CONSENT AGENDA/QUESTIONS SOUMISES À L’APPROBATION DU CONSEIL 4.1 Street Closure Request – Atlantic Ballet Theatre of Canada downtown event – August 18, 2016 (inclement weather – August 19) – Streets affected Main, Lutz and Mechanic Séance ordinaire publique 2 Le 18 juillet 2016 Motion: That the following street closure be approved to allow the Atlantic Ballet Theatre of Canada to execute their event as planned August 18. Street Closure Request: • From 11 a.m. on Thursday August 18th, 2016 until 12 p.m. on Thursday August 18th, 2016 • Main Street from Lutz Street to Mechanic Street Leaving Lutz and Mechanic open to through traffic. In case of inclement weather, they are requesting an alternate date for the street closure; either Wednesday, August 17th or Friday, August 19th. Should the rain date be activated, organizers will communicate with the Events Management Committee as well as all affected stakeholders to advise of the change. PUBLIC PRESENTATIONS/PETITIONS/APPEARANCES/ PRÉSENTATIONS, PÉTITIONS ET INTERVENTIONS PUBLIQUES 5.1 Presentation – Art Moment Featured artists: Lise Gagné – Bursting Freedom, 2016 Acrylic, ink and epoxy varnish Marilyn Cunningham – Quiet Path, 2016 Watercolour on paper 5.2 Presentation – L'Art ici SVP – Lisa Griffith & Matt Williston Mr. Williston and Ms. Griffith presented an overview of the 2016 Inspire Festival. They thanked the City of Moncton for their continued support of this festival. This year’s participants provided great feedback to the organizers, and most commented on the friendly and welcoming atmosphere of Greater Moncton. Both, Mr. Williston and Ms. Griffith, are beginning work on the 2017 Festival in the hopes of it becoming bigger and better. 5.3 Presentation – Humanity Project – Charles Burrell and Yves Doucet Mr. Burrell and Mr. Doucet came before Council this evening to discuss homelessness and poverty in the City of Moncton. Mr. Burrell had come before Council in November 2015 requesting a bus and piece of land be donated by the City of Moncton in order to feed and house the homeless. The Humanity Project has since that time struck a deal with Curl Moncton to utilize the facility at 358 Lutz Street. As this building is for sale, the group is requesting that the City forgive the debt on the building, to allow them to purchase the building. The plan is to revamp the building to house studio apartments and a community garden. Mr. Burrell advised Council the group has been successful in securing deals with local grocery stores to provide food for the clients. Councillor Crossman advised Mr. Burrell he will support the groups imitative and will work with Mr. Martin and Ms. Dallaire in order to prepare a plan. In response to Councillor Crossman’s request, Mr. Burrell indicated, for the record, that the group is looking for the City to forgive the $190,000 debt on the building. Once the loan is forgiven, the group will be able to purchase the building from Curl Moncton. The plan is to tear down a portion of the building and rebuild to allow for studio apartments and office space in order to help pay and maintain the building. Gardens will be planted and maintained in order to have fresh local vegetables to help feed their clients. 5.4 Presentation – Atlantic Ballet Theatre of Canada downtown event – Susan Chalmers-Gauvin, Allen Kaeja, and Igor Dobrovolskiy Ms. Chalmers-Gauvin came before Council to promote the event taking place on August 18, 2016. This event is a large scale community event, whereby, employees of downtown businesses are animated through dance - engaging real people working in real businesses. The performance throughout the downtown core will end with a Flock Landing where observers and audience participate in a movement based performance. The event concludes at the Riverfront Park where a community barbecue and a forum will take place allowing attendees to provide input on how Séance ordinaire publique 3 Le 18 juillet 2016 they imagine the future of downtown core. This open dialogue process will be led by facilitator Amanda Hachey. Both Mr. Kaeja and Mr. Dobrovolskiy provided a brief description of the dance/performance that will be required of participants. 5.5 Presentation – CAMA Recognition Mr. Dubé recognized Mr. MacLellan for his excellent work as the chair of CAMA (Canadian Association of Municipal Administrators); his year long term ended this past June. Mr. MacLellan provided an overview of the award presented to the City of Moncton for their work on environmental issues. Other Presentation/Autres presentations 6. PLANNING MATTERS/ QUESTIONS D’URBANISME 6.1 Public Presentation – MID Business Park - Urban Boundary Amendment Mr. Arcand provided a brief overview of the proposed project. An application has been received from Crandall Engineering, on behalf of Moncton Industrial Development Ltd (MID), for a business park development just south of TransCanada Highway (TCH – 2) near Elmwood Drive. The development - Moncton South Business Park - will include 54 lots on 63.55 hectares (157 acres) of lands and has been designed to accommodate growing small and medium sized business with many of the lots between 0.6 and 0.8 hectares in size. A public hearing is scheduled for August 17, 2016 to hear any objections to the project. No recommendations are permitted during the public presentation. 6.2 Public Hearing – 203 DesBrisay Avenue (part of PID 70620406) (P2 to IP) – No objections received Ms. Anderson indicated that the application for 203 DesBrisay Avenue is to accommodate a gravel storage area as part of a new development. The applicant is proposing to construct a building located within the front part of the lot, in the IP Zone (Industrial Park). This building will accommodate the combined offices and service shop for Fero Waste and Recycling and Dexter Construction. The remainder of the lot will have private accesses and will be fenced and gravelled. This part of the lot will be used for outdoor storage which is the proposed use for the rezoned land the combined shops of two local businesses. There were no objections received for this rezoning. Ms. Anderson provided an update to council on the urban boundary of the property. Development is permitted outside the urban boundary; however, city services are not permitted to be part of the development. Motion: That the rezoning process proceed for By-law amendment Z-213.28, from J.R Daigle, J R Daigle Engineering Ltd., on behalf of Municipal Enterprises Ltd., to rezone property at 203 DesBrisay Avenue (part of PID 70620406) from P2 (Open Space and Conservation Zone) and HI (Heavy Industrial Zone) to IP (Industrial Park Zone) to accommodate a gravel pad for outdoor storage (File 16MZ-40922). Further, that the rezoning shall be subject to a conditional rezoning agreement, including but not limited to the following conditions: 1) 2) 3) Street trees are required to be planted every 10 metres along the entire frontage of the lot on DesBrisay Avenue, as per section 58(2) of Zoning By-law Z-213; The development shall be carried out in substantial conformance with the plans submitted as Schedule B; and That the $1000 security deposit required for a Conditional Rezoning Agreement and by-law registry fees be paid prior to registration. Other additional conditions recommended by the Engineering and Environmental Services Department: 4) The developer shall be responsible to design and construct surface water storage, in accordance with the plans attached hereto as Schedule C; 5) Commencing on the one year anniversary date after this agreement comes into effect, and every year thereafter, for 3 years total, a third party engineering firm will be required to certify, through topographic surveying, that the surface water storage mentioned in the previous paragraph, is in existence and that the site is conforming with the approved design. After the initial 3 years, subsequent certifications will be done at a 2 year interval, unless otherwise directed by the City; Moved by: Councillor Boudreau Séance ordinaire publique 4 Le 18 juillet 2016 Seconded by: Councillor Léger MOTION CARRIED 6.3 Public Hearing – for Horsman Road (PID 70453618) (R3 to SC) – No objections received Ms. Anderson introduced the proposal to re-designate property on the Horsman Rd. from R3 to SC to accommodate a mixed used development. The property itself is well beyond the 30 meter specifications from the creek. A traffic study must be completed at the developers expense prior to any permits be granted. No objections were received for this rezoning. Motion: That the amendment process proceed for Municipal Plan By-law amendment Z-113.8 and Zoning By-law amendment Z-213.27 to accommodate a mixed use commercial development. Further, that the rezoning shall be subject to a conditional rezoning agreement, including but not limited to the following conditions: 1) 2) 3) 4) 5) 6) 7) That the developer agrees to contribute $ 13,662.00 to the costs of the Jonathan Creek Trunk Sewer services that this development benefits from. This payment shall be made by the developer to the City prior to any City permits being granted; That the Developer agrees to share in part of the cost of traffic signals at the intersection of Berry Mills Road and Horseman Road. A payment of $3,333.33 shall be made to the City prior to any City permits being granted any permits; That a second bike rack be provided at the northern end of the development next to the proposed bank; That a traffic study be completed prior to City permits being granted; That any recommendation in the traffic study, as confirmed by the Engineering Depart, be implemented by the developer, at the developer’s cost; The development shall be carried out in substantial conformance with the plans and drawings submitted as Schedules B & C; and That the $1000 security deposit required for a Conditional Rezoning Agreement and bylaw registry fees be paid prior to registration. Councillor Butler recommended that another bus stop be placed along Horsman Rd. In response to Councillor Léger’s question, Ms. Anderson indicated that a bus layby was not recommended for that area. He requested that in future development that this factor be taken into consideration, as to not have a repeat of Plaza Blvd. Moved by: Councillor Léger Seconded by: Councillor Turner MOTION CARRIED 6.4 New Rezoning Application for 296, 312, 316, 320 Killam Drive (part of PID 70355649) (SC to IP) Ms. Anderson provided an overview of the proposed project for rezoning of 296, 312, 316, 320 Killam Drive from SC to IP in order to accommodate the continued use of the land for industrial purposes. The application will be heard at the next Planning Advisory Committee July 27, 2016. A public hearing has been set for August 17 to hear any objections to the project. Motion: That Moncton City Council proceed with the Zoning By-law amendment being By-law Z-213.34 and: 1) That a public hearing be set for August 17, 2016; and 2) That By-law Z-213.34 be referred to the Planning Advisory Committee for its written views; and That the rezoning, if approved, should be subject to a conditional zoning agreement, including but not limited to: 1) Street trees are required to be planted every 10 metres along the entire frontage of the lot on Killam Drive, as per section 58(2) of Zoning By-law Z-213; 2) An opaque fence shall be located on the site to screen the outdoor storage from Killam Drive; 3) That a minimum 6 metre wide landscape buffer be located along the length of Killam Drive, as per the approved site plan; 4) The development shall be carried out in substantial conformance with the plans submitted as Schedule B; and 5) That the $1000 security deposit required for a Conditional Rezoning Agreement and by-law registry fees be paid prior to registration. Ms. Anderson advised Council that all other properties along that road are currently zoned IP. MOTION CARRIED 7. STATEMENTS BY MEMBERS OF COUNCIL/ EXPOSÉS DES MEMBRES DU CONSEIL Paulette Thériault • Expressed her delight for the art work in the Council Chambers. • Congratulated Geneviève Lalonde on earning a spot on the Canadian Olympic team. • Congratulated the organization Mosaiq Festival held in the downtown area this past weekend. • Spoke of the beauty of the Fundy Trial and the ongoing project. • Recognized several young citizens Veronica Carpenter and Mohamad Alim-Mahala for their work with immigration within the City. Blair Lawrence • Spoke of the festivals and events happening in the City of Moncton in the last few weeks. Charles Léger • He spoke of an initiative in Fredericton of spraying symbols on sidewalks, and suggested that any sidewalk off parking lot be spray painted indicating that it is a booting lot. Bryan Butler • Extended his condolences to the family of the late Moncton firefighter Andrew Petrie. Pierre Boudreau • Spoke of the City of Dieppe’s policy to exempt dogs that have a chip implant will no longer need to be licensed. • He questioned staff as to the purpose of licensing dogs and inquired as to where the money goes from licensing animals. Greg Turner • He congratulated Bill Doherty and his team on the success of the Atlantic Nationals. • Spoke of the success of the Mosaiq Festival. • Spoke of the Diner en Blanc which took place on the Waterfront this past weekend. • Nitro Circus will be in the City on July 29, and Selena Gomez on September 04 – both these are International events. • Sent his condolences to the family of Moncton firefighter Andrew Petrie. Dawn Arnold • Spoke of the many events happening in Moncton • Met with Minister John McCallum, Federal Minister of Immigration, Refugees and Citizenship • Spoke of the many families who have taking on a Syrian family in order to assist with the transition to their new home. • Spoke of the U18 Curling championships that will be held in our city in 2017. • She invited citizens to provide their suggestions for the betterment of the City – by contacting a councillor, adding a comment to the website/social media sites, or calling the City of Moncton. 8. REPORTS AND RECOMMENDATIONS FROM COMMITTEES AND PRIVATE MEETINGS/ RAPPORTS ET RECOMMANDATIONS DES COMITÉS ET RÉUNIONS À HUIS CLOS 8.1 Recommnendation – Committee of the Whole – June 27, 2016 1. That “No Parking” Restrictions be added on both sides of Crowley Farm Road commencing at Morton Avenue and extending northerly for a distance of 250 metres and that By-Law T-310 be amended accordingly. Moved by: Councillor Léger Seconded by: Councillor Butler MOTION CARRIED 2. That “No Parking” restrictions be added to the west side of Mitchener Avenue commencing at Collishaw Street and extending 35 meters, and that By-Law T-310 be amended accordingly. That the City of Moncton extend the current agreement with HotSpot Parking Inc. for a period of one year ending on July 31st, 2017, including a transaction fee of 2.67% which will be retained by HotSpot Parking Inc., and further that Engineering and Environmental Services research and develop an RFP to source the industry to provide a complete pay-by-phone solutions for parking, transit and other services. That a formal letter be forwarded to the Cities of New Brunswick seeking their support to amend the Municipalities Act to provide municipalities the ability to license booting companies. That an ad hoc committee be formulated to explore resolutions to the booting issue to report back to City Council with a summary of their findings by October 31st, 2016. The following councillors have been appointed. • • Councillor Butler Councillor Turner Moved by: Councillor Butler Seconded by: Councillor Léger Councillor Crossman provided the following concerns and suggestions for the newly appointed adhoc committee. He indicated that imposing regulations for private lot owners on booting may exceed the City’s authority as would impede on the private property owner’s rights. He hopes that the committee will take into account Councillor Léger’s suggestion on symbols. He also suggested the perhaps the use of sandwich boards be implemented at the entrance of the private lot. MOTION CARRIED 1. That Moncton City Council approve the Forgivable Loan Agreement between the City of Moncton an the Province of New Brunswick related to the construction of the Moncton Downtown Centre, and that the Mayor and City Clerk be authorized to sign the agreement and Letter of Offer with the Province of New Brunswick and affix the Corporate Seal of the City of Moncton thereto. That City Council authorize the sale of PID # 1014703 and an approximate 3,121 sq/ft portion of PID # 70351614 (located between PID #’s 70524921 and 728915) Millennium Blvd. to Controls + Equipment Ltd. for the appraised sum of $48,200 plus applicable taxes, subject to the retention of a Municipal Services Easement over the entire 3,121 sq/ft portion of PID # 70351614, and that the Mayor and City Clerk be authorized to enter into an agreement of purchase and sale with the purchaser by signing and affixing the Corporate Seal of the City of Moncton to said agreement and all other documentation required to close the transaction. That The Heritage Board recommends that Moncton City Council proceed with the adoption process regarding By-Law #Z-1116, being the Heritage Conservation By-Law, and 2. That a public hearing be set for the Regular Council Meeting of August 17, 2016. Moved by: Councillor Theriault Seconded by: Councillor Léger MOTION CARRIED 9. REPORTS FROM CITY MANAGER/ RAPPORTS DU DIRECTEUR MUNICIPAL 9.1 Quotation #QP16-042 - School Crossing Guard Services Motion: That that Quotation #QP16-042 for the provision of School Crossing Guard Services be awarded to the lowest Bidder meeting the Terms & Conditions, and Specifications, being Neptune Security Services Inc., in accordance with the Hourly Labour Rates specified in Neptune Security Services Inc.’s bid for Years One (1), Two (2) and Three (3) of the agreement. A lengthy discussion took place between Councillor Léger and staff members regarding his concerns with the process of the RFP and the award. Mr. Dubé reiterated, Mr. MacDonald’s comment that a municipality is not legally able to discriminate against any vendor outside the Province. Ms. Carter reviewed the ‘3 strike rule’ to terminate a contract with a successful vendor. That Request for Proposal #RFP16-051 – Transportation Dispersal Plan (Moncton Downtown Centre), be awarded to the highest-scoring Proponent, being IBI Group Professional Services (Canada) Inc., for the Total Proposed Price of $115,001.15, including H.S.T. @ 15%, and all estimated disbursements and out-of-pocket expenses. 2. Furthermore, it is recommended that the Mayor and City Clerk be authorized to sign an agreement with the successful Proponent to complete a Transportation Dispersal Plan for the Moncton Downtown Centre, and affix the Corporate Seal of the City of Moncton thereto. Moved by: Councillor Léger Seconded by: Councillor Butler In response to Councillor Pellerin question, Mr. Richard replied that he cannot confirm that the tender price includes the clearing of the lot at Queen and Lewis which Council has approved to close. Ms. Carter indicated that Council has the option to propose an amendment to the recommendation to delete that lot. Councillor Pellerin indicated that he wishes to table the motion. Williston et Mme Griffith donnent un aperçu du Festival Inspire de 2016. Ils remercient la Ville de Moncton de son soutien continu envers ce festival. Les participants de cette année ont offert d’excellents commentaires aux organisateurs, et la plupart d’entre eux ont mentionné l’atmosphère chaleureuse et conviviale du Grand Moncton. M. Williston et Mme Griffith ont commencé le travail pour le festival de 2017 dans l’espoir qu’il devienne plus grand et meilleur. 5.3 Présentation – The Humanity Project – Charles Burrell et Yves Doucet M. Burrell et M. Doucet se présentent devant le Conseil pour discuter de l’itinérance et de la pauvreté dans la Ville de Moncton. M. Burrell s’est présenté devant le Conseil en novembre 2015 pour demander que la Ville de Moncton fasse don d’un autobus et d’une parcelle de terrain afin de nourrir et d’héberger des sans-abri. L’Humanity Project a depuis conclu un marché avec Curl Moncton pour utiliser l’installation au 358, rue Lutz. Puisque cet immeuble est à vendre, le groupe demande que la Ville efface la dette de l’immeuble, afin de lui permettre de l’acheter. Le plan est de remanier l’immeuble pour qu’il contienne des studios et un jardin communautaire. M. Burrell informe le groupe que le Conseil a réussi à conclure des ententes avec des épiceries locales pour fournir de la nourriture aux clients. Le conseiller Crossman informe M. Burrell qu’il appuiera l’initiative du groupe et qu’il collaborera avec M. Martin et Mme Dallaire pour préparer un plan. En réponse à la demande du conseiller Crossman, M. Burrell indique aux fins de consignation que le groupe désire que la Ville efface la dette de 190 000 $ de l’immeuble. Une fois le prêt effacé, le groupe sera en mesure d’acheter l’immeuble de Curl Moncton. L’objectif est de démolir une partie de l’immeuble et de le reconstruire pour permettre des studios et un espace à bureaux afin d’aider à payer et à entretenir l’immeuble. Des jardins seront plantés et entretenus afin d’avoir des légumes frais locaux pour aider à nourrir les clients. 5.4 Présentation – Événement au centre-ville du Ballet-théâtre atlantique du Canada – Susan ChalmersGauvin, Allen Kaeja et Igor Dobrovolskiy Mme Chalmers-Gauvin se présente devant le Conseil pour promouvoir l’événement du 18 août 2016. Cet événement est un événement communautaire à grande échelle, où les employés des entreprises du centre-ville sont animés par la danse. De vraies gens travaillant dans de vraies entreprises y participent. Séance ordinaire publique 12 Le 18 juillet 2016 Le spectacle au cœur du centre-ville se terminera avec une activité où les observateurs et le public participeront à une représentation basée sur le mouvement. L’événement se termine au parc Riverain, où un barbecue communautaire et un forum auront lieu pour permettre aux participants de donner leur avis sur la façon dont ils imaginent l’avenir du cœur du centre-ville. Ce dialogue ouvert sera animé par Amanda Hachey. M. Kaeja et M. Dobrovolskiy font une brève description de la danse ou de la représentation qui seront requises des participants. 5.5 Présentation – Reconnaissance de l’ACAM M. Dubé souligne l’excellent travail de M. MacLellan en tant que président de l’Association canadienne des administrateurs municipaux (ACAM). Son mandat d’un an s’est terminé en juin dernier. M. MacLellan donne un aperçu de la récompense remise à la Ville de Moncton pour son travail sur des questions liées à l’environnement. Autres présentations 6. PLANNING MATTERS/ QUESTIONS D’URBANISME 6.1 Présentation publique – Parc commercial de Développement industriel de Moncton – Modification de la limite urbaine M. Arcand fournit un bref aperçu du projet proposé. Une demande a été reçue de Crandall Engineering, au nom de Développement industriel de Moncton Ltée, pour l’aménagement d’un parc commercial tout juste au sud de la route transcanadienne (route 2), près de la promenade Elmwood. Cet aménagement, le parc commercial du sud de Moncton, comprendra 54 lots de 63,55 hectares (157 acres) de terrains et a été conçu pour accueillir de petites et de moyennes entreprises croissantes, puisque bon nombre des lots ont une taille entre 0,6 et 0,8 hectare. Une audience publique est prévue le 17 août 2016 pour entendre toutes les objections à ce projet. Aucune recommandation n’est permise durant la présentation publique. 6.2 Audience publique – 203, avenue Desbrisay (partie du terrain portant le NID 70620406) (P-2 à IP) – Aucune objection reçue Mme Anderson indique que la demande pour la propriété située au 203, avenue Desbrisay vise à permettre l’aménagement d’une aire d’entreposage de gravier dans le cadre d’un nouveau projet d’aménagement. La demanderesse propose de construire un bâtiment dans la partie avant du lot, dans la zone IP (parcs industriels). Il abritera à la fois les bureaux et les ateliers de service de Fero Waste and Recycling et de Dexter Construction. Le reste du lot sera clôturé et recouvert de graviers et disposera d’un accès privé. Cette partie du lot servira à l’entreposage de produits en plein air, ce qui est l’utilisation proposée dans la demande associée aux ateliers combinés de deux entreprises locales. Aucune objection n’a été présentée relativement à ce projet de rezonage. Mme Anderson présente au Conseil une mise à jour concernant la limite urbaine de la propriété. Les aménagements sont permis à l’extérieur de la limite urbaine; toutefois, les services municipaux ne sont pas autorisés dans l’aménagement. Motion : Que le processus de rezonage relatif à la modification de l’arrêté Z-213.28, de J.R. Daigle, J.R. Daigle Engineering Ltd., au nom de Municipal Enterprises Ltd., visant à rezoner la propriété située au 203, avenue Desbrisay (portion du NID 70620406), pour qu’elle passe d’une zone P-2 (Espaces verts et conservation) et zone HI (industries lourdes) à une zone IP (parcs industriels) afin d’aménager une plateforme de gravier aux fins d’entreposage en plein air aille de l’avant (dossier 16MZ-40922). De plus, le Comité recommande que le rezonage fasse l’objet d’une entente conditionnelle sur le rezonage, qui comprend les dispositions suivantes, sans toutefois s’y limiter : 6) 7) 8) Des arbres de rue doivent être plantés aux 10 mètres sur l’avenue Desbrisay sur tout l’avant du lot, conformément au paragraphe 58(2) de l’Arrêté de zonage Z-213. Après les trois premières années, les attestations subséquentes seront fournies à des intervalles de deux ans, sauf indication contraire de la Ville. Proposée par le conseiller Boudreau Appuyée par le conseiller Léger MOTION ADOPTÉE 6.3 Audience publique – Chemin Horsman (NID 70453618) (R3 à SC) – Aucune objection reçue Mme Anderson présente une proposition pour donner une nouvelle désignation à la propriété située au chemin Horsman pour qu’elle passe d’une zone R3 à une zone SC afin de permettre un développement à usage mixte. La propriété elle-même est située bien au-delà de la limite de 30 mètres du ruisseau. Une étude de la circulation doit être effectuée aux frais des promoteurs avant que tout permis soit accordé. Aucune objection n’a été présentée relativement à ce projet de rezonage. Motion : Que le processus de modification pour la modification de l’arrêté du Plan municipal Z113.8 et la modification de l’Arrêté de zonage Z-213.27 aille de l’avant afin de permettre un développement commercial à usage mixte. De plus, le Comité recommande que le rezonage fasse l’objet d’une entente conditionnelle sur le rezonage, qui comprend les dispositions suivantes, sans toutefois s’y limiter : 1) 2) 3) 4) 5) 6) 7) Que le promoteur s’engage à verser 13 662 $ envers les coûts des services du collecteur principal du ruisseau Jonathan, dont profitera le développement. Que le promoteur accepte de payer sa part des coûts pour les feux de circulation à l’intersection du chemin Berry Mills et du chemin Horsman. Un paiement de 3 333,33 $ doit être versé à la Ville avant que tout permis municipal soit accordé. Qu’un deuxième support à vélos soit fourni pour l’extrémité nord du développement, à côté de la banque proposée. Qu’une étude de la circulation soit achevée avant que tout permis municipal soit accordé. Que toute recommandation formulée dans l’étude de la circulation, telle que confirmée par le service d’ingénierie, soit appliquée par le promoteur aux frais de ce dernier. Les travaux d’aménagement doivent être réalisés tout en étant substantiellement conformes aux plans fournis dans les annexes B et C. Que le dépôt de garantie de 1 000 $ qui est requis dans le cadre d’une entente conditionnelle sur le rezonage et que les droits relatifs au registre des arrêtés soient versés avant l’enregistrement. Le conseiller Butler recommande qu’un autre arrêt d’autobus soit installé le long du chemin Horsman. En réponse à la question du conseiller Léger, Mme Anderson indique qu’un point d’arrêt pour autobus n’est pas recommandé pour ce secteur. Il recommande que ce facteur soit pris en considération dans les aménagements à venir, afin que ne se répète pas ce qui s’est produit avec le boulevard Plaza. La demande sera entendue à la prochaine réunion du Comité consultatif d’urbanisme, le 27 juillet 2016. Une audience publique est fixée le 17 août pour entendre toutes les objections à ce projet. De plus, on recommande que la mairesse et la greffière municipale soient autorisées à signer une entente avec le soumissionnaire retenu en vue de mettre en place un Plan de transport réparti pour le complexe au centre-ville de Moncton, et à y apposer le sceau de la Ville de Moncton. Richard répond qu’il ne peut pas confirmer que le prix soumissionné comprend le déneigement du terrain à l’angle des rues Queen et Lewis, dont le Conseil a approuvé la fermeture. Mme Carter indique que le Conseil a la possibilité de proposer une modification à la recommandation pour supprimer ce terrain. Le conseiller Pellerin indique qu’il souhaite reporter la motion.
