Under the Greenhouse and Energy Minimum Standards (GEMS) Act 2012, the
Australian Government can set mandatory minimum efficiency performance standards
(MEPS) and energy rating label (ERL) requirements for electrical equipment and
appliance products. These requirements are set out in legislative instruments called
GEMS determinations.
Technical requirements for MEPS and ERLs are set out in the relevant Australian
Standards, which are published by Standards Australia. Under the GEMS Act, if a
product is:
covered by a GEMS determination; manufactured in or imported into Australia; and
made available for sale on or after the date that the relevant GEMS Determination
enters into force, then this product must meet the requirements set out in the relevant
Determination.
The Greenhouse and Energy Minimum Standards (Air Conditioners and Heat Pumps)
Determination 2013 establishes minimum energy efficiency and product performance
requirements, and associated requirements for conducting tests, for air conditioners and
heat pumps.

The proposal intends to align Directive 97/23/EC on pressure equipment to the "goods
package" - adopted in 2008 and in particular to Decision No 768/2008/EC establishing a
common framework for the marketing of products. It also intends to align Directive
97/23/EC to Regulation (EC) No 1272/2008 of the European Parliament and of the
Council of 16 September 2008 on classification, labelling and packaging of substances
and mixtures.
In this context, the proposal modifies a number of definitions which are commonly used
throughout Union harmonisation legislation in order to harmonise their meaning
throughout that legislation. It clarifies the obligations of manufacturers and authorised
representatives and introduces obligations for importers and distributors.
The proposal reinforces the notification criteria for conformity assessment bodies and
revises the existing safeguard clause procedure in line with the provisions of Decision
No 768/2008/EC. Directive 97/23/EC has selected the appropriate conformity

assessment procedures which manufacturers have to apply in order to demonstrate that
their pressure equipment complies with the essential requirements. The proposal aligns
these procedures to their updated versions set out in the Decision No 768/2008/EC.

The guideline for the hygienic assessment of elastomers coming into contact with
drinking water has already been notified under 2011/467/D. An addition was required to
the positive list. The positive list contains all substances recommended in the Elastomer
Guideline for the manufacture of elastomers in contact with drinking water. The
references to the DVGW and Cert GmbH are deleted from the text of the guideline.

The Coast Guard proposes to remove references to type codes in its regulations on the
carriage and labelling of Coast Guard-approved personal flotation devices (PFDs). PFD
type codes are unique to Coast Guard approval and are not well understood by the
public. Removing these type codes from our regulations would facilitate future
incorporation by reference of new industry consensus standards for PFD labelling that
will more effectively convey safety information, and is a step toward harmonization of
our regulations with PFD requirements in Canada and in other countries.
