Mr. Chapais brought down a message from His Excellency the Governor General, which he was commissioned to deliver to the House, containing various reports and letters on the subject of immigration. The Hon. Mr. Chapais laid on the table a message from His Excellency the Governor General, under his sign manual, which was transmitted for the information of the Senate, containing the Order in Council passed under the authority of the Act 29th Vic., cap. 15, entitled "An Act to provide against the introduction and spreading of disorders affecting certain animals." Mr. Campbell acquainted the House that he had another message from His Excellency the Governor General under his sign manual, which he was commanded to transmit for the information of the Senate, containing certain correspondence and documents relative to the affairs of the Province of Nova Scotia, and a minute of the Privy Council, embodying the terms of certain arrangements affecting that Province, which he recommends to the favourable consideration of the House. STEAMBOAT SUBSIDY—ENQUIRY SUBVENTION POUR UN BATEAU À VAPEUR—INTERPELLATION Hon. Mr. McCully enquired whether the Government intend to place a steamboat on the southern coast of Nova Scotia during the present season, to run between Halifax and Yarmouth, calling at intermediate ports; or to offer inducements, by subsidy or otherwise, to private capitalists to do so. He said it was expected last year that a subsidy would be offered, to enable capitalists to put a steamboat upon that route, in order that communication might be had between those ports. On the southern coast of Nova Scotia there are four of the most important counties in that Province, and they have not been provided with that accommodation to which they are entitled. This is a matter in which money is involved, and therefore the initiation of the measure must be in the hands of the Government. All he could do was to ask the Government if they intended to take any action in this matter. If Nova Scotia was not in the Confederation, she would have made such provisions as would not have left that part of the country without any means of communication between those ports. In these counties the people all have access to the sea shore, and look for mail communication by sea, as it is well known that the land routes are more or less impeded in the winter season but this route is always open. Some means should be taken to give the people this privilege, either by subsidy or otherwise. L'honorable M. Sur le littoral sud de la NouvelleÉcosse, quatre des comtés les plus importants de cette province ne jouissent pas encore de ce service auquel ils ont droit. Puisqu'il est question d'argent, l'initiative revient nécessairement au Gouvernement. Il aimerait dès lors savoir si le Gouvernement a l'intention de prendre les mesures qui s'imposent. Si la Nouvelle-Écosse ne faisait pas partie de la Confédération elle aurait fait en sorte que les ports de cette partie du pays ne restent pas complètement isolés. Toute la population de ces comtés a accès à la côte; elle s'attend à recevoir son courrier par mer, les routes étant impraticables en hiver alors que la voie maritime est toujours ouverte. Il faut donc assurer ce service à la population, que ce soit par une subvention ou par tout autre moyen. Hon. Mr. Campbell would state to the House, that it was not the intention of the Government to place a steamboat upon that route; but the Government would be glad to afford inducements, by paying handsomely for steamboats carrying the mails, if placed upon that route by private enterprise. Mr. McCully moved for an address to His Excellency the Governor General, praying that he will be pleased to cause to be laid before this House, copies of all letters and inquiries addressed by the Government or the Minister of Justice to the Judges of the Superior Courts of the several Provinces, and other persons, on the subject of Criminal Law, and their replies thereto. He said the House would recollect that important measures on Criminal Law were submitted to them at so late a period of the last session, that they could not give the subject the consideration it deserved. It was desirable to know the opinion of the judges and lawyers in the several Provinces upon this code of law, which was in a great measure codified from the Criminal Law of England. So amplified was this Criminal Law that it alone would amount to as large a volume as all the Statutes in Nova Scotia, municipal as well as criminal. The opinions of these men of the legal profession should be submitted to the House before legislating upon this question. L'honorable M. Les sénateurs se souviennent, dit-il, qu'on leur a soumis, lors de la dernière session, d'importantes mesures concernant un code criminel, mais qu'en raison de la date tardive, le Sénat n'a pas pu leur accorder l'attention qu'elles méritaient. Il serait souhaitable de connaître l'opinion des juges et des avocats des diverses provinces à propos de ce code, compilé essentiellement à partir du Code criminel anglais. Il ajoute que ce code est si vaste qu'à lui seul il remplira un volume aussi gros que celui des statuts municipaux et criminels de la Nouvelle-Écosse. L'avis des hommes de loi devrait être soumis au Sénat avant de légiférer sur cette question. Hon. Mr. Campbell said the statements he had to make to the House in answer to his hon. friend, would, he thought, be sufficient to induce him not to press this motion. Having seen the notice upon the papers, he took occasion to examine the only papers existing in connection with this subject. A circular was sent by the Minister of Justice to the Chief Justices of the Chief Courts in the Provinces of the Dominion. In this circular was enclosed copies of this Bill on Criminal Law, which was introduced last session of Parliament. In reply to this communication no information was received, except from the Judges of Nova Scotia. In examining their comments upon the Bill, and the improvements suggested by them, he found they expressed themselves confidentially. Finding such an expression in the communication, he took it for granted the House would not desire those communications to be laid before them. He hoped his hon. friend would not press his motion. Mr. McCully said he presumed the circular was sent to get information not solely for the benefit of the Ministry, but for the purpose of affording us, before whom the measure will come, the experience and views of those most eminently qualified to judge of the Criminal Law of the country. He could not understand why the Chief Justice of Nova Scotia, who heretofore had taken such an active part in the Criminal Law of his own country, should be so reticent in giving his L'honorable M. Mr. Campbell said a reason for it might suggest itself to their minds. A judge might express some opinions which he would not desire to be made public. Judges generally restrain their opinion upon a point of law until it comes before them for decision. They are naturally reluctant to give an expression of opinion upon Statute Law upon any subject whatever. L'honorable M. Campbell répond que cela peut facilement se justifier. Mr. Sanborn said if the Government had entertained the same opinion when they sent that circular, as they did now—that it was a matter of delicacy for Justices to give their opinion upon a matter of public interest—it was hardly worth while to have sought the information. He presumed the object was to get an expression of opinion from those best qualified to give the information, as to what chan ges were required in the Criminal Law. It was well known that the Criminal Law of Nova Scotia and New Brunswick is far more concise than the one which existed in the late Province of Canada, therefore this new Criminal Law would be received with far more repugnance in the Lower Provinces than it would be here. Under these circumstances he had wished to have the measure come before them in such a form, that men with professional knowledge could discuss the matter, in order that we might see whether the laws existing in Nova Scotia and New Brunswick are better than ours, or whether they really comprehend in smaller compass all that was proposed to be included in this Criminal Law to be put in force here. If so our Criminal Law reform ought to be in that direction. The Bi ll oflasteind gtocnise tended in a contrary direction. Instead of bringing the law into smaller compass, so far as it could be done without destroying its accuracy, precision and clearness, we were making our Criminal Law much more cumbrous by adopting the Criminal Laws of England, which are not applicable to our circumstances. It requires great examination and care to arrive at a conclusion as to what should be our law. At our last . session, we thought, and acted upon that impression, that we were not prepared to give an opinion upon the question at that time It is a subject requiring a careful consideration before becoming the law of the Dominion. It should be such a law as will remain hereafter, without much alteration, He had been informed by an hon. member of this House, that he has received suggestions from L'honorable M. Dans l'affirmative, notre réforme du droit criminel devrait être orientée en ce sens. Il ajoute que le Bill de la dernière session, au lieu de favoriser la concision, allait dans le sens contraire. Au lieu de rendre le droit criminel plus concis, pour autant qu'on puisse le faire sans en compromettre l'exactitude, la précision et la clarté, on l'encombre en adoptant celui de l'Angleterre qui ne convient pas à notre contexte. Il faudrait accorder à la question beaucoup d'attention et lui consacrer d'abondantes études avant de pouvoir définir notre code tel qu'il devrait être. Lors de la dernière session, nous avons pensé et agi avec l'idée que nous n'étions pas prêts à nous prononcer sur la question. Ce sujet exige qu'on l'examine attentivement avant d'en faire une loi de la Puissance. Il ne faudrait pas que cet ensemble de lois subisse trop de modifications par la suite. No one who has looked into the law of New Brunswick can fail to see that it is remarkable for comprehending a very great deal in a very small compass. The principle reason why we should not adopt something as short and comprehensive for including those general principles is, we should lessen the force of Criminal Law authority. Professional men know how to apply those authorities, and it did not depend upon the shortness or length of the law in applying them. Mr. Botsford said the Criminal Law in Nova Scotia and New Brunswick was revised and improved several years ago, and has given general satisfaction. It was considered a great improvement upon the Criminal Law previously in force. It was concise, but still very comprehensive. He regretted that they had not the opinion of so eminent a lawyer as the Chief Justice of Nova Scotia upon this subject. As he has stated his opinion to the Postmaster-General in confidence, we could not under these circumstances pass this address. L'honorable M. VERTE CANAL—ENQUIRY DOCUMENTS SUR LE CANAL DE LA BAIE VERTE—INTERPELLATION Hon. Mr. Dickey enquired whether the documents and surveys relative to the construction of a canal connecting the waters of the Gulf of St. Lawrence with those of the Bay of Fundy, have been procured pursuant to the address passed in this House on the 18th day of May last, and if so, when will they be laid before Parliament?
