01/06/2016 www.bdo.lu P A Y R O L L A L E R T Réforme fiscale 2017 – Nouvelles annonces Dans le prolongement des annonces faites le 29 février 2016 (voir notre payroll alert du 18 mars 2016), le Ministre des Finances a apporté lors d’une conférence de presse du 21 avril 2016 des compléments d’informations sur la réforme fiscale prévue pour 2017. Nous détaillons ci-dessous les points ayant un impact en matière d’impôt sur salaires. Chèques repas – Actuellement, avec une participation personnelle de 2,80 €, les salariés ne sont pas imposés sur les chèques repas qu’ils reçoivent si leur valeur ne dépasse pas 8,40 €. A partir de 2017, la valeur maximale des chèques repas pouvant être accordés en exonération d’impôts passera de 8,40 € à 10,80 €. Il s’agit d’un montant maximum, le choix de la valeur du chèque restera une décision de l’employeur. Pour ne pas être sujets à imposition, les salariés devront contribuer à hauteur de 3,60 € par chèque repas. 2016 2017 Valeur du chèque 8,40 € 10,80 € Participation du salarié 2,80 € 3,60 € Montant imposable 0€ 0€ Crédit d’impôt monoparental (CIM) – Actuellement, le CIM est diminué de 50% du montant des allocations (rentes, frais d’entretien etc.) dont bénéficie l’enfant, si ces allocations sont supérieures à 160 € par mois. Dès 2017, le montant mensuel des allocations ne réduisant pas le CIM sera porté de 160 € à 184 €. Charges extraordinaires – Différents plafonds de déduction de charges extraordinaires seront revalorisés en 2017. D’une part, l’abattement pour enfants ne vivant pas dans le ménage du contribuable sera augmenté de 3.480 € à 4.020 € par enfant et par an. D’autre part, l’abattement pour frais de domesticité, frais d'aides et de soins en raison de l'état de dépendance et frais de garde d'enfant passera de 3.600 € à 5.400 € par an. Imposition des frontaliers – Au courant de l’année 2017, l’Administration des Contributions Directes demandera aux contribuables non résidents mariés qu’ils fournissent des justificatifs pour déterminer leurs revenus mondiaux et leur classe d’impôt. A partir de 2018, ces contribuables seront imposés au taux global correspondant à l’ensemble de leurs revenus. Ceux qui ne transmettent pas les documents nécessaires à l’administration seront imposés en classe d’impôt 1. Cette proposition a pour objectif d’aligner l’imposition des non résidents sur celui des résidents. Les informations ci-dessus reflètent les communications gouvernementales récentes, qui sont d’ordre général. Des indications plus précises seront disponibles après le dépôt du projet de loi afférent. Nous vous tiendrons informés des prochains développements. 1 01/06/2016 www.bdo.lu Tax reform 2017 – New announcements In the wake of announcements made on February 29th, 2016 (see our payroll alert of March 18th, 2016), the Minister of Finance provided during a press conference of April 21th, 2016 further information concerning the tax reform expected for 2017. We summarise below the points which have an impact on the withholding tax on salaries. Meal vouchers – Currently, with a personal participation of 2.80 €, the employees are not taxed on meal vouchers they receive if their value does not exceed 8.40 €. From 2017, the maximal value of meal vouchers which can be granted tax-free will jump from 8.40 € to 10.80 €. This constitutes a maximal amount; the choice of the meal voucher’s value will remain a decision of the employer. In order not to be subject to taxation, the employees will have to contribute by 3.60 € per meal voucher. 2016 2017 Value of the voucher 8.40 € 10.80 € Employee’s participation 2.80 € 3.60 € Taxable amount 0€ 0€ Tax credit for single parent (“CIM”) – Currently, the CIM is reduced of 50% of the allowances (annuities, education costs etc.) granted to the child, if these allowances are higher than 160 € per month. From 2017, the monthly amount of the allowances which do not reduce the CIM will be increased from 160 € to 184 €. Extraordinary charges – Different deduction ceilings will be upgraded in 2017. First, the tax relief for children not living in the household will be increased from 3,480 € to 4,020 € per child and per year. In addition, the tax relief for housekeeping costs, aid and care costs due to the dependence and childcare costs will raise from 3,600 € to 5,400 € per year. Taxation of cross-borders – In the course of 2017, the tax authorities will ask non-resident taxpayers who are married to provide evidence in order to determine their worldwide income and their tax class. From 2018, these taxpayers will be taxed at the overall tax rate corresponding to their global income. Those who will not provide the tax authorities with the necessary evidence will be taxed with class 1. The goal of this proposition is to put on the same line the taxation of non-resident and resident taxpayers. The above information reflects the recent communications made by the government, which are of general order. Detailed indication will be available after the submission of the relevant draft law. Februar 2016 (siehe unsere Payroll Alert vom 18. März 2016) hat der Finanzminister anlässlich einer Pressekonferenz am 21. April 2016 weitere Informationen zu der geplanten Steuerreform 2017 gegeben. Nachstehend erläutern wir die Punkte, die Auswirkungen auf die Lohnsteuer haben werden. Essensschecks – Derzeit kommt es zu keiner Versteuerung, wenn sich die Arbeitnehmer mit 2,80 € pro gewährtem Essensscheck von einem Maximalwert 8,40 € beteiligen. Ab 2017 steigt der Maximalwert der steuerfrei gewährten Essensschecks von 8,40 € auf 10,80 €. Es handelt sich hierbei um einen Höchstbetrag, der Arbeitgeber entscheidet weiterhin über die Höhe des Essensschecks. Um auch in Zukunft steuerfrei zu bleiben, müssen die Arbeitnehmer sich mit 3,60 € an jedem Essensscheck beteiligen. 2016 2017 Wert des Essensschecks 8,40 € 10,80 € Beteiligung des Arbeitnehmers 2,80 € 3,60 € Steuerpflichtiger Betrag 0€ 0€ Steuerkredit für Alleinerziehende (CIM) – Derzeit wird der CIM um 50% der Zuschüsse (Unterhaltszahlungen, etc.), die das Kind erhält, gekürzt, soweit diese Zuschüsse einen monatlichen Betrag von 160 € übersteigen. Ab 2017 wird dieser Freibetrag von 160 € auf 184 € angehoben. Außergewöhnliche Belastungen – 2017 werden verschiedene Grenzen der absetzbaren außergewöhnlichen Belastungen angepasst. Zum einen wird der Abschlag für nicht im Haushalt des Steuerpflichtigen lebende Kinder von 3.480 € auf 4.020 € pro Jahr und Kind angehoben. Zum anderen wird der Abschlag für Kosten für Hauspersonal, Kosten aufgrund von Behinderung oder Hilfsbedürftigkeit, Kinderbetreuungskosten von 3.600 € auf 5.400 € pro Jahr erhöht. Besteuerung der Grenzgänger – Im Laufe des Jahres 2017 wird die Steuerverwaltung die verheirateten nichtansässigen Steuerpflichtigen auffordern, Nachweise für die Ermittlung von deren weltweiten steuerpflichtigen Einkommens sowie deren Steuerklasse beizubringen. Ab 2018 werden diese Steuerpflichtigen gemäß des auf die Gesamtheit ihres Einkommens anwendbaren Steuersatzes besteuert. Diejenigen, die der Steuerverwaltung die erforderlichen Unterlagen nicht vorgelegt haben, werden in der Steuerklasse 1 besteuert. Zweck dieses Vorschlags ist es, die Besteuerung der Nichtansässigen an diejenige der Ansässigen anzupassen. Die oben aufgeführten Informationen spiegeln die rezenten allgemeinen Mitteilungen der Regierung wider. Konkretere Hinweise werden nach Vorlage des Gesetzesentwurfs verfügbar sein.
