In France, the revolutionary laws of 1791 and 1793 treated intellectual property as “the most sacred, legitimate, unassailable and personal of all types of property.” French creativity went on to forge an international reputation that, starting in the 19th century, became a major asset in the development of French industry. Today, the protection of intellectual property rights is a major issue in the European Union: sealing the close connection between creation and industry, it offers opportunities to start new businesses and generate employment. The global success of the French luxury industry, including the 75 members of the Comité Colbert — which generate EUR 31 billion in sales and employ 131,000 people in France either directly or indirectly — is the result of the ability to create and innovate. For this business model, in step with the EU strategy “to generate smart, sustainable and inclusive growth” in Europe by 2020, the enforcement of intellectual property rights is primordial. 2012 — COMITÉ COLBERT LA LUTTE ANTI-CONTREFAÇON DE L’INDUSTRIE DU LUXE ÉDITORIAL French brands and businesses enjoy high customer recognition and are famous for their creativity. Our fragrance, beauty, fashion and accessory brands are among the most counterfeited in the European Union in their respective businesses. Although it is still difficult to quantify the impact of this scourge on our sector, counterfeit luxury products represent nearly 50% of the value of goods seized by French Customs, according to the French Directorate General for Customs and Excise. That’s why the Comité Colbert gives top priority to the fight against counterfeiting. It firmly believes that advocating and protecting intellectual property rights is one way of promoting the competitiveness of businesses and the well-being of consumers. Revendiquée par les auteurs, compositeurs et artistes depuis l’Antiquité, elle a été instaurée par les lois révolutionnaires de 1791 et 1793 comme « la plus sacrée, la plus légitime, la plus inattaquable, la plus personnelle de toutes les propriétés ». Elle a permis à la créativité française d’acquérir une notoriété et une envergure internationales et a constitué dès le XIXe siècle un atout majeur pour le développement de l’industrie française. Elle est aujourd’hui au cœur des préoccupations de l’Union européenne car elle scelle le lien harmonieux entre création et industrie et offre l’opportunité de créer des entreprises et des emplois. Le succès mondial de l’industrie française du luxe et en particulier des 75 maisons réunies au sein du Comité Colbert — qui réalisent 31 milliards d’euros de chiffres d’affaires et emploient directement et indirectement 131 000 personnes en France — tient à la capacité créative et d’innovation de celles-ci. Ce modèle économique, qui correspond à « la stratégie pour une croissance intelligente, durable et inclusive » de l’Union européenne pour 2020, repose sur le respect de la propriété intellectuelle. Or, en raison de la notoriété de ses marques et de la créativité de ses entreprises, la France est particulièrement exposée à la contrefaçon. Nos marques figurent parmi les marques les plus copiées dans l’Union européenne en matière de parfums, de cosmétiques, de vêtements et d’accessoires. Même si l’impact de ce fléau sur le secteur reste difficilement quantifiable, selon la Direction générale des douanes et droits indirects, les produits de luxe contrefaisants représenteraient près de 50 % de la valeur des saisies douanières en France. Ainsi, la lutte contre la contrefaçon est-elle une des priorités du Comité Colbert. Elle est fondée sur la conviction que la promotion et la protection des droits de propriété intellectuelle constituent un atout pour la compétitivité des entreprises et le bien-être des consommateurs. EN FRANCE La contrefaçon coûte chaque année, selon le Comité National Anti-Contrefaçon : • entre 30 000 et 40 000 emplois • 6 milliards d’euros de pertes pour l’économie française Cette économie souterraine est dotée de sites de production et d’importants réseaux de distribution. Elle est souvent liée avec les réseaux criminels : drogue, travail clandestin, criminalité organisée, voire terrorisme. Aussi, les saisies douanières sur les envois postaux et le fret express en France représentent aujourd’hui 16% de l’ensemble des saisies contre 2% pour l’année 2006 : Les chiffres des saisies d’articles de contrefaçon par les Douanes françaises témoignent de l’ampleur du phénomène : ARTICLES CONTREFAISANTS ARTICLES CONTREFAISANTS SAISIS EN FRANCE • 1994 : 200 000 • 1998 : 2,3 millions • 2011 : 8,9 millions LA LUTTE ANTI-CONTREFAÇON DE L’INDUSTRIE DU LUXE UN COÛT ÉCONOMIQUE ET SOCIAL UN TRAFIC MONDIALISÉ — COMITÉ COLBERT SAISIS SUR LES ENVOIS POSTAUX ET LE FRET EXPRESS MULTIPLIÉS PAR 44,5 ENTRE 1994 ET 2011 En Europe, le nombre de saisies douanières de contrefaçons a été multiplié par deux entre 2009 et 2010 avec 103 306 000 articles saisis en 2010 pour 1 110 000 000 d’euros. Au cours des cinq dernières années le développement de l’e-commerce a fait exploser le commerce des contrefaçons. Le trafic s’est professionnalisé en profitant de la croissance du marché, du sentiment d’anonymat et d’impunité que confère Internet et de la facilité de création et de mutation des sites. • 2006 : 75 000 • 2011 : 1,4 millions MULTIPLIÉS PAR 18,6 EN EUROPE La Direction générale Marché intérieur et services de la Commission européenne rapportait en 2010 que la contrefaçon et le piratage sont responsables d’une perte de : • 60 milliards d’euros en termes de recouvrement de TVA pour le G20 ENTRE 2006 ET 2011 L’Asie reste la première région productrice de contrefaçons (85% des articles saisis en Europe), le bassin méditerranéen tient toujours une place importante alors que de nouveaux réseaux actifs se développent ailleurs, notamment en Europe Centrale, en Europe de l’est et aux Etats-Unis. • 186 600 emplois À L’ÉCHELLE INTERNATIONALE Selon la Chambre de commerce internationale, en 2011 : • jusqu’à 2,5 millions d’emplois pourraient être créés dans les économies légales du G20 si la contrefaçon et la piraterie étaient éradiquées ou sérieusement réduites • plus de 1 000 milliards de dollars par an de pertes sont liées à la contrefaçon et au piratage pour l’économie mondiale • les pertes sont évaluées à l’horizon 2015 entre 1 220 et 1 770 milliards de dollars 7 LA LUTTE CONTRE LA CYBERDÉLINQUANCE, UNE DES PRIORITÉS DE LA DOUANE La riposte douanière à la fraude sur Internet a été déclinée dans un plan d’action sur plusieurs axes, dont le premier a été la création en 2009 d’un nouveau service « Cyberdouane ». Des protocoles de coopération ont également été signés avec des opérateurs de vente en ligne, comme Price Minister en 2009, afin de mettre en place une réelle collaboration et de limiter les offres suspectes sur internet. La croissance de l’« e-commerce » doit s’accompagner d’un renforcement proportionnel de l’« e-régulation », sous peine de voir le commerce sur internet échapper à toutes les règles et de transformer en économie souterraine ce qui doit rester un facteur majeur de croissance. Les produits contrefaisants échappent à toute norme de sécurité, à tout contrôle de qualité. En achetant par exemple des cosmétiques ou des accessoires contrefaisants, le consommateur s’expose à des risques d’allergies. De nombreux sites entretiennent la confusion pour vendre des produits de luxe contrefaisants. 38 % de ces contrefaçons achetées de bonne foi sur internet sont des articles de mode et des accessoires et 10 % sont des parfums. Source : Eurobaromètre 2009 La contrefaçon déprécie leur travail que les droits de propriété intellectuelle sont censés protéger et valoriser. POUR LES ENTREPRISES Acheter une contrefaçon, c’est accepter de mettre en péril notre industrie. Comment vouloir plus de croissance et d’emplois et à la fois acheter du faux ? Comment s’élever contre les délocalisations et à la fois accepter que des industries qui ont à cœur d’ancrer leur création et leur production en France et en Europe soient soumises à la concurrence déloyale des contrefacteurs ? POUR LES ETATS La contrefaçon entraîne de lourdes pertes économiques et fiscales en raison des circuits clandestins qu’elle emprunte. Le contrefacteur ne paye aucune taxe, ce qui lui permet de dégager d’énormes marges de profit tout en offrant ses produits à des prix défiant toute concurrence. QUELLES SONT LES SANCTIONS ENCOURUES ? Le code des douanes prévoit la confiscation des marchandises litigieuses ainsi qu’une amende comprise entre une à deux fois la valeur de la marchandise de contrefaçon. Par ailleurs, les sanctions pénales prévues par le code de la propriété intellectuelle sont une amende pouvant aller jusqu’à 300 000 € et une peine de prison de trois ans (droit d’auteur, dessins et modèles, brevets, marque). En cas de production ou d’importation de produits de marque contrefaisants dans un but commercial, les peines sont portées à 4 ans d’emprisonnement et 400 000 € d’amende. Les peines sont portées à cinq ans d’emprisonnement et 500 000 € d’amende en cas de délit en bande organisée. Source : Direction générale des douanes et des droits indirects 10 LA LUTTE ANTI-CONTREFAÇON DE L’INDUSTRIE DU LUXE COMITÉ COLBERT — 2012 LA STRATÉGIE DU COMITÉ COLBERT POUR LUTTER CONTRE LA CONTREFAÇON PREMIER SECTEUR INDUSTRIEL À AVOIR ALERTÉ LES POUVOIRS PUBLICS DÈS LA FIN DES ANNÉES 1990, LE SECTEUR DU LUXE A MIS EN PLACE UNE STRATÉGIE SELON TROIS AXES LA VEILLE LÉGISLATIVE Au niveau national, le Comité Colbert a joué un rôle prépondérant dans l’élaboration de la législation française en matière de lutte contre la contrefaçon, considérée aujourd’hui comme la plus répressive d’Europe, notamment dans la mise en place en 1994 de la Loi Longuet. Le Comité Colbert intervient depuis des années auprès des différentes instances européennes afin de développer une collaboration active entre Etats membres ainsi qu’une harmonisation des différentes politiques et législations. Le Comité Colbert se félicite de la création d’un observatoire européen de la contrefaçon et du piratage en 2009 et de la volonté affirmée de protéger les droits de propriété intellectuelle au niveau de la gouvernance de l’Union. 2012 — COMITÉ COLBERT LA LUTTE ANTI-CONTREFAÇON DE L’INDUSTRIE DU LUXE 11 LA COLLABORATION AVEC LES POUVOIRS PUBLICS ET LES ACTEURS ÉCONOMIQUES LES DOUANES Depuis 1994, date de la mise en place de la loi Longuet, une collaboration s’est instaurée entre les services douaniers et les marques françaises de luxe. Des contacts quotidiens ont ainsi été établis entre entreprises et douanes facilitant les vérifications et les procédures, notamment par le biais de la « demande d’intervention » que les entreprises peuvent déposer auprès de la douane. Ce partenariat exemplaire public-privé est un réel atout pour la protection des consommateurs et la compétitivité économique du pays. LES TRANSPORTEURS Afin de lutter plus efficacement contre la cyber contrefaçon, le Comité Colbert développe une collaboration avec les transporteurs, relais incontournable du commerce électronique. Le dialogue initié par le Comité Colbert avec la poste française au milieu des années 2000 permet ainsi de lutter contre la circulation de colis postaux contenant des contrefaçons. LES OPÉRATEURS DE CARTES DE CRÉDIT Il est crucial que les sites manifestement illicites vendant des contrefaçons ne puissent plus être accrédités. Le Comité Colbert travaille à obtenir la collaboration des groupes bancaires et des opérateurs (Visa, Mastercard, American Express, Paypal) pour endiguer ce trafic. COMMENT DÉCELER UNE CONTREFAÇON ? Plusieurs indices peuvent permettre aux acheteurs de distinguer un produit authentique d’un faux. Le prix : le critère déterminant d’une contrefaçon reste avant tout son prix. L’acheteur doit donc se montrer attentif aux offres de prix anormalement basses. Le lieu de vente : les marques de luxe sont vendues exclusivement par les magasins de la marque, les revendeurs agréés et les sites officiels des maisons qui distribuent par Internet. L’emballage : il est la plupart du temps de mauvaise qualité, contrairement aux emballages de produits authentiques. L’acheteur devra prendre soin d’examiner la qualité d’impression avec les éventuels défauts qui pourraient surgir (lignes moirées, impressions floues, mauvaises combinaisons de couleurs…). Source : Comité National Anti Contrefaçon 12 LA LUTTE ANTI-CONTREFAÇON DE L’INDUSTRIE DU LUXE COMITÉ COLBERT — 2012 2012 — COMITÉ COLBERT LA LUTTE ANTI-CONTREFAÇON DE L’INDUSTRIE DU LUXE 13 LA CAMPAGNE 2012 EN CHIFFRES 10 000 AFFICHES Dans les 18 aéroports français les plus fréquentés en période estivale LA SENSIBILISATION DU GRAND PUBLIC, LES CAMPAGNES ANTI-CONTREFAÇON DU COMITÉ COLBERT Le Comité Colbert met en place des campagnes de sensibilisation conjointement avec la Douane française et sous l’égide du Comité National Anti Contrefaçon. EN FRANCE Les affiches, déclinées en 2012 en 7 visuels créés par Cartier, Chanel, Christian Dior, Lacoste, Lonchamp, Louis Vuitton et Van Cleef & Arpels ont choisi le mode humoristique pour interpeler les voyageurs tout en leur rappelant la loi. Lancée pour la première fois en 1995 à destination des directions de la Douane française, les versions successives de cette campagne ont été progressivement déployées à une plus grande échelle dans les principaux points de passage touristiques – notamment dans les aéroports français grâce aux partenariats développés avec ADP, Air France et JCDecaux – mais également dans les missions économiques françaises, les bureaux des attachés douaniers à travers le monde et dans le cadre d’expositions ou de colloques. 7 MAISONS DU COMITÉ COLBERT 7 PAYS EUROPÉENS UN IMPACT RÉEL L’impact de ces campagnes sur le public français est important comme le révèle le sondage Eurobaromètre 2009. Le consommateur français est le mieux informé de l’existence de lois européennes communes sur la protection de la propriété intellectuelle (84 % des français interrogés, premier pays de l’UE). Source : Eurobaromètre 2009 EN EUROPE À la demande des douanes de différents pays européens, le Comité Colbert à mis à leur disposition sa campagne anti-contrefaçon. À ce jour, la campagne est diffusée, en plus du français et de l’anglais, en croate, tchèque, slovaque, roumain, hongrois et des affiches sont exposées dans les postes de douane et les aéroports de ces pays. Des opérations de sensibilisation et d’information du public y sont également développées. Depuis septembre 2011, les douanes italiennes ont également repris la campagne d’affichage du Comité Colbert qui intègre pour la première fois des marques italiennes. UNE PRISE DE CONSCIENCE 8 citoyens européens sur 10 estiment que la contrefaçon nuit aux entreprises et aux emplois qui y sont liés. Et 1 citoyen sur 2 estime que la contrefaçon décourage les entreprises à développer des nouveaux produits et à les introduire sur le marché. In many cases, criminal connections (e.g. with drug, illegal labour, organized crime and/or terrorist networks) are involved. COUNTERFEITS SEIZED • 1994: 200,000 • 1998: 2.3 million • 2011: 8.9 million 2012 BETWEEN 1994 AND 2011 In Europe, the number of knock-offs seized by customs doubled between 2009 and 2010. In 2010, 103,306,000 items were seized (value: EUR 1.11 trillion). In the last five years, the growth of e-commerce has led to a boom in the counterfeiting business. Traffickers have gone professional, taking advantage of a fast expanding market, the feeling of anonymity and impunity that Internet gives and the ease with which they can create and change websites. HOW THE LUXURY INDUSTRY FIGHTS COUNTERFEITING TRAFFICKING IN COUNTERFEIT GOODS HAS BECOME AN “INDUSTRY” AND ITS GEOGRAPHICAL COVERAGE IS FAST EXPANDING Given the clandestine nature of counterfeiting, it is hard to quantify the global impact with precision, but several recent studies enable one to make an estimate. IN FRANCE Counterfeiting costs every year, according to the French national anti-counterfeiting committee (CNAC): • 30,000 to 40,000 jobs • 6 billion euros in losses for the French economy Among the counterfeit goods confiscated by French Customs, 16% had been shipped by postal or express courier services, versus 2% in 2006: ON POSTAL OR EXPRESS COURIER SERVICES • 2006: 75,000 • 2011: 1.4 million MULTIPLIED BY 18.6 IN EUROPE The Directorate General Internal Market and Services of the European Commission reported in 2010 that counterfeiting and piracy generated the following losses: Asia still tops the list of regions in which counterfeit luxury goods are produced (85% of items seized in Europe) and the Mediterranean Basin continues to occupy a prominent position, although new active networks are developing elsewhere, especially in Central Europe, Eastern Europe and the United States. • 186,600 jobs lost • 60 billion euros in uncollected VAT revenues for the G20 BETWEEN 2006 AND 2011 MULTIPLIED BY 44.5 — COMITÉ COLBERT ECONOMIC AND SOCIAL COST COUNTERFEITS SEIZED The number of counterfeits seized by French Customs illustrate the magnitude of this phenomenon: — 2012 AT INTERNATIONAL LEVEL In 2011, according to the International Chamber of Commerce: • up to 2.5 million jobs could be created in the lawful economies of the G20 if counterfeiting and piracy were eradicated or substantially reduced • counterfeiting and piracy cost the global economy more than USD 1 trillion a year • estimated global losses could reach between 1.22 and 1.77 trillion dollars by 2015 17 FRENCH CUSTOMS TARGETS CYBERCRIME French Customs is going after online fraud with a multi-pronged action plan. In 2009, a new “cyber-customs” department was set up. The Customs administration has also entered into cooperation agreements with operators of online marketplaces (e.g. PriceMinister in 2009) to promote effective collaboration and limit “shady” offers on the Internet. The expansion of e-commerce should go hand in hand with a proportionate strengthening of e-regulation: if left unregulated, online trade will promote the emergence of an underground economy instead of continuing to serve as a major driver of growth. Source: French Directorate General for Customs and Excise 18 HOW THE LUXURY INDUSTRY FIGHTS COUNTERFEITING COUNTERFEITING CONSEQUENCES FOR CONSUMERS The purchase of a counterfeit product involves an element of risk: it may be hazardous to health. Counterfeit products are not subject to safety standards or quality control. For instance, the purchase of fake cosmetics or accessories exposes the consumer to the risk of an allergic response. COMITÉ COLBERT — 2012 2012 — COMITÉ COLBERT HOW THE LUXURY INDUSTRY FIGHTS COUNTERFEITING 19 FOR CREATORS THIS SCOURGE ATTACKS SOCIETY AT LARGE, WITH VERY SERIOUS ECONOMIC, SOCIAL AND HUMAN CONSEQUENCES Counterfeiting depreciates the value of their work, which intellectual property rights are supposed to protect and enhance. FOR BUSINESSES The purchase of a counterfeit item implies that the buyer agrees to jeopardize our industry. How can one argue that more growth and more jobs are needed, and then proceed to buy fakes? How can one criticize businesses that move their production offshore yet accept the exposure of businesses striving to create and manufacture in France and Europe to unfair trade practices? FOR COUNTRIES 22% OF ALL EU CITIZENS HAVE ALREADY BOUGHT COUNTERFEIT GOODS WITHOUT REALIZING IT The combat against counterfeiting is vital to consumer protection. Many websites use confusing language in order to sell fake luxury products. 38% of the fakes purchased in good faith over the Internet are fashion items and accessories while 10% are fragrances. Source: Eurobarometer survey, 2009 Counterfeiting generates heavy economic and tax-revenue losses because it operates through clandestine channels. Counterfeiters pay no taxes, so they can enjoy tremendous profit margins and offer products at unbeatable prices. PENALTIES Under the Code des Douanes, French Customs may confiscate goods suspected of being counterfeits and levy a fine whose amount may range from the value of the counterfeit goods to twice their value. The Code de la Propriété Intellectuelle provides penal sanctions for violations involving copyrights, designs, patents and trademarks: a fine of up to EUR 300,000 and three years of imprisonment. Heavier sentences are imposed (four years of imprisonment and a fine of EUR 400,000) for violations involving the manufacture and importation of counterfeit branded goods for commercial purposes. For offences committed by an organized gang, the penalties run to five years of imprisonment and a fine of EUR 500,000. Source: French Directorate General for Customs and Excise 20 HOW THE LUXURY INDUSTRY FIGHTS COUNTERFEITING COMITÉ COLBERT — 2012 THE COLBERT ANTICOUNTERFEITING STRATEGY THE FIRST INDUSTRY TO ALERT THE PUBLIC AUTHORITIES IN THE LATE 1990s, FRENCH LUXURY HAS ADOPTED A THREE-PRONGED STRATEGY 2012 — COMITÉ COLBERT HOW THE LUXURY INDUSTRY FIGHTS COUNTERFEITING WORKING WITH PUBLIC AUTHORITIES AND MARKET PLAYERS FRENCH CUSTOMS Since 1994, when the “Longuet” anti-counterfeiting law was passed in France, Customs and French luxury brands have been working together; daily contacts facilitate inspections and procedures i.e through the “application for action” sent from a company to Customs. This outstanding example of public-private collaboration is a genuine asset in the drive to protect consumers and economic competitiveness at national level. EXPRESS COURIER AND SHIPPING COMPANIES Seeking to fight counterfeiters more effectively, the Comité Colbert is building cooperation with these key companies which handle delivery for online vendors. The Comité Colbert initiated dialogue with the French postal service in the mid2000s to fight the circulation of counterfeit goods via parcel post. MONITORING LEGISLATION At national level, the Comité Colbert has played a prominent role in the development of French anti-counterfeiting policy, considered today to be among Europe’s most repressive, and in particular passing the first French anti-counterfeiting law known as the “Loi Longuet” in 1994. For years, the Comité Colbert has been lobbying various European institutions in an effort to develop active collaboration between Member States and obtain the harmonization of national policies and legislations. The Comité Colbert welcomes the creation of a European Observatory on Counterfeiting and Piracy in 2009 and the resolve asserted by EU governing bodies on the protection of IP rights. 21 PAYMENT SERVICE PROVIDERS It is vital to ensure that manifestly illicit websites selling counterfeit goods no longer receive certification. The Comité Colbert is working to get banking institutions and payment service providers (Visa, Mastercard, American Express and Paypal) to join the effort to curb this trafficking. HOW TO DETECT A COUNTERFEIT? Several indicators can help buyers discern the genuine product from a fake. Price: Price is still the determining criterion, so the prospective buyer must watch out for price offers that are abnormally low. Sales outlet: Luxury brands are exclusively sold by their own stores, approved retailers and official brand websites. Packaging materials: Most of the time, the quality of materials used for counterfeits is very low compared to those of authentic products. Before buying, one should check the print quality and see if there are any defects (e.g. moiré lines, blurred printing or poor colour combinations). IN FRANCE The posters use humour to bring the counterfeiting issue — as well as the current legislation — to the attention of travellers. In 2012, they featured 7 visuals created by Cartier, Chanel, Christian Dior, Lacoste, Lonchamp, Louis Vuitton and Van Cleef & Arpels. Successive versions of this campaign, first launched in 1995, have seen a gradual increase in scale. It targets the main ports of tourist entry, especially at French airports in cooperation with the Paris airport authority, Air France and the urban furniture specialist JCDecaux. The campaign poster is displayed at French Embassies all over the world (in the offices of the Economic & Commercial Sections and Customs Attachés) and used as a material for exhibitions and conferences. 7 COMITÉ COLBERT MEMBER COMPANIES 7 A REAL IMPACT According to a Eurobarometer survey in 2009, these campaigns have had a significant impact on the public at large in France. Source: Eurobarometer survey, 2009 EUROPEAN COUNTRIES IN EUROPE The Comité Colbert made its anti-counterfeiting campaign available to other European countries at the request of their customs administrations. So far, the French version has been adapted into English, Croatian, Czech, Slovak, Romanian and Hungarian, and the posters are on display at the Customs offices and airports in these countries. In addition, public information and awareness operations are also developed. In September 2011, Italian Customs launched an Italian version of the Colbert poster campaign that, for the first time, included non-French brands with the French ones. RAISING AWARENESS For 8 out of 10 European citizens, counterfeiting harms businesses and the jobs that they represent. In addition, 1 out of 2 thinks that counterfeiting discourages businesses from developing new products and putting them on the market.
