Hon. Mr. Campbell moved the second reading of the Bill (from the House of Commons)
to amend the Census Act. Its main object, he
stated, was to extend the provisions of the
original Act to Manitoba. It was also provided
in the amendments that if the census could not
not be taken within the term originally contemplated, then the time should be extended to
the first of September; and that the necessity
of making domiciliary visits in some cases
should be relaxed.

deuxième lecture du Bill de la Chambre des
communes visant à modifier l'Acte du recensement. Il précise que ce projet de loi a pour but
principal d'appliquer à la province du Manitoba les dispositions de la loi originale. Les
amendements prévoient aussi que si le recensement ne peut pas être fait dans le délai fixé, il
faudra prolonger celui-ci jusqu'au 1e" septembre et que, dans certains cas, on pourra se
dispenser des visites domiciliaires.
The Bill was read a second time, and referred
to a Committee of the Whole tomorrow.

Hon. Mr. Sanborn moved the adoption of
the fourth report of the Joint Committee on
Printing, and stated that it simply referred to
the printing of certain documents.

du quatrième rapport du Comité conjoint des
impressions du Sénat et de la Chambre des
communes; il précise que ce rapport a trait à
l'impression de certains documents seulement.
Hon. Mr. Hazen called the attention of the
Committee to the necessity of making some
arrangement with respect to those documents
which are not printed, and ought to be accessible in some shape or other.
L'honorable M. Hazen attire l'attention du
comité sur la nécessité de prévoir des arrangements relatifs aux documents qui ne sont pas
imprimés et qu'on doit rendre accessibles sous
une forme ou sous une autre.
Hon. Mr. Sanborn would bring the subject
under the notice of the Committee, and
explained that they adopted the plan of publishing all matters of general interest. Any
member interested in the printing of a document could always direct the attention of the
Committee to the matter, and it would be
considered.
L'honorable M. Sanborn répond qu'il fera
part de cette remarque au comité, qui, explique-t-il, s'est rallié autour d'un projet visant à
publier tous les documents d'intérêt général. Il
sera donc loisible à tout sénateur désireux de
faire imprimer un document de faire part de
son intention au comité qui se chargera alors
d'étudier la question.
The motion was carried.
Hon. Mr. Sanborn moved the adoption of
the fifth report of the same Committee, and
stated that it referred to the question of binding public matter. At the time Messrs. Hunter,
Rose tendered for that work, they also hoped to
get the parliamentary printing; but their contract was not as low as that of another person
who obtained the printing. The contract for
binding was only an insignificant affair, and
not sufficient to induce Messrs. Hunter, Rose &
Co. to remain at the capital. A Mr. Mortimer
had been recommended as a suitable person to
perform the work, and as he had furnished
sufficient securities, the Committee felt justified in recommending that he should take the
contract when it was given up by Hunter, Rose.
The motion was carried.

contrat d'impression a été octroyé à un concurrent qui avait fait une soumission plus basse.
Le contrat de reliure étant de peu d'importance, il n'a pas suffi à retenir dans la capitale
la firme Hunter, Rose et Compagnie. Comme
monsieur Mortimer a été recommandé pour ce
travail et qu'il a fourni toutes les garanties
nécessaires, le comité a cru bon de recommander que le contrat lui soit accordé quand MM.
Hunter et Rose y ont renoncé.
La motion est adoptée.

Hon. Mr. Hazen was of the opinion that such
Bills were of a local character and ought to fall
properly within the jurisdiction of the provincial legislatures. It was time that there should
be some definite understanding with respect to
such legislation.
L'honorable M. Hazen émet l'opinion qu'un
tel projet de loi est de nature locale et relève
nécessairement de la compétence des législatures provinciales. Selon lui, il est temps que l'on
en vienne à une entente sur ce genre de

Hon. Mr. Allan replied that the question had
been raised before, but it was now the practice
to introduce and pass such Bills in the Dominion Parliament. He was himself of opinion that
the spirit of the Union Act clearly pointed out
that all matters affecting general trade and
business, except those which were specially
excepted, could come before the Dominion
Legislature. Indeed, it was very important that
a measure so intimately connected with the
public interests should be thoroughly examined and criticised in that body.

Hon. Mr. Sanborn acknowledged that the
opinions just expressed were prevailing, but,
nevertheless, he believed such measures properly came under the jurisdiction of the local
legislature. It was important not merely to consider the question of propriety, but the question of legality as well. If the House exceeded
its jurisdiction, then the Courts might be
called upon to give a decision adverse to the
legality of the Act. In this connection, he
referred to the British North America Act in
which it was expressly stated that "the incor-

came under the purview of the provincial legislatures. Those matters which were taken out of
that local jurisdiction were specifically mentioned in section 91. An attempt had been made
to give Parliament jurisdiction in cases like the
present by declaring in the Act that the object
in view was for the interests of more than one
province. He was not, however, among those
who thought such legislation satisfactory.
Carrying out the same principle to its logical
conclusion, any mercantile incorporation could
be declared of a general character. He thought
such legislation by no means judicious, and
would willingly prevent it if possible.

Hon. Mr. Allan did not think that the House
should bind itself down too closely in considering measures of the kind now before it. The
association intended doing business over the
Dominion, and could not be considered of a
purely local nature.

près des mesures de ce genre. L'association a
l'intention de faire affaires dans tout le pays;

Hon. Mr. Hazen said that the mere passage
of such Acts by the House would not necessarily make them valid, and also referred to the
Union Act to show that the bill in question
came properly under the jurisdiction of the
provincial legislatures.

House went into Committee of the Whole on
the Bill to extend certain criminal laws to the
province of Manitoba, Hon. Mr. Wilmot in the
chair.

passed.

Hon. Mr. Letellier de St Just asked if the
Government had received any intelligence of
certain difficulties having arisen in Manitoba,
and of some peaceable persons having been
chased out of the country.

Hon. Mr. Campbell replied that the Government had no such information, and that he had
heard the rumour for the first time that very
moment.
