I would like to remind you briefly of the SCPP’s major responsibilities: 1. Collecting and distribution fees pertaining to: • music videos, • private audio and audiovisual copying, • equitable remuneration, • certain uses of commercial sound recordings (excluding. • equitable remuneration). 2. Defending and developing the rights of sound recording producers 9 10 Activity Report 2009 1 > COLLECTING 1.1 Music videos • Collections of fees for the distribution of your music videos stood at 18,514,000 euros in 2009 compared to 19,561,000 euros in 2008, which represents a drop of nearly 5%. • This drop can be explained primarily by the drop in revenue of certain music channels in a general context of reduced advertising resources of the broadcasters in 2009. 1.2 Private audio copying • Recall that the SORECOP is responsible for collecting this fee. Fifty percent goes to the authors, twenty-five percent to performers and twenty-five percent to the producers. • The total amount of SORECOP collections for the year 2009 stands at 85,426,000 euros compared to 80,452,000 euros in 2008, which is an increase of 6.2%. • This increase is mainly due to the liability of new media such as multimedia telephones and the increased capacity of sold external hard drives, USB keys, memory cards and multimedia hard drives, which more than offset the drops observed on the write-onceread-many media such as DVD R Data and CD R Data. The growth in collections is also due to a review at the end of 2008 of the shares of the remuneration reverting respectively to audio and audiovisual, generally favouring audio. 1.3 Private audiovisual copying • COPIE France is responsible for collecting fees, which are then distributed by PROCIREP, representing the audiovisual producers. • Total fees received by Copie France stood at 88 million euros in 2009 compared to 87 million euros in 2008 which is a very slight increase of 1.1%. The weaker growth in the remuneration for private audiovisual copying compared to of remuneration for private audio copying is tied to the review at the end of 2008 of the shares of the remuneration reverting respectively to audio and audiovisual, generally favouring audio. • The copying rate for music videos was 0.88% in 2008 compared to 0.78% in 2007. Remuneration for music video producers received in 2009 and concerning rights year 2008 stood at 262,000 euros. Moreover, the SCPP collected for the first time rights for the remuneration for private copying of fixed images (disc liners, music DVD jackets and frames of music videos). 1.4 Equitable remuneration – spre collection • Fees due by radio stations, television stations, clubs and public performances are collected by the SPRE, joint interest company for producers and performers. • Collecting fees from public performances is handled by the SACEM on behalf of the SPRE. • Total SPRE collections for equitable remuneration stood at 62 million euros in 2009, compared to 57 million euros in 2008, which is an increase of 8.2%. To this amount is added more than 13 million euros in amounts collected from television stations, which had been sequestered due to litigation going on in the sector, and which were able to be released subsequent to the agreements signed with TF1, M6, Canal Plus and France Télévisions. — 1.4.1 Radio sector • Collections across the entire radio sector stood at 28 million euros in 2009, compared to 25 million euros in 2008, which is an increase of nearly 11%. • This increase comes primarily from the application of the new tariff for private radio broadcasting adopted in October 2007, for which the first effects in terms of collections were not observed by the SPRE until during the year 2009. • The effects of the new tariff adopted on 17 September 2008 for public radio broadcasting will not appear in the collections of the SPRE until fiscal 2010. — 1.4.2 Television sector • There were no collections in 2008 in this sector due to the conflicting situation involving rights owners and broadcasters (3 million euros collected in 2004). • The Court of Cassation’s ruling of 16 November 2004 indeed defined the application scope of equitable remuneration in television to a highly limited domain, since most of the uses of commercial sound recordings by television stations pertain to the exclusive rights system, and especially the domain managed collectively by the SCPP and the SPPF. • This situation has resulted in the television stations asking for and obtaining legislative modifications within the framework of the DADVSI law of 1 August 2006. According to our analyses, these modifications do not call the Court of Cassation ruling of 16 November 2004 into question, although the television stations consider that these modifications extend the scope Activity Report 2009 11 of the legal licence for their uses of commercial sound recordings. Negotiations were opened at the end of 2006 with the main broadcasters, and then with ADAMI and SPEDIDAM, in order to find a solution to this dispute. More than 2 years of negotiating were required in order to allow for the signing of transactional agreements at the beginning of 2009 with the TF1, M6, Canal Plus groups and then with France Télévisions at the end of 2009. The impact of these agreements was primarily taken into account in the financial statements of the SCPP for 2008. The agreements have made it possible for the SPRE to resume in 2009 its collections in this sector at a level higher than that of 2004 and to release the sequestered sums starting at the end of 2004 by the SPRE at the request of the television stations. For the producers of sound recordings, the effect of the agreements is to multiply by threefold the amount of their collections in this sector compared to the case up until the end of 2004. — 1.4.3 Club sector • Collections in the club sector stood at 9.9 million euros in 2009 compared to 11.5 million euros in 2008, which is decrease of nearly 14%. • This drop reflects the strong impact of the economic crisis in the night entertainment sector in 2009. — 1.4.4 Public performance sector – SACEM collections Collections for the year 2009 stand at 20.7 million euros compared to 20.4 million euros for 2008, which represents a slight increase of nearly 1.2%, reflecting the rate structure in this sector, which is independent of the revenue of the tax payer, and therefore little affected by the economic crisis. The year 2009 was furthermore devoted to a renegotiation of the tariffs that apply in this sector within the Commission of Article L.214-1 of the Intellectual Property Code, which resulted in January 2010 in the adopting of a new tariff (see hereinafter). 1.5 Sound recordings (excluding equitable remuneration) • Since the middle of 1997, the SCPP has been intervening on behalf of its associates, within the framework of general contracts of common interest, in a certain number of sectors relating, not to equitable remuneration, but to the right of producers of sound recordings to authorise: use of sound recording excerpts by on-line services, reproduction right of sound system operators, audiotel, interactive listening terminals, telephone music-on-hold. Moreover, since 2006, the SCPP financial statements the revenue due by certain television stations for the portion of the uses of sound recordings carried out by the latter relating, not to equitable remuneration, but to exclusive rights managed collectively. With regards to the financial statements for fiscal 2008, the latter incorporated the very strong effects of the adjustment in the amounts owed by the main television companies for this. The amount of the collections for 2009 in the Sound Recording sector (excluding Equitable Remuneration) stands at 6.8 million euros, which represents an increase of nearly 25% compared to 2007 (5.5 million euros), a comparison with regards to 2008 is not pertinent, in light of the above. 2 > DISTRIBUTING • Nearly 63 million euros were distributed in 2009, which represents growth of nearly 7% compared to 2009 (59 million euros gross amounts). • These distributions were supplemented by a cash advance for a gross amount of 27 million euros, reduced to a net amount of 25.6 million euros after taking into account the advances and downpayments paid previously and not recovered (a cash advance of 26 million euros corresponding to a net amount of 23.2 million euros had been paid at the end of 2008). This advance was supplemented by an additional structural advance for a gross amount of 2,000,000 euros corresponding to a net amount of 2,245,000 euros (as certain associates had requested in 2009 the payment of a structural advance while they had not requested it in 2008). A detailed report of the distributions is provided in the financial report 2009. 3 > GRANTS • This assistance is covered in a report provided with these documents, «Grants allocated by the SCPP in 2009» - Appendix 3. Details of assistance per project are mentioned in this report. • For the year 2009, the SCPP had itself a total budget of 10,992,000 euros, including 8,834,000 euros in terms of the 25 % allocated to Private Audio Copying and Private Audiovisual Copying remunerations and in terms of the allocations of non-distributable remuneration resulting from equitable remuneration, with 1,072,000 euros coming from amounts that cannot be allocated relating to years of rights 1988 to 1998, 397,000 euros coming from the balance brought forward from 2008 and from cancelled selective assistance projects, and 689,000 euros coming from drawing rights that were not used or cancelled in 2008 and 2009. 12 Activity Report 2009 Activity Report 2009 4 > REPORT OF THE AUDITING COMMISSION ON SPRD (AUTHORS RIGHTS’ COLLECTIVE MANAGEMENT SOCIETIES) 6 > COMMUNICATIONS AND INSTITUTIONAL RELATIONS INSTITUTIONAL • The permanent Auditing Commission on authors rights’ collective management societies filed its seventh annual report in April 2010. This report is available on the Cour des Comptes website (www.ccomptes.fr) in the «Commission permanente de contrôle des SPRD» section. • This report includes 2 parts: one on the financial flows and the other on the wage policies and remuneration. With regards to the financial elements, some of the key ratios contained in the report illustrate the performance of the SCPP compared to the most comparable companies: Management expenses / collections 2008 SCPP SPPF ADAMI SPEDIDAM 9 % 14 % 18 % 12 % 1 % 31,4 % 26,9 % 7,3 % 68,9 % 171 % 182,9 % 267,8 % increase in expenses Management 2006/2008 treasury / collections 2008 13 • Pertaining to the wage policies and remuneration, although the report shows that the ranking of the remuneration of the managers per company does not always follow the ranking of the companies in terms of the number of employees or their revenue, it also mentions that the justification was provided showing that the remuneration of the manager of the SCPP is in line with the results of wage surveys, applied to his personal situation, taking into account in particular the number of employees and the revenue of the SCPP. Furthermore, over the period 2005/2008, the SCPP is the company where the growth in the remunerations of the top 5 paid people was the lowest out of all of the SPRD audited (7.1% compared to 10% on the average for author companies and 14% for artist companies), which confirms that the SCPP has indeed taken the crisis affecting phonographic production into account. • Copies of this report will be available at the General Shareholders’ Meeting of 24 June. • In addition, the SCPP will send a copy to any associate who requests one. 5. - COMBATING PIRACY • Details on the SCPP’s actions in terms of combating piracy are provided in the activity report of the Anti-piracy Unit in Appendix 4. • Once again in 2009, the actions of the SCPP have primarily concentrated on combating piracy on the Internet, within the framework of the plan adopted by the Board of Directors of the SCPP in October 2006, favouring action against software publishers and technical intermediaries, and the new forms of piracy other than the making available of sound recordings on the P2P networks without authorisation. With regards to the P2P networks, the upcoming implementation of the measures for a system to combat piracy implemented by the State have been taken into account. The actions of the SCPP have primarily consisted in: – maintaining the closing of all of the EDonkey (Emule) servers located in France and continuing actions of shutting down almost all of the Direct Connect servers located in France (117 servers have been shut down) – the maintaining of the shutting down by Free of access to all of the binary music newsgroups that it had selected (which therefore can no longer be accessed in France via a French operator) – the sentencing in the first instance of the managers of the Radioblog site, operating without any authorisation from the rights owners, following an action against an unknown person filed by the SCPP (an appeal has been filed against this ruling) – the sentencing in civil terms of a publisher of P2P software used massively to make sound recordings available illegally – the suppression of many illicit links to on-line storage sites of the «Rapidshare» type and the suppression of many «blogspots», subsequent to warning letters that the SCPP sent to their hosts • Despite the many favourable legal rulings that were handed down (detailed in the Anti-piracy unit’s report), this is still not enough to significantly reduce piracy on the Internet, in light of the importance that the illicit use of P2P networks continues to have. This is why the SCPP is expecting a lot from the implementation of the «Creation and Internet» and «Penal protection of Literary and Artistic Property on the Internet» laws, which should take place during the second half of 2010. 6.1 Communication • Appendix 5 contains a report on our communications efforts in 2009. 6.2 Institutional relations • Recall that since the end of 1996, the SCPP is in charge of a lobbying mission at a local level as well as on an international one. • This mission is performed in partnership with the SNEP. It exclusively involves the development and protection of the rights of producers of sound recordings and music videos. • The SCPP’s activity during the course of 2009 was primarily focussed on the adopting of the «Creation and Internet» law, then, subsequent to a partial censoring of the latter by the Constitutional Council, in the adopting of the «Penal protection of Literary and Artistic Property on the Internet» law, commonly referred to using the terms HADOPI 1 and HADOPI 2, implementing a portion of the agreement with the Elysée of 23 November 2007. • Moreover, the SCPP continued its participation in the work of the ISO MPEG Committee pertaining to the protection of literary and artistic property within the framework of the MPEG standards, and especially those pertaining to creating standard file formats for music and audiovisual content, allowing for interoperability with the various protection systems. 7. - CURRENT FISCAL PERIOD 7.1 Institutional relations • The scpp’s activity was primarily devoted to monitoring the implementation of the hadopi 1 and hadopi 2 laws: creation of hadopi, implementation decrees. • It also participated in a work group set up by the european commission intended to assess the various solutions of a legislative or contractual nature making it possible to combat the piracy of literary and artistic property on the internet and that the commission could lend its support. 7.2 Combating piracy New actions concerning the plan adopted in october 2006 continued to be carried out at the beginning of 2010 (details are provided in the report of the Anti-piracy Unit in Appendix 4). 7.3 Tariffs for public performances The Commission on Article L. 214-4 of the CPI has been meeting since February 2009 in order to revise the tariff for public performances, set since 1987 at 18% of authors’ rights, adopted on 5 January 2010 a new tariff for this sector. Although parity with the amount of author’s rights was not able to be obtained, the new tariff will result in a considerable increase in collections in this sector. It includes 4 independent tariffs for author’s rights (Cafés, Hotels and Restaurants; Musical theme bars, Retail shops, Hairdressing saloons), representing nearly 75% of the collections and a tariff at 65% of the author’s rights for other public performances (excluding clubs). The tariff came into effect on 1 February 2010. It includes a reduction in the rollout of 45% the first year, 30% the second year and 15% the third year. In light of the expected reductions in the costs of collecting this remuneration, the new tariff should make it possible in time to quadruple collections in this sector. 14 Activity Report 2009 CONCLUSION The year 2009 was a particularly busy year for the SCPP with the effective signing of the «sound recording» agreements with the TF1, M6, Canal Plus and France Télévisions groups, the negotiating of a new tariff for equitable remuneration for public performances and the monitoring of legislative and technical work needed to implement the agreements with the Elysée («Hadopi 1» and «Hadopi 2» laws). The financial statements for 2008 had taken into account the results of the negotiations with the television stations, which included non-recurring collections and which had made it possible for collections to reach a record level of 70 million euros. Collections in 2009 could only be down compared to the exceptional level reached in 2008. However, excluding the non-recurring elements of 2008 as well as those of 2009, the amount of collections in 2009 is very slightly higher than the amount of collections in 2008. With the progressive increased load of the radio tariffs and the setting of a new tariff for public performances at a level that in 4 years should reach a net amount nearly 4 times higher than it was before, this set of elements should result in significant growth in equitable remuneration in the upcoming years. The exceptional collections levels of 2008 should be able to be achieved, on a regular basis, by 2010. Furthermore, the effective operation of HADOPI in 2010 should make it possible to substantially reduce the level of piracy on the P2P networks, contributing to an improvement in the situation of the music sector that has been hoped for so many years now. The first part of this report covers the collections and distributions for the period, and the second part covers the 2009 financial statements for the company. In the appendices, you will find the report from our statutory auditors (Ernst & Young). 19 Financial Report 2009 21 COLLECTING [1] ≥ In 2009, the SCPP received 65.946 million euros, which is 5.5% more than in 2008 (€60.821 million), the adjustment year for Television rights (2003-2007). ≥ Collections from Private Copying grew 22% compared to that in 2008 but a portion of this increase is due to a modification in the recognition of this collection (cf. § Private Audio Copying). This increase, as well as that of ER, due to the resumed collection from television stations and the first effects of the new «Private radio station» tariffs offset the decrease in music videos broadcasting rights and the adjustments in favour of the SPPF for distributions of ER and Private Audio Copying. The SCPP paid €0.170 million to the SPPF in adjustments for the distribution of 2007 rights (SCPP share: 76,6%) ≥ The SCPP also received for 2009 • €2.231 million from television stations, • The SCPP collected €1.110 million from sound system operators, Internet sites and suppliers of music-on-hold (€1.029 million in 2008), • €1.477 million from sound system operators on behalf of foreign collective management companies (€1.442 million in 2008) TV 0 2009 2008 2007 2006 2005 2004 2003 2002 2001 2000 Private Audio Copying The increase in the Private Audio Copying remuneration collected for 2009 by the SCPP comes from: • the 6.2% increase in the SORECOP collection, which is €0.707 million more than in 2008 for the SCPP3 • The modification in the periodicity for recognising the Private Audio Copying which increased collections for 2009 (+€4.037 million) by two additional monthly payments. ≥ The SCPP and the SPPF have provisionally shared Private Audio Copying in 2009 based on a cash rate of 80.4% for the SCPP (compared to 80.7% in 2008 and 82.4% in 2007) and 19.6% for the SPPF. ≥ The final distribution for the 2007 Private Audio Copying distributed in proportion to sales (93%) between the two companies stands at 78.8% (80.7% for the 2006 Private Audio Copying) for the SCPP and at 21.2% for the SPPF. The SCPP paid the SPPF €1.023 million in Private Audio Copying fees. [2] Does not include the amounts paid by TV stations and sequestered by the SPRE. [3] SCPP/SPPF adjustment included [4] The SCPP provides collection operations on behalf of the SCPA. 23 24 Financial Report 2009 DISTRIBUTING ≥ The amounts distributed in 2009 are 6.9% higher than those distributed in 2008 (€58.855 million in 2008 and €55.022 million in 2007). The rate of withholding in 2009, subject to approval by the General Shareholders’ Meeting, is increased to 11.8%. ≥ To the current expenses of the SCPP are added for the first year the costs of implementing the Convention Collective Nationale de l’Edition Phonographique (3 positions and additional premises) and the measures for combating piracy of the Hadopi law. The withholding rate on «music video» rights and Private Audiovisual Copying remains set at 6%. The average rate of withholding of the SCPP is, in 2009, 8.86% (7.22% in 2008). b – Access to the «Sound recording» base As every year, the SCPP invoiced ADAMI for access rights to its database for €138 thousand. Financial income The SCPP distributed €0.505 million in financial income to its rights owners in December 2009. c – Extraordinary income and other income This income is comprised of compensation obtained from «Piracy» litigation and from capitalised wage costs. 4 > CONCLUSION In 2008, the SCPP had experienced major growth in its collections, mainly due to the adjustment in the situation of certain television stations, with regards to the SPRE as well as the SCPP. The effects of this adjustment continued this year without reaching the level of 2008. In 2010 this effect will also under the increase in the collection of Equitable Remuneration from public performances. Internal costs are booked as fixed assets based on the costs of wages used in creating the developments. All of these intangible fixed assets are depreciated using the straight-line method over three years. 2.5 Tangible fixed assets Tangible fixed assets are booked at their purchase cost. Depreciation is calculated over the estimated lifespan of the goods according to the straight-line or progressive methods, as follows: — 2.9.3 Non-distributable sums of equitable remuneration According to article l321-9 of the intellectual property code, sums collected starting on 1 august 2000 for equitable remuneration for radio broadcasting and communication in public places of commercial sound recordings, and which are non-distributable in accordance with the intellectual property code and with international agreements must be fully allocated to grants. Equitable remuneration received before 1 august 2000 is not concerned by this change in legislation. The allocation of non-distributable amounts that will be observed for these amounts at the time of the next distribution is therefore subject to the rules that were previously defined by lawmakers. These sums are booked on the liabilities side of the balance sheet. Rates of the statutory withholdings are set by the general meeting of partners. 5 years or 8 years 5 years 2.6 Equity interests Equity interests appear on the balance sheet at their historical cost or at their current value if the latter is less.‑ 2.7 Investment securities • Investment securities are booked at their purchase cost and, at the end of the period, an estimation is made of these securities, based on their market value. • Investment securities are comprised of capitalized s.I.C.A.V., Mutual funds and negotiable certificates of deposit. In accordance with the company’s by-laws, capital gains on these securities supplement the rights of producers of sound recordings.‑ 2.8 Provisions for risks The company books a provision for risks according to incurred litigation, likely to have an impact on its income and expenses. 2.9 Rules and methods concerning rights — 2.9.1 Obligation as to supporting creation The s.C.P.P. Must statutorily and in virtue of article l 321-9 of the intellectual property code devote a portion of the collected rights to grants: 25% of the amounts collected for private copying of sound recordings and all of the non-distributable amounts generated on years of rights after 1 august 2000. This contribution is booked on the liabilities side of the balance sheet and the various payments made for this purpose are then deducted. — 2.9.2 Collected and distributed rights All of the rights collected by the company must be distributed. The amount of rights collected or to be collected is therefore identical to the amount of rights distributed and to be distributed. Rights to be distributed to producers are booked on the liabilities side of the balance sheet for their total amount including tax, and have only one deduction for grants linked with rights stemming from private copying of sound recordings. The statutory withholding is considered as acquired when the credit notice is issued, regardless of the type of right. Statutory withholdings that are considered as acquired according to this method, but pertaining to rights in the process of distribution and not yet paid to producers, are booked separately on the asset side of the balance sheet, with accrued income. — 2.9.5 Rights due by the users of telephone music-on-hold On behalf of the scpp, the scpa provides administrative management of rights pertaining to telephone music-on-hold for payment of a management commission of 17% on collected rights. Application of this management commission has a retroactive effect on the share of the collected rights that will be paid to the s.P.P.F. The amount generated by the management fees collected by the scpp for collecting rights pertaining to telephone music-on-hold, stands at €518,398 at 31 december 2009. Since 2005, the amounts received during a given period have been considered as sums collected during this same year of rights. These rights are booked based on payments received in the current fiscal period, and no longer based on the rights period. 2.10 Joint scpp and sppf it costs In order to improve the accuracy and reliability of the respective distributions of the scpp and of the sppf, the latter have decided to share their costs for managing the social catalogue and distribution costs. The two companies, invoice the s.C.P.A., With proof, for their it expenses. This billing takes place twice a year for the sppf. The s.C.P.A. Then rebills each party for its share in the total of its expenses determined, in a final manner, based on the average share of the temporary distribution for the civil year, for the civil year in which the costs were incurred. Manuela OSTROLENK BUDA MUSIQUE Gilles FRUCHAUX SUNSET FRANCE Sébastien NORMAND BONSAI MUSIC Pierre DARMON ROY MUSIC Olivier CHINI V2 MUSIC Alain ARTAUD-MACARI 57 Appendices 2009 59 ≥ In accordance with Articles L.321.9 and R.321.8 of the Intellectual Property Code, «Civil Companies» of rights owners must file a report every year with the Ministry of Culture on the amount and use of the amounts that they «can use» for actions supporting creation, broadcasting live performances and in educating artists. ≥ The purpose of this report is, as every year, to report to the partners of the SCPP and to the Ministry of Culture on the use of the sums allocated either directly or indirectly by the SCPP for grants. 1 > Financing Grants ≥ The SCPP had, for this purpose, in 2009 of a total amount of 10,992,269 euros, including: • 3,851,042 euros, i.e. 25% of Private Copying, that the SCPP must devote to Grants, • 4,982,790 euros, taken from the non-distributable amounts of Equitable Remuneration distributed during the previous period, • 1,071,790 euros, which is the remaining amounts unallocated to distribution of years of rights 1988-1998, • 396,994 euros which is the balance of the Grant budget for 2008 («Selective Assistance» balance: 6,726 euros, «Drawing Rights» balance: 390,268 euros), • 321,077 euros in grants approved during previous periods that were cancelled in 2009 and reincorporated into the Selective Assistance budget for 2009, • and 368,576 euros in grants approved during previous periods that were cancelled in 2008 and reincorporated into the «Drawing Rights» budget for 2009. 2 > Allocating these sums Grants approved by the SCPP in 2009 ≥ The SCPP’s entire grant budget was allocated by the Board of Directors as such: • 7,549,814 euros for the «Drawing Rights» budget and • 3,442,455 euros for the «Selective Assistance» budget (i.e. 3,121,378 euros for the initial budget and 321,077 euros in cancelled and reincorporated grants from prior years) ≥ The «Selective Assistance» budget was allocated in accordance with the decision of the General Shareholders’ Meeting to: • grants for sound recordings: 887,656 euros) (829,094 Euros + 58,562 euros in cancelled grants from prior years). • grants for music videos: 417,292 euros) (315,888 Euros + 101,404 euros in cancelled grants from prior years). • grants for live performances: 651,318 euros) (490,707 Euros + 160,611 euros in cancelled grants from prior years). • grants for special projects: 1,486,189 euros). (1,485,689 + 500 euros in cancelled grants from prior years). 3 > Allocated grants ≥ During fiscal 2009, the Commission met 11 times to examine 860 grant request applications (778 in 2008 and 826 in 2007). The Board of Directors granted, as proposed by the Commission, 698 grants (608 in 2008 and 648 in 2007) for an amount of 10,535,491 euros (1)(i.e. 7,125,469 euros in terms of «Drawing Rights» and 3,410,022 euros in terms of Selective Assistance). • 81.16% of the requests were satisfied. The SCPP does not take any sums from the grant budget in order to finance this operation. This Commission, in compliance with the rules set forth by the Board of Directors and which all of the requesters are informed of [2], proposes to the Board of Directors: for selective assistance, whether or not a grant is allocated and the amount of it and, for applications using drawing rights, after a check on eligibility and that the requested amount complies with current ceiling rules, the allocation of the grant. The Board of Directors approved by the General Shareholders’ Meeting, after having heard a representative of the Commission, approves or does not approve the proposed grants. ≥ 50% of the grant is paid upon presentation of an invoice before the project is carried out, and the remaining 50% is paid on presentation for: • creating sound recordings: of 2 albums.(A check is carried out via sampling of one «Drawing Rights» dossier and one «Selective Assistance» dossier per month, in order to make sure that the allocated grant is not more than 40% of the actual recording costs). • music videos: a copy of the clip, a copy of the audiovisual production contract or invoices paid to produce the clip, making it possible to check that the allocated grant is not more than 40% of actual production costs. CREATIONS SHOWS TRAINING • tours and opening acts, the list of performance dates, with documents proving the producer’s contribution in financing the entire affair as well as a copy of the press inserts, posters, flyers, tracts, in order to check that the grant obtained does not exceed 50% of the producer’s participation. The verifications concerning the creating of sound recordings, tours and opening acts are submitted to the Commission for approval only when the amounts granted must be revised. ≥ The first half of the grant is recovered by the SCPP when the project does not take place. ≥ Only grants allocated for artist training and show cases, in halls that are approved by the SCPP, are paid in full in a single payment after proof that they have taken place. 000,00 2 300,00 10 535 491,50 Appendices 2009 75 ACTIVITY REPORT FOR THE ANTI-PIRACY UNIT Year 2009/2010 Introduction ≥ Systems for illegally exchanging and making available music files have once again changed in 2009/2010. Indeed, in addition to the use of peer to peer networks, the SCPP has in particular observed the development, at the initiative of organised virtual communities, of exchange forums that have built-in search engines, and/or blog platforms, which provide references to links allowing protected musical recordings to be downloaded from storage areas (cyberlockers) that are disseminated across the Internet network. That is why, again this year, the SCPP’s Anti-Piracy Unit has made combating piracy on the Internet a priority. ≥ However, so-called «traditional» piracy, on the fringes of piracy of music on the Internet, has not disappeared and the SCPP is continuing its activity and vigilance in this area. 1 > FIGURES FOR 2009/2010 Anti-piracy report ≥ During the course of the year, the Anti-Piracy Unit handled 101 dossiers, including 54 contentious dossiers and 47 dossiers concerning enforcement procedures, subsequent to the obtaining of legal rulings. ≥ 12 penal actions were filed in one year and the SCPP was a private party in 5 dossiers. ≥ 121,907 illicit links and pirate websites on the Internet, which is 1,210,292 MP3 files, were deleted this year, subsequent to the SCPP sending warning and removal letters. ≥ 12 «blogspot» type sites were shut down, corresponding to 6,000 illicit links, which is 90,000 MP3 files deleted. ≥ 4,313 illicit CDs were withdrawn from auction sales sites, such as Ebay. ≥ Faced with the many uses without authorisation of sound recordings listed in the SCPP’s social catalogue, and with the purpose of correcting them, 498 verifications were carried out, and certificates of offence were delivered by sworn agents. These verifications were primarily directed towards the telephone music-on-hold, interactive listening terminals, webradio sectors and on-line servers making excerpts of sound recordings or music videos available. 2 > CURRENT PROCEEDINGS ≥ Actions taken against Newsgroups • Subsequent to a decision that was handed down in a joint application presented by the SCPP, the SACEM/SDRM and FREE, the Paris Court of First Instance authorised FREE to extend the suspension of 46 music newsgroups that were previously set up. ≥ Actions taken against servers of the illicit P2P networks • Again this year, formal letters were sent by the SCPP to people operating servers in France devoted to pirate activities on the P2P networks (EDonkey, Emule, and Direct Connect networks). These formal letters resulted in the shutting down of 117 servers. ≥ Actions taken against illicit links sites • The SCPP intervened in several proceedings involving administrators of sites of links on which were illegally made available to the public, via downloading, sound recordings in the SCPP repertoire. For most of these proceedings, a preliminary investigation is underway. ≥ Action taken against a publisher of software used massively to make sound recordings available to the public illegally • On 9 June 2009, the SCPP filed an action against the publisher of a software used massively to make sound recordings available to the public illegally, this software in particular allows sound recordings proposed for listening purposes on legal streaming sites to be downloaded illegally. ≥ Actions in terms of traditional piracy • Again this year, the SCPP filed several actions, after becoming aware of the making available of CDs and DVDs reproducing sound and/or video recordings from the SCPP repertoire to the public without authorisation, via the sale in shops or on Internet sites. Eight actions moreover were filed subsequent to the Customs department discovering and seizing pirated Mickael Jackson sets, put into circulation after the death of the artist in June 2009. 76 Appendices 2009 3 > RELATIONS WITH INSTITUTIONS AND PROFESSIONAL ORGANISATIONS ≥ Intervention taken by the SCPP’s Anti-Piracy Unit during training programmes organised by the School of Gendarmerie at Fontainebleau, National School of Police, with specialised investigators attending, and with the Regional Customs Departments, allows institutional awareness to be strengthened concerning dossiers on music piracy. ≥ Close relations also exist with the SACEM / SDRM anti-piracy department, which has made possible, this year again, to work together on several cases of legal action. ≥ The anti-piracy unit enjoys privileged relations with the Secretariat of the IFPI and its various national groups, which gives rise to regular exchanges of information concerning the strategies developed to improve combating music piracy. ≥ The SCPP is a member of the Union des Fabricants (UF)(Manufacturer’s Union) and the Comité National Anti-Contrefaçon (CNAC)(National Committee on Anti-Piracy) and regularly participates in the commissions and work groups organised by these two bodies. 4 > JURISPRUDENCE 4.1 Traditional piracy CFI OF NICE > Bootlegs Judgement of 18 September 2009 of the Magistrates’ Court of Nice In a procedure filed against private individuals who offered CDs and musical DVDs for sale as organised fraud without the authorisation of the legal producers, the Magistrates’ Court of Nice sentenced the accused to a 3-month to 1-year suspended prison sentence and ordered the judgement to be published. A hearing on the civil interests has been set for 15 June 2010. CFI OF RENNES > Partial copies Judgement of 3 November 2009 of the Magistrates’ Court of Rennes Within the framework of an affair wherein «playback» versions of more than 4,000 music recordings burned on DVDs were offered for sale on the Internet, the Magistrates’ Court sentenced the pirates: • For one, to a suspended fine of 3,000 euros and the payment of 3,042 euros in damages (as reparation of the material prejudice), in addition to the sum of 500 euros pertaining to Article 475-1 of the French Penal Procedure Code. • For the other, to a suspended fine of 7,000 euros and the payment of 6,085 euros in damages (as reparation of the material prejudice), in addition to the sum of 500 euros pertaining to Article 475-1 of the French Penal Procedure Code. • Jointly: 500 euros in damages as reparation for the moral prejudice. This decision is final. 4.2 Efforts combating piracy on the Internet COURT OF CASSATION > P2P Disposition of appeal of 16 June 2009 of the Court of Cassation In a procedure against an internet user that had made nearly 24,000 music recordings available to the public on the internet using the Soulseek and Emule peer to peer software, the Superior Court annulled the disposition of appeal of the Court of Appeal of 11 December 2008 by declaring valid the procedure followed by the sworn agents who take the IP address for the purposes of later identification of the author of the counterfeiting. Indeed, it deemed that the visual observations made over the internet and the information collected by a sworn agent, who uses computer equipment and peer to peer software to access for the purposes of downloading the list of works that are irregularly proposed on the web by an internet user for whom he takes down the IP address in order to locate his service provider for the purposes of later discovering the author of the counterfeiting, fall within the powers granted to this agent and do not constitute processing of data of a personal nature. The affair has been returned to the Court of Appeal of Versailles. A hearing has been set for 7 June 2010. Appendices 2009 CFI OF VANNES > P2P Judgement of 25 June 2009 of the Magistrates’ Court of Vannes In a procedure filed against an internet user that had unlawfully copied and made music recordings available within the framework of peer to peer sharing networks, the Magistrates’ Court of Vannes sentenced the accused to a 2-month suspended prison sentence and an 18-month probationary period. Civil interests allocated to the SCPP: 17,913.60 euros in damages, in addition to the sum of 1,000 euros pertaining to Article 475-1 of the French Penal Procedure Code. The accused has filed an appeal against this judgement. CFI OF NANTERRE > P2P software Judgement of 25 June 2009 du Court of First Instance of Nanterre Within the framework of the action initiated by the SCPP against a foreign company, publisher of P2P software, manifestly intended to make sound recordings available to the public without authorisation of their producers, the Nanterre Court of First Instance prohibited the making available of said software and sentenced said company to pay damages to the SCPP. CFI OF TOULON>P2P Judgement of 2 July 2009 of the Magistrates’ Court of Toulon In a procedure filed against an internet user that had unlawfully copied and made more than 20,000 music recordings available within the framework of the Direct Connect peer to peer sharing network, the Court sentenced the accused to a 2-month suspended prison sentence and ordered the confiscation of the bonded items as well as the publication of the ruling. Civil interests allocated to the SCPP: 21,571 euros in damages, in addition to the sum of 1,000 euros pertaining to Article 475-1 of the French Penal Procedure Code. An appeal has been filed with regards to the civil interests. CFI OF PARIS > Streaming site Judgement of 3 September 2009 of the Magistrates’ Court of Paris In a procedure filed against a company and its managers who, on the one hand, made music recordings available to internet users using a streaming site and on the other hand, published and made available to internet users a software that is manifestly intended for the unauthorised making available to the public of sound recordings in the form of playlists, the court sentenced each of the managers to a 12-month suspended prison sentence and a fine of 10,000 euros and ordered the definitive shut down of the company that was used to commit the offences and the confiscation of the bonded items. Civil interests allocated to the SCPP: the managers were sentenced to jointly pay the sum of 871,804 euros in damages, in addition to the sum of 2,000 euros each pertaining to Article 475-1 of the French Penal Procedure Code. The accused have filed an appeal against this judgement. A hearing has been set for 4 May 2010. CFI OF AVRANCHES > P2P Judgement of 12 January 2010 of the Magistrates’ Court of Avranches In a procedure filed against an internet user who had made more than 65 gigabytes of sound recordings available to the public without the authorisation of their legal producers within the framework of the «Direct Connect» peer to peer sharing network, the Court sentenced the accused, an individual, to a fine of 4,000 euros and ordered the publication of the ruling. Civil interests allocated to the SCPP: 5,000 euros in damages, in addition to the sum of 800 euros pertaining to Article 475-1 of the French Penal Procedure Code. An appeal has been filed with regards to the civil interests. COURT OF CASSATION > Site of links Disposition of appeal of 23 March 2010 of the Court of Cassation In a procedure filed against an internet user who without the authorisation of the sound recording producers, made available to internet users on his internet site links allowing them to download nearly 6000 music recordings, the Court of Appeal of BASTIA confirmed the judgement of the 1st instance of 6 July 2007 in its penal dispositions and overturned it in its civil dispositions. The Court as such sentenced the accused to pay the SCPP the sum of 10,000 euros in damages, in addition to the sum of 4,000 euros pertaining to Article 475-1 of the French Penal Procedure Code. Repeal of the purview of the first instance dated 6 July 2007: Sentencing of the accused to a 3-month suspended prison sentence, omission of a ruling on the civil interests. The accused filed an appeal to the Court of cassation against this ruling but the Superior Court rejected it on 23 March 2010 for the reason, in particular, that the Court of Appeal justified its ruling by rejecting the plea of voidance raised in terms of the certificate of offence rendered by sworn agent, in that the sworn agent, in application of the powers that are granted to him by Article L.331-2 of the Intellectual Property Code, observed the existence of the disputed site by noting down in particular the IP address of its creator for whom the identification was, then, carried out, upon requisition, by the police within the framework of the preliminary investigation commissioned for this purpose. 77 Appendices 2009 79 COMMUNICATIONS DEPARTMENT / Activity report 2009 – 2010 SCPP communication continued with four objectives: Inform its members of SCPP activity on a regular basis Allow SCPP members to meet the players in the music sector via events and professional fairs Support lobbying actions and the efforts of the anti-piracy unit in their mission of defending producers’ rights Confirm the reputation of the SCPP by positioning it as the number one partner of producers of sound recordings. 1 > INFORMATION FOR MEMBERS 1.1 Written communication 1.1.1 Letter of the General Managing Director ≥ A genuine communications link with SCPP members, the General Managing Director’s letter informs its members of the activity and concerns of the SCPP. ≥ 1.1.2 The SCPP producer database The SCPP’s producer database, which is updated on a regular basis, presents each member company of the SCPP, indicating its main activity, its organisational chart, its catalogue and its corporate name. Especially useful during trade shows, this database can be consulted using the name of the company, the name of its manager or representative, the name of an artist, or by type of music. 1.2 Internet site and «returns» software ≥ The SCPP’s internet site, available in two languages, provides details on the mission of the SCPP, its operation, its members and its catalogue, and relays news of interest to SCPP members. Communications report ≥ A new version of the returns software began to be installed at our members. This software, which contains all of the instruments that allow them to declare their sound recordings and their sales to the SCPP as well as the means to manage their repertoire, allows them to save time in their relations with the SCPP. 2 > EVENTS AND PROFESSIONAL FAIRS 2.1 MIDEM ≥ As every year, the SCPP made a 195-m2 area available to its members at MIDEM, including private offices, equipped with audio and video equipment. In this way, SCPP members were able to take advantage of privileged rates to access the show. 2.2 SCPP general shareholders’ meeting ≥ At the occasion of its annual general shareholders’ meeting, members of the SCPP, journalists and professional partners are invited to a dinner cocktail at the Pavillon Dauphine. 3 > DEFENDING PRODUCERS’ RIGHTS ≥ SCPP communication continued in its mission of awareness for all professionals in music and for public powers in terms of compliance with the rights of music producers, especially: • with companies using telephone music-on-hold systems, • with public authorities within the framework of the «Creation and Internet» law. ≥ The SCPP wanted to inform possible offenders, producers and public powers of the risks that are taken when the rights of producers are not respected and confirmed its determination to have these rights complied with. 80 Appendices 2009 3.1 Combating piracy and promoting legal sites ≥ In order to encourage the development of legal downloading platforms, the SCPP is a partner of the «Tous pour la musique» association (www.touspourlamusique.org). 2) Relations with the press ≥ The communications department regularly informs the regional and national press of the favourable legal rulings obtained by the anti-piracy unit. As it does every year, the SCPP invites journalists one week before the MIDEM and on the day of its General Shareholders’ Meeting, for a press luncheon, allowing its President and its General Managing Director to mention producers’ concerns and wishes. IV – CONFIRM THE REPUTATION OF THE SCPP 4.1 Advertising ≥ SCPP advertisements are taken out in professional guides in the music sector, as well as in magazines that are distributed during the MIDEM. 4.2 The SCPP’s presentation portfolio ≥ The SCPP’s presentation portfolio covers the main responsibilities of the company and provides details on the types of collections as well as the rules for distribution.
