It is a centre for research and teaching in public and private international law, with the aim to further scientific and advanced studies of the legal aspects of international relations. The Academy’s scientific board, the Curatorium, invites academics, practitioners, diplomats, and other personalities from all over the world whom it considers qualified to give courses, in English or French (with simultaneous interpretation). These courses are on general or specialized subjects and take the form of a lecture series. The courses are published in the series Collected Courses of the Academy of International Law (Recueil des cours), which now runs to more than 370 volumes and is undoubtedly the most important encyclopedic publication on private and public international law. Since 2008 the Collected Courses are also available in a fully searchable online edition. Every year a select number of specialized courses are published in an affordable paperback edition: the Pocket Books of the Academy. In addition, the Academy’s publication program features the volumes of the Centre for Studies and Research in International Law and International Relations, and the Colloque/Workshop volumes. On the one hand, contested rules and the absence of competent institutions open the door to exploitation, smuggling and trafficking, and also to inefficient, often ineffective management at the State level; on the other, long-accepted rules of refugee protection, such as non-refoulement, are under strain as States struggle to cope with increasing numbers of the displaced and an international infra-structure seemingly incapable of dealing adequately with causes, including conflict, of promoting solutions and sharing responsibility fairly and equitably, and of ensuring protection of the rights of those on the move. This collection of essays could not be more timely. Coming from a wide range of backgrounds and experience, the authors take up these issues, from the very nature of migration and displacement in a world of sovereign States, through tentative efforts to improve migration management by way of treaty, to the ever-present tension between individual rights and State interests. This volume provides essential reading for anyone interested in the burning questions of today, and in the role of international law in steering coherent responses and facilitating humane solutions. AT I ON S OF T HE HAGUE ACA DEMY OF IN T E R NATIONAL L AW In addition to the prestigious Collected Courses of The Hague Academy of International Law in hardback, the Curatorium of the Academy has decided to yearly publish, in English or French, certain courses from the private or public international law sessions in the form of low-cost “pocket books”. Yusuf Eyal Benvenisti This book, inspired by the Law and Economics approach, introduces the concept of efficiency into PIL, aiming to show new dimensions of traditionally important issues. Pan-Africanism offers a unique vantage point to study Africa’s encounters with international law. This study examines those encounters through the various stages in the evolution of Pan-Africanism from a diaspora-based movement to groupings of independent States and intergovernmental organizations. The book argues that the decisionmaking processes within international organizations and other global governance bodies ought to be subjected to procedural and substantive legal constraints that are associated domestically with the requirements of the rule of law. Hardback • May 2015 • ISBN 978 90 04 29922 1 • Hardback (448 pp.) • List price EUR 148.- / US$ 192.• Imprint: Brill | Nijhoff It is directed not at topics or subject headings — sources, treaties, states, human rights and so on — but at some of the key unresolved problems of the discipline. Unresolved, they call into question its status as a discipline. Is international law “law” properly so-called ? In what respects is it systematic ? Does it — can it — respect the rule of law ? These problems can be resolved, or at least reduced, by an imaginative reading of our shared practices and our increasingly shared history, with an emphasis on process. In this sense the practice of the institutions of international law is to be understood as the law itself. They are in a dialectical relationship with the law, shaping it and being shaped by it. This is explained by reference to actual cases and examples, providing a course of international law in some standard sense as well.
