OUVERTURE DE LA SÉANCE 19 h 11 Councillor MacLeod stated that due to her absence at the regular meeting of February 9th, 2005, wished to declare not a pecuniary interest but a conflict of interest with regards to the discussions and decision by Council concerning the St Andrew’s Church as a result of her membership in the Ontario Heritage Foundation. PETITIONS, VISITORS DELEGATIONS Robert Gauthier Subdivision - Place AND PÉTITIONS, DÉLÉGATIONS ET VISITEURS Rivièra Robert Gauthier - Lotissement Place Rivièra Mr. Robert Gauthier was present to request the opening of Phase 10 within his subdivision in order to grant legal access to Phases 8 and 9 that had been previously authorized by Council at the last regular meeting. M. Robert Gauthier était présent afin de solliciter l’ouverture de la phase 10 à l’intérieur de son lotissement de façon à obtenir un accès légal aux phases 8 et 9 qui avaient été autorisées auparavant par le Conseil lors de la dernière réunion régulière. The Clerk-Treasurer stated that the Township of Champlain did not have one (1) foot reserves along the lots within Phase 10 and it was for this purpose that Mr. Robert Gauthier was requesting permission from Council in order to avoid surveying and legal expenses for development of Phase 10 and which would grant legal access to the remaining Phases with the exception of Phase 11. The Clerk-Treasurer stated that one (1) foot reserves exist for Phase 11 which is the subject of the drainage petition filed by Mr. Gauthier which is currently being considered by the Ontario Drainage Tribunal. Le greffier-trésorier indiquait que le Canton de Champlain ne possédait aucune réserve le long des lots à l’intérieur de la phase 10, et c’était pour cette raison que M. Robert Gauthier demandait la permission au Conseil de façon à éviter les dépenses légales et frais d’arpentage pour le développement de la phase 10, laquelle lui permettrait un accès légal aux phases restantes à l’exception de la phase 11. Le greffier-trésorier indiquait que des réserves d’un pied existent pour la phase 11 laquelle est sujette à la demande de drain soumise par M. Robert Gauthier (suite) The Clerk-Treasurer also presented a report of the By-Law Enforcement Officer with respect to the commercial operations of Mr. Robert Gauthier, the topsoil mixing including the use of steel slag as fill material for potential lots which is not permitted by the Ministry of the Environment. Le greffier-trésorier présentait aussi un rapport de l’Officier de la réglementation concernant les opérations commerciales de M. Robert Gauthier, le mélange de terres et l’utilisation de scories d’acier comme matériel de remplissage pour des lots potentiels lequel matériel n’est pas approuvé par le Ministère de l’Environnement. Mr. Robert Gauthier recognized the nonpermitted commercial operations and stated that the topsoil mixing would only be for the purpose of the development of his subdivision for landscaping of lots and road ditching. Mr. Robert Gauthier further stated that the only slag being used was for a temporary access road through lot 75 in Phase 9 of the subdivision and that the same would be eventually removed. The ClerkTreasurer presented a letter from the engineer of Mr. Gauthier certifying that no slag was used on any lots within phases 8, 9 and 10 of Mr. Gauthier’s Subdivision with the exception of the temporary access road over lot 75 in Phase 9 of the subdivision. M. Robert Gauthier reconnaissait que ces opérations commerciales n’étaient pas permises et indiquait que le mélange de terres servirait uniquement au développement de son lotissement pour l’aménagement paysager de lots et fossés le long des routes. M. Robert Gauthier indiquait de plus que les seuls scories d’acier présentement utilisés servaient à établir un accès temporaire à partir du lot 75 de la phase 9 du lotissement et que cette route serait éventuellement supprimée. Le greffier-trésorier présentait une lettre de l’ingénieur de M. Gauthier certifiant qu’aucun scorie d’acier n’avait été utilisé sur les lots à l’intérieur des phases 8, 9 et 10 du lotissement de M. Gauthier à l’exception de la route d’accès temporaire sur le lot 75 de la phase 9. Continued discussion ensued regarding the commercial operations and the complaints received regarding certain operations of Mr. Gauthier. It was the final consensus of Council that the appropriate by-laws for opening development of Phases 8, 9 and 10 be submitted to Council at the meeting of April 13th, 2005 and that Mr. Robert Gauthier submit to Council, in writing, on how and when he intends to resolve the issues discussed this evening at which time Council will evaluate Mr. Gauthier’s intentions prior to authorizing further development of the phases requested. Denis Séguin - Société Historique de Vankleek Hill (musée) Mr. Séguin described past activities with respect to the repairs and the restoration of the proposed museum located at 95 Main Street owned by the Township of Champlain and leased to the Vankleek Hill Historical Society. M. Séguin décrivait les activités antérieures concernant les réparations et la restauration du musée proposé situé au 95 de la rue Main, propriété du Canton de Champlain et louée à la Société Historique de Vankleek Hill. Mr. Séguin continued by stating that the society had raised over the years approximately $50,000 for this project with $17,000 currently in their bank account and that approximately $75,000 would be required to complete the restoration works. Mr. Séguin was requesting the Township of Champlain to contribute the sum of $50,000 over the next two (2) years and was willing to work in conjunction with a committee or Council on this project. M. Mr. Morrison stated that he had re-installed this railing since children were using his front entrance as a skateboard area and was concerned for liability issues. Mr. Jacques Gauthier was present and stated that the issue of non-compliance was with regards to the site visibility since the property of Mr. Morrison was at the intersection of Main Street and Derby Street. The Clerk-Treasurer stated that Mr. Gauthier had no discretionary powers in this matter since the replacement of the railing was not identical from its previous location and that only Council could authorize this matter under Section 3.12 of the Zoning By-Law (continuance and repairs of existing structures). 37-2005 M. Richard Morrison - Infraction au règlement de zonage M. Richard Morrison était présent afin d’informer le Conseil qu’il avait réinstallé une rampe sur les marches avant de sa propriété et que l’officier en chef de la construction avait indiqué que cette rampe n’était pas conforme aux dispositions du règlement de zonage. M. Morrison mentionnait qu’il avait réinstallé cette rampe puisque des enfants utilisaient son entrée avant comme zone de planche à roulettes et il s’inquiétait des questions de responsabilité. M. Jacques Gauthier était présent et indiquait que la question de non conformité concernait la visibilité du site puisque la propriété de M. Morrison se situe à l’intersection des rues Main et Derby. Le greffier-trésorier indiquait que M. Gauthier n’avait aucune juridiction dans cette affaire puisque le remplacement de la rampe n’était pas identique à son emplacement original et que seul le Conseil pouvait autoriser cette question sous l’article 3.12 du règlement de zonage. EN FAVEUR CONTRE Tous en faveur Aucun ADOPTÉ Mrs. Géraldine Mayer - Water Taking on Mme Géraldine Mayer - Prélèvement d’eau sur Front Road le chemin Front Mrs. Géraldine Mayer was present to request Council that the Township take steps immediately to have the operations of Mr. Daniel Lacelle who is taking water for commercial purposes terminated. 3 Mme Géraldine Mayer était présente afin de demander au Conseil de prendre les mesures nécessaires immédiatement afin que cesse les opérations de M. Daniel Lacelle qui prélève de l’eau à des fins commerciales. Mrs. Mayer also stated that she was personally being sued in the amount of $200,000 by Mr. Daniel Lacelle for harassment and loss revenue. Mme Mayer présentait plusieurs personnes appuyant sa demande incluant M. et Mme Daniel Lacelle lesquelles dirigeaient cette opération illégale. Mme Mayer indiquait de plus qu’elle faisait l’objet d’une poursuite personnelle en justice pour une somme de 200 000$ par M. Daniel Lacelle pour harcèlement et perte de revenus. Mrs. Mayer continued by stating that this was a dangerous operation due to the use of a large tanker truck and the impact the same has on the private water wells. Mrs. Mayer also stated that she had consulted with a provincial court judge including the Ministry of Municipal Affairs and Housing who concurred with her opinion that this operation should cease immediately by further legal action. Mme Mayer poursuivait en indiquant que cette opération était dangereuse en raison de l’utilisation d’une grosse citerne et son impact sur les puits environnants. Mme Mayer mentionnait aussi qu’elle avait demandé l’opinion d’un juge de la cour provinciale et du Ministère des Affaires municipales et du logement qui étaient en accord avec son opinion que cette opération devait prendre fin immédiatement en initiant d’autres procédures légales. Mayor Barton stated that the Township of Champlain had already issued a summons against the owner of the property since the taking of water is deemed to be a land use control by the zoning by-law of the Township and that the scheduled court appearance date was set for April 21st, 2005 and inquired from Mrs. Mayer her request from Council. It was finally determined that Mrs. Mayer was requesting that the Municipal Council seek an injunction to have these operations terminated immediately and Mayor Barton inquired as to the opinion of Council. Le Maire Barton indiquait que le Canton de Champlain avait déjà semoncé le propriétaire de cette propriété puisque la prise d’eau est réputée être à l’usage des terrains contrôlés par le règlement de zonage du Canton et que l’audience de cette cause en cour était prévue pour le 21 avril 2005. Par la suite le Maire Barton demandait à Mme Mayer quelle était au juste sa demande. Il était finalement déterminé que Mme Mayer revendiquait que le Conseil municipal demande une injonction afin de faire arrêter ces opérations immédiatement. Le Maire Barton demandait l’avis du Conseil. Councillor Miner indicated that he resides in the immediate vicinity and believes that the actions taken by Council were appropriate and Mayor Barton inquired if Council wished to initiate any other actions. There being none Mayor Barton indicated to Mrs. Mayer that no further action would be taken and additional discussions ensued with Mrs. Mayer. After further and lengthy debates with Mrs. Mayer, Mayor Barton recessed the meeting at 8:15 p.m. Le conseiller Miner indiquait qu’il résidait à proximité de la zone en question et croyait que les actions entreprises par le Conseil étaient appropriées. Après un long débat avec celle-ci, le Maire Barton ajournait la réunion pour une pause à 20h15. Councillor MacLeod declared a conflict of interest on this matter as a result of her directorship on the Ontario Heritage Foundation and withdrew from the Council table.
