Ladies and Gentlemen, Associates,
I am pleased to present the activity report of the SCPP for the period running from 1 January to 31 December 2011 inclusive.
I would like to remind you briefly of the SCPP’s main responsibilities:
1. Collecting and distributing fees pertaining to:
• music videos,
• private audio and audiovisual copying,
• equitable remuneration,
• certain uses of commercial sound recordings (excluding equitable remuneration).

1 > COLLECTING
1.1 Music Videos
• Collections of fees for the distribution of your music videos stood at 16,380,000 euros in 2011 compared to 15,058,000 euros in 2010, representing an increase of nearly 9%.
• This significant increase is mainly due to the renegotiation of the contract with M6, which took effect in May 2011.
1.2 Private Audio Copying
• I remind you that collection is now managed by COPIE France, which merged with SORECOP on 1 January 2011. Fifty percent goes to the authors, twenty-five percent to performers and twenty-five percent to the producers.
• The total amount collected in remuneration for private audio copying by COPIE France for 2011 represented 96,342,000 euros
compared with 93,244,000 euros in 2010 (by SORECOP), i.e. an increase of 3.3%.
• This increase is mainly due to the increase in the sale and capacity of multimedia telephones, the application of tariffs to multimedia touch screen tablets since 1 February 2011, and the increased capacity of sold external hard drives, USB sticks, memory cards
and multimedia hard drives, which continue to more than offset the falling figures recorded for write-once-read-many media such as DVD R Data and CD R Data. These tariffs were collected in difficult conditions, as some contributors have launched litigation against
the decisions of the private copying commission and have partially suspended payments for the remuneration of private copying.
Subsequent to the Padawan order issued by the Court of Justice of the European Union, the Conseil d’Etat (State council) did indeed
cancel the ruling no. 1 of 20 December 2008, which affected almost all remuneration tariffs.
• The Conseil d’Etat particularly decided that the system used in France, and in many European countries, to integrate the
professional usages of media subject to tariffs, consisting of a reduction on the amount of remuneration, was not compatible with the Padawan order issued by the CJEU.
• This led the public authorities to ensure that parliament adopt the law of 19 December 2011, modifying the Intellectual property
code, in order to integrate the decision of the Conseil d’Etat, and confirmed the tariffs cancelled for a duration of one year.
1.3 Private Audiovisual Copying
• A substantial portion of the collection of this remuneration (copying distributed music videos, copying fixed images extracted from
music videos) is performed by COPIE FRANCE, and the remuneration is distributed by PROCIREP, representing audiovisual producers.
The SCPP also collects a share of the remuneration for private copying for copying disc liners and DVD jackets from SORIMAGE.
• Total fees collected by COPIE FRANCE stood at 84 million euros in 2011 compared to 85 million euros in 2010, which is a decrease of nearly 1%. This decrease is mainly due to the decrease in the sale of DVD R Data, which has not fully been offset by the increased
capacity of sold multimedia telephones and the increased capacity of sold external hard drives, USB sticks, memory cards and
multimedia hard drives.
• The remuneration collected by the SCPP in 2011 represented 473,000 euros, down by 13.5% from 2010 (€547,000), which included
collections from previous years as remuneration for the private copying of sound recordings.
1.4 Equitable Remuneration – spre (Collecting Society For Equitable Remuneration) Collections
• Fees due by radio stations, television stations, clubs and public performances are collected by the SPRE, joint interest company for producers and performers.
• The collection of fees from most public performances is handled by the SACEM on behalf of the SPRE, as the latter collects directly
from clubs and musical theme bars.
• Total SPRE collections for equitable remuneration stood at 95 million euros in 2011, compared to 77 million euros in 2010, which is an increase of 23.5% primarily due to the implementation of the new tariffs for public performances.
— 1.4.1 Radio sector
• Collections across the entire radio sector stood at 31.8 million euros in 2011, compared to 28.6 million euros in 2010, which is an increase of nearly 10.9%.
• This significant increase comes primarily from the application of the new tariffs for private radio broadcasting, adopted in October 2007, and for public radio, in September 2008, which included a gradual period of application covering 4 years.
— ­­1.4.2 Television sector
• After a decade of litigation which had substantially disturbed collections in this sector, the agreements signed in 2009 with the main national television groups have allowed the SPRE to restart and develop its collections from television stations.
Collections reached 4.3 million euros in 2011, compared to 5.3 million euros in 2010, which is a decrease of 18.9%. This reduction is only relative, as collections in 2010 included a substantial public service adjustment, further to the signing of the
aforementioned agreements. In the absence of this adjustment, collections in 2011 would have increased by 8.4% compared Activity Report 2011

with 2010, mainly due to an increase in the use of sound recordings by some broadcasters and the adjustment of some satellite and cable stations.
— 1.4.3 Club / dance bar / musical theme bar sector
• Collections in the club sector stood at 12.8 million euros in 2011 compared to 11.8 million euros in 2010, which is an increase of nearly 8.5%.
• This increase reflects improved collection from dance bars and musical theme bars.
— 1.4.4 Public performance sector – SACEM collections
• Collections for the year 2011 stand at 31.3 million euros compared to 31.3 million euros for the year 2010, representing a sharp increase of nearly 47.7%, due to the progressive application of the new tariffs adopted in January 2010 and since updated. While the application of these new tariffs led to disputes in various sectors, interprofessional enforcement agreements signed
with most of the sectors in question rendered these disputes minor.
1.5 Sound Recordings (excluding Equitable Remuneration)
• Since mid-1997, the SCPP has been intervening on behalf of its associates, within the framework of general contracts of common
interest, in a certain number of sectors relating, not to equitable remuneration, but to the right to authorise producers of sound recordings to: use sound recording excerpts via on-line services, reproduction rights for sound system operators, audiotel,
interactive terminals, telephone music-on-hold, and the share of the use of sound recordings by television stations that is not
subject to equitable remuneration and for which the SCPP has been mandated. The amount collected for 2011 in the Sound
Recording sector (excluding Equitable Remuneration) stands at 7.9 million euros, which represents an increase of nearly 13.3%
compared to 2010 (7 million euros). This substantial increase is mainly due to the increase in the amount collected for webcasting
and initial amounts collected for podcasting.
2 > DISTRIBUTING
• Nearly 58 million euros were distributed in 2011, which represents a drop of nearly 9% compared to 2010 (64 million euros - gross amounts). This drop was mainly due to the presence of substantial non-recurrent distribution in 2010 (sound recording rights
and equitable remuneration collected from television stations in the context of adjustments for their activities up to end-2007.
• These distributions were supplemented by a cash advance for a gross amount of 37.4 million euros, reduced to a net amount of 34.5 million euros after taking into account the advances and downpayments paid previously and not recovered (a cash advance of 33.8 million euros corresponding to a net amount of 32.2 million euros had been paid at the end of 2010). This advance had been supplemented by a structural advance for a gross amount of nearly 5.2 million euros corresponding to a net amount of nearly 4.8 million euros. A detailed report of the distributions is provided in the financial report 2011.
3 > GRANTS
• A report on these grants is enclosed with this document under the title «Grants approved by the SCPP in 2011» - Appendix 3. This report includes the breakdown of grants per project.
• For the year 2011, the SCPP had a total budget of 11,576,000 euros, including 9,807,000 euros from the 25% allocated to Private
Audio Copying and Private Audiovisual Copying remunerations and from the allocations of non-distributable remuneration resulting
from equitable remuneration (including 445,000 euros in advance payment from non-distributable rights from 2012), 350,000 euros
from amounts that cannot be allocated relating to the year of rights 2003, 1,014,000 euros from the balance brought forward from 2010 and from cancelled selective assistance projects, and 405,000 euros from printing rights not used or cancelled in 2010.
The advance payment for 2012 was exceptional to avoid a fall in the total amount of assistance compared with 2010, in the
exceptional context of a substantial increase in the collection of equitable remuneration for public performances. 10

• On the date of issue of this report, the permanent Auditing Commission on authors rights’ collective management societies had not yet made its eighth annual general report public.
• This report should be available on the Cour des Comptes website (www.ccomptes.fr) in the «Commission permanente de contrôle
des SPRD» section. It will also be available on the SCPP web site.
• The SCPP does however have two final individual reports: One on financial flows and the second on the participation of associates in the activities of SCPP. With reference to financial flows, the report does not include any specific recommendations or observations.
With reference to the participation of associates in the activities of the company, the report includes two observations which the SCPP plans to implement: mention the grants created by the SCPP in the event of non-compliance by the distributors of our
members (all SCPP associates will be informed of this event by e-mail) in the financial report, and the direct availability on the SCPP
site of the report of the auditing commission (until now this report was accessible on our site via a link to the site of the auditing
commission and not directly). We considered that two other recommendations made by the auditing commission were not necessary:
The retranscription of any debating at assemblies in reports, as these reports are statements of decisions made by associates and not records of verbal statements, and the transmission of all regulated conventions to our statutory auditor, as we consider
that this requirement has already been entirely satisfied.
• Copies of the general report should be available at the General Shareholders’ Meeting on 26 June.
• In addition, the SCPP will send a copy to any associate who requests one.
5 > COMBATING PIRACY
• Details on the SCPP’s actions in terms of combating piracy are provided in the activity report of the Anti-piracy Unit in Appendix 4.
• Once again in 2011, the actions of the SCPP primarily concentrated on combating piracy on the Internet. The SCPP continued to send
the offenses detected on the P2P networks to HADOPI and to arrange for the deactivation of the links concerning sound recordings in its national catalogue to «Direct Download» sites. The increased impact of HADOPI expected for the end of the first half of 2011 was
delayed to the end of the first half of 2012, as HADOPI was expected to have access to the technical resources required for this
increased impact by this date. Despite the low number of offenses detected by the SCPP, which are still subject to a warning message
sent out by HADOPI, Internet piracy in France has dropped substantially (by almost 40 percent for P2P networks, without any significant
transfers to «Direct Download» sites) when compared with the situation which existed prior to the creation of HADOPI. In addition,
registered letters were addressed to a certain number of subscribers in the event of the repeat use of their Internet access for
fraudulent purposes.
6 > COMMUNICATIONS AND INSTITUTIONAL RELATIONS
6.1 Communication
• Appendix 5 contains a report on our communications’ efforts in 2011.
6.2 Institutional Relations
• Recall that since the end of 1996, the SCPP has been in charge of a lobbying mission at both local and international level.
• This mission is performed in partnership with the SNEP. It exclusively involves the development and protection of the rights of producers of sound recordings and music videos.
• The activities of the SCPP during the year 2011 mainly focused on the preparation and voting by Parliament of a law amending the Intellectual property code, in order to integrate the recent decision of the Conseil d’Etat on private copying (legal sources,
exemption of professional users) and to confirm the tariffs cancelled for a duration of one year (law of 19 November 2011, mentioned above).
• In addition, further to the report by Emmanuel Hoog, an agreement with 13 commitments for on-line music was signed in January
2011 by the professional organisations involved, under the auspices of the public authorities. Only two of the commitments of this
agreement, signed by the SCPP, apply for the latter: accept to discuss the conditions for accessing its sound recording database,
accept to implement, on behalf of its members, an amendment to the Convention Collective de l’Edition Phonographique (Collective
Bargaining Agreement), to be developed with social partners, concerning the remuneration of performers for the use of sound
recordings in Webcasting. Negotiations with representatives of performers in 2012 on these two points failed to reach a conclusion,
despite the very reasonable proposals raised by the SCPP.

• The SCPP also participated in the working group of the CSPLA (Conseil Supérieur de la Propriété Littéraire et Artistique - Higher
board of artistic and literary property) on cloud computing and the prefiguration of the National music centre.
• In addition, the SCPP continued its participation in the works of the ISO MPEG committee on the protection of artistic and literary
property in the context of the new MPEG standards and the implementation of international standards on data exchange formats
for the musical industry (in the context of the international organisation, DDEX, Digital Data Exchange), particularly for collective
management societies for related rights, and thereby to reduce the cost and lead times involved in processing rights for which the SCPP is mandated. A set of 3 data exchange messages (MLCs’ message suite), covering exchanges on catalogues, unit sales and
income between beneficiaries and collective management societies for related rights, and between these societies themselves, was thereby adopted in November 2011 at the initiative of the SCPP.
7 > CURRENT PERIOD
7.1 Institutional Relations
• The activities of the SCPP mainly focused on the working groups of the CSPLA (Conseil Supérieur de la Propriété Littéraire et Artistique - Higher board of artistic and literary property) on cloud computing and Internet referencing and the prefiguration of the National music centre.
• The SCPP also participated in the consultations organised by the Ministry of Culture on a draft law transposing directive 2011/77/EU of 27 September 2011 (extension of the duration of related rights from 50 to 70 years) into French law.
7.2 Combating Piracy
• The SCPP continued to send the offenses detected on the P2P networks to HADOPI and to arrange for the deactivation of the links concerning sound recordings in its national catalogue to «Direct Download» sites. HADOPI also transmitted some
counterfeiting dossiers to the courts.
7.3 Private Copying Tariffs
• In February 2012, the Commission defined in article L.335-1 of the Intellectual property code adopted a decision establishing
definitive remuneration for multimedia tablets, such as the iPad by Apple. This decision should maintain the level of remuneration
collected for private copying in 2012, subject to the many legal disputes to which remuneration for private copying gives rise and the scale of reimbursements or exceptions for professional usages.
CONCLUSION
2011 was a good year for the SCPP. Amounts collected for rights concerning the use of sound recordings were excellent
and increased 11% compared to 2010, thanks to the combined effect of the increased impact of new tariffs for equitable
remuneration for 2010 and 2011 in the public performance sector, the increased impact of radio tariffs from 2007 and 2008
and the maintained level of remuneration collected for private copying, despite the many legal disputes. Amounts collected
for broadcasting rights for music videos also increased, due to the renegotiation of the contract with M6, which took effect
on 1 May 2011. Amounts collected for the use of sound recordings based on exclusive rights also increased substantially.
Subject to the impact of disputes in relation to remuneration for private copying, amounts collected in 2012 should still
climb substantially, particularly thanks to the increased impact of the tariffs for equitable remuneration in the public
performances sector.

Financial Report 2011
During the period 2011, the SCPP:
• received 72,147 million euros, i.e. 11.2% more than in 2010 (64,877 million euros),
• distributed 57,930 million euros, i.e. 9.8% more than in 2010(64,250 million Euros).
The first part of this report covers collections and distributions for the period, and the second part covers the financial statements for 2011 for the company.
The appendices include the report by our statutory auditors (Ernst & Young).

This increase was due to

Equitable Remuneration
≥ In 2011, the SCPP received 74.25% of the Equitable Remuneration paid by the SPRE to the SCPA during the period (76% in 2010, 76.5% in 2009), and paid €0.472 million to the SPPF in order to adjust the distribution for rights year 2009 between the two companies.
≥ The SPRE received €95.2 million in Equitable Remuneration in 2011, i.e. a 23% increase compared to 2010 (€77.1 million). The increase (+47.6%) was caused by the rise in the tariffs for RE owed for Public performances.
Private Audio Copying
≥ The SCPP and the SPPF provisionally shared Private Audio Copying collections in 2011 based on a cash rate of 75.5% for the SCPP (compared to 78.8% in 2010 and 80.4% in 2009) and 24.5% for the SPPF.
≥ The final distribution for the 2009 Private Audio Copying collections pro rata to sales between the two societies stands at 74.05% (74.65% for Private Audio Copying in 2008) for the SCPP and at 25.95% for the SPPF. The SCPP paid the SPPF €1.544 million in Private Audio Copying remuneration.
Private Audiovisual Copying
≥ Private Audiovisual Copying remuneration comes from three sources: the copying of distributed music videos, the copying of static images extracted from music videos and the copying of disc and DVD liners representing €473 thousand, down by 17% from 2010.
≥ Remuneration for the private copying of music videos, DVD liners and frames (static images extracted from music videos) is distributed pro rata to the distribution of remuneration for broadcasting by television channels (with an audience of over 1% of market share) of music videos based in France.
≥ Remuneration for the private copying of disc liners is distributed with CPS remuneration.

≥ The SCPA received, on behalf of the SPPF and of the SCPP, €3.077 M from users of telephone music-on-hold (€2.943 M in 2010).

≥ 77% of net amounts received for rights were paid to the SCPP in 2011 (79.5 % in 2010), i.e. €1.877 M, by the SCPA (€1.878 M in 2010) in the context of the agreement concluded between the SPPF and the SCPP in 2002.
The SCPP also collected €9.8K in equitable remuneration collections from foreign collective management societies, to be distributed to the members of the SCPP.

≥ The amounts distributed in 2011 (€57.930 M) were 9.8% below those distributed in 2010 (€64.250 M in 2010 and €62,919 M in 2009).
In 2010, the amount of CPS remuneration distributed included 14 months of collections. In 2009 and 2010, amounts collected for «sound recording» and equitable remuneration rights for televisions were distributed pro rata to sales and therefore, in full, in 2011, this remuneration had just started to be distributed pro rata to the durations of broadcasting by the television channels.

1 > KEY FIGURES
≥ Over the years, new responsibilities have been added to the main responsibility of the SCPP - collect and distribute certain fees
for producer rights. The cost of these responsibilities have been separated from the routine expenses of the SCPP and combined
under an “Other expenses” heading.
The routine expenses of the SCPP have increased by 2%, with total expenses up by 7.26%. The provision booked in 2010 hedging the risk that the tax administration subject the SCPA to the Business tax for the years 2008 and 2009, and oblige associates to pay
this tax, was re-integrated in full as the SCPA obtained a positive response to its request submitted to the tax administration.

“SCPA Business Tax” provision
≥ The withholding rate for 2011, subject to approval by the General Shareholders’ Meeting, is maintained at 11.8%; 87% of P&L (€652 K) is attributable to the re-integration of the above provision. This amount carried forward offsets the negative amount carried forward in 2010, itself the consequence of this provision.
Withholdings on music videos broadcasting rights remains at 6%.
At 31 December 2011, the amount of withholdings booked represented €7.185 M (€6.125 million in 2010) and represented 8.04% of current collections (9.44% in 2010).
The “routine expenses / collections” ratio, which was 8.8% in 2010, dropped to 7.9% in 2011.

This difference, as for every period, is primarily composed of:
• 0.104 million euros representing the cost of MIDEM, financed by the non-allocated non-distributable amounts
(expense transfers that were not in the budget),
• 0.087 million euros from the recognition as income of the SPPF’s share of the costs for collecting the «Telephone music-on-hold» remuneration, which is deducted from expenses in the SCPP’s budgets.

Finally, the modification of the «local» tax, and especially the transition from the Business tax to the CFE (corporate property tax)

The table shows, for each type of remuneration collected by the SCPP, the withholdings which were applied, by rights year, by intermediate societies prior to collection by the SCPP, and those to be applied, at the time of distribution, also by rights year, by the SCPP. It is specified that rates are net before the use of financial income, for societies which exclusively collect (SPRE, COPIE France, SCPA) and financial income is not used for societies which also manage distribution tasks (PROCIREP, SCPP). Financial income for societies which exclusively collect is low, as these societies pay the amounts collected to their associates within a short period. The mean management rate is that which includes the costs of the SCPP as a collecting and distributing
society, the mean rate with responsibilities also includes the cost of the responsibilities entrusted to the SCPP by its associates and which are added to the society’s costs of collection and
distribution (particularly the combat against piracy and the financing of professional tools).

The increase in amounts collected by the SCPP represented 4.8% in 2010.This amount represented 11.2% in 2011 and is forecast as 7.14% for the 2012 budget of the SCPP. This constant increase is mainly due to the increase in the amount collected for Equitable

a – Withholdings
• «Sound recording» withholdings were defined as 11.8% in 2009 and in 2010 and may remain at this same level in 2011. The withholding rate on «music video» rights and Private Audiovisual Copying remains set at 6%.
• The average rate of withholding of the SCPP was 9.96% in 2011 (9.44% in 2010).
• With reference to the amount of the withholdings taken by the societies collecting remuneration for rights partially on behalf of the SCPP, the table on the following page shows the total withholding rate, i.e. successive debits by the different
societies, accepted by SCPP members, representing 16%.
b – Access to the «Sound recording» base
• The contribution of the ADAMI to the cost of the SCPP’s producer data base represents €146k. The SPPF contributed €56K to the cost of creating the «Musicians» site («Implementation of the Collective bargaining agreement» responsibility).
c – Financial income
• The SCPP distributed €0.52 million in financial income to its beneficiaries in December 2011.
d – Extraordinary income and other income
• This income comprises compensation obtained from «Piracy» litigation and from the rebilling of rent to the FCM and SNEP.
e – Expense transfers and re-integration of provision
The reintegration of the provision created in 2010 to hedge the risk of having to pay part of the business tax of the SCPA, which the tax administration wished to attribute to the SCPP (€543K), the rebilling of rent to the FCM and the SNEP, and the cost
of MIDEM financed by unallocated non-distributed amounts (€104K) represent almost all of this account.

APPENDIX
1 > Main events during the period
The Société Civile des Producteurs Associés underwent a verification of its accounting in January 2011, concerning the tax
returns for the period from 1 January 2008 to 31 December 2009, extended to the month of November 2010 for the VAT returns.
Within the framework of this audit, on 21 January 2011, the tax administration sent a letter to the SCPP, informing it that the SCPA was liable for the business tax but that the tax is established in the name of each of its members.
In terms of 2008 and 2009, the tax bases were reduced for the SCPP by €1,806,843 for 2008 and €1,816,860 for 2009.
At 31 December 2010, the SCPP booked a tax provision of €543,000 for this €543,000.

2.4 Tangible assets
Tangible fixed assets are booked at their purchase cost. Depreciation is calculated over the estimated lifespan of the goods
according to the straight-line or progressive methods, as follows:

The company disputed this position with the administration and obtained the tax administration’s agreement to its request.
Therefore, the SCPP failed to post any expense in this respect during the period 2011 and the SCPP was able to recover the entire provision created previously.
In addition, a dispute has arisen between the Lagardere group and the SCPP on the payment of broadcasting rights for music
videos by the Gulli and Tiji channels. The Lagardere group refuses the payment of part of the rights intended for a member of the SCPP, as the latter is itself in the course of litigation with one of the members of the SCPP.
According to the facts and the transactions underway, the litigation is between two parties with no relation with the SCPP, and there is no need to create a provision on this basis.
2 > Accounting rules and methods
2.1 Legal framework of reference
General accounting methods were applied in compliance with the conservatism principle, in accordance with basic hypotheses:
• continuity in operations,
• consistency of accounting methods from one period to the next,
• independence of periods.
The enclosed financial statements were drawn up in accordance with regulation no. 99-03 of 29 April 1999 of the Comité de la Réglementation Comptable relative to the general chart of accounts amended in particular by regulation no. 2000-6 of 7 December 2000 pertaining to liabilities, no. 2002-10 of 12 April 2002 pertaining to asset amortisation and depreciation and no. 2004-6 of 23 November 2004 relative to the definition, recognition and evaluation of assets as well as regulation no. 2008-09 pertaining to the recognition of authors’ rights.
2.2 Method of presenting the management report and the income statement
Operations are resumed and presented using the «Management account» as defined in the provisions of Decree no. P8-1040 of 18 November 1998, appendix 1. This management account, in accordance with the decree of 18 November 1998, is completed
with an income statement presented according to the provisions of the general chart of accounts.
2.3 Intangible assets
Intangible fixed assets are comprised of:
• software purchased by the company,
• design costs for distribution software and databases, carried out by IT service providers or the SCPP’s IT department. Internal costs are booked as fixed assets based on the costs of wages used in creating the developments
All of these intangible fixed assets are depreciated using the straight-line method over three years.

2.5 Equity interests
Equity interests appear on the balance sheet at their historical cost or at their current value if the latter is less.
2.6 Securities
Investment securities are booked at their purchase cost and, at the end of the period, an estimation is made of these securities, based on their market value.
Investment securities are comprised of capitalized S.I.C.A.V., mutual funds and negotiable certificates of deposit. In accordance with the company’s by-laws, capital gains on these securities supplement the rights of producers of sound recordings.
2.7 Provisions for risks
The company books a provision for risks according to incurred litigation, likely to have an impact on its income and expenses.
2.8 Rules and methods concerning rights
— 2.8.1 Obligation as to supporting creation
The S.C.P.P. must statutorily and in virtue of Article L 321-9 of the Intellectual Property Code devote a portion of the collected
rights to grants: 25% of the amounts collected for private copying of sound recordings and all of the non-distributable
amounts generated on years of rights after 1 August 2000.
This contribution is booked on the liabilities side of the balance sheet and the various payments made for this purpose are then deducted.
— 2.8.2 Collected and distributed rights
All of the rights collected by the company must be distributed.
The amount of rights collected or to be collected is therefore identical to the amount of rights distributed and to be distributed.
Rights to be distributed to producers are booked on the liabilities side of the balance sheet for their total amount including tax,
and have only one deduction for grants linked with rights stemming from the private copying of sound recordings.

According to Article L321-9 of the Intellectual Property Code, sums collected starting on 1 August 2000 for equitable
remuneration for radio broadcasting and communication in public places of commercial sound recordings, and which are
non-distributable in accordance with the Intellectual Property Code and with International Agreements must be fully
allocated to grants.
Equitable remuneration received before 1 August 2000 is not concerned by this change in legislation. The allocation of non-distributable amounts that will be observed for these amounts at the time of the next distribution is therefore
subject to the rules that were previously defined by lawmakers.
These sums are booked on the liabilities side of the balance sheet.
Non-distributable equitable remuneration received after 1 August 2000 that the company has is used for financing its
grants, putting on live performances and for artist education.
Subsequent to the «Distributions II» agreement signed on 15 July 2011 between SCPP and SPPF, weighting and distribution
procedures for equitable remuneration between companies are affected as follows.

2.9 Joint SCPP and SPPF IT costs
Up to 31 December 2010, in order to improve the accuracy and reliability of the respective distributions of the SCPP and of the
SPPF, the latter had decided to share their costs for managing the social catalogue and distribution costs. The two companies
invoiced the S.C.P.A., with proof, for their IT expenses. The S.C.P.A. then rebilled each party for its share in the total of its
expenses determined, in a final manner, based on the average share of the temporary distribution for the civil year, for the civil
year in which the costs were incurred.
Subsequent to the «Distributions II» agreement signed on 15 July 2011 between the SCPP and the SPPF, this clause on the sharing
of IT expenses between the different parties has been repealed. Therefore, no cost incurred in the managing of the social
catalogue and distribution was rebilled by the SCPP and the SPPF to the SCPA for 2011. An amount of €12,446 was posted in the
accounts for the period 2011; this amount corresponds to an adjustment for the previous period, determined by the processing
of the final weighting.
3 > Additional information concerning the balance sheet and the income statement
3.1 Information concerning rights

Article 2.1 stipulates that the amounts of Equitable Remuneration perceived for the year of rights 2009 and subsequent

— 2.8.5 Rights due by the users of telephone music-on-hold
On behalf of the SCPP, the SCPA provides administrative management of rights pertaining to Telephone music-on-hold for payment of a management commission of 17% on collected rights. Since 1998, the application of this management
commission has a retroactive effect on the share of the collected rights that will be paid to the S.P.P.F.
The amount generated by the management fees collected by the SCPP for collecting rights pertaining to telephone
music-on-hold, stands at €500,329 at 31 December 2011.
Since 2005, the amounts received during a given period have been considered as sums collected during this same year of rights. These rights are booked based on payments received in the current fiscal period, and no longer based on the rights period.

4.2 Management’s compensation
This information is not provided, as it would result in revealing individual remuneration.
4.3 Pension commitments
Indemnities are paid to company employees when they take their retirement. Taking the age and seniority of the employees
into account, the amount of gross indemnities (excl. social contributions) calculated at the closing of the period stand at
€ 39,974. No provision was booked at 31 December 2011.
4.4 First-request guarantee
Some SPRD preferred that Copie France place some of the amounts likely to be reimbursed subsequent to a decision by the Conseil d’Etat (State council) in reserve (cancellation of decision no. 11 of the private copying commission).
The members of the Board of directors, which met on 5 July 2011, unanimously confirmed that they authorised the SCPP to act as the guarantor of the SCPA (first-request financial guarantee to the benefit of COPIE France representing 4 million
euros, created with the Société Générale bank) in the context of the cancellation of decision no. 11 of the private copying
commission up to 31 December 2012.
4.5 S.I.C.A.V. securities
On 24 March 2010, the SCPP guaranteed S.I.C.A.V. with the Société Générale bank to the benefit of the lessor of the premises for an initial amount of € 122,883.75. At 31 December 2011, this security was increased to € 208,975.45.

The purpose of this report is, as every year, to report to the partners of the SCPP and to the Ministry of Culture on the use of the sums allocated either directly or indirectly by the SCPP for grants.
1 > Financing Grants
≥ The SCPP had, for this purpose, in 2011, a total amount of 11,576,571 euros, including:
• 4,413,393 euros, i.e. 25% of Private Copying, that the SCPP must devote to Grants,
• 5,393,940 euros, including 4,948,730 euros taken from the non-distributable amounts of Equitable Remuneration distributed during the previous period and 445,210 euros taken from non-distributable amounts for 2012,
• 350,000 euros, which is the remaining amount unallocated to distribution of years of rights 2003,
• 1,014,308 euros which is the balance of the Grant budget for 2010 («Selective Assistance» balance: 162,976 euros, «Printing Rights» balance: 851,332 euros),
• 128,210 euros in grants approved during previous periods that were cancelled in 2011 and reincorporated into the Selective Assistance budget for 2011,
• and 276,720 euros in «Printing Rights» grants approved during previous periods that were cancelled by the producers in 2010 and reincorporated into the budget for 2011.
2 > Allocating these sums

≥ The SCPP’s entire grant budget was allocated by the Board of Directors as follows:
a) 8,027,078 euros for the «Printing Rights» budget and
b) 3,549,493 euros for the «Selective Assistance» budget (i.e. 3,421,283 euros for the initial budget and 128,210 euros in cancelled and reincorporated grants from prior years)
≥ The «Selective Assistance» budget was allocated in accordance with the decision of the General Shareholders’ Meeting to:
• grants for sound recordings: 1,444,452 euros
(1,410,517 euros + 33,935 euros in cancelled grants from prior years).
• grants for music videos: 301,628 euros
(276,335 euros + 25,293 euros in cancelled grants from prior years).
• grants for live performances: 276,233 euros
(207,251 euros + 68,982 euros in cancelled grants from prior years).
• grants for special projects: 1,527,180 euros.
3 > Allocated grants
≥ During the period 2011, the Commission met 11 times to examine 898 grant request applications (869 in 2010 and 860 in 2009).
The Board of directors accorded, at the proposal of the Commission, 717 subsidies (714 in 2010 and 698 in 2009) for an amount of
10,968,766 euros [1](i.e. 7,635,026 euros for «Printing rights» and 3,333,740 euros for Selective assistance).
• 79.84% of the requests were satisfied.
[1] This amount does not include the grants from 2011 cancelled at the request of their beneficiaries during the year 2011.

≥ In 2011,
• 85.09% of the SCPP’s grant budget was directly allocated to phonographic producers, i.e. 9,333,256 euros.
• 9.76% to institutions (le Fair, Le Studio des Variétés, Voix du Sud, Francophonie Diffusion, Zone Franche, FCM, Fam, and Tous pour la Musique), i.e.
1,070,582 euros.
• 2.66% to show organisers within the framework of professional awards ceremonies and tribute (Association Prix Constantin, Les Victoires de la Musique, Festival au Fil des Voix, Association La Nuit des Musiciens, Le Printemps des Poètes and the Festival
International des Arts du Clip) i.e. 291,600 euros.
• 2.49% to phonographic producers within the framework of agreements with show halls, i.e. 273,328 euros.
5 > The cost of managing grants
≥ The cost of managing grants is covered by the company’s general budget. The SCPP does not take any sums from the grant
budget in order to finance this operation. Costs for this management are however estimated for 2011 at 148,516 euros.
≥ During the period 2011, the SCPP signed 21 agreements with theatres making it possible to subsidise 154 «show-cases»:

6 > Allocation procedures
≥ All requests for grants (other than those pertaining to special projects) are submitted to an allocation Commission of which its 9 members are elected each year by the company’s General Shareholders’ Meeting. This Commission, in compliance with the rules
set forth by the Board of Directors and which all of the requesters are informed of [2], proposes to the Board of Directors: for
selective assistance, whether or not a grant is allocated and the amount accorded, and, for applications using printing rights, after a check on eligibility and that the requested amount complies with current ceiling rules, the allocation of the grant. The Board of Directors approved by the General Shareholders’ Meeting, after having heard a representative of the Commission,
approves or does not approve the proposed grants.
≥ 50% of the grant is paid upon presentation of an invoice before the project is carried out, and the remaining 50% is paid on presentation for:
• creating sound recordings: of 2 CDs or the screen shot of available tracks on a download site.(A check is carried out via sampling of one «Printing Rights» dossier and one «Selective Assistance» dossier per month, in order to make sure that the allocated grant
does not represent more than 40% of the actual recording costs).
• music videos: a DVD copy of the clip, or the screen shot of the video available on a download site, the copy of the audiovisual
production contract or invoices paid to produce the clip, making it possible to check that the allocated grant does not represent
more than 40% of actual production costs.
• tours and opening acts, the list of performance dates, with documents proving the producer’s contribution in financing the tour as well as a copy of press inserts, posters, flyers, tracts, in order to check that the grant obtained does not exceed 50% of the
producer’s participation.
≥ The verifications concerning the creating of sound recordings, tours and opening acts are submitted to the Commission for
approval only when the amounts granted must be revised.
≥ The first half of the grant is recovered by the SCPP when the project does not take place.
≥ Only grants allocated for artist training and show cases, in halls that are approved by the SCPP, are paid in full in a single payment
after proof that they have taken place.
≥ The balance of the «Selective Assistance» budget stood at the end of 2011 at 215,753 euros, and that of the «Printing Rights»
budget at 392,052 euros.

Introduction
≥ Combating piracy on the Internet remains a priority for SCPP’s Anti-Piracy Unit, due to the massive use of various systems
for illegally making musical recordings available, such as, in particular, exchange forums with built-in search engines, platforms with hypertext links to access musical recordings hosted on storage spaces or unauthorised streaming platforms.
≥ In the context of the deployment of the «Creation and Internet» law, the SCPP transmits reports on the illegal availability
of sound recordings and music videos included in the catalogue of its producer members to the HADOPI on a daily basis. These reports are issued by a sworn-in officer.
≥ According to the HADOPI, 755,015 Internet users received at least one initial recommendation by e-mail between 1 October 2010
and 1 December 2011. Tens of thousands of warnings were also sent out by HADOPI in the form of a registered letter with
acknowledgement of receipt further to a repeat offense.
≥ Finally, the HADOPI Rights Protection Commission transmitted initial dossiers, for repeat offenders having failed to comply
with the two initial warnings issued, to the courts in question early-2012.These dossiers should lead to initial prosecution and
convictions at the initiative of the Public ministry (fines, or if applicable, suspension of the Internet connection).
≥ A substantial drop in the number of illegal downloads has already been recorded on peer-to-peer networks for the first time
in the last decade.
≥ With regard direct downloads via search tools (Direct Download), early 2012 was dominated by the closing of the Megaupload
storage site in the United States, subsequent to an enquiry by the FBI, which established the active participation of the
directors of this site in the illegal availability of protected content.
Megaupload was the largest host for illegal files, most of which were audiovisual, but also musical (the site generated 4% of international Internet flows with 50 million visitors per day).
1 > FIGURES FOR 2011/2012
Activity report
of the anti-piracy unit
Year 2011-2012
≥ Within the framework of implementing the «Creation and Internet» law, the SCPP’s sworn-in officers send the HADOPI Rights
Protection Commission, tens of thousands of reports on the illegal availability of sound recordings and music videos within the framework of peer-to-peer exchange systems, on a daily basis. Over the past period, a total of around 6 million reports were sent by the SCPP to HADOPI, relating to a regularly-updated reference data base of 10,000 sound recordings. All of these
reports relate to a highly-varied catalogue (Variety, pop, rap, dance, Rock, R&B and also new stars in classical music, etc.).
≥ During the course of the year, the Anti-Piracy Unit handled 75 dossiers, including 24 contentious dossiers and 24 dossiers
concerning enforcement procedures, subsequent to the obtaining of legal rulings.
≥ 1,876,571 illegal links and pirate websites on the Internet, meaning over 18 million MP3 files, were deleted subsequent
to the SCPP sending warning and removal letters.
≥ 1 Edonkey on-line server was closed definitively and 10,047 audio and video links were deleted further to requests by the SCPP.
≥ Advertisements concerning the sale of unauthorised CDs were also removed from on-line sales sites such as Ebay and Itraque.
≥ Faced with the many unauthorised uses of sound recordings and music videos listed in the SCPP’s social catalogue,
406 verifications were carried out, and reports issued by sworn-in officers, in view of correcting the situation. These verifications
were primarily directed towards the telephone music-on-hold, interactive listening terminals, and webradio sectors, television
channels and on-line servers making excerpts of sound recordings or music videos available.

2 > CURRENT PROCEEDINGS
≥ Actions taken against Newsgroups
• Subsequent to several orders issued on the basis of joint motions presented by the SCPP, the SACEM/SDRM and FREE, the Paris
Court of First Instance authorised FREE to extend the suspension of 49 music newsgroups.
≥ Actions taken against sites with illegal links
• The SCPP intervened in several proceedings involving administrators of sites of links via which sound recordings in the SCPP
catalogue were illegally made available to the public, via downloads. The preliminary investigation is coming to a close for some of these proceedings and hearings should be scheduled by end-2012.
≥ Actions in terms of traditional piracy
• The SCPP has filed a penal action further to the discovery of packs copying recordings by the «Pink Floyd» group without the
authorisation of the legitimate producer. These packs, from China, were available for sale from on-line advertisement sites and the Internet site of the pirates. A preliminary enquiry has been opened. All of the advertisements for these packs have been
removed.
3 > RELATIONS WITH INSTITUTIONS AND PROFESSIONAL ORGANISATIONS
≥ Intervention taken by the SCPP’s Anti-Piracy Unit during training programmes organised by the Regional Customs Departments
in Orléans, Nice and Mulhouse contributed, this year, to increasing institutional awareness concerning dossiers on music piracy.
≥ Close relations exist with the SACEM / SDRM anti-piracy department, enabling joint contributions to several cases
of legal action yet again this year.
≥ The anti-piracy unit enjoys privileged relations with the Secretariat of the IFPI and its various national groups, which gives rise
to the regular exchange of information on the strategies applied to improve the combat against music piracy.
≥ The SCPP is a member of the Union des Fabricants (UNIFAB)(Manufacturer’s Union) and the Comité National Anti-Contrefaçon
(CNAC)(National Committee on Anti-Piracy) and regularly participates in the commissions and work groups organised by these
two bodies.

4.1 Traditional piracy

Judgement of 3 October 2011 by the Magistrates’ Court of Pau
In proceedings initiated by the SCPP against the publisher of an Internet site copying musical recordings in MP3 format to DVD-R at request, the Magistrates’ Court of Pau sentenced the accused party to a suspended four-month prison sentence, and a two-year probationary period and ordered the publication of the decision. Civil interests allocated to the SCPP: 10,000
euros in damages, in addition to the amount of 1,500 euros in application of article 475-1 of the French Penal Procedure Code.
The accused party has filed an appeal against this decision.

Judgement of 7 June 2011 by the Magistrates’ Court of Bayonne
In proceedings initiated against an Internet user having administrated a site for «.torrent» files, enabling the illegal downloading
of musical recordings, the Magistrates’ court of Bayonne sentenced the accused party to a suspended six-month prison sentence
and a fine of 1000 euros, and ordered the publication of the decision in the form of an extract. Civil interests allocated to the
SCPP: 74,840 euros in damages, in addition to the amount of 1,500 euros in application of article 475-1 of the French Penal
Procedure Code.
The accused party has filed an appeal against this decision.
TGI DE METZ > Software cleared intended to make sound recordings available illegally
Judgement of 9 June 2011 by the Magistrates’ Court of Metz
In proceedings initiated by the SCPP against the publisher of software which was clearly intended for the unauthorised
availability of musical recordings for the public enabling, in particular, the illegal downloading of musical recordings available for
listening on legal streaming sites, the Magistrates’ court sentenced the accused party to a suspended six-month prison sentence
and ordered the publication of the decision in the form of an extract. Civil interests allocated to the SCPP: 5,000 euros in
damages, in addition to the amount of 1,500 euros in application of article 475-1 of the French Penal Procedure Code.
This decision is final.
COURT OF APPEAL OF PARIS > Site of links
Order of 1 July 2007 of the Court of Appeal of Paris
In proceeding initiated against an Internet user having administrated a site offering links which could be used for the illegal
downloading of musical recordings in MP3 format, the Court of appeal of Paris overturned the decision to discharge the accused
party issued by the court of first instance and sentenced the accused party to a suspended two-month prison sentence. The Court also ordered the confiscation of the bonded items. Civil interests allocated to the SCPP: 8,600 euros in damages, in addition to the amount of 800 euros in application of article 475-1 of the French Penal Procedure Code.

sentenced the accused party to a suspended five-month prison sentence and ordered the confiscation of the bonded items.
Civil interests allocated to the SCPP: 81,332 euros in damages, in addition to the amount of 2,000 euros in application of article
475-1 of the French Penal Procedure Code.

COURT OF APPEAL OF DOUAI> Forum
Order of 24 November 2011 issued by the Court of Appeal of DOUAI
In proceedings initiated against several members of an IT piracy network with a clear structure and organisation, whose aim was to enable the illegal availability and downloading of musical recordings to the benefit of its members, the Court of Appeal of
DOUAI, issuing a decision on civil interests, sentenced the accused parties to pay the total amount of 6,314 euros in damages, in
addition to the amount of 1,300 euros in application of article 475-1 of the French Penal Procedure Code. The Court also ordered
the confiscation of the bonded items.
One of the accused has filed an appeal to the Court of cassation against this ruling.
Reminder of the decision of the court of first instance dated 29 January 2004: All of the accused were sentenced to a suspended
prison sentence ranging from 2 months to 10 months and a fine ranging from 4,000 to 5,000 euros. Civil interests allocated to the SCPP: 1 euro as a provision for each of the accused. The court deferred the instance to a future hearing for a ruling on civil
interests.

In proceedings initiated against an Internet user having illegally copied and made available over 20,000 musical recordings from
the social catalogue of the SCPP, in the context of the peer-to-peer exchange network «Direct Connect», the Court of Appeal
confirmed the decision of the Court of first instance, particularly sentencing the accused party to pay the SCPP the amount of 21,571 euros in damages, in addition to the amount of 1000 euros in application of article 475–1 of the French Penal Procedure
Code, and allocated the additional amount of 1000 euros in application of article 475-1 of the French Penal Procedure Code.

In proceedings initiated against an Internet user having administrated a site including links which could be used for the illegal
downloading of musical recordings, particularly those in MP3 format, the Cour of Cassation dismissed the appeal of the accused
party and reformed the civil provisions of the appeal decision, having refused to accord indemnities for the material losses
incurred by the SCP, considering that the existence of material losses was the result of the detection of the counterfeit and that the Court of appeal was responsible for determining the scope of the losses, according to its sovereign powers of
assessment, in view of ensuring full compensation.
The instance is deferred to the Court of appeal of Caen for a new ruling on civil interests.

Civil interests allocated
to the SCPP: 3,500 euros in damages, in addition to the amount of 500 euros in application of article 475-1 of the French Penal

≥ A genuine communications link with SCPP members, the General Managing Director’s newsletter informs members
of the activities and concerns of the SCPP. 1.1.2 The SCPP producer database
≥ The SCPP producer database, which is updated on a regular basis, presents each member company of the SCPP, indicating
its main activity, its organisational chart, its catalogue and its corporate name. Especially useful during trade shows, this
database can be consulted using the name of the company, the name of its manager or representative, the name of an artist, or by type of music.

1.2. IT tools
≥ This year, the IT team has developed new tools in order to allow our members to save time in their relations with the SCPP
and to monitor changes in their dossiers.
• The Grants portal was launched on-line early in the year. This portal can be used by all of our members to submit their requests for assistance directly to the site, and track their dossier up to the final decision by the Assistance commission and the Board of directors.
• In 2010, a new internet website intended for musicians, backup singers and choir artists, shared by the SCPP and the SPPF, had been created in order to facilitate the application of the Convention collective nationale de l’édition phonographique (CCNEP - National collective convention on sound recording). This site (http://musiciens.lascpa.org) has been equipped with new
functionalities this year, including the tracking of discharges and accounts (submission of invoices and tracking of payments).
2 > EVENTS AND PROFESSIONAL FAIRS
2.1 MIDEM
≥ As every year, the SCPP provided members with a 195-m2 area at MIDEM, including private offices, equipped with audio
and video equipment. In this way, SCPP members were able to take advantage of special rates to access the show.
2.2 SCPP general shareholders’ meeting
≥ At the occasion of its annual general shareholders’ meeting, members of the SCPP, journalists and professional partners
are invited to a dinner cocktail at the Pavillon Dauphine.
3 > DEFENDING PRODUCERS’ RIGHTS
≥ SCPP communication continued with its mission to ensure the awareness of all music professionals and public authorities
in terms of compliance with the rights of music producers, especially:
• with companies using telephone music-on-hold systems,
• with public authorities within the framework of the «Creation and Internet» law.
≥ The SCPP aimed to inform possible offenders, producers and public authorities of the risks incurred when the rights
