Box 710 Casselman, Ontario KOA'IMO (613) 764-3139 LA CORPORATION DU VILLAGE DE CASSELMAN REGLEMENT No.: 2008-257 Reglement amendant Ie Reglement de Zonage No. 1996-635, tel qu'amende; ATTENDU QUE Ie Reglement de Zonage No. 1996-635 regit I'usage des terrains, I'utilisation et la construction des batiments et des structures sur Ie territoire du Village de Casselman; ET ATTENDU QUE Ie Conseil de la Corporation du Village de Casselman juge approprie, de modifier Ie Reglement de Zonage No. 1996-635 tel que decrit dans ce reglement; EN CONSEQUENCE Ie Conseil de la Corporation du Village de Casselman decrete ce qui suit: Article 1: La propriete situee du cote ouest de la rue St-Joseph, au sud de la rue Jeanne Mance et au nord de la rue Ste-Marie, decrite comme Ie Lot 7 et une Partie du Lot 8, cote ouest de la rue St-Joseph, Plan R.W. Lendrum P.L.S., en date du 13 mai 1890, Village de Casselman, et arborant Ie numero civique 661, rue St-Joseph, identifiee en noir sur Ie plan Annexe « A» ci-joint, faisant partie integrante de ce reglement, sera la propriete concernee par Ie present reglement. Article 2: L'article 6.1.3 intitule « Zones d'exception» est par la presente modifie en ajoutant a la fin Ie nouveau paragraphe suivant: (7) R1-7, 661, rue St-Joseph Nonobstant les dispositions de la zone « Residentiel Premiere Densite (R1) », la propriete zone « R1-7» a l'Annexe "An sera developpee selon les dispositions suivantes : Usqge autorise: Article 3: Un batiment d'habitation de type unifamilial avec une unite d'habitation accessoire au sous-sol. Le plan Annexe « A » du Reglement de Zonage No. 1996-635 est par la presente amende en modifiant de « Residentiel Premiere Densite (R1) » a « Residentiel Premiere Densite - Exception (R1 7) », Ie terrain identifie a I'Annexe « A » du present reglement. Page: 1 de 3 ARR!::TE 2008-257, ARR!::TE MODIFIANT L'ARR!::TE 96-635 PROPRIETE AU 661, RUE ST-JOSEPH Article 4: Sujet a I'avis d'adoption de ce rE3glement conformement aux dispositions de I'article 34(18) de la Loi sur I'amenagement du territoire, L.R.O. 1990, tel qu'amendee, Ie present reglement entrera en vigueur a la date de son adoption par Ie Conseil de la Corporation du Village de Casselman sous reserve de I'approbation de la Commission des Affaires municipales de l'Ontario ou suite a la date limite pour Ie depot des avis d'opposition conformement a I'article 34(21), selon Ie cas. Greffier Page: 2 of 3 THE CORPORATION OF THE VILLAGE OF CASSELMAN BY-LAW No. 2008-257 Being a By-Law to amend Zoning By-Law 1996-635 WHEREAS Zoning By-Law No. 1996-635 regulates the use of land and the use and erection of buildings and structures within the Village of Casselman; AND WHEREAS the Council of the Corporation of the Village of Casselman deems it advisable to amend Zoning By-Law No. 1996-635 as hereinafter set forth; NOW THEREFORE the Council of the Corporation of the Village of Casselman enacts as follows: Section 1: The property located on the west side of St-Joseph Street, south of Jeanne Mance Street, and north of Ste-Marie Street, designated as Lot 7 and Part of Lot 8, west side of St-Joseph Street, Plan R.W. Lendrum P.L.S., dated May 13, 1890, Village of Casselman, and bearing the civic number 661 St-Joseph Street, identified in black on Schedule "A" attached hereto and forming part of this by-law, shall be the property affected by this by-law. Section 2: Section 6.1.3 entitled "Zone Exceptions" is hereby amended by adding at the end the following new paragraph: (7) R1-7, 661 St-Joseph Street Notwithstanding the provisions of the « First Density Residential Zone (R 1)>>, the property zoned « R1-7 }) on Schedule « A }) of this By-law shall be developed according to the following provisions: Permitted Use: A single detached dwelling house with an accessory dwelling unit in the basement Section 3: Schedule« A » of Zoning By-Law No. 1996-635 is hereby amended by changing from « First Density Residential Zone (R1)" to « First Density Residential Zone - Exception (R1-7)>> the zoning category of the land identified on Schedule « A» of this by-law. Section 4: Subject to the giving of notice of passing of this by-law, in accordance with Section 34(18) of the Planning Act, R.S.O. 1990 as amended, this by-law shall come into force on the date of Page: 1 of 3 BY~LAW 2008~257. A BY-LAW AMENDING ZONING BY-LAW 96-635 PROPERTY AT 661 ST-JOSEPH STREET, CASSELMAN, ON passing by the Council of the Corporation of the Village of Casselman where no notice of appeal or objection is received, pursuant to Section 34(21) of the Planning Act, R.S.O. 1990 as amended. Cette modification aura pour but de reconnaitre I'existence d'une unite d'habitation au sous-sol du batiment de type unifamilial. EXPLANATORY NOTE Purpose and Effects of By-Law The property affected by this amendment to Zoning By-Law No. 1996-635 is located on the west side of St-Joseph Street, south of Jeanne Mance Street, and north of Ste-Marie Street. The property is designated as Lot 7 and Part of Lot 8, west side of St-Joseph, Plan R.W. Lendrum P.L.S., dated May 13, 1890, Village of Casselman, and bears the civic number 661 St-Joseph Street. The purpose of the amendment is to change the zoning category from "Residential First Density (R1)" to "Residential First Density- Exception (R1-7)". The amendment will recognize the existence of an accessory dwelling unit in the basement of the single detached dwelling house.
