ADOBE DIGITAL ENTERPRISE PLATFORM SUPPLEMENTAL TERMS
1. DEFINITIONS.
1.1 “Adobe Digital Enterprise Platform Basic” or “ADEP Basic” means Document Services Foundation,
Document Services Workbench, Document Services Designer, Document Services Output, Document
Services PDF Generator, Document Services Reader Extension, Experience Services Core, Experience
Services RIA Core, Experience Services Basic Data Services (but this component may not be utilized on a
Cluster), the ADEP SDK, and five (5) Authorized Users of Flash Builder (provided Adobe Flash Builder is
installed as part of the Software and is used solely in combination with the ADEP SDK components to
modify Software components and create Applications that integrate with the Software components).
1.2 “Adobe Digital Enterprise Platform Standard” or “ADEP Standard” means ADEP Basic plus the
following components: Document Services Digital Signatures, Document Services Forms, Document
Services Process Management, Document Services Rights Management, ADEP Mobile, Experience
Services Advanced Data Services, and Experience Services Composite Application Framework.
1.3 “Application” means a computer program designed for a specific task or use that uses the Software
to access, store, or process data, generate Documents, or display data or content. Examples of an
Application are a corporate website, a blog, a wiki, an e-learning platform, online shopping, games,
online calendar, maps, or auction sites.
1.4 “Authentication” means the valid entry of a required secure credential (such as a user
name/password combination, smart card, or biometric) prior to use or access of the Software or
Document whether such credential is entered directly into the Software or passed to the Software
programmatically, allowing a user a specific set of rights to the Software or Document.
1.5 “Computer” means one or more CPUs in a hardware device (including a Server) that accepts
information in digital or similar form and manipulates it for a specific result based on a sequence of
instructions.
1.6 “Cluster” means a group of Servers that operate together such as may be required to, by example,
enable high availability, scalability, and/or load balancing.
1.7 “CPU” means central processing units on Computers used to operate the Software provided that:
(a) all CPUs on a Computer on which the Software is installed shall be deemed to operate the Software
unless Licensee configures that Computer (using a reliable and verifiable means of hardware or software
partitioning) such that the total number of CPUs that actually operate the Software is less than the total
number on that Computer; and, (b) when a CPU contains more than one processing core, each group of
two (2) processing cores, and any remaining unpaired processing core, will be deemed one (1) CPU.
1.8 “Deployment” means a group of Server(s) that have the Software installed and which operate one or
more Applications where all Server(s) operate all the Applications and are operating at the same
physical site.
1.9 “Document” means an electronic or printed file that is processed or generated by the Software,
including Documents that contain data fields where data may be entered and saved.
1.10 “Features” means: (a) certain technology embedded into PDF files by the Software that enables
features in Adobe Reader software that would not otherwise be available (e.g., the ability to save
documents locally or add annotations); and (b) metadata (stored on a Computer and/or embedded in
an electronic file of a supported file format) that contains or refers to access and usage rights designed
to be enforced by Adobe Document Services Rights Management components of the Software directly
or through supported software applications.
1.11 “Instance” means one in-memory copy of the Software instantiated and running within a Java
virtual machine process on one Server as Production Software.
1.12 “Metric Term” means a single calendar year.
1.13 “Server” means a Computer designed or configured for access by multiple users through a network.
Where a Server contains more than one (1) Virtual Machine, each Virtual Machine shall be counted as a
Server.
1.14 “Trade Up” means a license of Software where Licensee releases its preexisting license rights in one
edition of the Software toward the license of another edition of the Software (e.g. releases its license
rights to ADEP Basic toward a license for ADEP Standard or releases its license rights to Adobe LiveCycle
Reader Extensions toward a license of ADEP Basic).
2. SOFTWARE DEFINTIONS AND ADDITIONAL LICENSING TERMS.
2.1 ADOBE DIGITAL ENTERPRISE PLATFORM.
2.1.1 Definition of Software. If Licensee has licensed the Adobe Digital Enterprise Platform (“ADEP”),
then “Software” means either (a) ADEP Basic or (b) ADEP Standard as indicated in the Ordering
Documents.
2.1.1.1 The Adobe Digital Enterprise Platform Software may be licensed as Development Software on a
per Deployment License Metric.
2.1.2 Additional Licensing Terms.
2.1.2.1. “ADEP Authorized User” means a unique person who uses Authentication to log into an
Application created using the Software or Document or output of the Software in order to act on behalf
of a business, government, educational institution, or other organization. An ADEP Authorized User shall
also have all the rights of an ADEP Recipient. Each ADEP Authorized User is licensed only for a single
Deployment.
2.1.2.2 “Base” means one (1) Deployment.
2.1.2.3 “ADEP Recipient” means a unique person in any Metric Term who (a) without using
Authentication, uses an Application or Document or the output of the Software in order to act on behalf
of a business, government, educational institution, or other organization; (b) uses Authentication to log
into an Application, Document, or the output of the Software and is not acting on behalf of a business,
government, educational institution, or other organization; (c) accesses Documents with Features; (d)
submits data into an Application created using the Software; or (e) receives Documents generated using
the Software. Each ADEP Recipient is licensed only for a single Deployment.
2.2 ADOBE WEB EXPERIENCE MANAGEMENT SOLUTION.
2.2.1 Definition of Software. If Licensee has licensed the Adobe Web Experience Management Solution
(“WEM”), then “Software” means ADEP Basic but all such use is limited solely to components in the
Experience Services Core and (a) if Licensee has licensed the WEM Basic edition, Web Content
Management, Advanced Content Management, Adobe Online Marketing Suite Site Catalyst Integration,
and LDAP with SSO and CIFS Support components; (b) if Licensee has licensed the WEM Standard
edition then “Software” includes all WEM Basic components plus the Portal, Portal Director, Social
Collaboration, Targeting, and Digital Asset Management; or (c) if Licensee has licensed the WEM
Premium edition, then “Software” includes all WEM Standard components plus the WEM Mobile,
Marketing Campaign Management, Active Clustering, Adobe Online Marketing Suite Test & Target
Integration, and Multi-Site Manager components.
Each Production Software license to this Software includes an unlimited number of Development
Software licenses to this Software so long as all use under the Development Software license adheres to
the usage restrictions of this Software.
2.2.2.1 “WEM Authorized User” means employee(s) or agent(s) of Licensee that uses Authentication to
log into the Software or an Application for purposes of administration and/or authoring of web
properties.
2.2.2.2 “Base” means two (2) Instances.
2.3 ADOBE INTEGRATED CONTENT REVIEW SOLUTION.
2.3.1 Definition of Software. If Licensee has licensed the Adobe Integrated Content Review Solution
(“ICR”), then “Software” means ADEP Standard and (a) if Licensee has licensed the ICR Standard edition,
(i) a project planning interface that enables the creation and management of project timelines,
schedules, project teams, and workflows to create, review, and approve content and (ii) the Adobe®
Creative Suite® Task List Extension for Integrated Content Review or (b) if Licensee has licensed the ICR
Premium edition, then “Software” includes all ICR Standard components plus one (1) Instance of Digital
Asset Management.
All use of the Software is limited solely to initiating, conducting, and participating in content reviews on
digital assets and documents generated by a desktop application or via automated processes so long as
all such generated content initiates a review and approval process within the Software. The Software
may not be used to generate content in the form of PDF documents, forms, or batch output for
distribution or for document services or process management purposes other than as required for the
review and approval process.
2.3.2.1 “ICR Authorized User” means Licensee’s employee or agent who uses Authentication to log into
the Software or an Application to create, implement, submit, initiate, or alter a campaign, project, asset,
or schedule that controls the content review and approval process. An ICR Authorized User shall also
have all the rights of an ICR Recipient. Each ICR Authorized User is licensed only for a single
Deployment.
2.3.2.3 ”ICR Recipient” means a unique person in any Metric Term whose rights are limited to reading,
reviewing, approving, or rejecting a content review or approval task monitored by the Software. An ICR
Recipient may not create or modify the parameters of a content review and process or asset. Each ICR
Recipient is licensed only for a single Deployment.
2.4 ADOBE CUSTOMER COMMUNICATIONS SOLUTION.
2.4.1 Definition of Software. If Licensee has licensed the Adobe Customer Communications Solution
Standard (“CC”), then “Software” means ADEP Standard and Asset Placement plug-in for Adobe
Designer and Flash Builder, Asset Placement service, Batch service, Asset Manager and Asset Editor
interfaces, Correspondence Creation interface, Expression Manager, Asset Composer, and Data
Dictionary services, but all such use is limited solely to the creation, management, administration, and
delivery of the following types of correspondence to CC Recipients: customer statements, bills,
customer inquiry responses, human resources correspondence, reminder and notification letters,
endorsement notices, policy issuance documents, welcome kits, or account application packages
including the securing or rights management of any of the above listed types of documents. Usage of
interactive components associated with CC Recipients shall be limited to the interactions directly
associated with creation or response to personalized correspondence. Prohibited usage includes (but is
not limited to) publishing a non-personalized Document with Features onto a website or utilizing the
ADEP Experience Services Core to publish or store content not utilized or generated by the Software.
2.4.2.1 “CC Authorized User” means a unique person that uses Authentication to log into the Software or
an Application for the purpose of, authoring and administering correspondence templates, creating,
managing or modifying correspondence, documents, or statements or the delivery of correspondence,
documents, or statements. Each CC Authorized User is licensed only for a single Deployment.
2.4.2.3 “CC Recipient” means a unique person in any Metric Term who receives, views, or otherwise has
access to correspondence, documents, or statements generated by the Software and is not a Business
Recipient. “Business Recipient” means a person acting on behalf of a business, government or
educational institution, or other organization that receives, views, or otherwise has access to
correspondence, documents, or statements generated by the Software. Each CC Recipient is licensed
only for a single Deployment.
2.5 ADOBE COLLABORATION SERVICE.
2.5.1 Definition of Software. If Licensee has licensed the Adobe Collaboration Services, then “Software”
means the Adobe Collaboration Service and all use is subject to additional license and service terms at
http://www.adobe.com/go/terms.
2.5.2.1 “Concurrent User” means the maximum number of users that will simultaneously access the
Software during a Metric Term.
2.6 ADOBE DIGITAL ENTERPRISE PLATFORM EXTENSION – PRODUCTION PRINT.
2.6.1 Definition of Software. If Licensee has licensed the Adobe Digital Enterprise Platform Extension –
Production Print, then “Software” means only the specific edition and options specified in the Ordering
Documents.
2.6.2.1 This Software is licensed as Production Software on a per CPU basis.
2.6.2.2 This Software is licensed as Development Software on a per Server basis.
2.6.2.3 If Licensee has licensed the Story Teller option, then “Software” means only the specific version
and components specified in the Ordering Documents and “Story Teller Authorized User” means
Licensee’s employee or agent who uses the Software.
2.6.2.4 If Licensee has licensed the Composition Center option, then “Software” means only the specific
version and components specified in the Ordering Documents. Each license of this Software includes
twenty five (25) Composition Center Authorized User licenses and two (2) Story Teller Authorized User
licenses and “Composition Authorized User” means Licensee’s employee or agent who uses the
Software.
2.6.2.5 If Licensee has licensed the Graphics option, then “Software” means only the specific version and
components specified in the Ordering Documents. Each license of this Software includes one (1)
Storyteller Authorized User license which license may be used only with the Software.
2.7 ADOBE DIGITAL ENTERPRISE PLATFORM CONNECTORS.
2.7.1 Definition of Software. If Licensee has licensed any of the Adobe Digital Enterprise Connectors,
then “Software” shall mean only the specific component specified in the Ordering Documents.
2.7.2.1 “Base” means one (1) Production Software Deployment and unlimited Development Software
Deployments.
3. ADDITIONAL TERMS APPLICABLE TO ALL SOFTWARE.
3.1 Experience Services Data Services.
Unless Licensee has obtained a valid license to the Production Software version of the Experience
Services Data Services (“ESDS”) software, Licensee may only utilize that Software’s remoting end point
functionality for the purpose of calling licensed public APIs from a program or application developed in
Adobe Flex except that any use of ESDS that results in use of the unmodified ESDS features is permitted
without a separate license to the software to the extent such validly licensed Software is designed to
access the ESDS Features programmatically. In addition, the Data Services Modeler plugin must be used
in conjunction with ESDS and Adobe Flash Builder. Licensee may only use that software in accordance
with the License Metrics it has obtained for ESDS and Adobe Flash Builder. “ESDS Features” means the
remoting features and associated data services destinations automatically installed and configured with
the initial installation of the Software.
3.2 Adobe Flex SDK.
If Licensee’s Software includes the Flex SDK, then Licensee may (a) use the Flex SDK for the sole
purpose of internally developing Applications, (b) use the Flex SDK as part of Licensee’s website for the
sole purpose of compiling the Developer Programs that are distributed through the Licensee’s website,
(c) modify and reproduce Flex SDK Source Files for use as a component of Developer Programs that add
Material Improvements to the Flex SDK Source Files, and (d) distribute Flex SDK Source Files in object
code form and/or source code form only as a component of Developer Programs that add Material
Improvements to the Flex SDK Source Files, provided that (1) such Developer Programs are designed to
operate in connection with Adobe Flash Builder, Flex Charting, ESDS, or the Flex SDK, (2) Licensee
distributes such object code and/or source code under the terms and conditions of an End User License
Agreement, (3) Licensee includes a copyright notice reflecting the copyright ownership of Licensee in
such Developer Programs, (4) Licensee shall be solely responsible to its customers for any update or
support obligation or other liability which may arise from such distribution, (5) Licensee does not make
any statements that its Developer Program is “certified” or that its performance is guaranteed by Adobe,
(6) Licensee does not use Adobe’s name or trademarks to market its Developer Programs without
written permission of Adobe, (7) Licensee does not delete or in any manner alter the copyright notices,
trademarks, logos or related notices, or other proprietary rights notices of Adobe (and its licensors, if
any) appearing on or within the Flex SDK Source Files and/or Flex SDK Components, or any
documentation relating to the Flex SDK Components, (8) Licensee causes any modified files to carry
prominent notices stating that Licensee changed the files, and (9) Licensee does not use “mx”, “mxml”,
“flex”, “flash”, “livecycle”, “ADEP” or “adobe” in any new package or class names distributed with the Flex
SDK Source Files. Any modified or merged portion of the Flex SDK Source Files is subject to this
Agreement.
3.2.1 Additional Definitions.
3.2.1.1 “End User License Agreement” means an end user license agreement that contains: (a) a limited,
nonexclusive right to use the Developer Program; (b) terms ensuring that any sublicensees of Licensee
shall comply with all restrictions and obligations set forth in this Section 3.2, (c) standard prohibitions
against reverse engineering or decompiling the Developer Program (d) a statement that Licensee and
its suppliers retain all right, title and interest in the Developer Program, (e) a statement that Licensee’s
suppliers disclaim all warranties and representations regarding the Developer Program, and (f) a
limitation of liability that disclaims all liability on behalf of Licensee’s suppliers.
3.2.1.2 “Developer Programs” shall mean programs or applications that are built consisting partly of the
Flex SDK Source Files and partly of Licensee’s Material Improvement to add to or extend the Flex SDK
Source Files.
3.2.1.3 “Flex SDK Components” means the files, libraries, and executables contained in the directory
labeled Flex SDK or similarly labeled directories (e.g., Flex SDK 2, etc.) (except for the contents
contained in the subdirectory “samples”), including the Flex SDK Source Files, build files, compilers, and
related information, as well as the file format specifications, if any, included as part of the Software as
described in the Flex SDK Documentation or a “Read Me” file accompanying the Flex SDK software.
3.2.1.4 “Flex SDK Source Files” shall mean the Flex Framework source code files that are provided with
the Flex SDK.
3.2.1.5 “Material Improvement” shall mean perceptible, measurable, and definable improvements to the
Flex SDK Source Files that provide extended or additional significant and primary functionality that adds
significant business value to the Flex SDK Source Files.
3.2.2 Restrictions.
3.2.2.1 General Restrictions. Except for the limited distribution rights above with respect to Flex SDK
Source Files, Licensee may not distribute, sell, sublicense, rent, loan, or lease the Flex SDK Components
and/or any component thereof to any third party. For the avoidance of doubt, Licensee shall not have a
right to distribute any Flex SDK Components that are provided as executables and/or in object code
form. Licensee also agrees not to add or delete any program files that would modify the functionality
and/or appearance of other Adobe software and/or any component thereof.
3.2.2.2 Development Restrictions. Licensee agrees that it will not use the Flex SDK Components to
create, develop or use any program, software or service which (a) contains any viruses, Trojan horses,
worms, time bombs, cancelbots or other computer programming routines that are intended to damage,
detrimentally interfere with, surreptitiously intercept, or expropriate any system, data or personal
information; (b) when used in the manner in which it is intended, violates any law, statute, ordinance or
regulation (including without limitation the laws and regulations governing export control, unfair
competition, antidiscrimination, or false advertising); or (c) interferes with the operability of other
Adobe or third-party programs or software.
3.2.3 Indemnification. Licensee agrees to defend, indemnify, and hold Adobe and its suppliers harmless
from and against any claims or lawsuits, including reasonable attorneys’ fees, that arise or result from
the use or distribution of Developer Programs provided that Adobe gives Licensee prompt written
notice of any such claim, tenders to Licensee the defense or settlement of such a claim at Licensee’s
expense, and cooperates with Licensee, at Licensee’s expense, in defending or settling such claim.
3.3 Adobe Document Services PDF Generator.
3.3.1 Use of Adobe Acrobat Pro. A copy of Adobe Acrobat Pro accompanies Adobe Document Services
PDF Generator for use subject to the following limitations: (a) Licensee may install one (1) copy of
Adobe Acrobat Pro on each Server on which Adobe Document Services PDF Generator is installed;
(b) Licensee may only use Adobe Acrobat Pro indirectly through use of the Software and only to the
extent that Adobe Document Services PDF Generator is designed to access Adobe Acrobat Pro
programmatically as described in the Documentation; and (c) Licensee may not use Adobe Acrobat Pro
directly or otherwise use features and functionality of Adobe Acrobat Pro that are not enabled or
supported through use of Adobe Document Services PDF Generator unless Licensee obtains a separate
license to do so.
3.3.2 Use of Supported Adobe Software Products. The Adobe Document Services PDF Generator
software is designed to operate in connection with certain other Adobe software applications as
described in the Documentation (each a “Supported Adobe Software Product”). To the extent that
Licensee has separately licensed a Supported Adobe Software Product, Licensee may use such
Supported Adobe Software Product with the Adobe Document Services PDF Generator software for the
sole purpose of converting files in the native file formats of such Supported Adobe Software Products
(e.g., files in the .psd format) subject to the following limitations: (a) Licensee may install one (1) copy of
each licensed Supported Adobe Software Product on each Server on which the Adobe Document
Services PDF Generator software is installed; and (b) Licensee may only use the Supported Adobe
Software Products indirectly through use of the Adobe Document Services PDF Generator software to
the extent the Adobe Document Services PDF Generator software is designed to access the Supported
Adobe Software Products programmatically as described in the Documentation.
3.4 ADDITIONAL TERMS APPLICABLE TO LICENSEES UPGRADING FROM ADOBE LIVECYCLE.
3.4.1 All updates, upgrades and Trade Ups are subject to Section 5 of the Adobe Digital Enterprise
Platform License Agreement. If Licensee is licensing a component of the Software as an upgrade to a
previously licensed Adobe LiveCycle component, then “Software” means the same component and
License Metric as rebranded under the current license. By example, a Licensee that had previously
licensed Adobe LiveCycle Rights Management will be upgraded to ADEP Document Services Rights
Management and will remain on the License Metric applicable to its original license.
3.4.2 Exceptions. Notwithstanding the provisions of Section 3.4.1, Licensees of the following LiveCycle
components will receive the following Upgrades under their existing License Metrics:
3.4.2.1 For Licensees of LiveCycle Mosaic, “Software” means the ADEP Experience Services Composite
Application Framework, Experience Services Core, and Experience Services RIA Core.
3.4.2.2 or Licensees of LiveCycle Content Services, “Software” means, in addition to ADEP Document
Services Content Services as provided in Section 3.4.1, the ADEP Experience Services Core.
3.4.2.3 For Licensees of the Interactive Statements Solution Accelerator, “Software” means the Customer
Communications Solution, provided all such usage is limited to the terms of their original license grant.
3.4.2.4 For Licensees of the Correspondence Management Solution Accelerator, “Software” means the
Customer Communications Solution, provided all such usage is limited to the terms of their original
license grant.
3.4.2.5 For Licensees of the Managed Review and Approval Solution Accelerator, “Software” means the
Integrated Content Review Solution provided all such usage is limited to the terms of their original
license grant.

1. DEFINITIONS.
1.1 Le terme « Eléments de base d’Adobe Digital Enterprise Platform » ou « Eléments de base
d’ADEP » désigne Document Services Foundation, Document Services Workbench, Document Services
Designer, Document Services Output, Document Services PDF Generator, Document Services Reader
Extension, Experience Services Core, Experience Services RIA Core, Experience Services Basic Data
Services (mais ce composant n’est pas utilisable dans un Groupe), l’ADEP SDK et cinq (5) Utilisateurs

1.3 Le terme « Application » désigne un logiciel conçu pour une tâche ou utilisation spécifique qui sert
à utiliser le Logiciel afin d'accéder, de sauvegarder ou de traiter des données, de créer des Documents
ou d'afficher des données ou du contenu. Des exemples d’une Application sont un site Web d’une
entreprise, un blogue, un wiki, une plate-forme de formation électronique, un service d’achat en ligne,
des jeux, un calendrier en ligne, des cartes ou des sites de vente aux enchères.
1.4 Le terme « Authentification » désigne la saisie validée d’informations de connexion obligatoires
(telles qu'un nom d’utilisateur et un mot de passe, une carte intelligente ou des données biométriques)
avant l’utilisation ou l’accès au Logiciel ou au Document, que de telles informations de connexion soient
saisies directement dans le Logiciel ou transmises vers le Logiciel par le biais d’une programmation,
donnant à un utilisateur un ensemble précis de droits au Logiciel ou au Document.
1.5 Le terme « Ordinateur » désigne une ou plusieurs unités centrales de traitement (ci-après « UC »)
d’un dispositif matériel (y compris un Serveur) qui accepte les informations sous forme numérique ou
similaire et qui les manipule afin d’obtenir un résultat précis en fonction d’une séquence d’instructions.
1.6 Le terme « Groupe » désigne un groupe de Serveurs qui fonctionnent à l’unisson dans l’obligation,
par exemple, de fournir de meilleurs disponibilité, extensibilité et/ou équilibre des charges.
1.7 Le terme « UC » désigne les unités centrales de traitement des Ordinateurs sur lesquels fonctionne
le Logiciel en supposant que : (a) toutes les UC d’un Ordinateur sur lequel le Logiciel est installé sont
réputées exploiter le Logiciel, sauf si le Licencié configure cet Ordinateur (en utilisant un moyen fiable et
vérifiable de partitionnement matériel ou logiciel) de sorte que le nombre total d’UC qui exploitent
réellement le Logiciel soit inférieur au nombre total sur cet Ordinateur ; et (b) si une UC contient
plusieurs cœurs de traitement, chaque groupe de deux (2) cœurs de traitement et tout cœur de
traitement non apparié subsistant sont réputés constituer une (1) UC.
1.8 Le terme « Déploiement » désigne un groupe de Serveurs sur lesquels est installé le Logiciel et qui
exécute une ou plusieurs Applications alors que tous les Serveurs exécutent toutes les Applications et
fonctionnent depuis le même site physique.
1.9 Le terme « Document » désigne un fichier électronique ou imprimé qui est traité ou créé par le
Logiciel, y compris des Documents qui contiennent des champs dont les données devront
potentiellement être saisies et enregistrées.
1.10 Le terme « Fonctionnalités » désigne : (a) certaines technologies intégrées dans les fichiers PDF
par le Logiciel afin d’activer des fonctionnalités sous le logiciel Adobe Reader qui ne seraient autrement

commentaires) ; et (b) des métadonnées (stockées dans un ordinateur et/ou intégrées dans un fichier
électronique à un format de fichier pris en charge) qui contiennent ou font référence aux droits d’accès
et d’utilisation désignés applicables aux composants Adobe Document Services Rights Management du
Logiciel, soit directement, soit par le biais de logiciels pris en charge.
1.11 Le terme « Instance » désigne une copie en mémoire du Logiciel instancié et fonctionnant dans un
traitement de machine virtuelle sur un Serveur comme Logiciel de production.
1.12 Le terme « Durée » désigne une seule année civile.
1.13 Le terme « Serveur » désigne un Ordinateur conçu ou configuré pour être accessible par plusieurs
utilisateurs sur un réseau. Si un serveur possède plusieurs (1) Machines virtuelles, chacune d’entre elles
doit être comptabilisée en tant que Serveur.
1.14 Le terme « Reprise » désigne une licence du Logiciel dont le Licencié a abandonné ses droits de la
licence actuelle d’une édition du Logiciel au bénéfice de la licence d’une autre édition du Logiciel (par
exemple : l’abandon des droits de licence Eléments de base d’ADEP au bénéfice d’une licence Eléments
standards d’ADEP ou l’abandon des droits de licence d’Adobe LiveCycle Reader Extensions au bénéfice
d’une licence Eléments de base d’ADEP).
2. DEFINITIONS DU LOGICIEL ET AUTRES DISPOSITIONS DE LICENCE.
2.1.1 Définition du logiciel. Si le licencié détient une licence pour Adobe Digital Enterprise Platform
(« ADEP »), alors le terme « Logiciel » désigne, soit (a) Eléments de base d’ADEP, soit (b) Eléments
standards d’ADEP comme stipulé dans les Documents de commande.
2.1.1.1 Le Logiciel Adobe Digital Enterprise Platform peut être sous licence comme Logiciel de
développement pour une Durée de Licence de déploiement.
2.1.2 Conditions de licence supplémentaires.
2.1.2.1. Le terme « Utilisateur autorisé d’ADEP » désigne une seule personne physique qui utilise
l’Authentification pour se connecter à une Application créée avec le Logiciel, Document ou la sortie du
Logiciel pour agir au nom d'une entreprise, d’un gouvernement, d’une institution d’enseignement ou
d’une autre entreprise. Un Utilisateur autorisé d’ADEP détient également tous les droits d’un Bénéficiaire
d’ADEP. Chaque Utilisateur autorisé d’ADEP détient une licence d’un seul Déploiement.
2.1.2.2 Le terme « Base » désigne un (1) Déploiement.
2.1.2.3 Un « Bénéficiaire d’ADEP » désigne une seule personne dans une Durée qui : (a) sans
Authentification, utilise une Application, un Document ou la sortie du Logiciel pour agir au nom d'une
entreprise, d’un gouvernement, d’une institution d’enseignement ou d’une autre entreprise. ; (b) utilise
l’Authentification pour se connecter à une Application, un Document ou la sortie du Logiciel et qui
n’agit pas au nom d'une entreprise, d’un gouvernement, d’une institution d’enseignement ou d’une
autre entreprise ; (c) accède à des Documents intégrant des fonctionnalités ; (d) envoie des données
dans une Application créée avec le Logiciel ; ou (e) reçoit des Documents créés avec le Logiciel. Chaque
Bénéficiaire d’ADEP détient une licence d’un seul Déploiement.
2.2.1 Définition du Logiciel. Si le licencié détient une licence Adobe Web Experience Management
Solution (« WEM »), alors le terme « Logiciel » désigne les Eléments de base d’ADEP, mais toutes les
utilisations se limitent exclusivement aux composants dans Experience Services Core ; et (a) si le
Licencié détient une licence de l'édition WEM Basic, Web Content Management, Advanced Content
Management, Adobe Online Marketing Suite Site Catalyst Integration, et LDAP avec des composants
SSO et CIFS Support ; (b) si le Licencié détient une licence de l'édition WEM Standard, alors le terme
« Logiciel » inclut tous les composants WEM Basic plus Portal, Portal Director, Social Collaboration,
Targeting et Digital Asset Management ; ou (c) si le Licencié détient une licence de l'édition WEM
Premium, alors le terme « Logiciel » inclut tous les composants WEM Standard, plus les composants
WEM Mobile, Marketing Campaign Management, Active Clustering, Adobe Online Marketing Suite Test
& Target Integration et Multi-Site Manager.
Chaque licence de Logiciel de production de ce Logiciel inclut un nombre illimité de licences de Logiciel
de développement à ce Logiciel tant que toutes les utilisations sous la licence de Logiciel de
développement respectent les restrictions d’usage de ce Logiciel.
2.2.2.1 Le terme « Utilisateur autorisé WEM » désigne les employés ou agents du licencié qui utilisent
l’Authentification pour se connecter au Logiciel ou à une Application à des fins d’administration et/ou
de création des propriétés Web.
2.2.2.2 Le terme « Base » signifie deux (2) Instances.
2.3.1 Définition du Logiciel. Si le Licencié détient une licence Adobe Integrated Content Review Solution
(« ICR »), alors le terme « Logiciel » désigne les Eléments standards d’ADEP et (a) si le Licencié détient
une licence de l’édition ICR Standard ; (i) une interface de planification de projets qui active la création
et la gestion des flux de travaux, des équipes de projet, des planifications et des durées de projet pour
créer, vérifier et approuver le contenu ; et (ii) Adobe® Creative Suite® Task List Extension pour Integrated
Content Review ou (b) si le Licencié détient une licence de l’édition ICR Premium, alors le « Logiciel »
inclut tous les composants ICR Standard plus une (1) Instance de Digital Asset Management.
Toutes les utilisations du Logiciel se limitent exclusivement au démarrage, à la conduite et à la
participation aux vérifications de contenu sur des documents et des actifs numériques créés par une
application de bureau ou par un traitement automatisé tant que ledit contenu créé démarre un
processus d’approbation et de vérification dans le Logiciel. Le Logiciel n’est pas utilisable pour créer du
contenu sous forme de documents PDF, formulaires ou sortie par lot pour la distribution, des services
documentaires ou la gestion de processus autres que nécessaire pour le processus d’approbation et de
vérification.
2.3.2.1 Le terme « Utilisateur autorisé ICR » désigne un agent ou un employé du Licencié qui utilise
l’Authentification pour se connecter au Logiciel ou une Application afin de créer, mettre en œuvre,
envoyer, démarrer ou modifier une campagne, un projet, un actif ou une planification qui gère le
processus d’approbation et de vérification. Un Utilisateur autorisé ICR détient également tous les droits
d’un Bénéficiaire ICR. Chaque Utilisateur autorisé ICR détient une licence d’un seul Déploiement.
2.3.2.3 Le terme « Bénéficiaire ICR » désigne une seule personne dans une Durée qui détient des droits
limités pour lire, vérifier, approuver ou refuser une tâche d’approbation ou de vérification de contenu
surveillé par le Logiciel. Un Bénéficiaire ICR ne peut pas créer ni modifier les paramètres d’un actif ou
d’un processus et une vérification de contenu. Chaque Bénéficiaire ICR détient une licence d’un seul
Déploiement.
2.4.1 Définition du Logiciel. Si le Licencié détient une licence Adobe Customer Communications
Solution Standard (« CC »), alors le « Logiciel » désigne le plug-in « ADEP Standard and Asset
Placement » pour Adobe Designer et Flash Builder, le service Asset Placement, le service Batch, les
interfaces Asset Manager et Asset Editor, l’interface Correspondence Creation, Expression Manager,
Asset Composer et les services Data Dictionary, mais une telle utilisation se limite exclusivement à la
création, la gestion, l’administration et l’envoi des types suivants de correspondance aux Bénéficiaires
CC : relevés du client, factures, réponses aux questions du client, correspondance des ressources
humaines, rappel et lettres de notification, avis d’approbation, formulaires d'émission de police, kits de
bienvenue, ou packages de demande de compte, notamment la protection ou la gestion de droits d’un
des types de documents énumérés ci-dessus. L’usage de composants interactifs associés aux
Bénéficiaires CC se limite aux interactions directement associées à la création ou la réponse d'une
correspondance personnalisée. Un usage interdit comprend (mais sans s’y limiter) la publication d'un
document non personnalisé intégrant des Fonctionnalités sur un site Web ou l'utilisation d'ADEP
Experience Services Core pour publier ou stocker du contenu qui n’a pas été utilisé ou crée par le
Logiciel.
2.4.2.1 Le terme « Utilisateur autorisé CC » désigne une seule personne qui utilise l’Authentification
pour se connecter au Logiciel ou à une Application afin de créer et gérer les modèles de
correspondance, créer, gérer ou modifier la correspondance, les documents ou les relevés, ou l’envoi de
correspondance, de documents ou de relevés. Chaque Utilisateur autorisé CC détient une licence d’un
seul Déploiement.
2.4.2.3 Un « Bénéficiaire CC » désigne une seule personne dans une Durée qui reçoit, visualise ou a
autrement accès à la correspondance, aux documents ou aux relevés créés par le Logiciel et qui n’est
pas un Bénéficiaire professionnel. Le terme « Bénéficiaire professionnel » désigne une personne qui agit
au nom d’une société, un gouvernement, une institution d’enseignement ou autre entreprise qui reçoit,
visualise ou sinon a accès à la correspondance, aux documents ou aux relevés créés par le Logiciel.
Chaque Bénéficiaire CC détient une licence d’un seul Déploiement.
2.5.1 Définition du Logiciel. Si le Licencié détient une licence Adobe Collaboration Services, alors le
terme « Logiciel » désigne le service Adobe Collaboration Service et toute utilisation doit respecter les
autres dispositions de service et de licence indiquées sur le site http://www.adobe.com/go/terms_fr.
2.5.2.1 Le terme « Utilisateur simultané » désigne le nombre maximal d’utilisateurs qui accèdent
simultanément au Logiciel pendant une Durée.
2.6.1 Définition du Logiciel. Si le Licencié détient une licence Adobe Digital Enterprise Platform
Extension – Production Print, alors le « Logiciel » désigne uniquement l’édition et les options indiquées
dans les Documents de commande.
2.6.2.1 Ce Logiciel est licencié comme Logiciel de production par UC.
2.6.2.2 Ce Logiciel est licencié comme Logiciel de développement par Serveur.
2.6.2.3 Si le Licencié détient une licence de l’option Story Teller, alors le « Logiciel » désigne
uniquement la version et les composants indiqués dans les Documents de commande et « Utilisateur
autorisé Story Teller » désigne l’agent ou l’employé du Licencié qui utilise le Logiciel.
2.6.2.4 Si le Licencié détient une licence de l’option Composition Center, alors le « Logiciel » désigne
uniquement la version et les options indiquées dans les Documents de commande. Chaque licence de
ce Logiciel comprend vingt-cinq (25) licences d’Utilisateur autorisé Composition Center et deux (2)
licences d’Utilisateur autorisé Story Teller, et « Utilisateur autorisé Composition » désigne l’agent ou
l’employé du Licencié qui utilise le Logiciel.
2.6.2.5 Si le Licencié détient une licence de l’option Graphics, alors le « Logiciel » désigne uniquement
la version et les options indiquées dans les Documents de commande. Chaque licence de ce Logiciel
comprend une (1) licence d’Utilisateur autorisé Storyteller qui peut être utilisée uniquement avec le
Logiciel.
2.7.1 Définition du Logiciel. Si le Licencié détient une licence d’un des Adobe Digital Enterprise
Connectors, alors le « Logiciel » désigne uniquement le composant indiqué dans les Documents de
commande.
2.7.2.1 Le terme « Base » désigne un (1) Déploiement du Logiciel de production et des Déploiements
illimités du Logiciel de développement.
3. AUTRES DISPOSITIONS EN VIGUEUR POUR TOUS LES LOGICIELS.
Sauf si le Licencié a obtenu une licence valide de la version Logiciel de production du Logiciel
Experience Services Data Services (« ESDS »), il ne peut utiliser que la fonctionnalité de point de fin
d’accès à distance du Logiciel aux fins d’appel des API publiques licenciées à partir d'une application ou
d'un programme développé sous Adobe Flex sauf que l’utilisation d’ESDS qui engendre l’utilisation de
fonctionnalités ESDS non modifiées est autorisée sans licence distincte au logiciel tant que le Logiciel
sous licence valide est désigné pour accéder aux Fonctionnalités ESDS par le biais d’une
programmation. En outre, le plug-in Data Services Modeler doit être utilisé avec ESDS et Adobe Flash
Builder. Le Licencié ne doit utiliser ce Logiciel qu'en accord aux Durées de licence obtenues pour ESDS
et Adobe Flash Builder. Le terme « Fonctionnalités ESDS » désigne les fonctionnalités d’accès à distance
et les destinations de services de données associés installés et configurés automatiquement lors de
l'installation initiale du Logiciel.
3.2 Adobe Flex SDK.
Si le Logiciel du Licencié comprend FLEX SDK, alors le Licencié peut (a) utiliser Flex SDK aux seules fins
de développement interne d’Applications ; (b) utiliser Flex SDK dans le cadre du site Web du Licencié
aux seules fins de compiler des Programmes de Développeur distribués via le site Web du Licencié ;
(c) modifier et reproduire les Fichiers Sources Flex SDK afin de les utiliser comme composant des
Programmes de Développeur, ajoutant des Améliorations importantes aux Fichiers Sources Flex SDK ;
et (d) distribuer les Fichiers Sources Flex SDK en code objet et/ou code source uniquement en tant que
composant des Programmes de Développeur, ajoutant des Améliorations importantes aux Fichiers
Sources Flex SDK, à condition que (1) ces Programmes de Développeur soient conçus pour fonctionner
avec Adobe Flash Builder, Flex Charting, ESDS ou Flex SDK ; (2) le Licencié distribue ce code objet et/ou
code source en vertu des dispositions d’un Contrat de Licence Utilisateur Final ; (3) le Licencié inclut
une mention de droit d’auteur reflétant la titularité du droit d’auteur du Développeur sur ces
Programmes de Développeur ; (4) le Licencié soit seul responsable à l’égard de ses clients de toute mise
à jour ou obligation d’assistance ou autre qui peut résulter d’une telle distribution ; (5) le Licencié ne
fasse aucune déclaration selon laquelle son Programme de développeur est « certifié » ou que son
fonctionnement est garanti par Adobe ; (6) le Licencié n’utilise pas le nom ou les marques d’Adobe pour
commercialiser ses Programmes de développeur sans l’autorisation écrite d’Adobe ; (7) le Licencié ne
supprime pas ou n’altère pas d’une autre manière les mentions de droits d’auteur, marques, logos et
mentions connexes, ou d’autres mentions de droits de propriété d’Adobe (et de ses concédants, le cas
échéant) figurant sur ou dans les Fichiers Sources et/ou Composants Flex SDK, ou toute documentation
relative aux Composants Flex SDK ; (8) le Licencié mentionne de manière visible que, pour tous fichiers
modifiés, le Licencié a modifié les fichiers ; et (9) le Licencié n’utilise pas « mx », « mxml », « flex »,
« flash », « livecycle », « ADEP » ou « adobe » sur tout nouvel emballage ou nom de catégorie
distribué avec les Fichiers Sources Flex SDK. Toute partie modifiée ou fusionnée des Fichiers Sources
Flex SDK est régie par le présent Contrat.
3.2.1 Définitions supplémentaires.
3.2.1.1 Le terme « Contrat de Licence Utilisateur Final » désigne un contrat de licence utilisateur final
qui prévoit : (a) un droit limité et non exclusif pour utiliser le Programme de développeur ; (b) des
dispositions assurant que tout sous-licencié du Licencié respecte toutes les restrictions et obligations
énoncées dans cet Article 3.2 ; (c) les interdictions habituelles contre la décompilation et l’ingénierie
inverse du Programme de développeur ; (d) une déclaration selon laquelle le Licencié et ses
fournisseurs conservent les droits, titres et intérêts sur le Programme de développeur ; (e) une
déclaration selon laquelle les fournisseurs du Licencié excluent toutes garanties ou représentations
concernant le Programme de développeur ; et (f) une limitation de responsabilité excluant la
responsabilité au bénéfice des fournisseurs du Licencié.
3.2.1.2 Le terme « Logiciels de développeur » désigne les logiciels ou applications qui sont composés
en partie des Fichiers Sources Flex SDK et des Améliorations importantes du Licencié s’ajoutant ou
étendant les Fichiers sources Flex SDK.
3.2.1.3 Le terme « Composants Flex SDK » désigne les fichiers, bibliothèques et exécutables contenus
dans le répertoire Flex SDK ou, le cas échéant, dans des répertoires suivants (ex : Flex SDK 2, etc.) (sauf
le contenu du sous-répertoire « samples »), y compris les Fichiers Sources Flex SDK , fichiers de
construction, les compilateurs et les informations connexes, ainsi que les spécifications du format du
fichier, le cas échéant, inclus en tant qu’élément du Logiciel tel que décrit dans la Documentation Flex
SDK ou un fichier « Lisez-moi » accompagnant le Logiciel Flex SDK.
3.2.1.4 Le terme « Fichiers sources Flex SDK » désigne les fichiers de code source Flex Framework
fournis avec Flex SDK.
3.2.1.5 Le terme « Amélioration importante » désigne toutes améliorations perceptibles, mesurables et
définissables apportées aux Fichiers Sources Flex SDK qui fournissent des fonctionnalités significatives et
essentielles étendues ou supplémentaires, ajoutant une valeur commerciale significative aux Fichiers
Sources Flex SDK.
3.2.2 Limitations.
3.2.2.1 Limitations générales. A l’exception des droits de distribution limités ci-dessus concernant les
Fichiers Sources Flex SDK, le Licencié s’interdit de distribuer, vendre, concéder en sous-licence, louer,
prêter ou louer en crédit-bail les Composants Flex SDK et/ou leurs composants, à un tiers. Pour éviter
toute confusion, le Licencié ne peut pas distribuer les Composants Flex SDK qui sont fournis en tant
qu’exécutables et/ou en code objet. Le Licencié accepte également de ne pas ajouter ou supprimer des
fichiers d’application de manière à modifier les fonctionnalités et/ou l’apparence d’autres logiciels
Adobe et/ou leurs composants.
3.2.2.2 Limitations concernant le développement. Le Licencié accepte de ne pas utiliser les Composants
du kit Flex SDK pour créer, développer ou utiliser un programme, logiciel ou service qui (a) contient des
virus, chevaux de Troie, vers, bombes à retardement, robots d’annulation ou autres routines de
programmation informatique qui aient pour but d’endommager, d’interférer de façon dommageable,
d’intercepter subrepticement ou d’exproprier tout système, toute donnée ou information
personnelle ; (b) lorsqu’il est utilisé conformément à sa destination, viole une loi, une ordonnance ou un
règlement important (y compris, notamment, les lois et règlements régissant le contrôle des
exportations, la concurrence déloyale, la lutte contre la discrimination ou la publicité mensongère) ;
ou (c) interfère avec l’opérabilité des autres programmes ou logiciels Adobe ou tiers.
3.2.3 Indemnisation. Le Licencié accepte de défendre, d’indemniser et de garantir Adobe et ses
fournisseurs contre toute réclamation ou procédure, y compris les honoraires raisonnables des avocats,
résultant de l’utilisation ou de la distribution des Programmes de développeur, à condition qu’Adobe
remette sans délai au Licencié une notification écrite l’informant d’une telle réclamation, qu'Adobe
laisse au Licencié le contrôle des moyens de défense ou de transaction, aux frais de ce dernier, et
coopère avec le Licencié pour la défense et le règlement de la réclamation, aux frais de ce dernier.
3.3.1 Utilisation d’Adobe Acrobat Pro. Une copie d’Adobe Acrobat Pro est livrée avec Adobe Document
Services PDF Generator aux fins d’une utilisation limitée de la manière suivante : (a) Le licencié peut
installer une (1) copie d’Adobe Acrobat Pro sur chaque Serveur sur lequel Adobe Document Services
PDF Generator est installé ; (b) le Licencié peut uniquement utiliser Adobe Acrobat Pro indirectement
par l’utilisation du Logiciel et uniquement dans la mesure où Adobe Document Services PDF Generator
est conçu pour accéder à Adobe Acrobat Pro par le biais d’une programmation comme décrit dans la
Documentation ; et (c) le Licencié ne peut pas utiliser Adobe Acrobat Pro directement ou les fonctions
et fonctionnalité d’Adobe Acrobat Pro qui n’ont pas été activées ou prises en charge par l’utilisation
d’Adobe Document Services PDF Generator sans que le Licencié obtienne une licence individuelle à cet
effet.
3.3.2 Utilisation des produits logiciels Adobe pris en charge. Le logiciel Adobe Document Services PDF
Generator est conçu pour fonctionner en connexion avec un certain nombre de logiciels Adobe comme
décrit dans la Documentation (chacun désigné comme « Produit logiciel Adobe pris en charge »). Dans
la mesure où le Licencié détient une licence individuelle d’un Produit logiciel Adobe pris en charge, il
est autorisé à utiliser ledit produit avec le logiciel Adobe Document Services PDF Generator aux seules
fins de convertir des fichiers aux formats de fichier natifs desdits Produits logiciels Adobe pris en charge
(fichiers au format .psd par exemple) sous réserve des limites et restrictions suivantes : (a) Le Licencié
peut installer une (1) copie de chaque Produit logiciel Adobe pris en charge sur chaque Serveur sur
lequel le logiciel Adobe Document Services PDF Generator est installé ; et (b) le Licencié n’utilise les
Produits logiciels Adobe pris en charge que d’une manière indirecte par le biais du logiciel Adobe
Document Services PDF Generator dans la mesure où le logiciel Adobe Document Services PDF
Generator est conçu pour accéder aux Produits logiciels Adobe pris en charge comme décrit dans la
Documentation.
3.4 AUTRES DISPOSITIONS EN VIGUEUR POUR LA MISE A NIVEAU DES LICENCIES D’ADOBE
LIVECYCLE.
3.4.1 Toutes les reprises, mises à jour et mises à niveau doivent se conformer aux dispositions de
l’Article 5 du Contrat de licence Adobe Digital Enterprise Platform. Si le Licencié détient une licence d’un
composant du Logiciel en tant que mise à niveau d'un ancien composant Adobe LiveCycle sous licence,
alors le terme « Logiciel » désigne le même composant et la même durée que sous la licence actuelle.
Par exemple, un licencié qui détient une ancienne licence Adobe LiveCycle Rights Management mettra
à niveau vers ADEP Document Services Rights Management, et conservera la Durée en vigueur de la
licence d’origine.
3.4.2 Exceptions. Nonobstant des dispositions de l’Article 3.4.1, les Licenciés des composants LiveCycle
ci-dessous bénéficieront des mises à niveau suivantes sous leurs Durées actuelles :
3.4.2.1 Pour les Licenciés de LiveCycle Mosaic, « Logiciel » désigne ADEP Experience Services
Composite Application Framework, Experience Services Core et Experience Services RIA Core.
3.4.2.2 Pour les Licenciés de LiveCycle Content Services, « Logiciel » désigne, en plus des ADEP
Document Services Content Services comme décrit à l’Article 3.4.1, ADEP Experience Services Core.
3.4.2.3 Pour les Licenciés d’Interactive Statements Solution Accelerator, « Logiciel » désigne Customer
Communications Solution, en supposant que l’usage est limité aux dispositions de leur accord de
licence d’origine.
3.4.2.4 Pour les Licenciés de Correspondence Management Solution Accelerator, « Logiciel » désigne
Customer Communications Solution, en supposant que l’usage est limité aux dispositions de leur accord
de licence d’origine.
3.4.2.5 Pour les Licenciés de Managed Review et Approval Solution Accelerator, « Logiciel » désigne

1. DEFINITIONEN.
1.1 „Adobe Digital Enterprise Platform Basic“ oder „ADEP-Basic“ bezeichnet Document Services
Foundation, Document Services Workbench, Document Services Designer, Document Services Output,
Document Services PDF Generator, Document Services Reader Extension, Experience Services Core,
Experience Services RIA Core, Experience Services Basic Data Services (diese Komponente darf jedoch
nicht auf einem Cluster verwendet werden), ADEP SDK und fünf (5) autorisierte Benutzer von Flash
Builder (vorausgesetzt, Adobe Flash Builder ist als Teil der Software installiert und wird ausschließlich in
Verbindung mit den ADEP SDK Komponenten zur Modifikation der Software-Komponenten und
Schaffung von Anwendungen benutzt, die in die Software-Komponenten integriert werden).
1.2 „Adobe Digital Enterprise Platform Standard“ oder „ADEP Standard“ bezeichnet ADEP Basic plus die
folgenden Komponenten: Document Services Digital Signatures, Document Services Forms, Document
Services Process Management, Document Services Rights Management, ADEP Mobile, Experience
Services Advanced Data Services und Experience Services Composite Application Framework.
1.3 „Anwendung“ bezeichnet ein Computerprogramm, das für eine spezifische Aufgabe oder
Verwendung entwickelt wurde, die die Software zum Zugriff, Speichern oder Verarbeiten von Daten, zur
Erstellung von Dokumenten oder zur Anzeige von Daten oder Inhalten verwendet. Beispiele einer
Anwendung sind eine Unternehmens-Website, ein Blog, ein Wiki, eine eLearning-Plattform, Websites für
Online-Shopping, Spiele, Online-Kalender, Landkarten oder Auktionen.
1.4 „Authentifizierung“ bezeichnet die gültige Eingabe eines erforderlichen sicheren
Berechtigungsnachweises (z.B. eine Benutzername/Kennwort-Kombination, Smartcard oder
biometrische Daten) vor der Verwendung oder dem Zugriff auf die Software oder das Dokument, ganz
gleich ob dieser Berechtigungsnachweis direkt in die Software eingegeben wird oder vom Programm in
die Software übergeben wird, womit dem Benutzer ein spezifischer Satz von Rechten auf die Software
oder das Dokument übertragen wird.
1.5 „Computer“ bezeichnet einen oder mehrere Prozessor(en) (CPU) in einem Hardwaregerät
(einschließlich eines Servers), das Informationen in digitaler oder ähnlicher Form aufnehmen und
entsprechend einer Befehlsfolge in ein spezielles Resultat umwandeln kann.
1.6 „Cluster“ bezeichnet eine Gruppe von Servern, die je nach Bedarf zusammen betrieben werden, um
z.B. eine hohe Verfügbarkeit, Skalierbarkeit und/oder Verteilung der Arbeitslast zu ermöglichen.
1.7 „CPU“ bezeichnet Prozessoren auf Computern, die zur Ausführung der Software verwendet werden,
unter der Voraussetzung: (a) Alle Prozessoren in einem Computer, auf dem die Software installiert ist,
werden als die Software ausführend erachtet, es sei denn, der Lizenznehmer konfiguriert diesen
Computer (mittels einer zuverlässigen und nachprüfbaren Methode zur Hardware- oder
Softwarepartitionierung) so, dass die Gesamtanzahl von Prozessoren, die die Software tatsächlich
ausführen, geringer ist als die Gesamtanzahl auf diesem Computer, und (b) wenn ein Prozessor mehrere
Prozessorkerne enthält, gilt jede Gruppe von zwei (2) Prozessorkernen und ein verbleibender nicht in
einem Paar enthaltener Prozessorkern als ein (1) Prozessor (CPU).
1.8 „Einsatz“ bedeutet eine Gruppe von Servern, auf denen die Software installiert ist und die eine oder
mehrere Anwendungen ausführen, wobei alle Server alle Anwendungen ausführen und am gleichen
physischen Standort betrieben werden.
1.9 „Dokument“ bezeichnet eine elektronische oder gedruckte Datei, die von der Software verarbeitet
oder erzeugt wird, einschließlich Dokumente mit Datenfeldern, in denen Daten eingegeben und
gespeichert werden können.
1.10 „Funktionen“ bezeichnet: (a) eine bestimmte, durch die Software in PDF-Dateien integrierte
Technologie, die Funktionen in der Adobe Reader Software aktiviert, die anderweitig nicht verfügbar
wären (z. B. die Fähigkeit, Dokumente lokal zu speichern oder Anmerkungen hinzuzufügen); und
(b) Metadaten (auf einem Computer gespeichert und/oder in einer elektronischen Datei eines
unterstützten Dateiformats integriert), die Zugriffs- und Nutzungsrechte enthalten oder sich darauf
beziehen, die von Software-Komponenten von Adobe Document Services Rights Management direkt
oder über unterstützte Software-Anwendungen durchgesetzt werden sollen.
1.11 „Instanz“ bezeichnet eine speicherresidente Kopie der Software, die innerhalb eines virtuellen
Java-Maschinenprozesses auf einem Server als Produktionssoftware instanziiert und ausgeführt wird.
1.12 „Metrischer Zeitraum“ bezeichnet ein einzelnes Kalenderjahr.
1.13 „Server“ bezeichnet einen Computer, der für den Zugriff durch mehrere Nutzer über ein Netzwerk
ausgelegt bzw. konfiguriert ist. Wenn ein Server mehr als eine (1) virtuelle Maschine enthält, zählt jede
virtuelle Maschine als ein Server.
1.14 „Trade-Up“ bezeichnet eine Softwarelizenz, wobei der Lizenznehmer seine vorbestehenden
Lizenzrechte an einer Softwareversion für die Lizenz einer anderen Softwareversion aufgibt (z.B. Aufgabe
seiner Lizenzrechte an ADEP BASIC für eine Lizenz für ADP Standard oder Aufgaben seiner Lizenzrechte
an Adobe LiveCycle Reader Extensions für eine Lizenz für ADEP Basic).
2. SOFTWARE-DEFINITIONEN UND ZUSÄTZLICHE LIZENZBEDINGUNGEN.
2.1.1 Definition von Software. Wenn ein Lizenznehmer eine Lizenz für Adobe Digital Enterprise Platform
(„ADEP“) erworben hat, bezeichnet „Software“ entweder (a) ADEP Basic oder (b) ADEP Standard, wie
auf den Bestelldokumenten angegeben.
2.1.1.1 Die Adobe Digital Enterprise Platform Software kann als Entwicklungssoftware oder nach
Einsatz-Lizenzmessgröße lizenziert werden.
2.1.2. Zusätzliche Lizenzbedingungen.
2.1.2.1. „Authorisierter ADEP-Benutzer“ bezeichnet eine bestimmte Person, die Authentifizierung
verwendet, um sich bei einer von der Software erstellten Anwendung oder Dokument oder
Softwareausgabe anzumelden, um im Namen eines Unternehmens, einer staatlichen Stelle, einer
Bildungseinrichtung oder einer anderen Organisation aufzutreten. Ein autorisierter ADEP-Benutzer hat
auch alle Rechte eines ADEP-Empfängers. Jeder autorisierte ADEP-Benutzer hat nur eine Lizenz für
einen einzigen Einsatz.
2.1.2.2 „Grundanwendung“ bedeutet einen (1) Einsatz.
2.1.2.3 „ADEP-Empfänger“ bedeutet eine spezielle Person in einem metrischen Zeitraum, die (a) eine
Anwendung oder ein Dokument oder die Softwareausgabe ohne Authentifizierung verwendet, um im
Namen eines Unternehmens, einer staatlichen Stelle, einer Bildungseinrichtung oder anderen
Organisation zu handeln; (b) Authentifizierung verwendet, um sich bei einer Anwendung, einem
Dokument oder der Ausgabe der Software anzumelden, und nicht im Namen eines Unternehmens,
einer staatlichen Stelle, einer Bildungseinrichtung oder anderen Organisation handelt; (c) über
Funktionen auf Dokumente zugreift; (d) Daten bei einer Anwendung einreicht, die mit der Software
erstellt wurden; oder (e) mit der Software erstellte Dokumente empfängt. Jeder ADEP-Empfänger hat
nur eine Lizenz für einen einzigen Einsatz.
2.2.1 Definition von Software. Wenn der Lizenznehmer eine Lizenz für die Adobe Web Experience
Management Solution („WEM“) hat, bezieht sich „Software“ auf ADEP Basic, aber alle diese
Verwendungen sind ausschließlich auf Komponenten im Experience Services Core beschränkt und
(a) wenn der Lizenznehmer eine Lizenz für die WEM Basic Version, Web Content Management,
Advanced Content Management, Adobe Online Marketing Suite Site Catalyst Integration und LDAP mit
SSO und CIFS Support Komponenten erworben hat; (b) wenn der Lizenznehmer eine Lizenz für die
WEM Standard Version erworben hat, umfasst die „Software“ alle WEM Basic Komponenten plus Portal,
Portal Director, Social Collaboration, Targeting und Digital Asset Management; oder (c) wenn der
Lizenznehmer eine Lizenz für die WEM Premium Version erworben hat, umfasst „Software“ alle WEM
Standard Komponenten plus die Komponenten von WEM Mobile, Marketing Campaign Management,
Active Clustering, Adobe Online Marketing Suite Test & Target Integration sowie Multi-Site Manager.
Jede Produktionssoftware-Lizenz für diese Software umfasst eine unbegrenzte Anzahl von
Entwicklungssoftware-Lizenzen für diese Software, solange alle Verwendungen unter der
Entwicklungssoftware-Lizenz die Nutzungseinschränkungen dieser Software befolgen.
2.2.2. Zusätzliche Lizenzbedingungen.
2.2.2.1 „Autorisierter WEM-Benutzer“ bezeichnet Mitarbeiter oder Vertreter von Lizenznehmern, die
Authentifizierung verwenden, um sich bei der Software oder einer Anwendung für administrative
Zwecke oder die Erstellung von Web-Eigenschaften anzumelden.
2.2.2.2 „Grundanwendung“ bedeutet zwei (2) Instanzen.
2.3.1 Definition von Software. Wenn ein Lizenznehmer eine Lizenz für die Adobe Integrated Content
Review Solution („ICR“) hat, bezieht sich „Software“ auf ADEP Standard und (a) wenn der Lizenznehmer
eine Lizenz für die ICR Standard Version hat, (i) eine Projektplanungsschnittstelle, die die Erstellung und
das Management von Projekt-Zeitplänen, Plänen, Projektteams und Workflows ermöglicht, um Inhalte
zu erstellen, prüfen und genehmigen, und (ii) die Adobe® Creative Suite® Task List Extension for
Integrated Content Review, oder (b) wenn der Lizenznehmer eine Lizenz für die ICR Premium Version
hat, umfasst „Software“ alle ICR Standard-Komponenten plus eine (1) Instanz von Digital Asset
Management.
Die gesamte Verwendung der Software ist ausschließlich auf die Initiierung, Durchführung und
Teilnahme an Inhaltsprüfungen an digitalen Assets und Dokumenten beschränkt, die von einer
Desktop-Anwendung oder über automatische Prozesse erzeugt werden, solange diese erzeugten
Inhalte einen Prüfungs- und Genehmigungsprozess innerhalb der Software einleiten. Die Software darf
nicht zur Erzeugung von Inhalten in Form von PDF-Dokumenten, Formularen oder Batch-Ausgaben zur
Verteilung oder für Dokumentdienste oder Prozessmanagement-Zwecke verwendet werden,
ausgenommen die für den Prüfungs- und Genehmigungsprozess erforderlichen Zwecke.
Entwicklungssoftware-Lizenzen für diese Software, solange alle Verwendungen unter der
2.3.2 Zusätzliche Lizenzbedingungen.
2.3.2.1 „Autorisierter ICR-Benutzer“ bezeichnet einen Mitarbeiter oder Vertreter des Lizenznehmers, der
Authentifizierung verwendet, um sich bei der Software oder einer Anwendung anzumelden, um eine
Kampagne, ein Projekt, ein Asset oder einen Plan zu erstellen, implementieren, einzureichen,
einzuleiten oder zu ändern, der den Inhaltsprüfungs- und Genehmigungsprozess steuert. Ein
autorisierter ICR-Benutzer hat auch alle Rechte eines ICR-Empfängers. Jeder autorisierte ICR-Benutzer
hat nur eine Lizenz für einen einzigen Einsatz.
2.3.2.3 „ICR-Empfänger“ bedeutet eine spezifische Person in einem metrischen Zeitraum, deren Rechte
auf das Lesen, Prüfen, Genehmigen oder Ablehnen einer von der Software überwachten Inhaltsprüfung
oder Genehmigungsaufgabe beschränkt sind. Ein ICR-Empfänger darf Parameter von Inhaltsprüfungen,
Prozessen und Assets nicht erstellen oder modifizieren. Jeder ICR-Empfänger hat nur eine Lizenz für
einen einzigen Einsatz.
2.4.1 Definition von Software. Wenn ein Lizenznehmer den Adobe Customer Communications Solution
Standard („CC“) erworben hat, bezieht sich „Software“ auf ADEP Standard und Asset Placement Plug-in
für Adobe Designer und Flash Builder, Asset Placement Service, Batch-Service Service, Asset Manager
und Asset Editor Schnittstellen, die Correspondence Creation Schnittstelle, Expression Manager, Asset
Composer und Data Dictionary Services, aber alle diese Verwendungen sind ausschließlich auf die
Erstellung, das Management, die Verwaltung und Zustellung der folgenden Arten von Korrespondenz
an CC-Empfänger beschränkt: Kundenabrechnungen, Rechnungen, Antworten auf Kundenanfragen,
Personalkorrespondenz, Erinnerungs- und Mitteilungsschreiben, Bestätigungsmitteilungen, Dokumente
zu Grundsatzausgabe, Begrüßungspakete oder Kontoantragspakete, einschließlich Sicherung oder
Verwaltung der Rechte der oben aufgeführten Dokumenttypen. Die Verwendung von interaktiven
Komponenten in Verbindung mit CC-Empfängern ist auf die Interaktionen beschränkt, die direkt mit der
Erstellung oder Beantwortung von persönlich gestalteter Korrespondenz verbunden sind. Verbotene
Nutzungen umfassen (u.a.) die Veröffentlichung eines nicht persönlich gestalteten Dokuments mit
Funktionen auf einer Website oder Verwendung der ADEP Experience Services Core zur
Veröffentlichung oder Speicherung von Inhalten, die nicht von der Software verwendet oder erzeugt
wurden.
Entwicklungssoftware-Lizenzen für diese Software, solange alle Verwendungen die
2.4.2.1 „Autorisierte CC-Benutzer“ bedeutet eine spezifische Person, die Authentifizierung verwendet,
um sich bei der Software oder einer Anwendung anzumelden, und zwar zum Zweck der Erstellung und
Verwaltung von Korrespondenzvorlagen, der Erstellung, Verwaltung oder Modifikation von
Korrespondenz, Dokumenten oder Abrechnungen oder der Zustellung von Korrespondenz,
Dokumenten oder Abrechnungen. Jeder autorisierte CC-Benutzer hat nur eine Lizenz für einen einzigen
Einsatz.
2.4.2.3 „CC-Empfänger“ bezeichnet eine spezifische Person in einem metrischen Zeitraum, die von der
Software erzeugte Korrespondenz, Dokumente oder Abrechnungen empfängt, anzeigt oder anderweitig
Zugriff darauf hat, und die kein geschäftlicher Empfänger ist. „Geschäftlicher Empfänger“ bezeichnet jede
Person, die im Namen eines Unternehmens, einer staatlichen Stelle oder Bildungseinrichtung oder einer
anderen Organisation auftritt und von der Software generierte Korrespondenz, Dokumente oder
Abrechnungen empfängt, prüft oder anderweitig Zugriff darauf hat. Jeder CC-Empfänger hat nur eine
Lizenz für einen einzigen Einsatz.
2.5.1 Definition von Software. Wenn ein Lizenznehmer eine Lizenz für die Adobe Collaboration Services
hat, bezeichnet „Software“ den Adobe Collaboration Service, und alle Verwendungen unterliegen einer
zusätzlichen Lizenz und den Service-Bedingungen auf http://www.adobe.com/go/terms_de.
2.5.2.1 „Gleichzeitiger Benutzer“ bezeichnet die Höchstanzahl der Benutzer, die während eines
metrischen Zeitraums gleichzeitig auf die Software zugreifen.
2.6.1 Definition von Software. Wenn ein Lizenznehmer eine Lizenz für Adobe Digital Enterprise Platform
Extension – Production Print hat, bezeichnet „Software“ nur die spezifische Version und Optionen, die in
den Bestelldokumenten angegeben sind.
2.6.2.1 Diese Software wird auf der Grundlage der CPU-Anzahl lizenziert.
2.6.2.2 Diese Software wird als Entwicklungssoftware auf der Grundlage der Server-Anzahl lizenziert.
2.6.2.3 Wenn der Lizenznehmer die Storyteller-Option hat, bedeutet „Software“ nur die spezifische
Version und die Komponenten, die in den Bestelldokumenten angegeben sind, und „Autorisierter
Benutzer von Storyteller“ bezeichnet den Mitarbeiter oder Vertreter des Lizenznehmers, der die
Software benutzt.
2.6.2.4 Wenn der Lizenznehmer eine Lizenz für die Option „Composition Center“ hat, bedeutet
„Software“ nur die spezifische Version und Komponenten, die in den Bestelldokumenten angegeben
sind. Jede Lizenz dieser Software umfasst fünfundzwanzig (25) Lizenzen für autorisierte Benutzer des
Composition Center und zwei (2) Lizenzen für autorisierte Benutzer von Storyteller. „Autorisierte
Composition-Benutzer“ bezeichnet einen Mitarbeiter oder Vertreter des Lizenznehmers, der die
Software verwendet.
2.6.2.5 Wenn der Lizenznehmer eine Lizenz für die Graphics-Option hat, bedeutet „Software“ nur die
spezifische Version und Komponenten, die in den Bestelldokumenten angegeben sind. Jede Lizenz
dieser Software umfasst nur eine (1) Lizenz für einen autorisierten Storyteller-Benutzer, die nur für die
Software verwendet werden darf.
2.7.1 Definition von Software. Wenn ein Lizenznehmer eine Lizenz für einen der Adobe Digital
Enterprise Connectors hat, bezeichnet „Software“ nur die spezifische Komponente, die in den
Bestelldokumenten angegeben ist.
2.7.2.1 „Grundanwendung“ bezeichnet einen (1) Produktionssoftware-Einsatz und unbegrenzte
Entwicklungssoftware-Einsätze.
3. ZUSÄTZLICHE BEDINGUNGEN, DIE FÜR DIE GESAMTE SOFTWARE ANWENDBAR SIND.
Sofern der Lizenznehmer nicht eine gültige Lizenz für die Produktionssoftware-Version der Experience
Services Data Services („ESDS“) Software erworben hat, darf der Lizenznehmer nur die RemotingEndpunkt-Funktionalität zum Zweck des Aufrufs von lizenzierten öffentlichen APIs aus einem Programm
oder einer Anwendung verwenden, die in Adobe Flex entwickelt wurde, mit der Ausnahme, dass jede
Verwendung von ESDS, die zur Verwendung der unmodifizierten ESDS-Funktionen führt, ohne eine
separate Lizenz für die Software erlaubt ist, und zwar in dem Maße, wie diese gültig lizenzierte Software
zum Programm-Zugriff auf die ESDS-Funktionen bestimmt ist. Außerdem muss das Data Services
Modeler Plugin in Verbindung mit ESDS und Adobe Flash Builder verwendet werden. Der Lizenznehmer
darf diese Software nur im Einklang mit der Lizenzmessgröße verwenden, die er für ESDS und Adobe
Flash Builder erworben hat. „ESDS-Funktionen“ bezeichnet die Remoting-Funktionen und zugehörigen
Daten-Services-Ziele, die automatisch mit der ersten Software-Installation installiert und konfiguriert
werden.
3.2 Adobe Flex SDK.
Wenn die Software des Lizenznehmers Flex SDK umfasst, darf der Lizenznehmer (a) Flex SDK nur für
interne Zwecke der Erstellung von Anwendungen nutzen, (b) Flex SDK, die in die Website des
Lizenznehmers eingebunden sind, nur für Zwecke der Kompilierung der Entwicklungsprogramme, die
durch die Website des Lizenznehmers weitergegeben werden, verwenden, (c) die Flex SDK
Quelldateien modifizieren und reproduzieren, um sie als Teile der Entwicklungsprogramme zu nutzen,
die zu einer wesentlichen Verbesserung der Flex SDK Quelldateien beitragen, und (d) die Flex SDK
Quelldateien im Objektcode und/oder Quellcode nur als Teil der Entwicklungsprogramme vertreiben,
die zu einer wesentlichen Verbesserung der Flex SDK Quelldateien beitragen, vorausgesetzt jedoch,
dass (1) die Entwicklungsprogramme so gestaltet sind, dass sie mit Adobe Flash Builder, Flex Charting,
ESDS oder mit Flex SDK funktionieren, und vorausgesetzt, dass (2) der Lizenznehmer den Objektcode
und/oder den Quellcode gemäß den Bedingungen eines Endnutzerlizenzvertrags vertreibt, (3) der
Lizenznehmer einen Urheberrechtshinweis in den Entwicklungsprogrammen anbringt, die das
Urheberrecht des Entwicklers an diesen Entwicklungsprogrammen bezeichnet, (4) der Lizenznehmer
seinen Kunden gegenüber sich allein zum Support und zur Lieferung von Updates verpflichtet und die
alleinige Haftung für den Weitervertrieb übernimmt, (5) der Lizenznehmer keine Erklärung dahingehend
abgibt, dass sein Entwicklungsprogramm „zertifiziert“ ist oder seine Funktionsfähigkeit von Adobe
garantiert ist, (6) der Lizenznehmer die Namen und Marken von Adobe für Zwecke der Vermarktung
seiner Entwicklungsprogramme nicht ohne schriftliche Zustimmung von Adobe nutzt, (7) der
Lizenznehmer Urheberrechtshinweise, Marken, Logos oder sonstige zugehörige Bezeichnungen oder
sonstige proprietäre Rechtsbezeichnungen von Adobe (und gegebenenfalls ihrer Lizenzgeber), die in
den Flex SDK Quelldateien und/oder den Flex SDK Komponenten oder in sich auf die SDK
Komponenten beziehenden Dokumentationen ersichtlich werden, nicht löscht und nicht bearbeitet,
(8) der Lizenznehmer auf bearbeiteten Dateien den ausdrücklichen Hinweis anbringt, dass er die Datei
bearbeitet hat, (9) der Lizenznehmer nicht die Bezeichnungen „mx“, „mxml“, „flex“, „flash“, „livecycle“,
„ADEP“ oder „adobe“ in neuen Paketen oder Klassenbezeichnungen verwendet, die mit den Flex SDK
Quelldateien vertrieben werden. Jeder bearbeitete oder zusammengeführte Teil der Flex SDK
Quelldateien unterliegt den Bestimmungen dieses Vertrages.
3.2.1 Zusätzliche Definitionen.
3.2.1.1 „Endnutzerlizenzvertrag“ bezeichnet einen Endnutzerlizenzvertrag, der folgende Bestimmungen
enthält: (a) ein beschränktes, nicht ausschließliches Recht zur Nutzung des Entwicklerprogramms;
(b) Bedingungen, die gewährleisten, dass alle Unterlizenznehmer des Lizenznehmers alle in diesem
Abschnitt 3.2 dargelegten Einschränkungen und Verpflichtungen einhalten, (c) Standardverbote der
Rückentwicklung oder Dekompilierung des Entwicklungsprogramms, (d) eine Erklärung, dass der
Lizenznehmer und seine Lieferanten alle Rechte, Ansprüche und Interessen am Entwicklungsprogramm
behält, (e) eine Erklärung, dass die Lieferanten des Lizenznehmers alle Gewährleistungen und Zusagen
des Lizenznehmers für das Entwicklerprogramm ausschließen, und (f) eine Haftungseinschränkung, die
die gesamte Haftung im Namen der Lieferanten der Lizenznehmer ausschließt.
3.2.1.2 „Entwicklungsprogramme“ bezeichnet Programme oder Anwendungen, die Teile der Flex SDK
Quelldateien und Teile der wesentlichen Verbesserungen des Lizenznehmers enthalten, die den Flex
SDK Quelldateien hinzugefügt werden oder sie erweitern.
3.2.1.3 „Flex SDK Komponenten“ bezeichnet Dateien, Bibliotheken und ausführbare Programme, die im
Verzeichnis als Flex SDK oder in ähnlich bezeichneten Verzeichnissen (z.B. Flex SDK 2 usw.) bezeichnet
werden (mit Ausnahme von Inhalten, die im Unterverzeichnis „Muster“ enthalten sind), einschließlich
die Flex SDK Quelldateien, „build files“, Compiler und zugehörigen Informationen sowie ggf.
Dateiformatspezifikationen, die in der Software enthalten und in der Flex SDK Dokumentation
beschrieben sind oder einer „Read Me“-Datei enthalten sind, die zur Flex SDK-Software gehören.
3.2.1.4 „Flex SDK Quelldateien“ bezeichnet die Flex Framework Quellcode-Dateien, die mit Flex SDK
geliefert werden.
3.2.1.5 „Wesentliche Verbesserung“ bezeichnet erkennbare, prüfbare und definierbare Verbesserungen
der Flex SDK Quelldateien, die Erweiterungen und zusätzliche bedeutende und primäre
Funktionalitäten enthalten und die Geschäftstauglichkeit der Flex SDK Quelldateien steigern.
3.2.2. Einschränkungen.
3.2.2.1 Allgemeine Beschränkungen. Mit Ausnahme der vorstehend genannten beschränkten
Vertriebsrechte ist der Lizenznehmer nicht berechtigt, die Flex SDK Quelldateien und/oder deren
Komponenten an Dritte zu vertreiben, zu verkaufen, zu sublizenzieren, zu vermieten, zu verleihen oder
zu leasen. Es wird klargestellt, dass der Lizenznehmer nicht berechtigt ist, Flex SDK Komponenten, die in
ausführbarer Form und/oder im Objektcode bereitgestellt werden, zu vertreiben. Darüber hinaus ist der
Lizenznehmer nicht berechtigt, Programmdateien hinzuzufügen oder zu löschen, die die
Funktionsfähigkeit und Erkennbarkeit der Adobe Software oder ihrer Komponenten abändern.
3.2.2.2 Beschränkungen für Entwicklungen. Der Lizenznehmer erklärt sich bereit, die Flex SDKKomponenten nicht zu nutzen, um Programme, Software oder Dienste zu erstellen, zu entwickeln oder
zu verwenden, die (a) Viren, trojanische Pferde, Würmer, Zeitbomben, Cancelbots oder sonstige
Computerprogrammabläufe enthalten, die dazu bestimmt sind, Systeme, Daten oder persönliche
Informationen vorsätzlich zu beschädigen oder zu beeinträchtigen, abzufangen oder anderweitig zu
entwenden, (b) trotz bestimmungsgemäßer Nutzung rechtswidrig sind (insbesondere gegen
Vorschriften zur Exportkontrolle, zum unlauteren Wettbewerb, zur Nichtdiskriminierung oder
irreführenden Werbung verstoßen) oder (c) andere Software oder Programme von Adobe oder Dritten
beeinträchtigen.
3.2.3 Freistellung. Der Lizenznehmer verpflichtet sich, Adobe und ihre Lieferanten von Ansprüchen und
Klagen einschließlich Rechtsanwaltskosten in angemessener Höhe freizustellen und schadlos zu halten,
die in Folge der Nutzung oder des Vertriebs der Entwicklerprogramme geltend gemacht werden,
vorausgesetzt, dass Adobe den Lizenznehmer von der Geltendmachung solcher Ansprüche
unverzüglich schriftlich informiert, dem Lizenznehmer die Verteidigung oder die einvernehmliche
Beilegung der Ansprüche auf Kosten des Lizenznehmers überlässt und den Lizenznehmer auf dessen
Kosten bei der Verteidigung oder Beilegung der Ansprüche unterstützt.
3.3.1 Verwendung von Adobe Acrobat Pro. Eine Kopie von Adobe Acrobat Pro wird mit dem Adobe
Document Services PDF Generator zur Verwendung vorbehaltlich der folgenden Einschränkungen
mitgeliefert: (a) Der Lizenznehmer darf eine (1) Kopie von Adobe Acrobat Pro auf jedem Server
installieren, auf dem Adobe Document Services PDF Generator installiert ist; (b) der Lizenznehmer darf
Adobe Acrobat Pro nur indirekt durch die Benutzung der Software benutzen und nur in dem Maße, wie
Adobe Document Services PDF Generator zum Zugriff auf Adobe Acrobat Pro über das Programm
vorgesehen ist, wie es in der Dokumentation beschrieben ist; und (c) der Lizenzinhaber darf Adobe
Acrobat Pro nicht direkt verwenden oder anderweitig Merkmale und Funktionen von Adobe Acrobat
Pro verwenden, die nicht aktiviert sind oder durch die Verwendung von Adobe Document Services PDF
Generator unterstützt werden (außer wenn der Lizenzinhaber eine entsprechende separate Lizenz
erwirbt).
3.3.2 Verwendung von unterstützten Adobe Software-Produkten. Die Adobe Document Services PDF
Generator-Software ist zur Ausführung in Verbindung mit bestimmten anderen AdobeSoftwareanwendungen bestimmt, wie in der Dokumentation beschrieben (jeweils ein „unterstütztes
Adobe Software-Produkt“). Wenn der Lizenznehmer eine separate Lizenz eines unterstützten Adobe
Software-Produkts erworben hat, kann der Lizenzinhaber dieses unterstützte Adobe Software-Produkt
mit der Adobe Document Services PDF Generator-Software zum alleinigen Zweck der Konvertierung
der Dateien in die nativen Dateiformate dieser unterstützten Adobe Software-Produkte (d.h. Dateien im
.psd-Format) verwenden, und zwar vorbehaltlich der folgenden Einschränkungen: (a) Der Lizenzinhaber
darf eine (1) Kopie jedes lizenzierten unterstützten Adobe Software-Produkts auf jedem Server
installieren, auf dem die Adobe Document Services PDF Generator Software installiert ist, und (b) der
Lizenznehmer darf nur die unterstützten Adobe Software-Produkte indirekt über die Verwendung der
Adobe Document Services PDF Generator-Software verwenden, und zwar in dem Maße, wie die Adobe
Document Services PDF Generator-Software zum Programmzugriff auf die unterstützten Adobe
Software-Produkte vorgesehen sind, wie es in der Dokumentation beschrieben ist.
3.4 ZUSÄTZLICHE BEDINGUNGEN FÜR LIZENZNEHMER, DIE EIN UPGRADE VON ADOBE LIVECYCLE
VORNEHMEN.
3.4.1 Alle Updates, Upgrades und Trade-Ups unterliegen Abschnitt 5 des Lizenzvertrags von Adobe
Digital Enterprise Platform. Wenn ein Lizenznehmer eine Komponente der Software als Upgrade einer
zuvor lizenzierten Adobe LiveCycle-Komponente per Lizenz übernimmt, bezeichnet „Software“ die
gleiche Komponente und Lizenzmetrik wie das Neubranding unter der aktuellen Lizenz. Zum Beispiel
erhält ein Lizenznehmer, der zuvor eine Lizenz für Adobe LiveCycle Rights Management hatte, ein
Upgrade für ADEP Document Services Rights Management und bleibt auf der für die ursprüngliche
Lizenz anwendbaren Lizenz-Metrik.
3.4.2 Ausnahmen. Ungeachtet der Bestimmungen von Abschnitt 3.4.1 erhalten Lizenznehmer der
folgenden LiveCycle-Komponenten die folgenden Upgrades unter ihrer bestehenden Lizenzmetrik:
3.4.2.1 Für Lizenznehmer von LiveCycle Mosaic bezeichnet „Software“ das ADEP Experience Services
Composite Application Framework, Experience Services Core und Experience Services RIA Core.
3.4.2.2 Für Lizenznehmer von LiveCycle Content Services bezeichnet „Software“ zusätzlich zu ADEP
Document Services Content Services, wie in Abschnitt 3.4.1 vorgesehen, den ADEP Experience
Services Core.
3.4.2.3 Für Lizenznehmer des Interactive Statements Solution Accelerator bezeichnet „Software“ die
Customer Communications Solution, vorausgesetzt, dass diese Nutzung auf die Bedingungen ihrer
ursprünglichen Lizenzerteilung begrenzt ist.
3.4.2.4 Für Lizenznehmer des Correspondence Management Solution Accelerator bezeichnet „Software“
die Customer Communications Solution, vorausgesetzt, dass diese Nutzung auf die Bedingungen ihrer
ursprünglichen Lizenzerteilung begrenzt ist.
3.4.2.5 Für Lizenznehmer des Managed Review and Approval Solution Accelerator bezeichnet
“Software” die Integrated Content Review Solution, vorausgesetzt, dass diese Nutzung auf die
Bedingungen ihrer ursprünglichen Lizenzerteilung begrenzt ist.

ADOBE DIGITAL ENTERPRISE PLATFORM 補足ライセンス契約
1. 定義
1.1 「Adobe Digital Enterprise Platform Basic」すなわち「ADEP Basic」とは、Document
Services Foundation、Document Services Workbench、Document Services Designer、
Document Services Output、Document Services PDF Generator、Document Services Reader
Extension、Experience Services Core、Experience Services RIA Core、Experience
Services Basic Data Services（このコンポーネントはクラスタで利用できません）、ADEP
SDK、および Flash Builder の 5 人の認定ユーザーを意味します（Adobe Flash Builder を本
ソフトウェアの一部としてインストールして ADEP SDK コンポーネントと組み合わせてのみ使
用し、ソフトウェアコンポーネントを改変して本ソフトウェアコンポーネントと連携するアプ
リケーションを作成することを条件とします）。
1.2 「Adobe Digital Enterprise Platform Standard」すなわち「ADEP Standard」とは、ADEP
Basic に次のコンポーネントを加えたものを意味します。Document Services Digital
Signatures、Document Services Forms、Document Services Process Management、Document
Services Rights Management、ADEP Mobile、Experience Services Advanced Data Services、
および Experience Services Composite Application Framework。
1.3 「アプリケーション」とは、本ソフトウェアを使用してデータのアクセス、保存、または処
理、ドキュメントの生成、データもしくはコンテンツの表示を行なう特定のタスクまたは用途に
向けて作成されたコンピュータープログラムを意味します。アプリケーションの例は、会社の
Web サイト、ブログ、Wiki、E ラーニングプラットフォーム、オンラインショッピング、ゲーム、
オンラインカレンダー、オークションサイトなどです。
1.4 「認証」とは、該当する認証情報が本ソフトウェアに対して直接入力されるかプログラムで
渡されるかにかかわらず、本ソフトウェアまたはドキュメントの使用もしくはアクセスを行う前
に要求される保護された認定情報（ユーザー名とパスワードの組み合わせ、スマートカード、指
紋照合など）を意味し、本ソフトウェアまたはドキュメントに対する特定の権限をユーザーに許
可します。
1.5 「コンピューター」とは、デジタルまたはこれに類似する形式で情報を受け取り、特定の結
果を得るために一連の指示に基づき情報を操作するハードウェアデバイス（サーバーを含みま
す）内にある 1 基以上の CPU を意味します。
1.6 「クラスタ」とは、高可用性、拡張性、負荷分散などを実現するために共に動作するサー
バーの集合体を意味します。
1.7 「CPU」とは、以下を条件に、本ソフトウェアを実行するためにコンピューターで使用され
る中央演算処理装置を意味し、(a) ライセンシーが、実際に本ソフトウェアを起動する CPU の
総数がコンピューター上の CPU 総数を下回るようにコンピューターを設定している場合（信頼
性があり検証可能なハードウェアまたはソフトウェアのパーティション分割を使用する）を除き、
本ソフトウェアがインストールされているコンピューター上にあるすべての CPU が本ソフト
ウェアを起動するものと見なし、また、(b) 1 基の CPU に 2 基以上のプロセッシングコアが搭
載されている場合は 2 基のプロセッシングコアを 1 組とし、1 組にならない残りのプロセッ
シングコアを 1 基の CPU と見なします。
1.8 「導入」とは、本ソフトウェアがインストールされたサーバーの集合体が、2 つ以上のアプ
リケーションを実行し、これらのサーバーがすべてのアプリケーションを同じ物理的サイトで実
行することを意味します。
1.9 「ドキュメント」とは、本ソフトウェアが処理または生成する電子もしくは印刷ファイルを
意味し、データが入力されたり保存されるデータフィールドを持つドキュメントを含みます。
1.10 「機能」とは、(a) 本ソフトウェアにより PDF ファイルに埋め込まれた特定の技術で、そ
れ以外では利用できない Adobe Reader の機能（ドキュメントをローカルで保存したり注釈を付
ける機能など）を有効にし、また(b) 本ソフトウェアの Adobe Document Services Rights
Management コンポーネントにより直接、またはサポートされるソフトウェアアプリケーション
を介して実施されるように設計されたアクセス権および使用権を記載もしくは参照するメタデー
タ（コンピューターに保存および／またはサポートされるファイル形式の電子ファイルに埋め込
まれている）を意味します。
1.11 「インスタンス」とは、本ソフトウェアが 1 台のサーバー上で製品版ソフトウェアとして
インスタンス化し Java 仮想マシンプロセスで実行する 1 部のメモリ内コピーを意味します。
1.12 「メトリックターム」とは、1 歴年度を意味します。
1.13 「サーバー」とは、ネットワークを通じて複数のユーザーがアクセスできるように設計ま
たは設定されたコンピューターを意味します。サーバーには 2 機以上の仮想マシンが搭載され、
それぞれがサーバーとして数えられるものとします。
1.14 「トレードアップ」とは、ライセンシーが本ソフトウェアに関する 1 つの版の既存のライ
センスの権利を別の版のライセンスに向けてリリースするソフトウェアのライセンスを意味しま
す（ADEP Basic のライセンスの権利を ADEP Standard に向けてリリースしたり、Adobe
LiveCycle Reader Extensions のライセンスの権利を ADEP Basic に向けてリリースするなど）。
2. ソフトウェアの定義と追加のライセンス条件
2.1 ADOBE DIGITAL ENTERPRISE PLATFORM
2.1.1 ソフトウェアの定義ライセンシーが Adobe Digital Enterprise Platform（「ADEP」と
いいます）のライセンスを許諾した場合、「ソフトウェア」とはオーダー書類に記載される (a)
ADEP Basic または (b) ADEP Standard を意味します。
2.1.1.1 Adobe Digital Enterprise Platform は、導入ライセンスメトリック単位の開発版ソフ
トウェアとしてライセンスを許諾されます。
2.1.2 追加のライセンス条件
2.1.2.1 「ADEP 認定ユーザー」とは、企業、政府当局、教育機関、または他の組織の代理を務
めるために、本ソフトウェア、ドキュメント、または本ソフトウェアの出力を使用して作成され
たアプリケーションに認証を使用してログインする 1 人のユーザーを意味します。ADEP 認定
ユーザーは ADEP 受信者のすべての権利も与えられるものとします。各 ADEP 認定ユーザーは 1
つの導入に対してのみライセンスを許諾されます。
2.1.2.2 「ベース」とは、1 つの導入を意味します。
2.1.2.3 「ADEP 受信者」とは、任意のメトリックタームにおける以下に該当する 1 人のユー
ザーを意味し、(a) 企業、政府当局、教育機関、または他の組織の代理を務めるために、認証を
使用せずに本ソフトウェア、ドキュメント、または本ソフトウェアの出力を使用する、(b) アプ
リケーション、ドキュメント、または本ソフトウェアの出力に認証を使用してログインし、企業、
政府当局、教育機関、または他の組織の代理を務めない、(c) 機能を使用してドキュメントにア
クセスする、(d) 本ソフトウェアを使用して作成されたアプリケーションにデータを送信する、
または (e) 本ソフトウェアを使用して生成されたドキュメントを受信する、各 ADEP 認定ユー
ザーは 1 つの導入に対してのみライセンスを許諾されます。
2.2 ADOBE WEB EXPERIENCE MANAGEMENT SOLUTION
2.2.1 ソフトウェアの定義ライセンシーが Adobe Web Experience Management Solution
（「WEM」といいます）のライセンスを許諾した場合、「ソフトウェア」とは ADEP Basic を意
味しますが、その使用は Experience Services Core のコンポーネントに制限され、(a) ライセ
ンシーが WEM Basic edition、Web Content Management、Advanced Content Management、Adobe
Online Marketing Suite Site Catalyst Integration、SSO および CIFS サポートがある LDAP
コンポーネントのライセンスを許諾した場合、(b) ライセンシーが WEM Standard 版のライセン
スを許諾した場合、「ソフトウェア」はすべての WEM Basic コンポーネント、Portal、Portal
Director、Social Collaboration、Targeting、および Digital Asset Management を含む、ま
たは (c) ライセンシーが WEM Premium 版のライセンスを許諾した場合、「ソフトウェア」はす
べての WEM Standard コンポーネント、WEM Mobile、Marketing Campaign Management、Active
Clustering、Adobe Online Marketing Suite Test & Target Integration、および Multi-Site
Manager コンポーネントを含むことを意味します。
このソフトウェアに許諾される各製品版ソフトウェアのライセンスは、開発版ソフトウェアライ
センスに基づくすべての使用がソフトウェアの使用制限に従う限り、このソフトウェアに許諾さ
れる開発版ソフトウェアの無制限のライセンス数が含まれます。
2.2.2.1 「WEM 認定ユーザー」とは、Web プロパティの管理および／または作成の目的で本ソ
フトウェアもしくはアプリケーションに認証を使用してログインする社員または代理人を意味
します。
2.2.2.2 「ベース」とは 2 個のインスタンスを意味します。
2.3 ADOBE INTEGRATED CONTENT REVIEW SOLUTION
2.3.1 ソフトウェアの定義ライセンシーが Adobe Integrated Content Review Solution
（「ICR」といいます）のライセンスを許諾した場合、「ソフトウェア」とは ADEP Standard お
よび (a) ライセンシーが ICR Standard 版のライセンスを許諾しているときには、(i) プロ
ジェクトのタイムライン、スケジュール、プロジェクトチームおよびワークフローの作成と管理
を有効にしてコンテンツの作成、確認、承認を行うプロジェクト計画インタフェイスおよび
(ii) Adobe® Creative Suite® Task List Extension for Integrated Content Review、または
(b) ライセンシーが ICR Premium 版のライセンスを許諾しているときには、「ソフトウェア」
にはすべての ICR Standard コンポーネントおよび Digital Asset Management の 1 つのイン
スタンスが含まれることを意味します。
本ソフトウェアのすべての使用は、該当するすべての生成コンテンツが本ソフトウェア内で確認
および承認プロセスを開始する場合に限り、デジタル資産およびデスクトップアプリケーション
または自動プロセスにより生成されたドキュメントのコンテンツレビューの開始、実施、参加の
みに制限されます。本ソフトウェアを使用して、配布、ドキュメントサービスまたは確認および
承認プロセスで必要になる以外の目的に、PDF ドキュメントの形式、他の形式、またはバッチ出
力でコンテンツを生成することはできません。
2.3.2.1 「ICR 認定ユーザー」とは、本ソフトウェアまたはアプリケーションに認証を使用して
ログインし、キャンペーン、プロジェクト、資産、またはコンテンツレビューおよび承認プロセ
スを管理するスケジュールを作成、実施、送信、開始、変更するライセンシーの社員または代理
人を意味します。ICR 認定ユーザーは ICR 受信者のすべての権利も与えられるものとします。
各 ICR 認定ユーザーは 1 つの導入に対してのみライセンスを許諾されます。
2.3.2.2 「ベース」とは 1 つの導入を意味します。
2.3.2.3 「ICR 受信者」とは、本ソフトウェアが監視するコンテンツレビューまたは承認タスク
の読み込み、承認、もしくは拒否にその権利が制限される任意のメトリックタームにおける 1
人のユーザーを意味します。ICR 受信者は、コンテンツレビューおよびプロセスまたは資産のパ
ラメーターを作成もしくは変更できません。各 ICR 受信者は 1 つの導入に対してのみライセン
スを許諾されます。
2.4 ADOBE CUSTOMER COMMUNICATIONS SOLUTION
2.4.1 ソフトウェアの定義ライセンシーが Adobe Customer Communications Solution
Standard（「CC」といいます）のライセンスを許諾した場合、「ソフトウェア」とは Adobe
Designer および Flash Builder 用の ADEP Standard と Asset Placement プラグイン、Asset
Placement サービス、Batch サービス、Asset Manager と Asset Editor のインタフェイス、
Correspondence Creation インタフェイス、Expression Manager、Asset Composer、および
Data Dictionary サービスを意味しますが、その使用は CC 受信者に対する以下のタイプの通信
の作成、管理、および送信に制限されます。顧客取引明細書、請求書、顧客の照会応答、人事通
信、案内と通知の書簡、裏書き通知、ポリシー発行ドキュメント、ウェルカムキット、アカウン
ト申請パッケージで、前述のドキュメントの保護と権利の管理を含みます。CC 受信者に関連す
る双方向コンポーネントの使用は、個人用通信の作成または応答に直接関連する意思疎通に制限
されるものとします。禁止される使用は、個人用ではない機能付きドキュメントの Web サイト
への公表、その使用または生成が本ソフトウェアによるものではないコンテンツの公表または保
存を行うための ADEP Experience Services Core の使用が含まれますがこれらに限定されませ
ん。
2.4.2.1 「CC 認定ユーザー」とは、通信テンプレートの作成と管理、通信、ドキュメント、ま
たは明細書の作成、管理、変更、もしくは通信、ドキュメント、または明細書の配信を目的に認
証を使用して本ソフトウェアまたはアプリケーションにログインする 1 人のユーザーを意味し
ます。各 CC 認定ユーザーは 1 つの導入に対してのみライセンスを許諾されます。
2.4.2. 「ベース」とは 1 つの導入を意味します。
2.4.2.3 「CC 受信者」とは、本ソフトウェアが生成する通信、ドキュメント、または明細書を
受信、表示、もしくはこれらにアクセス権を持つ任意のメトリックタームにおける 1 人のユー
ザーでビジネス受信者でない者を意味します。「ビジネス受信者」とは、企業、政府当局、教育
機関、または本ソフトウェアが生成する通信、ドキュメント、または明細書を受信、表示、もし
くはこれらにアクセス権を持つ他の組織の代理を務めるユーザーを意味します。各 CC 認定ユー
ザーは 1 つの導入に対してのみライセンスを許諾されます。
2.5 ADOBE COLLABORATION
2.5.1 ソフトウェアの定義ライセンシーが Adobe Collaboration のライセンスを許諾した場合、
「ソフトウェア」とは Adobe Collaboration を意味し、そのすべての使用は
http://www.adobe.com/go/terms_jp に記載されている追加のライセンスおよびサービス条件が適
用されます。
2.5.2.1 「コンカレントユーザー」とは、メトリックタームに本ソフトウェアに同時にアクセス
する最大ユーザー数を意味します。
2.6 ADOBE DIGITAL ENTERPRISE PLATFORM EXTENSION – PRODUCTION PRINT
2.6.1 ソフトウェアの定義ライセンシーが Adobe Digital Enterprise Platform Extension –
Production Print のライセンスを許諾した場合、「ソフトウェア」とは、オーダー書類に指定
される特定の版およびオプションのみを意味します。
2.6.2.1 このソフトウェアは製品版ソフトウェアとして CPU 単位でライセンスを許諾されます。
2.6.2.2 このソフトウェアは開発版ソフトウェアとしてサーバー単位でライセンスを許諾され
ます。
2.6.2.3 ライセンシーが Story Teller オプションのライセンスを許諾した場合、「ソフトウェ
ア」とは、オーダー書類に指定される特定のバージョンおよびコンポーネントのみを意味し、
「Story Teller 認定ユーザー」とはこのソフトウェアを使用するライセンシーの社員または代
理人を意味します。
2.6.2.4 ライセンシーが Composition Center オプションのライセンスを許諾した場合、「ソフ
トウェア」とは、オーダー書類に指定される特定のバージョンおよびコンポーネントのみを意味
します。このソフトウェアの各ライセンスには 25 の Composition Center 認定ユーザーライ
センスと 2 つの Story Teller 認定ユーザーライセンスが含まれており、「Composition 認定
ユーザー」とは、このソフトウェアを使用するライセンシーの社員または代理人を意味します。
2.6.2.5 ライセンシーが Graphics オプションのライセンスを許諾した場合、「ソフトウェア」
とは、オーダー書類に指定される特定のバージョンおよびコンポーネントのみを意味します。こ
のソフトウェアの各ライセンスには 1 つの Storyteller 認定ユーザーライセンスが含まれて
おり、ライセンスはこのソフトウェアでのみ使用できます。
2.7 ADOBE DIGITAL ENTERPRISE PLATFORM CONNECTORS
2.7.1 ソフトウェアの定義ライセンシーが任意の Adobe Digital Enterprise Connectors のラ
イセンスを許諾した場合、「ソフトウェア」とは、オーダー書類に指定される特定のコンポーネ
ントのみを意味します。
2.7.2.1 「ベース」とは、1 つの製品版ソフトウェアの導入と無制限の開発版ソフトウェアの
導入を意味します。
3. すべてのソフトウェアに適用される追加の条件
3.1 Experience Services Data Services
ライセンシーが Experience Services Data Services（「ESDS」といいます）の製品版ソフト
ウェアの有効なライセンスを取得していない場合、ライセンシーはライセンス許諾された公開
API を Adobe Flex で開発されたプログラムまたはアプリケーションから呼び出すことを目的に
ソフトウェアのリモートエンドポイント機能のみを利用できますが、結果として未修正の ESDS
機能を使用することになる ESDS の使用が、ソフトウェアの別途ライセンスがなくても、有効に
ライセンス許諾されたソフトウェアがプログラムで ESDS 機能にアクセスするように設計されて
いる場合を除きます。また、Data Services Modeler プラグインは ESDS および Adobe Flash
Builder と併用する必要があります。ライセンシーは、ESDS および Adobe Flash Builder のた
めに取得したライセンスメトリックに従ってのみこのソフトウェアを使用できます。「ESDS 機
能」とは、リモート機能および本ソフトウェアの初回インストール時に自動的にインストールさ
れ設定された関連データサービスデスティネーションを意味します。
3.2 Adobe Flex SDK
ライセンシーのソフトウェアに Flex SDK が含まれている場合、ライセンシーは、(a) 内部で開
発するアプリケーションのみのために Flex SDK を使用し、(b) ライセンシーの Web サイトを介
して配布される開発者プログラムのコンパイルのためにのみ、Flex SDK をライセンシーの Web
サイトの一部として使用し、(c) Flex SDK ソースファイルに重要な改善を加える開発者プログラ
ムのコンポーネントとして使用するために Flex SDK ソースファイルを修正および再生し、かつ
(d) Flex SDK ソースファイルに重要な改善を加える開発者プログラムのコンポーネントとしての
み、オブジェクトコード形式および／またはソースコード形式で Flex SDK ソースファイルを配
布するための、非独占的な譲渡不可のライセンスを許諾しますが、(1) 上記開発者プログラムは
Adobe Flash Builder、Flex Charting、ESDS、または Flex SDK と連動するように設計されてい
る、(2) ライセンシーはエンドユーザーライセンス契約の条件に基づき上記オブジェクトコード
および／またはソースコードを配布する、(3) ライセンシーは上記開発者プログラムに開発者の
著作権を反映する著作権表示を含める、(4) ライセンシーは上記配布により生じる更新もしくは
サポート義務またはその他の責任につき顧客に対して単独で責任を負う、(5) ライセンシーは、
自らの開発者プログラムがアドビの「認証を受けた」またはその性能がアドビによって保証され
ているとの表明を行わない、(6) ライセンシーはアドビの書面による許可を受けずに自らの開発
者プログラムのマーケティングのためにアドビの名称または商標を使用しない、(7) ライセン
シーは、Flex SDK ソースファイルおよび／または Flex SDK コンポーネント、もしくは Flex
SDK コンポーネントに関連するドキュメンテーション上またはその内部に表示されたアドビ（お
よび存在する場合は、そのライセンサー）の著作権表示、商標、ロゴもしくは関連の表示、また
はその他の所有権の表示を削除し、または何らかの方法で改変しない、(8) ライセンシーは、変
更したファイルに、ライセンシーがファイルを変更した旨の目に付く表示を付す、かつ (9) ライ
センシーが Flex SDK ソースファイルと共に配布する新規パッケージまたはクラスの名称に
「mx」、「mxml」、「flex」、「flash」、「livecycle」、「ADEP」、または「adobe」を使用し
ないことを条件とし、Flex SDK ソースファイルの修正または併合された部分には、本契約が適用
されます。
3.2.1 追加の定義
3.2.1.1 「エンドユーザーライセンス契約」とは、以下が含まれるエンドユーザーライセンス契
約を意味し、(a) 開発者プログラムの限定的かつ非独占的な使用権、(b) ライセンシーのサブラ
イセンシーに第 3 条 2 項に定めるすべての制限および義務を遵守させる条件、(c) 開発者プロ
グラムのリバースエンジニアリングまたはデコンパイルの標準的な禁止、(d) ライセンシーおよ
びそのサプライヤーが開発者プログラムのすべての権利、権原、および利益を保持する旨の声明、
(e) ライセンシーのサプライヤーが開発者プログラムに関するすべての保証および表明を行わな
い旨の声明、および (f) ライセンシーのサプライヤーのためにすべての責任を免責するという
責任の制限を含みます。
3.2.1.2 「開発者プログラム」とは、部分的に Flex SDK ソースファイルにより、また部分的に
Flex SDK ソースファイルに付加しまたはこれを拡張するライセンシーの重要な改善により、構
築されたプログラム叉はアプリケーションを意味するものとします。
3.2.1.3 「Flex SDK コンポーネント」とは、Flex SDK ソースファイル、ビルドファイル、コン
パイラ、および関連する情報を含む、Flex SDK のラベルを付されたディレクトリ、または類似
したラベルを付されたディレクトリ（Flex SDK 2 など）に含まれるファイル、ライブラリ、お
よび実行ファイル（ただし、「サンプル」というサブディレクトリに含まれるコンテンツを除
く）、ならびに、Flex SDK ドキュメンテーションまたは Flex SDK ソフトウェアに添付される
「お読みください」ファイルに記載されるとおり、本ソフトウェアの一部として含まれるファイ
ルフォーマット仕様書（該当する場合のみ）を意味します。
3.2.1.4 「Flex SDK ソースファイル」とは、Flex SDK と共に提供される Flex Framework ソー
スコードを意味します。
3.2.1.5 「重要な改善」とは、Flex SDK ソースファイルに対する知覚可能、測定可能および定
義可能な改善であって、Flex SDK ソースファイルに重大な事業価値を付加する、拡張されたま
たは追加的な、重大かつ主要な機能を提供するものを意味するものとします。
3.2.2 制限
3.2.2.1 一般的な制限事項 Flex SDK ソースファイルに関して上記に定める限定的な配布の権
利を除き、ライセンシーは、Flex SDK コンポーネントおよび／またはそのいずれかのコンポー
ネントを第三者に配布、販売、サブライセンス、賃貸、貸与またはリースすることはできませ
ん。疑義を避けるため、ライセンシーは、実行ファイルとしておよび／またはオブジェクト
コード形式で提供される Flex SDK コンポーネントを配布する権利を有しないものとします。
本ライセンシーは、その他のアドビのソフトウェアおよび／またはそのいずれかのコンポーネ
ントの機能および／または外観を修正するプログラムファイルを追加または削除しないことに
も同意します。
3.2.2.2 開発の制限ライセンシーは、自らが Flex SDK コンポーネントを使用して (a) システ
ム、データまたは個人情報に損害を与え、有害な干渉をし、秘密裏に妨害し、もしくは盗用する
ことを意図する、ウイルス、トロイの木馬、ワーム、時限爆弾、キャンセルボットもしくはその
他のコンピュータープログラミングルーチンを含んでいる、(b) 意図された方法で使用された場
合に、重要な法律、条例もしくは規制（輸出管理、不当競争、差別禁止もしくは虚偽広告に適用
される法律および規制を含むがこれらに限定されない）に違反する、または (c) アドビまたは
第三者のその他のプログラムもしくはソフトウェアの操作性を妨げるプログラム、ソフトウェア
またはサービスを作成、開発、または使用しないことに同意します。
3.2.3 補償ライセンシーは、合理的な弁護士費用を含め、開発者プログラムの使用または配布
により生じたもしくはその結果である請求または訴訟から、アドビおよびそのサプライヤーを防
御および補償し、かつアドビおよびそのサプライヤーが損害を被らないようにすることに同意す
るものとします。ただし、アドビは、ライセンシーに対し、速やかに当該請求の通知を書面によ
り行い、ライセンシーの費用負担で当該請求の防御または和解をライセンシーに申し出、かつラ
イセンシーの費用負担で当該請求の防御または和解においてライセンシーに協力するものとしま
す。
3.3 Adobe Document Services PDF Generator
3.3.1 Adobe Acrobat Pro の使用 Adobe Document Services PDF Generator に添付される
Adobe Acrobat Pro のコピーの使用には、(a) ライセンシーは、Adobe Document Services PDF
Generator がインストールされている各サーバーに Adobe Acrobat Pro のコピー 1 部をインス
トールできる、(b) ライセンシーは、Adobe Acrobat Pro を本ソフトウェアの使用を通じて間接
的にのみ、かつドキュメントに記載されるように Adobe Document Services PDF Generator が
Adobe Acrobat Pro にプログラムでアクセスするように設計されている範囲でのみ使用できる、
(c) ライセンシーは、別途ライセンスを取得しない場合、Adobe Acrobat Pro を直接使用できず、
Adobe Document Services PDF Generator を使用することで有効化またはサポートされない
Adobe Acrobat Pro の特徴および機能を使用できないという制限が適用されます。
3.3.2 サポートされる Adobe ソフトウェア製品の使用 Adobe Document Services PDF
Generator は、ドキュメントに記載される特定の他の Adobe ソフトウェアアプリケーションと
連動するように設計されています（それぞれを「サポートされる Adobe ソフトウェア製品」と
いいます）。ライセンシーがサポートされる Adobe ソフトウェア製品にライセンスを別途許諾
する範囲で、ライセンシーは、ファイルをかかるソフトウェア製品のネイティブファイル形式
（.psd 形式のファイルなど）に変換する目的にのみ、サポートされる Adobe ソフトウェア製品
を Adobe Document Services PDF Generator と共に使用できますが、(a) ライセンシーは、
Adobe Document Services PDF Generator がインストールされている各サーバーにライセンスを
許諾されたサポートされる Adobe ソフトウェア製品のコピー 1 部をインストールできる、
(b) ライセンシーは、サポートされる Adobe ソフトウェア製品を Adobe Document Services
PDF Generator の使用を通じて間接的に、ドキュメントに記載されるようにサポートされる
Adobe ソフトウェア製品に Adobe Document Services PDF Generator がプログラムでアクセス
するように設計されている範囲でのみ使用できるという制限が適用されます。
3.4 ADOBE LIVECYCLE からアップグレードするライセンシーに適用される追加条件
3.4.1 すべての更新、アップグレード、およびトレードアップは Adobe Digital Enterprise
Platform ライセンス契約の第 5 条が適用されます。ライセンシーが、以前ライセンス許諾され
た Adobe LiveCycle コンポーネントのアップグレードとして本ソフトウェアのコンポーネント
にライセンスを許諾する場合、「ソフトウェア」とは現在のライセンスに基づきブランド再生さ
れた同一コンポーネントとライセンスメトリックを意味します。例えば、ライセンシーが以前ラ
イセンス許諾した Adobe LiveCycle Rights Management は ADEP Document Services Rights
Management にアップグレードされますが、元のライセンスが適用されたライセンスメトリック
を引き継ぎます。
3.4.2 例外第 3 条 4 項 1 号の規定にもかかわらず、以下の LiveCycle コンポーネントのラ
イセンシーは既存のライセンスメトリックに基づく次のアップグレードを受け取ります。
3.4.2.1 LiveCycle Mosaic のライセンシーの場合、「ソフトウェア」とは、ADEP Experience
Services Composite Application Framework、Experience Services Core、および Experience
Services RIA Core を意味します。
3.4.2.2 または LiveCycle Content Services のライセンシーの場合、「ソフトウェア」とは、
第 3 条 4 項 1 号に記載される ADEP Document Services Content Services に加えて、ADEP
Experience Services Core を意味します。
3.4.2.3 Interactive Statements Solution Accelerator のライセンシーの場合、「ソフトウェ
ア」とは、すべての使用がそれぞれの元のライセンス許諾の条件に制限されることを条件に、
Customer Communications Solution を意味します。
3.4.2.4 Correspondence Management Solution Accelerator のライセンシーの場合、「ソフト
ウェア」とは、すべての使用がそれぞれの元のライセンス許諾の条件に制限されることを条件に、
Customer Communications Solution を意味します。
3.4.2.5 Managed Review and Approval Solution Accelerator のライセンシーの場合、「ソフ
トウェア」とは、すべての使用がそれぞれの元のライセンス許諾の条件に制限されることを条件
に、Integrated Content Review Solution を意味します。
