Die Hauptverhandlung wird eröffnet am Montag, 30. Mai 2016 um 10 Uhr am Sitz des Gerichts, Viale Stefano Franscini 7, 6501 Bellinzona. Die Verhandlung dauert mit Unterbrüchen voraussichtlich bis Freitag, 1. Juli 2016. Die Urteilseröffnung ist provisorisch vorgesehen für Freitag, 30. September 2016. Das mutmassliche Verhandlungsprogramm wird auf der Webseite des Gerichts veröffentlicht (www.bstger.ch, Verhandlungen http://www.bstger.ch/de/dibattimenti/date-dei-dibattimenti.html). Postalisch werden keine weiteren Informationen zugestellt. Dieses Schreiben gilt als Einladung zur Verhandlung. 2. Die Verhandlung ist öffentlich. Es steht den anwaltlich nicht vertretenen Privatklägern frei, als Zuhörer an der Verhandlung teilzunehmen. Da das Platzangebot beschränkt ist, haben sich die Privatkläger für diesen Fall zwecks Prozessorganisation beim Gericht bis 27. April 2016 schriftlich anzumelden. Ohne Anmeldung kann das Gericht einen Platz im Verhandlungssaal nicht garantieren; dies gilt insbesondere für den ersten Verhandlungstag. 3. Die Privatkläger haben ihre Forderungen im Vorverfahren angemeldet. Das Gericht entscheidet über die Forderungen der anwaltlich nicht vertretenen Privatkläger aufgrund der Akten. Es ist grundsätzlich nicht erforderlich, dass sich die Privatkläger schriftlich oder mündlich an das Gericht wenden, um die Behandlung ihrer Sache zu erreichen. 4. Die Mehrheit der Privatkläger hat im Vorverfahren darauf verzichtet, zur Verhandlung vorgeladen zu werden. Das wird als Dispensationsgesuch im Sinne von Art. 338 Abs. 1 StPO entgegengenommen. Die Anwesenheit der Privatkläger an der Gerichtsverhandlung ist nicht erforderlich. Unter Vorbehalt von Ziffer 8 unten werden grundsätzlich alle Privatkläger von der Teilnahme an der Verhandlung dispensiert. 5. Es steht den Privatklägern frei, dennoch beim Gericht Eingaben zu machen, um ihre Ansprüche zu begründen. Ebenso haben sie das Recht, für die Verhandlung die Erhebung von bisher nicht erhobenen Beweisen zu beantragen. Sie werden ersucht, gegebenenfalls dafür eine Frist bis zum 27. April 2016 zu beachten. 6. Die Privatkläger haben überdies das Recht, sich aktiv an der Verhandlung zu beteiligen. Falls sie beabsichtigen, von diesem Recht Gebrauch zu machen, haben sie das dem Gericht mit Frist bis zum 24. März 2016 schriftlich mitzuteilen. 7. Die Privatkläger können ihre Klage jederzeit zurückziehen. Ziehen sie Ihre Klage vor Abschluss der bevorstehenden erstinstanzlichen Hauptverhandlung vor dem Strafgericht zurück, so können sie ihre Klage vor dem zuständigen Zivilgericht erneut geltend machen. 8. Das Gericht wird eine bestimmte Anzahl von Privatklägern in der Verhandlung als Auskunftspersonen befragen. Die noch auszuwählenden Personen werden vom Gericht individuell mittels Gerichtsurkunde auf ein bestimmtes Datum vorgeladen. Diesen Vorladungen, die später ergehen, ist trotz grundsätzlicher Dispensation aller Privatkläger gemäss Ziffer 4 oben Folge zu leisten. 9. Die vorliegende Verfügung wird den anwaltlich nicht vertretenen Privatklägern in Kopie zustellt. Wenn sie ein original unterzeichnetes Exemplar wünschen, können sie das bei der Gerichtskanzlei anfordern. L'ouverture des débats a été fixée au lundi 30 mai 2016 à 10 heures au siège du Tribunal pénal fédéral, viale Stefano Franscini 7, 6501 Bellinzone. Il est prévu que les débats durent jusqu’au vendredi 1er juillet 2016, avec des interruptions. La lecture du jugement a été fixée provisoirement au vendredi 30 septembre 2016. Le programme provisoire des débats est publié sur le site web du Tribunal pénal fédéral (www.bstger.ch, débats http://www.bstger.ch/fr/dibattimenti/date-dei-dibattimenti.html). Aucune autre information ne sera transmise par poste. Ce courrier tient lieu d’invitation aux débats. 2. Les débats sont publics. Les parties plaignantes qui ne sont pas représentées par un avocat sont libres de participer aux débats en tant qu’auditeurs. Le nombre de places étant limité et pour des raisons d’organisation, les parties plaignantes sont tenues de s’annoncer par écrit auprès du Tribunal pénal fédéral jusqu’au 27 avril 2016, passé ce délai, le tribunal ne peut garantir une place dans la salle d’audience, en particulier pour le premier jour des débats. 3. Les parties plaignantes ont fait valoir leurs prétentions lors de la procédure préliminaire. Le tribunal statue sur les prétentions des parties plaignantes qui ne sont pas représentées par un avocat sur la base du dossier. Il n’est en principe pas nécessaire pour les parties plaignantes de s’adresser par écrit ou oralement au tribunal pour que leur cause soit prise en compte. 4. La majorité des parties plaignantes a renoncé, lors de la procédure préliminaire, à être convoquée aux débats, ce qui est considéré comme une demande de dispense de comparution au sens de l’art. 338 al. 1 CPP. La présence des parties plaignantes aux débats n’est pas nécessaire. Sous réserve de la disposition énoncée au chiffre 8 ci-dessous, toutes les parties plaignantes sont en principe dispensées de prendre part aux débats. 5. Cependant, les parties plaignantes sont libres de présenter des requêtes au Tribunal pénal fédéral afin de fonder leurs prétentions, de même qu’elles sont en droit de demander l’obtention de moyens de preuves jusqu’alors pas encore obtenus. A cet effet, les parties plaignantes sont priées de respecter le délai du 27 avril 2016, le cas échéant. 6. En outre, les parties plaignantes ont le droit de participer activement aux débats. Si elles souhaitent faire valoir ce droit, elles sont priées d’en informer le tribunal par écrit jusqu’au 24 mars 2016. 7. Les parties plaignantes peuvent à tout moment retirer leur plainte. Si elles retirent leur plainte auprès du Tribunal pénal fédéral avant la clôture des débats, elles pourront faire valoir leur plainte devant la juridiction civile compétente. 8. Le Tribunal interrogera un certain nombre de parties plaignantes en qualité de personnes appelées à donner des renseignements. Ces personnes, qui n’ont pas encore été sélectionnées, seront citées individuellement, par acte judiciaire, à comparaître par devant le tribunal, à une date précise. Ces citations, qui seront envoyées ultérieurement, devront être honorées, et ce malgré la dispense de principe de toutes les parties plaignantes mentionnée au chiffre 4 ci-dessus. 9. La présente décision est transmise en copie aux parties plaignantes qui ne sont pas représentées par un avocat. Dieter Behring Information for the attention of all private plaintiffs who are not represented by counsel; procedural ruling 1. The trial will commence at 10:00 a.m. on Monday May 30, 2016, at the seat of the court, located at Viale Stefano Franscini 7, in 6501 Bellinzona. The trial is likely to last until Friday July 1, 2016, including adjournments. The notice of the verdict is scheduled to take place on Friday September 30, 2016. The projected docket is published on the Court’s website: (www.bstger.ch, trials and hearings dates: http://www.bstger.ch/de/dibattimenti/date-dei-dibattimenti.html). No other information will be mailed out. This letter is your invitation to the trial. 2. The trial is open to the public. The private plaintiffs who are not represented by counsel are free to take part in the trial as spectators. Since the allotted seats for spectators are limited the private plaintiffs should contact the Court in writing for case management purposes by April 27, 2016 at the latest if they intend to attend the trial. If the plaintiffs do not contact the Court in advance to advise that they intend to attend the trial there can be no guarantee that seating will be available for them in the courtroom; this applies to the first day of the trial in particular. 3. The private plaintiffs have filed their claims in the preliminary proceedings. The Court will rule on the claims of the private plaintiffs who are not represented by counsel on the basis of the case files. As a rule, it is not necessary for the private plaintiffs to address the Court orally or in writing to have their claims considered. 4. The majority of the private plaintiffs waived their right to be summoned to the trial during the preliminary proceedings. This waiver has been received by the Court as a dispensation request as provided for in Article 338(1) of the Swiss Criminal Procedure Code. The presence of the private plaintiffs at the trial is not mandatory. Save as provided for in section 8 below, all private plaintiffs are in principle granted dispensation from taking part in the trial. 5. However, the private plaintiffs still have the option of making submissions to the Court to substantiate their claims. They also have the right to petition for having evidence taken in the trial that has not yet been taken. They are kindly advised to note that any such petitions must be received by no later than April 27, 2016. 6. The private plaintiffs also have the right to actively take part in the trial. If they intend to exercise this right they must notify the Court in writing by no later than March 24, 2016. 7. Private plaintiffs can withdraw their complaint at any time. If they withdraw their complaint before the conclusion of the forthcoming first-instance trial before the Criminal Court, they can refile it with the competent civil court. 8. The Court will question a certain number of private plaintiffs in the trial in their capacity as persons providing information. The persons to be selected for this purpose will be individually summoned by the Court for a specific date by way of legal courier and process service. These summonses, which will be issued at a later date, must be complied with despite the fact that all the private plaintiffs are in principle granted dispensation from taking part in the trial pursuant to section 4 above. 9. A copy of this ruling will be sent to the private plaintiffs who are not represented by counsel. If they wish to have an originally signed copy, they must submit a request to this effect to the court registry. El juicio oral se abrirá el lunes 30 de mayo de 2016, a las 10:00 horas, en la sede del Tribunal, Viale Stefano Franscini 7, 6501 Bellinzona. Se prevé que el juicio, con suspensiones, se prolongue hasta el viernes 1 de julio de 2016. El pronunciamiento de la sentencia está previsto, provisionalmente, para el viernes 30 de septiembre de 2016. El programa presumible del juicio se publicará en el sitio web del Tribunal (www.bstger.ch, juicios http://www.bstger.ch/de/dibattimenti/date-deidibattimenti.html). No se entrega por correo ninguna otra información. El presente escrito vale como citación al juicio. 2. El juicio es público. Si lo desean, los querellantes particulares no representados por abogados pueden asistir al juicio como oyentes. En ese caso, dado que las plazas son limitadas, los querellantes particulares deberán notificarlo por escrito al Tribunal antes del 27 de abril de 2016, a efectos de la organización del proceso. Si no se realiza esa notificación, el Tribunal no puede garantizar que haya plaza en la sala, en especial el primer día de juicio. 3. Los querellantes particulares han anunciado sus pretensiones en el procedimiento preliminar. El Tribunal resuelve sobre las pretensiones de los querellantes particulares no representados por abogados basándose en los autos. En principio, no es necesario que los querellantes se dirijan por escrito u oralmente al Tribunal para solicitar el tratamiento de su caso. 4. La mayoría de los querellantes particulares, en el procedimiento preliminar, han renunciado a ser citados al juicio. Dicha renuncia se acepta como solicitud de dispensa en el sentido del art. 338, párrafo 1 de la Ley suiza de enjuiciamiento penal (StPO, por sus siglas en alemán). No es necesario que los querellantes particulares estén presentes en el juicio. Sin perjuicio del apartado 8 siguiente, en principio todos los querellantes particulares quedan dispensados de asistir al juicio. 5. Con todo, si lo desean, los querellantes particulares pueden hacer peticiones al Tribunal para fundamentar sus reclamaciones. Asimismo, tienen derecho a solicitar la práctica de pruebas no presentadas hasta el momento. En ese caso, se les solicita que respeten el plazo máximo del 27 de abril de 2016. 6. Los querellantes particulares tienen asimismo el derecho a participar activamente en el juicio. Si tienen intención de ejercer dicho derecho, deberán comunicarlo por escrito al Tribunal antes del 24 de marzo de 2016. 7. Los querellantes particulares pueden retirar su demanda en cualquier momento. Si retiran su demanda antes de que concluya el inminente juicio oral de primera instancia ante el Tribunal penal, podrán volver a presentarla ante el Tribunal civil competente. 8. El Tribunal interrogará en el juicio a un número determinado de querellantes particulares como informantes. Dichas personas, aún por seleccionar, serán citadas individualmente por el Tribunal para una fecha concreta por medio de notas judiciales. Esas citaciones, que se emitirán más adelante, deberán acatarse a pesar de la dispensa básica de todos los querellantes particulares expuesta en el párrafo 4. 9. La presente providencia se entrega en forma de copia a los querellantes particulares no representados por abogados.
