MODIFICATION PROPOSÉE DE L'APPENDICE I
CONCERNANT LES ÉTATS-UNIS
COMMUNICATION PRÉSENTÉE PAR LES ÉTATS-UNIS AU TITRE DE L'ARTICLE XXIV:6 A)1
DE L'ACCORD SUR LES MARCHÉS PUBLICS
La communication ci-après, datée du 4 décembre 2013, est distribuée à la demande de la
délégation des États-Unis.

Conformément à l'article XXIV:6 a) de l'Accord sur les marchés publics, les États-Unis proposent
de supprimer les entités ci-après de l'Annexe 1 de l'Appendice I de l'Accord:

Advisory Commission on Intergovernmental Relations: L'Advisory Commission on
Intergovernmental Relations (ACIR) a été créée pour analyser les relations
intergouvernementales au niveau fédéral. Il a été mis fin à l'ACIR en tant que telle par la
P.L. 104-52. Par la suite, en 1996, la P.L. 104-328 a rétabli l'ACIR aux seules fins de
conclure les contrats relevant de la Commission d'étude sur l'incidence des jeux sur le
plan national (NGISC). La NGISC a été dissoute 60 jours après avoir publié son rapport
final le 18 juin 1999. Aucun autre organisme fédéral n'a repris les fonctions de l'ACIR.

National Commission on Libraries and Information Science: La loi qui avait porté création
de la National Commission on Libraries and Information Science (NCLIS) a été abrogée
par la P.L. 111-340, en 2010. Les fonctions de la NCLIS, y compris toutes ses fonctions
de passation de marchés, ont été transférées à l'Institute of Museum and Library
Science, qui fait partie de la National Foundation on the Arts and the Humanities. La
National Foundation on the Arts and the Humanities est une entité visée. C'est pourquoi
la modification proposée ne réduira pas le champ d'application mutuellement convenu de
l'Accord.

Office of the Nuclear Waste Negotiator: L'Office of Nuclear Waste Negotiator (ONWR) a
été créé pour trouver des sites qui pourraient être adaptés au dépôt et à l'entreposage à
long terme de matériaux radioactifs aux États-Unis. La Loi de 1987 portant modification
de la politique en matière de déchets nucléaires (42 USC 10250) précisait que l'ONWR
"cesserait d'exister au plus tard 7 ans et 30 jours après le 22 décembre 1987". L'ONWR
a disparu quand son budget n'a pas été renouvelé par le Congrès en 1995.
Richard Stallings, négociateur chargé de la question des déchets nucléaires, a présenté
le rapport final de l'ONWR au Congrès le 5 avril 1995. Aucune entité n'a été établie pour

Comité convoquera le Comité dans les moindres délais. Le Comité examinera la proposition et toute demande
d'ajustements compensatoires, afin de préserver l'équilibre des droits et des obligations et de maintenir le
champ d'application mutuellement convenu du présent accord à un niveau comparable à son niveau antérieur à
la notification. S'il n'est pas possible d'arriver à un accord, la question pourra être traitée ensuite selon les
dispositions de l'article XXII.

-2remplacer l'ONWR. La Nuclear Regulatory Commission, entité visée, est chargée de
l'agrément des installations d'entreposage et de stockage définitif des déchets fortement
radioactifs. C'est pourquoi la modification proposée ne réduira pas le champ d'application
mutuellement convenu de l'Accord.

Office of Thrift Supervision: L'Office of Thrift Supervision (OTS) était chargé de réguler
les sociétés d'épargne et leurs sociétés de holding au niveau fédéral et au niveau des
États. Au titre de l'article 313 de la Loi Dodd-Frank sur la réforme de Wall Street et la
protection du consommateur, P.L. 111–203 (Loi Dodd-Frank), l'OTS a été dissous. Au
titre de l'article 312 de la Loi Dodd-Frank, les fonctions de l'OTS ont été transférées à
l'Office of the Comptroller of the Currency, à la Federal Deposit Insurance Corporation,
et au Federal Reserve Board of Governors. La Federal Deposit Insurance Corporation et
le Federal Reserve Board of Governors sont des entités visées. L'Office of the
Comptroller of the Currency fait partie du Département du Trésor qui est également une
entité visée. C'est pourquoi la modification proposée ne réduira pas le champ
d'application mutuellement convenu de l'Accord.
La pièce A jointe au présent document indique (mentions biffées et soulignées) les modifications
que les États-Unis proposent d'apporter aux pages 2/5 et 3/5 de l'Annexe 1 de l'Appendice I les
concernant. La pièce jointe B indique comment ces pages se présenteraient après les modifications
proposées.2

Speciality metals, defined as steels melted in steel manufacturing facilities located in the
United States or its possessions, where the maximum alloy content exceeds one or more of
the following limits, must be used in products purchased by DOD: (1) manganese, 1.65 per
cent; silicon, 0.60 per cent; or copper, 0.06 per cent; or which contains more than 0.25 per
cent of any of the following elements: aluminium, chromium, cobalt, columbium, olybdenum,
nickel, titanium, tungsten, or vanadium; (2) metal alloys consisting of nickel, iron-nickel and
cobalt base alloys containing a total of other alloying metals (except iron) in excess of 10 per
cent; (3) titanium and titanium alloys; or (4) zirconium base alloys;
FSC 19 and 20 - that part of these classifications defined as naval vessels or major
components of the hull or superstructure thereof;
FSC 5l and 52;
Following FSC categories are not generally covered due to application of Article XXIII,
