The undersigned, therefore issues an Order pursuant to section 61 of The Municipalities Act to: (a) dissolve the Village of Rockhaven and include its area within the Rural Municipality of Cut Knife No. 439; (b) designate this area as a “special service area” for the purpose of assigning different tax rates, applying different tax tools and providing different service levels within the Rural Municipality of Cut Knife No. 439; (c) confirm the designated “special service area” as being within the boundaries of the former Village of Rockhaven; (d) confirm any additional terms and conditions of the restructuring agreement entered into by the Village of Rockhaven and the Rural Municipality of Cut Knife No. 439 as follows: (i) this agreement has been entered into by the Village of Rockhaven and the Rural Municipality of Cut Knife No. 439 for the purpose of the dissolution of the Village of Rockhaven; (ii) a municipal council consisting of a Reeve and six (6) councillors will continue to govern the Rural Municipality of Cut Knife No. 439, with the Village of Rockhaven being designated a special service area for the purposes of assigning different tax rates and/or application of tax tools and providing different service levels; (iii) the designated service area being within the boundaries of the former Village of Rockhaven; 8 THE SASKATCHEWAN GAZETTE, JANUARY 4, 2008 (iv) this agreement may be amended by the Council of the Rural Municipality of Cut Knife No. 439 only when an amendment is in the best interests of the ratepayers of the former Village of Rockhaven and the Rural Municipality of Cut Knife No. 439; (v) the assets and liabilities of the Village of Rockhaven shall become the assets and liabilities of the Rural Municipality of Cut Knife upon dissolution of the Village of Rockhaven; (vi) cash assets remaining subsequent to settlement of the Village of Rockhaven’s assets and liabilities will be set aside for provision of services and/or benefits within the former Village of Rockhaven; (vii) the administrator for the Village of Rockhaven, Karri Risling will not continue as an employee of the Rural Municipality of Cut Knife No. 439; (viii) the Rural Municipality of Cut Knife No. 439 agrees to provide streetlights as required, subject to periodic review; (ix) the Rural Municipality of Cut Knife No. 439 agrees to provide snow removal within the former Village of Rockhaven; this may be changed or adjusted as required by the Rural Municipality of Cut Knife No. 439; (x) this agreement will come into effect on the date of dissolution as set out in the Minister’s Order; (e) authorize the imposition of special levies on affected properties for a period not greater than 10 years or in the case of retiring a debt of the municipality not greater than the term of the debt, for the following purposes: • renewing municipal infrastructure; • remedying and reclaiming contaminated sites; • settling any liabilities; (f) confirm that the dissolution shall take effect on December 31, 2007; (g) appoint Don McCallum to adjust and settle the assets and liabilities of the Village of Rockhaven including: (i) the sale of, the disposition of and the conversion into money of sufficient assets to satisfy the liabilities of the village and pay the remuneration of the person appointed by this order; (ii) the allocation of any grants, surplus funds and reserves; and (iii) the manner of dealing with the liabilities and pursuant to section 63(4) of The Municipalities Act, if there are insufficient realizable assets to satisfy the liabilities of the municipality to: assess, levy, collect and enforce payment of any amount that may be required to satisfy the liabilities of the municipality and all associated expenses and pay the remuneration of the person appointed pursuant to this order; (h) determine the remuneration payable to Don McCallum to be $25.00 per hour of work, and $0.3888 per travelled kilometre and reimbursement of related miscellaneous expenses. NOTE: A form of Petition can be obtained on application to the Clerk of the Legislative Assembly. PRIVATE BILLS 75(1) All petitions for Private Bills shall be in duplicate and shall be filed with the Clerk of the Assembly not later than the twentieth sitting day of the Session. 75(2) No petition for any Private Bill shall be received by the Assembly if presented after the first twenty-five sitting days of the Session. 75(3) No Private Bill may be introduced in the Assembly after the first thirty sitting days of the Session. 76(1) Every applicant for a Private Bill shall deposit with the Clerk of the Assembly, along with the petition for same, 2 copies of the bill, with marginal notes inserted, and an accepted cheque payable to the Minister of Finance for the sum of two hundred and fifty dollars, if the said bill does not exceed ten pages, and fifteen dollars additional for each page over that number; four hundred and fifty words shall be held to constitute a page. 76(2) In the case of a bill incorporating a company, a receipt from the Registrar of Joint Stock Companies for any statutory fees required shall also be deposited with the Clerk of the Assembly. 77 No remittance of a deposit on account of a Private Bill or any portion thereof shall be ordered by the Assembly unless the same has been recommended by the committee charged with its consideration, or unless the bill has been withdrawn, rejected or not reported upon, in which cases the actual expenses incurred shall be deducted from the deposit received before making such remittance. THE SASKATCHEWAN GAZETTE, JANUARY 4, 2008 29 79(1) All petitions to the Legislature for Private Bills of any nature whatsoever, shall require a notice, clearly and distinctly specifying the nature and object of the application, and where the same refers to any proposed work, indicating generally the location of the work, and signed by and on behalf of the petitioners, with the address of the party signing the same; and when the petition is for an act of incorporation, the name of the proposed company shall be stated in the notice. 79(2) Such notice shall be published prior to the filing of the petition with the Clerk of the Assembly as required in Rule 75(1) in 2 consecutive issues of The Saskatchewan Gazette and 4 consecutive issues of a newspaper, published in English and having circulation in the locality affected. 79(3) A copy of the notice with a statutory declaration of the several publications of advertisement shall be filed with the Clerk of the Assembly along with the petition and bill. 80(2) Every bill for an act of incorporation, where a form of model bill has been adopted, shall be drawn in accordance with such model bill, copies of which may be obtained from the Clerk of the Assembly. Any provisions contained in any such bill which are not in accord with the model bill shall be inserted between brackets and shall be so printed. 83 When any bill for confirming any agreement is filed with the Clerk of the Assembly, a true copy of such agreement must be attached to it. COMMITTEE RULING In cases where the proposed bill provides that the property to be used or occupied by the petitioner be exempt from taxation, either in whole or in part, the petitioner must file with the Clerk of the Assembly, along with the petition, a written statement from the local municipal authority in which the said property is situated approving the intent of the provisions of the proposed bill which provide for the exemption from taxation. The name of the Member who is to present the petition and Private Bill must be furnished to the Clerk of the Assembly at the time of filing the petition. Une page est réputée renfermer quatre cent cinquante mots. 76(2) Si le projet de loi prévoit la constitution d’une société, le récépissé des droits réglementaires donné par le registraire des sociétés par actions est également déposé auprès du greffier de l’Assemblée. 77 L’Assemblée ne peut ordonner la remise totale ou partielle des dépôts relatifs aux projets de loi d’intérêt privé, sauf recommandation du comité chargé d’étudier le projet en question ou si celui-ci est retiré ou rejeté ou encore n’est pas rapporté.
