PLANNING MATTERS/ QUESTIONS D’URBANISME 4.1 Public Hearing – Rezoning Application for 191 & 197 Université Ave. (PID 00684662 and 00684670) – No objections received Mr. Budd provided an overview of the rezoning the properties at 191 & 197 Université avenue from R3 to MU. The project will accommodate a medical and infusion clinic. Mr. Budd indicated that no objections were received for this rezoning. Motion: That the amendment process for By-law Z-113.10 and Z-213.29 proceed. Further, that the rezoning shall be subject to a conditional rezoning agreement, including but not limited to the following conditions: 1) 2) 3) 4) 5) 6) both lots (00684662 and 00684670) be consolidated into one lot prior to the issuance of a development permit; a parking count of not less than 12 spaces including 1 barrier free shall be required on-site and in the case of unforeseen circumstances which requires a lower parking count, the property owner shall be required to pay $2,500 for each parking space fewer than required; parking be allowed within the 6 m required rear yard provided a 3 m wide landscape area be maintained along the rear property line; a decorative 2 m high wood fence be place along the rear property line; the development being carried out in substantial conformance with the plans submitted; and a $1000 security deposit required for a Conditional Rezoning Agreement and by-law registry fees be paid prior to registration. Moved by: Councillor Theriault Seconded by: Councillor Turner The applicant, Yves Page, reassured Council that any building code issues will be addressed. MOTION CARRIED 4.2 Public Hearing – Rezoning Application for 777 Mapleton Rd. (PID 001019579, 01019587, 70214630 and 70199351) – Objections received Mr. Budd reviewed the proposed rezoning of 777 Mapleton Rd. The project will consists of hotel, a gas bar and fast food restaurant. He indicated that upon staff review, it was noted that an additional PID had to be added to the rezoning area. Mr. Budd indicated that several objections were received for this development. He indicated that many of the objections surround safety issues in the area. Staff from the Engineering, Urban Planning, Fire Departments reviewed these issues and provided some clarification. Dr. Nach Daniel – Applicant Dr. Daniel advised Council that the traffic impact study completed indicates that no safety issues or increase traffic will occur in the area. The applicant indicated that the developers are contributing funds towards a sidewalk and the realignment of the road in that area. Andrew Quinlan – Objector Advised Council of his discontent with the following: • The omission of one of the PIDs in the first rezoning notice; • The notice sent to his home by the City of Moncton indicating the rezoning of the area; Special Public Meeting Séance extraordinaire publique • 3 July 20, 2016 Le 20 juillet 2016 The email provided by the Director of Urban Planning indicating that he would have the opportunity to speak at the Public Presentation. The following are points presented by Mr. Quinlan: • He provided the Clerk with a petition with 250 signatures. • Spoke of the unsafe conditions at the intersection. • Spoke of the increase in traffic by 5300 daily in the area daily. • Spoke of the moratorium that was imposed in the area for development. • Indicated that he felt that the City of Moncton will be liable for any injury Matt Dunfield – not present Robert Snider - Objector Does not oppose development; however, he feels that any project must be done safely. George Flynn – Proponent He knows of no problem in the area since the Hampton Inn was developed. He indicated that many changes have occurred in the past 20 years. He reiterated that if council had not approved changes in the area; development would not have occurred and the residents would not enjoy the services that are currently available. Councillor Boudreau He advised the assembly that Council has always madesafety a priority. He indicated that the Province will not make changes to an off-ramp prior to a property being developed. Motion: That the amendment process for Municipal Plan By-law amendment Z-113.11 and Zoning Bylaw amendment Z-213.30 proceed. This will allow the rezoning of property at 777 Mapleton Road (PIDs 001019579, 01019587, 70214630, 00942185 and 70199351) from R1A (Single Unit Dwelling Zone) and R2 (Two Unit Dwelling Zone) to HC (Highway Commercial Zone) in order to accommodate a highway commercial development that includes a 120 suite Holiday Inn Express, Convenience Store and Gas Bar with a fast food drive thru restaurant, and area for two additional full service restaurants. Further, that the rezoning shall be subject to a conditional rezoning agreement, including but not limited to the following conditions: 1) That a pedestrian crossing be installed on Mapleton Road on the north side of the Northwood Road intersection; 2) That pedestrian sidewalks /pathway be constructed into the development from Mapleton Road and Queensway Drive and throughout the development as shown on the site plan; 3) Prior to issuing any building permits, that the developer agrees to contribute $48,678 for 122 metres of curb, sidewalk and landscaping (excluding driveway opening) along Mapleton Road frontage, engineering and tax included. Work to be done by City when it undertakes future street improvements; 4) Prior to issuing any building permits, that the developer agrees to contribute $85,496 for a 177 metres of curb, sidewalk and landscaping (excluding driveway opening) along Queensway Drive frontage, engineering and tax included. Work to be done by City when it undertakes future street improvements; 5) The development shall be carried out in substantial conformance with the plans and drawings submitted; and 6) That the $1000 security deposit required for a Conditional Rezoning Agreement and by-law registry fees be paid prior to registration. Moved by: Councillor Boudreau Seconded by: Councillor Turner The General Manager of Engineering and Director of Urban Planning responded to questions from several Councillors. A suggestion was made that perhaps street lights be placed at the off ramps. It was also suggested that a side walk and crosswalks be installed in the area. Point of clarification – Councillor Boudreau clarified the reason the objector only received one reply to his email. Public hearings under the Community Planning Act are considered a quasi-judicial process and Council are strongly advised not to engage in any way prior to the public hearing. A projection has not been completed for the realigning of the road and installation of sidewalks at present time. The amount would have to be added to the Capital Works budget. Mr. MacDonald and Mr. Richard reiterated that the cost of upgrades to the area to allow for sidewalks could be as high as $1M. MOTION CARRIED Nay: Councillor Pellerin Councillor Butler Special Public Meeting Séance extraordinaire publique July 20, 2016 Le 20 juillet 2016 4 4.3 Amending Conditional Zoning Agreement – 55 Queen Street Mr. Arcand indicated that this zoning was previously rezoning. As this rezoning had a time line of two years for completion of the project, and time has elapsed, there is a need to be an amendment to the conditional zoning agreement. Mr. Arcand explained the project to Council. The ground floor will accommodate 1000 sq. meters of commercial services – half will accommodate a restaurant. The remainder of the floors will accommodate a 75 room boutique hotel and 43 residential condos. A public hearing will be held during the Public Council meeting of August 17, 2016. Motion: That the amendment of the Conditional Zoning Agreement for By-law Z-202.143 proceed and: 1) That a public hearing be set for August 17th, 2016; and 2) That the proposed amending CZA be referred to the Planning Advisory Committee for its written views; and That the conditional zoning agreement be amended to include the following conditions only: a) THAT despite subsection 27(2) a lot drainage and grading plan shall provide for adequate storm water detention storage based on the capacity limitations which shall be determined the City Engineer, and that such plan be submitted by the Developer and approved by City Engineer. During development, said plan shall be implemented by, and at the cost of the Developer; b) THAT despite Table 16.3 of the Zoning By-law, a rear yard of 0 metres is acceptable and a maximum height of 26.5 metres is permitted; c) THAT despite Division 10.1 of the Zoning By-law, the aluminum panels shown on the plans and drawings submitted, attached herewith dated April 15, 2013, shall be permitted and the size and number of public doors is deemed to be acceptable; d) THAT the development shall be carried out in substantial conformity with the plans and drawings submitted, attached herewith dated April 15, 2013; Moved by: Councillor Theriault Seconded by: Councillor Léger MOTION CARRIED 5. PLANNING MATTERS/ QUESTIONS D’URBANISME 5.1 Audience publique – Demande de rezonage des propriétés situées aux 191 et 197, avenue Université (NIP 00684662 et 00684670) – Aucune objection reçue M. Budd donne un aperçu du rezonage des propriétés situées aux 191 et 197, avenue Université, pour faire passer la classification s’y rapportant de zone R3 à zone MU. Le projet permettra la construction d’une clinique médicale et d’injection. M. Budd ajoute qu’aucune objection n’a été présentée relativement à ce rezonage. Motion : Que le processus de modification concernant les modifications d’arrêté Z-113.10 et Z-213.29 aille de l’avant. De plus, le Comité recommande que le rezonage fasse l’objet d’une entente conditionnelle sur le rezonage, qui comprend les dispositions suivantes, sans toutefois s’y limiter : 7) 8) 9) 10) 11) 12) les deux lots (00684662 et 00684670) seront regroupés en un lot avant la délivrance du permis d’aménagement; un stationnement comprenant au moins 12 places, y compris une place à accès facile sur les lieux mêmes; si moins de places sont aménagées en raison de circonstances imprévues, le propriétaire sera tenu de payer la somme de 2 500 $ pour chaque place de stationnement en deçà du nombre requis; un stationnement sera permis dans les six (6) mètres requis de la cour arrière, à condition qu’une zone d’aménagement paysager de trois (3) mètres soit conservée le long de l’arrière de la propriété; une clôture décorative en bois de deux (2) mètres doit être érigée sur toute la longueur de la limite de la propriété arrière; les travaux d’aménagement doivent être réalisés de façon substantiellement conforme aux plans fournis; un dépôt de garantie de 1 000 $ requis dans le cadre d’une entente conditionnelle sur le rezonage et les droits relatifs au registre des arrêtés doivent être versés avant l’enregistrement. Proposée par la conseillère Thériault Appuyée par le conseiller Turner Le demandeur, Yves Page, rassure le Conseil que tout problème lié au Code du bâtiment sera réglé. MOTION ADOPTÉE 4.2Audience publique – Demande de rezonage de la propriété située au 777, chemin Mapleton (NIP 001019579, 01019587, 70214630 et 70199351) – Objections reçues M. Budd passe en revue le rezonage proposé de la propriété située au 777, chemin Mapleton. Le projet comprendra un hôtel, un poste d’essence et un restaurant-minute. Il indique qu’après un examen effectué par le personnel, il a été noté qu’un NID supplémentaire a dû être ajouté au secteur de rezonage. M. Budd indique que plusieurs objections ont été reçues pour cet aménagement. Il indique que bon nombre des objections concernent les problèmes liés à la sécurité dans le secteur. Le personnel des services d’ingénierie, d’urbanisme et d’incendie passe en revue ces problèmes et fournit des précisions. Dr Nach Daniel – Demandeur Le Dr Daniel informe le Conseil que l’étude sur les répercussions de la circulation indique qu’il n’y aura pas de problème de sécurité ou d’augmentation de la circulation dans le secteur. Andrew Quinlan – Opposant Il informe le Conseil de son mécontentement quant aux points suivants : • L’omission de l’un des NID dans le premier avis de rezonage. • L’avis envoyé à sa maison par la Ville de Moncton pour l’informer du rezonage du secteur. • Le courriel fournit par le directeur du Service d’urbanisme indiquant qu’il aurait l’occasion de s’exprimer à une présentation publique. Il rappelle que si le Conseil n’avait pas approuvé les changements dans le secteur, l’aménagement ne se serait pas produit et les résidants ne profiteraient pas des services qui sont actuellement disponibles. Conseiller Boudreau Il informe l’assemblée que le Conseil a toujours fait de la sécurité une priorité. Il indique que la province n’apportera pas de changements à la voie de sortie avant l’aménagement d’une propriété. Motion : Que le processus de modification concernant la modification de l’arrêté Z-113.11 du Plan municipal et la modification de l’Arrêté de zonage Z-213.30 aille de l’avant. Ces modifications permettront le rezonage de la propriété située au 777, chemin Mapleton (portant les NID 001019579, 01019587, 70214630, 00942185 et 70199351), de zone R1A (habitations unifamiliales) et R2 (habitations bifamiliales) à HC (commerce routier), dans le but de permettre l’aménagement de commerces routiers comprenant un hôtel Holiday Inn Express de 120 chambres, un dépanneur avec poste d’essence, un restaurant-minute avec service au volant ainsi qu’une aire pour deux autres restaurants avec service complet. De plus, le Comité recommande que le rezonage fasse l’objet d’une entente conditionnelle sur le rezonage, qui comprend les dispositions suivantes, sans toutefois s’y limiter : 7) Qu’un passage pour piétons soit installé sur le chemin Mapleton du côté nord de l’intersection avec le chemin Northwood. 8) Que des trottoirs pour piétons et un sentier soient construits tout le long de l’aménagement à partir de l’intersection entre le chemin Mapleton et la promenade Queensway, comme il est illustré sur le plan du site. 9) Avant la délivrance d’un permis de construction, que le promoteur s’engage à contribuer 48 678 $ pour 122 mètres de bordure, de trottoir et d’aménagement paysager (à l’exception de l’entrée de voie d’accès) le long de la façade du chemin Mapleton, y compris les taxes et les travaux techniques. Arcand décrit le projet au Conseil. Le rez-de-chaussée contiendra 1 000 mètres carrés de services commerciaux, dont la moitié sera occupée par un restaurant. Les autres étages contiendront un hôtel-boutique de 75 chambres et 43 appartements en copropriété. Une audience publique aura lieu au cours de la séance ordinaire publique du Conseil le 17 août 2016.
