées en pratique. On simulera chacune des étapes clés d’un procès en matière de violence familiale
et les juges devront gérer l’affaire, à l’aide de la rétroaction des animateurs experts. Il s’agit de la première
édition de ce cours qui sera ajouté, en tout ou en partie, à la programmation permanente de l’INM.
Les thèmes suivants seront abordés :
Rôle du juge dans le processus contradictoire;
Limites du rôle du juge;
Quand et comment le juge devrait intervenir;
Décider si l’accusé devrait être libéré ou demeurer en détention;
Évaluer les risques du cautionnement;
Rôle du juge lors des discussions avant le procès;
Plaignant qui se rétracte;
Résoudre les questions relatives à la preuve dans ces procédures : connaissance d’office,
preuve d’expert, comment traiter de la connaissance du contexte acquise par le juge;
Interaction entre le criminel et les procédures en droit de la famille;
Déterminer la crédibilité dans un contexte de témoignages contradictoires de la part du
plaignant et de l’accusé;
Gestion du processus;
Communication efficace;
Événements inattendus lors du procès;
Accusé non représenté;
Rédiger et présenter un jugement oral.
