REPORTS AND RECOMMENDATIONS FROM COMMITTEES AND PRIVATE MEETINGS/ RAPPORTS ET RECOMMANDATIONS DES COMITÉS ET RÉUNIONS À HUIS CLOS 4.1 Recommendation : Private Session – January 26, 2011 Recommandation : Séance privée – Le 26 janvier 2011 Motion: That the following recommendations from the Special Private Meeting of January 26, 2011, be adopted: A 1) That Bernard LeBlanc be appointed as Internal Auditor for a three-year term commencing on a date no later than March 5, 2011, subject to established terms and conditions; and That Moncton City Council, in consultation with the City Manager, the CFO and John Sanford of Grant Thornton, determine a one year work plan for the Internal Auditor by February 28, 2011. A 2) a) That Moncton City Council authorize the Mayor and City Clerk to sign a Letter of Understanding with the CFL and subsequent contract to be developed by the City’s Legal Department. Further that the City of Moncton invest $150,000 in Touchdown Atlantic II, said funding to be shared $75K from ticket service fees, and $75K for the 2011 operating budget contingency account. b) That Moncton City Council authorize the Mayor and City Clerk to sign a contract drafted by the City’s Legal Department, per the established terms and conditions for a U2 concert, in Moncton on July 30, 2011. 4.2 Recommendation – Private Session – January 31, 2011 Recommandation – Séance privée – Le 31 janvier 2011 Motion: That the following recommendations from the Special Private Meeting of January 31, 2011 be adopted: A 1) That Moncton City Council approve the proposed exchange of the approximate 7,535 square foot portion of Spring Street for the approximate 4,680 square foot portion of PID # 997759 located on Main Street and owned by 635972 N.B. Ltd., outlined on the ortho map, subject to the following: a. b. c. d. The successful completion of a formal Stop-Up-and-Close application to be undertaken by the City’s Legal Department with respect to Spring Street. 635972 N.B. Ltd. undertaking to assume complete responsibility with respect to soil quality issues relating to the portion of Spring Street being acquired, providing the City agrees to do the same with the Main Street parcel being acquired. Survey costs and advertising costs related to the Stop-Up-and-Closure of Spring Street as well as the City’s legal closing costs and disbursements being absorbed by 635972 N.B. Ltd. up to an amount of $2,000. 635972 N.B. Ltd. grant the City an option to repurchase Spring Street for $166,000, at any time until March 31, 2012. And further that the Mayor and City Clerk be authorized to enter into an agreement of purchase and sale outlining the proposed land exchange subject to the above-mentioned 635972 NB Ltd. has plans to construct a financial institution on its property at 135 Main Street (PID # 997759). The developer has agreed to relocate their development 10 meters northward to accommodate the eventual widening of Main Street in the future. They have also agreed to allow the City to purchase back Spring Street for the current appraised value up to March 31, 2012, if the City requires same for municipal purposes. 4.3 Presentation : Irishtown Nature Park Management Plan Update and Committee Update – Dan Hicks, Supervisor of Parks and Grounds & Dr. Alyre Chiasson, Chairman Irishtown Nature Park Committee Présentation : Mise à jour du Plan de gestion du Parc naturel d’Irishtown et compte rendu du comité – Dan Hicks, superviseur, parcs et espaces verts, et Dr Alyre Chiasson, président du Comité du Parc naturel d’Irishtown A 5.
