The provisionally protection in accordance with art. 67(1),(2) of the EPC is not effective
in France until the translation of the claims has been made available to the INPI and
whether published in the B.O.P.I. or communicated to the person using the invention
in France. There is no time limit to submit the translation of the claims.
According to the provision of art. 70(3)(4) EPC, the applicant or proprietor of the patent
has the right to file a corrected translation of the European application or European
patent in the event the application or patent in the language of the translation confers
a narrower protection than that in the language of the proceedings. The corrected
translation will be regarded as authentic (except for revocation proceedings).
This code refers to the submittion to the INPI of a corrected translation of the claims,
event which is advertised in the "Bulletin Officiel de la Propriété Industrielle" under the
above-mentioned heading adding an asterisk before the EP publication number.
Any person who in good faith is using (or has made effective and serious preparations
for using) an invention which does not constitute infringement of the patent in the
original translation may continue such use without payment after the corrected
translation has taken effect.
Article 4 of the French Patent Law (see explanation of code EP P ET1) is valid also for
translations to obtain the provisional protection in accordance with article 67 EPC.
