REDEFINITIONS
Est désigné par parking sécurisé poids lourds (PSPL) à proximité de grands axes routiers, un parc de stationnement
pour poids lourds, clos, soumis à paiement, équipé de systèmes de surveillance et de sas d’accès par barrières. La
surveillance du parking est assurée 24h/24.
Sont désignés comme moyens de paiement, les cartes accréditives et le télépéage PL. Les moyens de paiement acceptés
sont affichés à l’entrée du parking.
Est désignée par APRR l’exploitant du présent parking sécurisé PL.
Est désigné par client le conducteur routier utilisant le parking sécurisé PL. Le présent règlement d’exploitation est
affiché à l’entrée du parking et il est tenu à disposition sur simple demande au restaurant.
DESCRIPTION DU SITE
APRR a construit un parking sécurisé poids lourds (PSPL) qui comporte entre autre : 100 places de stationnement ainsi
que les voiries correspondantes une installation de paiement comportant une voie d’entrée et une voie de sortie à terme,
une station-service une clôture de 2 m de hauteur minimum un système vidéo permettant de surveiller l’ensemble
des installations et des clôtures, conforme à loi n° 95-73 du 21 janvier 1995 un système de blocage physique des voies
de paiement qui est désactivé lorsque les transactions d’entrée ou de sorties sont validées Le parking sécurisé est
une composante d’un Centre Routier qui comportera à terme, un bâtiment accueillant un restaurant, une boutique
généraliste, un espace détente avec jeux, un espace de communication, un coin TV, un espace d’information, une salle
de repos.
GENERALITES
Le client est informé que les transactions d’entrée et de sortie des véhicules sont filmées pour des raisons de sécurité,
de lutte contre le vol et contre la fraude. Un relevé des immatriculations des véhicules stationnés dans le PSPL sera
effectué de façon régulière. L’accès au PSPL n’est possible qu’aux véhicules dont le conducteur dispose d’un moyen de
paiement accepté, en cours de validité et dont il a le droit d’usage. Le client est informé que les systèmes de paiement
peuvent pratiquer des contrôles automatiques pour lutter contre la fraude. Tous les stationnements dans le PSPL
sont soumis au présent règlement d’exploitation qui prévaut sur tout autre document, sauf dérogation expresse et
formelle de la part d’ APRR. Toute demande de stationnement, concrétisée par le fait de faire pénétrer un véhicule
ou de l’immobiliser dans le PSPL, même temporairement, implique l’acceptation, sans restriction ni réserve, du
présent règlement. Il est de la responsabilité du client de s’assurer que le sationnement de son véhicule respecte les
contraintes réglementaires de sûreté et de sécurité, notamment celles prévues par l’arrêté ADR du 01 juin 2001 pour
le transport des matières dangereuses. Sauf dispositions exceptionnelles dûment affichées, le stationnement dans le
PSPL n’est accessible qu’aux véhicules poids lourds affectés au transport de marchandises (camions et semi-remorque)
à l’exception des transports de matières dangereuses. Il est interdit aux véhicules légers, aux véhicules dont le PTAC
est inférieur à 3,5 tonnes et aux véhicules affectés au transport de personnes (autobus, autocar, …). Il est strictement
interdit de dételer des ensembles routiers composés d’un véhicule tracteur et d’une remorque. Une remorque laissée
seule sera considérée comme véhicule abandonné.
En cas de discordance entre le nombre d’essieux du véhicule entrant et le nombre d’essieux du véhicule sortant, une
majoration forfaitaire sera automatiquement appliquée. APRR se réserve le droit d’apporter toutes modifications au
présent règlement d’exploitation à tout moment.
HORAIRES
Le PSPL est ouvert en permanence.
La surveillance du parking est assurée de manière déportée par des agents dans un local de télé-surveillance. Elle
est opérationnelle 24h/24. En outre, un gardiennage est assuré de nuit par un prestataire externe dument habilité. Un
agent assure également la télé-surveillance des installations de paiement. En cas de problème, un interphone en voie
et des interphones d’appel d’urgence sur le parking permet la communication entre le client et l’agent. Concernant la
restauration, les horaires d’ouverture sont les suivants : ouverture du bar de 5h à 23h tous les jours sauf dimanches et
jours fériés ; ouverture du service de restauration (repas ou restauration légère) de 11h30 à 14h30 et de 18h30 à 23h,
sauf samedis soir, dimanches et jours fériés. En cas de fermeture, un point « services » est disponible sur l’aire située
en vis à vis du PSPL.
TARIFS ET MOYENS DE PAIEMENT
Les seuls moyens de paiement acceptés par les bornes de paiement sont le télébadge Poids Lourds et les cartes
accréditives pétrolières (liste non exhaustive) :DKV, ESSOCARD,EUROTRAFIC, EUROSHELL,ROUTEX, UTA, TOTAL GR,
RESSA . Les chèques fixes et variables, les cartes bancaire, le télépéage VL, les réquisitions de passage sont refusés. Le
paiement « espèces» est traité par procédure. Les tarifs et les moyens de paiement acceptés sont affichés dans les voies
d’entrée et de sortie du parking sécurisé PL.
ENTREES ET SORTIES
Entrées
L’entrée dans les parkings sécurisés PL est entièrement automatique et peut être provoquée par : l’insertion d’une
carte de paiement dans la borne d’entrée, ou l’identification d’un badge télépéage ; cette opération ne provoque aucun
paiement ; ou l’autorisation à distance du personnel d’APRR suite à une demande par l’interphone. L’exécution d’une de
ces deux opérations déclenche l’ouverture de la barrière d’entrée.
Sorties
La sortie des parkings sécurisés PL est entièrement automatique et est soumise au règlement du montant du
stationnement au terme de celui-ci.
La sortie des parkings sécurisés PL est soumise à :
l’insertion, dans la borne de sortie, de la carte de paiement ayant été introduite lors de l’entrée du véhicule ou
l’identification du badge télépéage. Le montant correspondant à la durée de stationnement s’affiche sur la borne,
et un justificatif est délivré. Le montant est ensuite prélevé selon les procédures propres au moyen de paiement. ou
l’intervention à distance du personnel d’APRR suite à une demande par l’interphone, pour des cas de figure spécifiques :
incident lié au moyen de paiement ou au fonctionnement du matériel.
PAIEMENTS
Le stationnement dans les parkings sécurisés PL donne lieu à paiement suivant les tarifs fixés par décision d’APRR
et affichés en entrée et en sortie du parking. Le paiement doit être effectué avant le départ du parking sécurisé PL
pour les moyens de paiement à débit immédiat, ou sera facturé en fin de mois pour les autres moyens. Le montant du
paiement est compté par période d’une heure indivisible à partir de l’heure d’entrée. Toute heure commencée est due.
Une utilisation du parking pour une durée inférieure à deux heures est gratuite. Des frais de facturation, de relance et
de contentieux pourront être réclamés en cas de non respect des délais de règlement, suivant la réglementation en
vigueur.
PERTE DU MOYEN DE PAIEMENT
En cas de perte ou d’oubli du moyen de paiement ayant été utilisé en entrée, ou de l’échéance de validité du moyen
de paiement au moment de la sortie, le client se verra appliquer le tarif forfaitaire. L’impossibilité de paiement du
stationnement sera traitée au cas par cas par l’agent à distance. Le non-paiement fera l’objet d’une reconnaissance
de dette établie par l’agent. Dans ce cas, le client, considéré comme le débiteur, sauf à prouver qu’il est salarié du
propriétaire du véhicule qui devient alors le débiteur, a l’obligation de présenter ses papiers et ceux de son véhicule à
l’agent qui le lui demanderait.
STATIONNEMENT
Modalités de stationnement :
De façon générale, le code de la route s’applique à la circulation sur le PSPL ouvert à la circulation publique. Les véhicules
doivent être garés correctement sur l’un des emplacements prévus à cet effet et tracés au sol. Ils doivent être fermés à
clefs lorsque le conducteur quitte le véhicule. Tout colportage, démarchage, déballage ou vente d’objets quelconques,
affichage, distribution de prospectus, ainsi que tout déchargement de marchandises ou transfert de marchandises entre
poids lourds, même partiels, sont strictement interdits.
Durée de stationnement :
La durée maximale de stationnement d’un véhicule est limitée à 7 jours sauf accord préalable d’APRR. Dans tous les
cas de dépassement de la durée maximale de stationnement, un tarif forfaitaire correspondant au prix le plus élevé
sur 7 jours sera réclamé conformément aux modalités affichées en entrée du parking. Conformément à la législation,
tout véhicule en stationnement illicite ou ne respectant pas cette législation fera l’objet d’un enlèvement par mesure de
sécurité sans qu’aucun recours ne soit accepté et cela aux frais et aux risques et périls des contrevenants.
CIRCULATION, MANOEUVRE SUR LES PARKINGS SECURISES
Toutes les opérations de circulation, de manœuvre, de stationnement, de débarquement et d’embarquement de
passagers dans l’enceinte des parkings sécurisés se font sous l’entière responsabilité des clients, propriétaires des
véhicules ou leurs préposés. Les clients sont responsables des accidents corporels et de tous dégâts mobiliers ou
immobiliers qu’ils pourraient occasionner sur les installations des parkings sécurisés. En cas d’accident survenant
aux installations, le responsable est tenu d’en faire la déclaration immédiatement et par écrit à : APRR PARIS –
Service Clientèle - Echangeur de Nemours Sud – 77140 NEMOURS et à sa compagnie d’assurance. La circulation et
la manœuvre des véhicules doivent être effectuées à l’intérieur des parkings sécurisés à allure modérée (30 km/h
maximum). Elles sont soumises aux dispositions du Code de la Route. Les clients sont tenus de respecter les sens des
flèches de circulation et les règles résultant de l’implantation des panneaux et feux de signalisation. La marche arrière
n’est autorisée que lors de la manœuvre nécessaire à un véhicule pour se garer sur un emplacement. Dans certaines
situations d’exception, les clients sont tenus de respecter les consignes qui leur seront données par l’exploitant du
parking en contact interphonique dans les voies d’entrée et de sortie. Les clients circulant à pied sur les parkings doivent
porter la plus grande attention à la circulation et emprunter les passages balisés dès que possible. En outre, ils ne
doivent jamais circuler sur les voies d’accès et les aires de parking, sauf s’ils y ont été invités par un agent.
GESTION DES CONTENTIEUX
Au cas où les règlements des paiements donneraient lieu à réclamation de la part du client, celui-ci doit informer par
écrit : APRR PARIS – Service Clientèle, Echangeur de Nemours Sud – 77140 NEMOURS
Il devra joindre à son écrit la raison et l’original de son relevé d’opérations sur lequel figure le débit constaté.
RESPONSABILITES - EXCLUSIONS
APRR est titulaire d’un contrat d’assurance couvrant les conséquences pécuniaires de la responsabilité civile qu’elle
peut encourir dans l’exercice de ses activités. Lors du stationnement des véhicules dans les parkings sécurisés PL,
APRR n’est pas responsable : du vol de véhicules, ni du vol des accessoires ou tout autre bien fixés ou laissés à l’intérieur
du véhicule quel qu’en soit la valeur ou l’importance (postes de radio, magnétophones à cassette, lecteurs de disques
laser, galeries, téléphones, etc...) ; du vol de la cargaison, du vol des éléments démontables du véhicule, des dommages
causés aux véhicules à l’intérieur des parkings sécurisés PL (chocs, rayures…). En aucun cas, APRR ne souscrit
d’assurance au nom et pour le compte des clients en vue de couvrir des risques pour lesquels sa responsabilité n’est
pas engagée. APRR ne répond pas de cas fortuits, de phénomènes à caractère naturel ou de cas de force majeure, tels
que vol à main armée, incendie, gel, inondation, neige, tempête, grèves, émeutes..., cette liste étant énonciative et non
limitative.
SECURITE ET HYGIENE
Il est interdit de procéder au ravitaillement en carburant dans l’enceinte des parkings sécurisés PL (à l’exception du
ravitaillement à la station-service) ainsi qu’à l’exécution de tout travail ou opération d’entretien. Il est également interdit de
répandre ou de laisser s’écouler, dans l’enceinte des parkings sécurisés PL, des liquides gras inflammables ou corrosifs.
Dans le cas contraire, les frais éventuels de nettoiement et de remise en état seront mis à la charge du client intéressé, la
constatation de l’incident ayant, au préalable, été faite par l’exploitant. Les clients sont responsables des accidents corporels
et de tous dégâts mobiliers ou immobiliers qu’ils pourraient occasionner sur les parkings sécurisés PL.
L’usage des avertisseurs sonores est interdit dans l’enceinte parkings sécurisés PL, sauf danger immédiat et imprévisible.
L’installation électrique des parties accessibles au public est uniquement destinée à l’éclairage. Les prises de courant,
de quelque sorte que ce soit, sont exclusivement réservées à l’usage des agents de Park+ pour les besoins du Service.
Leur utilisation par les clients est strictement interdite.
Un emplacement de stationnement pour Personnes à Mobilité Réduite est disponible. Tout client utilisant cet
emplacement abusivement sera sommé par l’exploitant de le libérer dans les meilleurs délais.
SURVEILLANCE
Les parkings sont surveillés par des caméras, ces installations ayant obtenu les autorisations prévues par la loi. Cette
surveillance est complétée par des prestations de gardiennage et, si nécessaire, le recours aux agents de la force
publique sera effectué.
PANNES
En cas de panne d’un véhicule sur le parking sécurisé PL, le client peut faire appel à un dépanneur pour une réparation
sur site, uniquement s’il s’agit d’une petite panne. Dans le cas d’une panne plus conséquente, impliquant des opérations
de mécanique lourde ou génératrice de pollution avec un impact environnemental, le véhicule doit être évacué par le
dépanneur pour une réparation extérieure au parking sécurisé PL. L’importance de la panne est laissée à l’arbitrage
de l’exploitant.
Le dépanneur ne pourra pénétrer dans le parking qu’avec l’accord de l’opérateur et après avoir indiqué son identité, la
raison sociale et l’adresse de son entreprise ainsi que l’identité, la raison sociale et l’adresse du propriétaire du véhicule
à dépanner ainsi que son immatriculation.
Le dépanneur est soumis aux tarifs en vigueur pour le stationnement sur le parking sécurisé PL, quitte à répercuter les
coûts correspondants sur la facture émise à l’attention de son client.
Une liste de dépanneurs est tenue à la disposition des clients intéressés par l’exploitant.
SECOURS
En cas de constat d’un délit, d’une agression ou de dommages aux biens, le client doit alerter l’agent présent au local de
surveillance par l’interphone, qui demande alors l’intervention des secours ou des forces de police.
SANCTIONS
En application des articles 3.6 et 9.2, il peut être fait procéder, aux risques et périls des contrevenants, à l’enlèvement des
véhicules ou remorques laissés en stationnement en infraction aux dispositions du présent règlement d’exploitation.
LOI APPLICABLE - COMPETENCE
A défaut de règlement amiable, tout litige relatif à l’usage des parkings sécurisés PL sera, de convention expresse entre
les parties, soumis au droit français et de la compétence exclusive du Tribunal du ressort du domicile élu par APRR,
nonobstant pluralité de défenseurs ou appel en garantie. Cette disposition s’applique également en matière de référé.

DEFINITIONS
A secure truck park (STP) designates an enclosed truck park for heavy goods vehicles, close to major road axes, subject
to payment, equipped with surveillance systems and with barrier access systems. 24-hour surveillance of the truck park
is provided. Means of payment designates credit cards and the HGV electronic tolling system. The means of payment
accepted are posted at the entrance to the truck park.
APRR designates the operator of the present secure truck park. Client designates the road driver using the secure truck
park. The present operating regulations are posted at the entrance to the truck park and are available upon request at
the restaurant located close to the truck park.
DESCRIPTION OF THE SITE
APRR has constructed a secure truck park (STP) which includes the following:
100 parking spaces and the corresponding roadways a payment facility, including an entrance channel and an exit
channel an enclosure fence of minimum height 2m a video system providing surveillance of all the installations and
enclosures, in accordance with French Law no. 95-73 of 21 January 1995 a physical blocking system for the payment
channels, which is deactivated when the entry and exit transactions are validated
The secure truck park is a component of a Centre Routier, which will comprise (opening planned for May 2009) a building
housing a restaurant, a general shop, a leisure zone with games, a communication zone, a TV corner, an information
area and a rest room.
GENERAL ASPECTS
The client is informed that vehicle entrance and exit transactions are filmed for security, anti-theft and anti-fraud
reasons.
A list is regularly drawn up of the registration numbers of vehicles parked in the STP.
Access to the STP is only possible for vehicles of which the driver has an accepted valid means of payment which he is
entitled to use. The client is informed that the payment systems may carry out automatic anti-fraud checks.
Parking in the STP is subject to the present operating regulations, which prevail over any other document, unless
expressly and formally stated otherwise by APRR. Any request to park, made effective by the act of driving a vehicle into
or halting a vehicle in the STP, even temporarily, entails acceptance, without restriction or reservation, of the present
regulations.
The client is responsible for ensuring that his vehicle is parked in accordance with the regulatory safety and security
restrictions, in particular those stipulated by French Order (known as the Arrêté ADR) of 1 June 2001 concerning the
carriage of dangerous goods.
Except in the case of exceptional provisions which are duly posted, parking in the STP is only open to heavy goods vehicles
intended for the carriage of merchandise (trucks and semi-trailers), excluding the carriage of dangerous goods. Light
vehicles which have a maximum authorised total weight (MATW) of less than 3.5 tonnes and vehicles intended for the
transport of persons (bus, coach, etc.) are not permitted.
It is strictly forbidden to separate road vehicles composed of a drawing vehicle and trailer. A trailer left alone will be
considered an abandoned vehicle.
In the event of a discrepancy between the number of vehicle axles entering and the number of vehicle axles exiting, a
fixed rate extra charge will automatically be applied.
APRR reserves the right to make any modifications to the present operating regulations at any time.
OPENING HOURS
The STP is open around the clock.
Surveillance of the parking is provided remotely by agents in a remote surveillance location. It is operational 24 hours a
day. Security is also provided at night by a duly authorised external service provider.
An agent also provides remote surveillance of the payment installations. In the event of a problem, an interphone at
the entrance and exit and emergency interphones in the truck park enable communication between the client and the
agent.
With regard to catering services, the opening hours are as follows:
bar open from 05:00 to 23:00 every day except Sunday and public holidays;
catering service open (meals or light snacks) from 11:30 to 14:30 and from 18:30 to 23:00, except Saturday evenings,
Sundays and public holidays. If they are closed, a services point is available at the Galande – La Mare Laroche service
station located opposite the STP.
RATES AND MEANS OF PAYMENT
The only means of payment accepted by the payment terminals are the HGV badge and fuel credit cards (non-exhaustive
list): DKV, ESSOCARD, EUROTRAFIC, EUROSHELL, ROUTEX, UTA, TOTAL GR, RESSA.
Fixed rate and variable cheques, bank cards, light vehicle electronic payment systems and orders of passage are not
accepted.
“Cash” payment is handled by procedure.
The rates and means of payment accepted are posted in the entrance and exit channels of the secure truck park.
ENTRANCE AND EXIT
Entrance
Entrance to the secure truck parks is fully automatic and can be initiated by:
insertion of payment card into the entrance terminal or identification of an badge; this operation does not lead to any
payment; or remote authorisation by APRR personnel in response to a request by interphone.
Performance of one of these two operations triggers opening of the entrance barrier.
Exit
Exit from the secure truck parks is fully automatic and subject to payment of the cost of the parking at the end of the
parking period.
Exit from the secure truck parks is subject to:
insertion into the exit terminal of the payment card used at the time of entrance of the vehicle or identification of the
badge. The sum corresponding to the period of parking is shown on the terminal and a receipt is issued. The sum is then
deducted according to the specific procedures for the means of payment. or remote intervention by APRR personnel
in response to an interphone request, for specific cases: incident linked to the means of payment or operation of the
equipment.
PAYMENTS
Artikel 1 BEGRIFFSBESTIMMUNGEN
Als gesicherter LKW-Parkplatz in der Nähe großer Verkehrsadern wird ein abgeschlossener, gebührenpflichtiger, mit
Überwachungssystemen und einer durch Schranken gesicherten Einfahrt ausgestatteter LKW-Parkplatz bezeichnet.
Die Überwachung des Parkplatzes wird rund um die Uhr sichergestellt.
Als Zahlungsmittel werden Tankkreditkarten und Mautausweise bezeichnet. Die angenommenen Zahlungsmittel sind
an der Einfahrt zum Parkplatz angezeigt.
Als APRR wird der Betreiber des vertragsgegenständlichen gesicherten LKW-Parkplatzes bezeichnet.
Als Kunde wird der LKW-Fahrer bezeichnet, der den gesicherten LKW-Parkplatz nutzt.
Die vorliegenden Nutzungsbestimmungen werden an der Einfahrt zum Parkplatz angezeigt und stehen auf Anfrage in
der Gaststätte in der Nähe des Parkplatzes zur Verfügung.
Artikel 2 STANDORTBESCHREIBUNG
APRR hat einen gesicherten LKW-Parkplatz mit folgender Ausstattung gebaut:
100 Stellplätze mit den entsprechenden Zufahrten, eine Zahlstelle mit Ein- und Ausfahrt, eine Umzäunung von mindestens
2 m Höhe, eine Videoüberwachungsanlage für die gesamten Anlagen und Umzäunungen gemäß Gesetz Nr. 95-73 vom 21.
Januar 1995, eine Schranke an der Ein- und Ausfahrt, die sich bei vorschriftsmäßiger Ein- bzw. Ausfahrt öffnet.
Der gesicherte Parkplatz gehört zu einem Rastplatz, der im Mai 2009 eröffnet werden soll und ein Hauptgebäude mit
einer Gaststätte, einem Laden, einem Erholungsbereich mit Spielen, einem Kommunikationsbereich, einer Fernsehecke,
einem Informationsbereich und einer Ruhezone umfasst.
Artikel 3 ALLGEMEINES
Der Kunde wird davon in Kenntnis gesetzt, dass alle Ein- und Ausfahrten von Fahrzeugen aus Sicherheitsgründen sowie
aus Gründen der Diebstahls- und der Betrugsbekämpfung gefilmt werden.
Die amtlichen Kennzeichen der auf dem gesicherten Parkplatz abgestellten Fahrzeuge werden regelmäßig erfasst.
Die Zufahrt zum gesicherten LKW-Parkplatz ist nur für Fahrzeuge möglich, deren Fahrer über ein akzeptiertes und
gültiges Zahlungsmittel verfügt, zu dessen Nutzung er berechtigt ist. Der Kunde wird davon in Kenntnis gesetzt, dass die
Zahlungssysteme aus Gründen der Betrugsbekämpfung automatische Kontrollen durchführen können.
Für alle auf dem gesicherten Parkplatz abgestellten Fahrzeuge gelten die vorliegenden Nutzungsbestimmungen, die vor
allen anderen Dokumenten Vorrang haben, sofern von APRR keine ausdrückliche und offizielle Ausnahmegenehmigung
vorliegt. Um den gesicherten Parkplatz zu nutzen, d.h. ein Fahrzeug auf den Parkplatz zu fahren oder dort, selbst
vorübergehend, abzustellen, müssen die vorliegenden Bestimmungen uneingeschränkt und vorbehaltlos eingehalten
werden.
Der Kunde muss sicherstellen, dass beim Abstellen seines Fahrzeugs die geltenden Sicherheitsvorschriften eingehalten
werden, darunter diejenigen der Verordnung vom 1. Juni 2001 für Gefahrguttransporte.
Sofern keine ordnungsgemäß angezeigten Ausnahmebestimmungen vorliegen, dürfen auf dem gesicherten Parkplatz
ausschließlich LKWs abgestellt werden, die für Gütertransporte vorgesehen sind (LKWs und Sattelschlepper).
Ausgenommen sind Gefahrguttransporte. Das Abstellen von PKWs, Fahrzeugen mit einem zulässigen Gesamtgewicht
unter 3,5 Tonnen sowie Fahrzeugen für Personentransporte (Busse, Reisebusse usw.) ist untersagt.
Das Abhängen von Fahrzeugteilen, wie beispielsweise die Abkopplung von Schlepper und Anhänger, ist streng verboten.
Ein abgekoppelter Anhänger gilt als herrenloses Fahrzeug.
Bei Unstimmigkeiten hinsichtlich der Anzahl der Achsen des einfahrenden und des ausfahrenden Fahrzeugs kommt
automatisch eine Zusatzpauschale zur Anwendung.
APRR behält sich das Recht vor, die vorliegenden Nutzungsbestimmungen jederzeit zu ändern.
Artikel 4 ÖFFNUNGSZEITEN
Der gesicherte LKW-Parkplatz ist durchgehend geöffnet.
Der Parkplatz wird durch Sicherheitspersonal in einer Überwachungszentrale rund um die Uhr fernüberwacht. Nachts
erfolgt die Bewachung durch einen ordnungsgemäß befugten externen Dienstleister.
Auch die Zahlstellen werden durch einen Sicherheitsbeauftragten fernüberwacht. Bei Problemen ermöglichen
Gegensprechanlagen an der Einfahrt sowie Notrufsäulen auf dem Parkplatz die Kommunikation zwischen dem Kunden
und dem Sicherheitsbeauftragten.
Die Gaststätte ist zu folgenden Uhrzeiten geöffnet:
das Café ist täglich außer sonn- und feiertags von 5.00 bis 23.00 Uhr geöffnet; die Küche ist für Mahlzeiten oder Snacks
außer sonn- und feiertags sowie außer Samstagabend von 11.30 bis 14.30 Uhr sowie von 18.30 bis 23.00 Uhr geöffnet.
Sollte die Gaststätte geschlossen sein, gibt es auf dem Rastplatz Galande – La Mare Laroche gegenüber dem gesicherten
LKW-Parkplatz einen Verkaufsautomaten.
Artikel 5 PREISE UND ZAHLUNGSMITTEL
Die einzigen an den Zahlstellen akzeptierten Zahlungsmittel sind der LKW-Mautausweis und folgende
Tankkreditkarten (wobei die Aufstellung keinen Anspruch auf Vollständigkeit erhebt): DKV, ESSOCARD,EUROTRAFIC,
EUROSHELL,ROUTEX, UTA, TOTAL GR, RESSA. Schecks mit vorgegebenen oder freien Betragsangaben, Bankkarten,
PKW-Mautausweise sowie Passierscheine werden nicht angenommen. Barzahlungen werden im Rahmen der üblichen
Verfahren bearbeitet. Die Preise und die akzeptierten Zahlungsmittel sind an den Ein- und Ausfahrten zum gesicherten
LKW-Parkplatz angezeigt.
Artikel 6 EIN- UND AUSFAHRTEN
6.1 Einfahrten
Die Einfahrt zu den gesicherten LKW-Parkplätzen erfolgt automatisch: durch Einführung einer Zahlkarte in das
Terminal an der Einfahrt oder Erfassung eines Mautausweises. Bei diesem Vorgang erfolgt keine Zahlung. oder durch
Genehmigung durch APRR-Mitarbeiter nach einer Anfrage über die Gegensprechanlage. Nach Ausführung eines dieser
beiden Vorgänge öffnet sich die Schranke an der Einfahrt.
6.2 Ausfahrten
Die Ausfahrt aus den gesicherten LKW-Parkplätzen erfolgt automatisch und setzt die Begleichung der Parkgebühr nach
Ablauf der Parkzeit voraus.
Ausfahrt aus den gesicherten LKW-Parkplätzen: Einführung der Zahlkarte, die bereits bei der Einfahrt verwendet
wurde, in das Terminal an der Ausfahrt oder Erfassung des Mautausweises. Der der Parkdauer entsprechende Betrag
erscheint auf der Anzeige und ein Beleg wird ausgegeben. Der Betrag wird anschließend gemäß den für das jeweilige
Zahlungsmittel geltenden Verfahren abgebucht. oder Fernbetätigung durch APRR-Mitarbeiter nach einer Anfrage über
die Gegensprechanlage bei Zwischenfällen im Zusammenhang mit dem Zahlungsmittel oder mit dem Anlagenbetrieb.
Parking in the secure truck parks gives rise to payment in accordance with the rates decided by APRR and posted at the
entrance and exit to the truck park.
Payment must be made before departure from the secure truck park for immediate debit means of payment, or will be
invoiced at the end of the month for other means. The payment sum is counted by indivisible one-hour periods from the
time of entrance. Part hours must be paid for. Use of the truck park for a period of less than two hours is free of charge.
Invoicing, reminder and legal costs may be claimed if payment deadlines are not met, in accordance with the regulations
in force.
Artikel 7 ZAHLUNGEN
If the means of payment used at the entrance is lost or forgotten, or the means of payment has become invalid at the time
of exit, the fixed rate shall be applied to the client.
If it is impossible to pay for the parking, this will be handled by the remote agent on a case by case basis. A debt
acknowledgement will be drawn up by the agent in the case of non-payment. In this case, the client, unless he can prove
that he is the employee of the owner of the vehicle, who then becomes the debtor, is considered to be the debtor and
required to present his papers and those of his vehicle to the agent upon request.
Bei Verlust oder Vergessen des bei der Einfahrt verwendeten Zahlungsmittels oder bei Ungültigkeit des
Zahlungsmittels bei der Ausfahrt ist eine Pauschalgebühr zu zahlen. Die nicht erfolgte Bezahlung der Parkdauer wird
vom zuständigen Mitarbeiter von Fall zu Fall fernbearbeitet. Für die Nichtbezahlung wird vom zuständigen Mitarbeiter
eine Schuldanerkennung erstellt. In diesem Fall gilt der Kunde als Schuldner, es sei denn, er kann beweisen, dass er
Angestellter des Fahrzeugeigentümers ist, der dann seinerseits zum Schuldner wird. Er muss seine Papiere und die
seines Fahrzeugs auf Wunsch des zuständigen Mitarbeiters vorlegen.
LOSS OF THE MEANS OF PAYMENT
PARKING
Parking terms and conditions:
Generally, the French highway code (code de la route) applies to driving in the STP open to public traffic.
Vehicles must be parked correctly in one of the spaces provided for this purpose and marked on the ground. They must
be locked when the driver leaves the vehicle.
Any hawking, selling, unpacking or sale of any objects, billposting, distribution of leaflets, and any unloading of
merchandise or transfer of merchandise between trucks, even partial, is strictly forbidden.
Parking duration:
The maximum duration for parking a vehicle is limited to 7 days, unless agreed in advance by APRR.
In all cases of exceeding the maximum parking duration, a fixed rate corresponding to the highest rate for seven days
will be claimed, in accordance with the terms and conditions posted at the entrance to the truck park.
In accordance with the legislation, any vehicle illegally parked or not complying with this legislation shall be towed away
as a security measure, without the right to any appeal, at the expense and risk of the offender.
CIRCULATION AND MANOEUVRES IN THE SECURE TRUCK PARK
The clients, owners of the vehicles or their agents are solely liable for all vehicle circulation, manoeuvres, parking and
the unloading and loading of passengers within the secure truck park.
Clients are liable for bodily injury and all damage (whether to property or buildings) which they may cause to the
installations of the secure truck park.
In the event of an accident occurring to the installations, the party responsible is required to immediately send a written
declaration thereof to: APRR PARIS - Service Clientèle - Echangeur de Nemours Sud - 77140 NEMOURS - France
and to its insurance company.
Circulation and manoeuvring of vehicles within the secure truck parks must be performed at a moderate speed (30 km/h
maximum). They are subject to the provisions of the Highway Code.
Clients are required to follow the directions of the circulation arrows and the rules dictated by signs and traffic lights.
Reversing is only permitted during manoeuvres required to park a vehicle in a parking space.
In certain exceptional situations, clients are required to follow instructions given to them by the operator of the truck
park through interphone contact in the entrance and exit channels.
Clients travelling on foot in the secure truck park must pay great attention to traffic and use the marked paths whenever
possible. Furthermore, they must never circulate on the access channels and parking areas, unless invited to do so by
an agent.
MANAGING DISPUTES
If the settlement of payments gives rise to a complaint by the client, the latter must give notice in writing to:

He must include the reason and the original copy of his itemised statement on which the debit item concerned is
shown.
LIABILITIES - EXCLUSIONS
APRR holds an insurance contract covering the monetary consequences of the legal liability it may incur in exercising
its activities.
When vehicles are parked in the secure truck parks, APRR is not liable:
for the theft of vehicles, the theft of accessories or any other item fixed or left inside the vehicle whatever the value or size
(radios, cassette players, laser disc players, roofracks, telephones, etc.);
theft of the cargo,
theft of parts of the vehicle that can be dismantled,
damage caused to the vehicles within the secure truck parks (impacts, scratches, etc.).
In no case does APRR take out insurance in the name of and on behalf of clients in order to cover risks for which it is not
held liable.
APRR is not liable for unexpected events, natural phenomena or cases of force majeure, such as armed robbery, fire,
freezing, flooding, snow, storms, strikes, riots, etc.; this list is indicative and non-exhaustive.
HEALTH AND SAFETY
Refuelling is not permitted within the secure truck park; nor is the performance of any work or maintenance operation.
It is also forbidden to spill or allow to drain inflammable or corrosive oily liquids. If this occurs, any cleaning and renovation
costs shall be borne by the client concerned, a report of the incident having been prepared in advance by the operator.
Clients are liable for bodily injuries and all damage (whether to property or buildings) which they may cause in the secure
truck park.
The use of sound alarms is forbidden within the secure truck park, unless there is an immediate and unpredictable
danger.
The electricity fittings in the areas accessible to the public are only intended for lighting use. Electricity sockets of any
sort are exclusively reserved for use by APRR agents for the requirements of the Service. Their use by clients is strictly
forbidden.
A parking space is available for persons with reduced mobility. Any client using this space improperly shall be ordered by
the operator to leave it as soon as possible, failing which he will be liable for a penalty.
SURVEILLANCE
The truck parks are monitored by cameras, these installations having obtained the authorisations stipulated by the law.
This surveillance is complemented by security services, and if necessary law enforcement agents will be called upon.
BREAKDOWNS
In the event of breakdown of a vehicle in the secure truck park, the client can call upon a breakdown agent for an on-site
repair, for small repairs only. For more serious breakdowns, involving heavy mechanical or contamination-generating
operations with an environmental impact, the vehicle must be towed away by the breakdown agent for repair outside the
secure truck park. The seriousness of the breakdown is to be decided by the operator.
The breakdown agent may only enter the truck park with the agreement of the operator and after having indicated its
identity, company name and the address of its company, along with the identity, company and address of the owner of the
vehicle to be towed away and its registration number.
The breakdown agent is subject to the rates in force for parking in the secure truck park, and may later pass on the
corresponding costs on the invoice issued to its client.
The operator can supply interested clients with a list of breakdown agents.
EMERGENCIES
In the event of witnessing a crime, attack or damage to property, the client must inform the agent present at the surveillance
location by interphone; the latter shall then request intervention by the emergency services or police force.
SANCTIONS
Pursuant to articles 3.6 and 9.2, vehicles or trailers left parked in breach of the provisions of the present operating
regulations may be removed, at the risk of the offender.
APPLICABLE LAW - JURISDICTION
Für das Abstellen von Fahrzeugen auf den gesicherten LKW-Parkplätzen sind die von APRR festgelegten Gebühren zu
entrichten, die an der Ein- und Ausfahrt des Parkplatzes angezeigt sind. Die Zahlung hat bei Zahlungsmitteln mit sofortiger
Abbuchung vor dem Verlassen des gesicherten LKW-Parkplatzes zu erfolgen oder wird bei anderen Zahlungsmitteln
am Monatsende in Rechnung gestellt. Die Parkgebühr wird pro Stunde ab dem Zeitpunkt der Einfahrt fällig. Jede
angefangene Stunde ist fällig. Parken unter zwei Stunden ist gebührenfrei. Bei Nichteinhaltung der Zahlungsfristen
können je nach geltenden Bestimmungen Rechnungs-, Mahn- und Gerichtsgebühren verlangt werden.
Artikel 8 VERLUST DES ZAHLUNGSMITTELS
Artikel 9 ABSTELLEN VON FAHRZEUGEN
9.1 Modalitäten:
Generell gilt auf dem für den öffentlichen Verkehr zugänglichen gesicherten LKW-Parkplatz die Straßenverkehrsordnung.
Die Fahrzeuge müssen ordnungsgemäß auf den vorgesehenen und auf dem Boden markierten Stellplätzen abgestellt
werden. Sie müssen bei Verlassen abgeschlossen werden.
Hausieren, das Anbieten, Auspacken oder Verkaufen von Gegenständen beliebiger Art, Werbung, Verteilung von
Prospekten sowie das selbst teilweise Ent- bzw. Umladen von Waren zwischen LKWs sind streng verboten.
9.2 Parkdauer:
Die Höchstparkdauer ist auf 7 Tage begrenzt. Für eine längere Parkdauer ist die vorherige Einwilligung von APRR
erforderlich. Bei einer Überschreitung der Höchstparkdauer kommt gemäß den an der Parkplatzeinfahrt angezeigten
Modalitäten eine Pauschalgebühr in Höhe der Höchstgebühr für 7 Tage zur Anwendung. Laut Gesetz wird jedes unbefugt
abgestellte Fahrzeug, welches die Bestimmungen nicht einhält, auf Kosten und Gefahr des Zuwiderhandelnden aus
Sicherheitsgründen abgeschleppt, ohne dass hiergegen ein Rechtsmittel eingelegt werden kann.
Artikel 10 FAHREN UND MANÖVRIEREN AUF GESICHERTEN PARKPLÄTZEN
10.1: Sämtliche Fahr- und Parkmanöver sowie das Aus- und Einsteigen von Fahrgästen im Bereich der gesicherten
Parkplätze erfolgen unter der ausschließlichen Verantwortung der Kunden, die Eigentümer der Fahrzeuge oder deren
Angestellte sind.
10.2: Die Kunden haften für Personenunfälle sowie sämtliche Sachschäden an beweglichen oder unbeweglichen
Gütern, die sie möglicherweise an den Anlagen der gesicherten Parkplätze verursachen.
10.3: Bei einem Unfall an den Anlagen ist der Verursacher verpflichtet, unverzüglich eine entsprechende schriftliche
Meldung zu machen an: APRR PARIS - Service Clientèle - Echangeur de Nemours Sud - F-77140 NEMOURS
sowie an seine Versicherung.
10.4: Das Fahren und Manövrieren müssen im Bereich der gesicherten Parkplätze bei mäßiger Geschwindigkeit
(höchstens 30 km/h) erfolgen. Es gilt die Straßenverkehrsordnung.
10.5: Die Kunden sind verpflichtet, die Verkehrsrichtung und die Regeln einzuhalten, die sich aus Schildern und Ampeln
ergeben.
10.6: Der Rückwärtsgang ist nur zulässig, wenn dies für das Einparken eines Fahrzeugs in einen Stellplatz erforderlich ist.
10.7: In bestimmten Ausnahmesituationen sind die Kunden verpflichtet, den Anweisungen des Parkplatzbetreibers
über die Gegensprechanlage in den Ein- und Ausfahrten Folge zu leisten.
Kunden, die zu Fuß auf den Parkplätzen unterwegs sind, müssen aufmerksam auf den Verkehr achten und nach
Möglichkeit die markierten Gehwege benutzen. Ferner dürfen sie sich unter keinen Umständen auf den Zufahrten und
in den Parkbereichen aufhalten, außer wenn sie von einem Mitarbeiter dazu aufgefordert werden.
Artikel 11 STREITFÄLLE
Sollte die Entrichtung der Zahlung zu einer Beschwerde durch den Kunden führen, muss dieser eine entsprechende
schriftliche Mitteilung richten an: APRR PARIS - Service Clientèle - Echangeur de Nemours Sud - F-77140 NEMOURS
Darin muss er den Grund angeben und das Original seiner Abrechnung beifügen, auf welcher die entsprechende
Abbuchung genannt ist.
Artikel 12 HAFTUNG – HAFTUNGSAUSSCHLÜSSE
APRR ist Inhaber eines Haftpflichtversicherungsvertrags für die finanziellen Konsequenzen seiner Tätigkeit.
Beim Abstellen von Fahrzeugen auf den gesicherten LKW-Parkplätzen übernimmt APRR in folgenden Fällen keine
Haftung:
Diebstahl von Fahrzeugen, von Zubehör oder von allen anderen im Fahrzeuginnenraum befestigten oder liegen
gelassenen Gegenständen, unabhängig von Wert oder Größe (Autoradio, Kassettendeck, CD-Spieler, Dachständer,
Telefon usw.),
Diebstahl der Ladung,
Diebstahl von abnehmbaren Fahrzeugelementen,
Schäden, die an Fahrzeugen auf dem gesicherten LKW-Parkplatz verursacht werden (Zusammenstöße, Kratzer usw.).
Keinesfalls schließt APRR eine Versicherung im Namen und auf Rechnung der Kunden ab, um Risiken zu versichern, für
welche die Betreibergesellschaft nicht haftet.
APRR haftet nicht für Zufälle, Naturereignisse oder Fälle höherer Gewalt wie bewaffneten Raubüberfall, Brand, Frost,
Überschwemmung, Schnee, Sturm, Streiks und Aufstände, wobei diese Aufzählung keinen Anspruch auf Vollständigkeit
erhebt.
Artikel 13 GESUNDHEIT UND SICHERHEIT
13.1: Tanken sowie die Ausführung beliebiger Reparatur- oder Instandhaltungsarbeiten sind im Bereich des gesicherten
LKW-Parkplatzes nicht gestattet.
13.2: Ferner ist die Verwendung oder Verbreitung brennbarer oder ätzender Flüssigkeiten im Bereich des gesicherten
LKW-Parkplatzes nicht gestattet. Bei Nichteinhaltung dieser Bestimmung gehen die eventuellen Reinigungs- oder
Wiederinstandsetzungskosten zu Lasten des betroffenen Kunden, wenn der Betreiber den Zwischenfall zuvor
beanstandet hat.
13.3: Die Kunden haften für Personenunfälle und Sachschäden an beweglichen oder unbeweglichen Gegenständen, die
sie möglicherweise auf den gesicherten LKW-Parkplätzen verursachen.
13.4: Hupen ist, außer bei einer unmittelbaren und unvorhersehbaren Gefahr, im Bereich der gesicherten LKWParkplätze nicht gestattet.
13.5: Die Elektroinstallationen in den der Öffentlichkeit zugänglichen Bereichen sind ausschließlich für Beleuchtung
bestimmt. Steckdosen beliebiger Art sind ausschließlich den Mitarbeitern von APRR zur dienstlichen Verwendung
vorbehalten. Ihre Nutzung durch die Kunden ist strengstens verboten.
13.6: Ein Stellplatz für Personen mit Mobilitätseinschränkungen steht zur Verfügung. Jeder Kunde, der diesen Stellplatz
missbräuchlich verwendet, wird vom Betreiber unter Androhung von Strafe aufgefordert, ihn schnellstmöglich frei zu
machen.
Artikel 14 ÜBERWACHUNG
Die Parkplätze sind kameraüberwacht. Die entsprechenden Anlagen sind gesetzlich genehmigt. Diese Überwachung
wird durch Wachdienste sowie gegebenenfalls durch die Hinzuziehung öffentlicher Ordnungskräfte ergänzt.
Artikel 15 PANNEN
Bei einer Fahrzeugpanne auf dem gesicherten LKW-Parkplatz kann der Kunde einen Pannendienst für die Reparatur vor
Ort rufen, wenn es sich um eine kleine Panne handelt. Bei größeren Pannen, die umfassende Reparaturen erforderlich
machen oder zu Umweltverschmutzung führen, muss das Fahrzeug vom Pannendienst abgeschleppt und außerhalb des
gesicherten LKW-Parkplatzes repariert werden. Die Bewertung des Pannenumfangs wird dem Betreiber überlassen.
Der Pannendienst kann mit Einwilligung des Betreibers, und nachdem er sich ausgewiesen und den Namen und die
Anschrift seiner Firma sowie die Identität, den Firmennamen und die Anschrift des Eigentümers des zu reparierenden
Fahrzeugs sowie sein amtliches Kennzeichen angegeben hat, auf den Parkplatz fahren. Für den Pannendienst gelten
die für das Abstellen auf dem gesicherten LKW-Parkplatz geltenden Gebühren, die er gegebenenfalls seinem Kunden
weiterverrechnen kann. Ein Pannendienst-Verzeichnis wird vom Betreiber zur Verfügung gehalten.
If an amicable settlement cannot be reached, any dispute relating to the use of the secure truck park shall, by express
agreement between the parties, be subject to French law and come under the exclusive jurisdiction of the Court within
the jurisdiction of which falls the address for service chosen by APRR, notwithstanding the introduction of multiple
defendants or third parties. This provision also applies to summary proceedings.
Artikel 16 NOTHILFE
The present operating regulations are posted at the entrance to the truck park and available to download from the
website aprr.fr or by mail sent to the following address:

In Anwendung der Artikel 3.6 und 9.2 können auf Kosten und Gefahr der Zuwiderhandelnden die Fahrzeuge oder
Anhänger abgeschleppt werden, die entgegen den Bestimmungen der vorliegenden Nutzungsbestimmungen abgestellt
wurden.
PUBLICITY
Bei Feststellung einer Straftat, eines Überfalls oder von Sachbeschädigung muss der Kunde den im Überwachungsraum
anwesenden Mitarbeiter über die Gegensprechanlage benachrichtigen, der dann den Notdienst oder die Polizei
verständigen muss.
Artikel 17 SANKTIONEN
Artikel 18 GELTENDES RECHT – GERICHTSSTAND
Falls es zu keiner gütlichen Einigung kommt, wird zwischen den Parteien ausdrücklich vereinbart, dass für jeden Streitfall
im Zusammenhang mit der Nutzung der gesicherten LKW-Parkplätze französisches Recht gilt und ausschließlich
das für den von APRR gewählten Erfüllungsort zuständige Gericht zuständig ist, ungeachtet des Vorhandenseins
mehrerer Beschuldigter oder einer Gewährleistungsklage. Diese Bestimmung gilt auch bei Antrag auf eine einstweilige
Verfügung.
Artikel 19 VERÖFFENTLICHUNG
Die vorliegenden Nutzungsvorschriften werden an der Einfahrt zum Parkplatz angezeigt und können auf der Homepage
aprr.fr heruntergeladen oder per Post an folgender Anschrift angefordert werden:
