EFFECTIVE
APPLICATION
AND
A
HARMONIOUS DEVELOPMENT OF THE TERRITORY

Pour les fins de la présente, les conseillers déclarent
avoir lu le présent règlement et renonce à la lecture
dudit règlement.
For the purpose of this, councillors declare having
read the present by-law and waive the reading of the
said by-law.
CONSIDÉRANT QUE la MRC d’Argenteuil a émis un avis de
non-conformité (résolution 14-10-339) envers l’article
3 du règlement 226-2014 ;
WHEREAS the RCM of Argenteuil issued a notice of noncompliance (Resolution 14-10-339) to Article 3 of
Regulation 226-2014;
CONSIDÉRANT les pouvoirs prévus à l’article 137.4.1 de
la loi sur l’aménagement et l’urbanisme qui permettent
dans
pareil
cas
au
conseil
de
la
municipalité
« d’adopter un seul règlement qui ne contient que les
éléments du règlement désapprouvé qui n'ont pas
entraîné cette désapprobation »;
WHEREAS that in such cases, Article 137.4.1 of the Law
on Planning and Development allows the municipal
council to "adopt a single regulation that contains
only the elements of the by-law that have not driven
this non-compliance";
CONSIDÉRANT QU’en vertu de ce même article de la loi,
un tel règlement n’a pas à être soumis de nouveau à la
consultation publique ou à l’approbation des personnes
habiles à voter, mais doit toutefois être transmis à la
MRC pour approbation ;
WHEREAS within the same section of the law, the
affected by-law does not need not be represented to the
public by public consultation nor does it need the
approval of qualified voters, it must nevertheless be
resubmitted to the RCM for approval ;
EN CONSÉQUENCE, il est proposé par Monsieur le
Conseiller Richard Francoeur, appuyé par Madame la
Conseillère Chantal Scapino et résolu que soit adopté le
règlement numéro 226-2014 -1, intitulé
« Règlement modifiant le règlement de zonage 192-2012 »
qui ne contient pas les éléments de l’article 3 qui ont
fait objet de non-conformité . Une copie du présent
règlement

en
annexe
au
livre
des
délibérations.

resolved to adopt By-Law No. 226-2014-1 entitled "By-Law
Amending the zoning By-Law 192-2012" with the removal of
elemts in article 3 of the by-law that were subject to
non compliance. A copy of this by-law is annexed in the
minute book.

CONSIDÉRANT QUE la MRC d’Argenteuil a émis un avis de
non-conformité (résolution 14-10-339) envers l’article
3 du règlement 231-2014 ;

Regulation 231-2014;

programme d’infrastructures Québec-Municipalités (PIQM)
à DWB Consultants pour un montant de 22 500 $ taxes en

taxes à DWB Consultants dans le cadre du projet de

administratifs approuvé pour une subvention sous le
programme d’infrastructures Québec-Municipalités.
THEREFORE,
it
is
proposed
by
Councillor
Peter
Burkhardt, seconded by Councillor Gabrielle Parr and
unanimously resolved to authorize the payment for the
sum of $ 9 191.25 plus taxes to DWB Consultants under
the
Construction
of
a
Municipal
Garage
and
Administrative Offices project which has been approved
for a grant under the Quebec Municipal infrastructures
program.

OF A MUNICIPAL GARAGE AND ADMINISTRATIVE

CONSIDÉRANT QUE le conseil a adopté la résolution no
2014-06-R102 afin d’octroyer un contrat pour des
services professionnels en ingénierie de structure pour
le projet de construction d’un garage municipal et de
bureaux administratifs dans le cadre du programme
d’infrastructures Québec-Municipalités (PIQM) à DWB
Consultants pour un montant de 17 427.70 $ taxes en
sus;
WHEREAS the council has adopted resolution no 2014-06R102 to award the contract for structural engineering
services regarding the construction project of the
municipal garage and administrative offices under the
Quebec Municipal infrastructures
program
(PIQM)
to
DWB
Consultants
for
the
amount
of
$
17 427.70 plus taxes;
CONSIDÉRANT la préparation du rapport de conception,
des plans et devis préliminaires et de l’estimation des
coûts à 100 % et la réalisation des plans et devis
définitifs à 75 % selon la facture numéro 1996 au 31
août 2014 ainsi que l’avancement mis à jour des plans
et devis définitifs à 95 % au 30 septembre 2014 selon
la facture numéro 2048 ;
WHEREAS 100 % of the work relating to the design
report, preliminary plans and specifications, and
budget estimate as well as 75 % of the work relating to
the final plans and specifications have been completed
as of the 31st of August as mentioned in invoice number
1996 and that 95% of the work relating to the final
plans and specifications have been completed as of the
30th of September and updated as mentioned in invoice
number 2048;

THEREFORE,

unanimously resolved to authorize the payment for the

ATTENDU QUE la Municipalité du Canton de Harrington a
procédé à la négociation du renouvellement de contrat
pour le poste de Directeur des Travaux Publics avec
Monsieur Neil Swail avec modification des conditions
actuelles ;
WHEREAS the municipality proceeded with negotiating the
renewal of Mr. Neil Swail’s contract as Director of
Public Works with modifications made to the current
conditions;
ATTENDU QUE le comité de ressources humaines a présenté
les nouvelles conditions du contrat de Directeur des
Travaux Publics à Monsieur Neil Swail ;
WHEREAS the human resources committee presented the
modified conditions relating to the Director of Public
Works’ contract to Mr. Neil Swail;
PAR CONSÉQUENT, il est proposé par Madame la Conseillère
Gabrielle Parr, appuyé par Monsieur le Conseiller
Richard Francoeur et résolu à l’unanimité
Que le conseil de la Municipalité du Canton de
Harrington procède à la signature du contrat de travail
de Monsieur Neil Swail à titre de Directeur des Travaux
Publics qui entrera en vigueur le 17 février 2015;
Le salaire ainsi que les conditions sont stipulés audit
contrat de travail dûment approuvé par les parties;
Que le maire, monsieur Jacques Parent et la directrice
générale, Madame Sarah Channell, soient mandatés à
signer pour et au nom de la municipalité ledit contrat
de travail.
