Taylor (613) 580-2477, [email protected] Ward: BAY (7) / BAIE (7) File Number: ACS2016-CCS-TRC-0001 SUBJECT: Waivers for Use and Care of Roads By-Law and the City’s Encroachment By-Law for Roy Rump & Sons to retain vintage car display on City set-back OBJET: Dérogations au règlement sur l’utilisation et l’entretien des routes et au règlement municipal sur les empiètements pour permettre à roy rump & sons de conserver son aire de présentation d’une voiture ancienne sur une emprise de la ville REPORT RECOMMENDATION That the Transportation Committee recommend that Council approve waivers to the Use and Care of Roads By-law and the City’s Encroachment By-law for Roy Rump & Sons at 1037 Pinecrest Road to retain, on the City’s right-of-way, the interlock bricks in place as well as have a car, an air pump and a gas pump on the 2 interlock, subject to the signing of an encroachment agreement with the City of Ottawa and payment of related annual fees. RECOMMANDATION DU RAPPORT Que le Comité des transports recommande au Conseil d'approuver les dérogations au Règlement sur l’utilisation et l’entretien des routes et au Règlement municipal sur les empiètements pour que Roy Rump & Sons, situé au 1037, chemin Pinecrest, puisse conserver en place, sur l’emprise de la Ville, les pavés à emboîtement ainsi qu'une voiture, une pompe à air et une pompe à essence, sous réserve de la signature d’un accord d’empiètement avec la Ville d’Ottawa et du paiement des frais annuels connexes. BACKGROUND On 6 July 2016, the Transportation Committee received a Notice of Motion from Councillor Fleury on behalf of Councillor Taylor, with regards to a request to waive two by-laws for a business in his ward. A copy of the Notice of Motion is attached as Document 1 to this report.. DISCUSSION Roy Rump & Sons has been operating at 1037 Pinecrest Road, at the corner of Queensview Road, for several years. They had installed interlocking bricks for the display of a vintage automobile and vintage air/gas pumps three years ago. While there were no objections by residents in the community to this display, it came to the attention of By-Law Services that the display was constructed on the City’s right-of-way. As the display does not interfere with City operations and the overall opinion of the community is that the display is a beautification to the area, the ward councillor would like to ensure it remains. RURAL IMPLICATIONS There are no rural implications associated with the recommendation in this report. CONSULTATION Public Works and Environmental Services Department The Public Works and Environmental Services Department is supportive of the report’s recommendation, as the vintage automobile and vintage air/gas pumps are placed in 3 storage during the winter months, and therefore present no operational challenges or difficulties to the department. Planning, Infrastructure and Economic Development Department Should the proponent demonstrate that the installation does not constitute a safety concern, in terms of obstructing a driver's sightline, and enter into an encroachment agreement with the City; Planning and Growth Management has no objection to the installation. The above-mentioned encroachment agreement would stipulate that the proponent assume any maintenance and liability issues arising from the installation and would be subject to the annual encroachment fee as required by the City's Encroachment By-law. COMMENTS BY THE WARD COUNCILLOR(S) I am in full support of this waiver as it enhances the beautification of the area, an otherwise industrial/commercial space. The Rump station has been a community fixture for many years and allowing this minor encroachment serves to enhance and promote a distinct community identity feature. ADVISORY COMMITTEE(S) COMMENTS No consultation with the City’s advisory committees was required. LEGAL IMPLICATIONS There are no legal impediments to the implementation of the report recommendation. Should the recommendation be approved, Planning, Infrastructure and Economic Development staff have advised that the confirmation of the non-obstruction of the sightline at the site in question will be undertaken by an inspection carried out by the Area Traffic Management Inspector. Should no site-line obstruction concerns exist, steps will be taken to enter into an encroachment agreement as set out in the recommendation and report. RISK MANAGEMENT IMPLICATIONS As the proponent will be required to enter into an agreement with the City, in which the proponent assumes any maintenance and liability issues stemming from the installation, there would be no risk management concerns related to the installation. 4 FINANCIAL IMPLICATIONS The encroachment is subject to the annual encroachment fee, as required by the City’s Encroachment By-law. ACCESSIBILITY IMPACTS There are no Accessibility Impacts related to this report. TERM OF COUNCIL PRIORITIES This report has no direct impacts on the City’s strategic priorities or directions identified for the current Term of Council.
