Report on the application of the postal services directive

This significant directive, which has been keeping us busy for many years, contains a clause according to
which the European Commission has to draw up a report on the state of affairs, once in every four (4) years.
The rapporteur, Georges Bach (PPE-Lux), had prepared a proposal which he discussed with the members
and substitutes of the Committee of Social Affairs.
He referred to the technical reforms, the switch from letter post to parcel services. As usual, the European
Commission had laid down in its report that it lacks recent information. But this is what we as trade union
already know for a long time. The new postal directive has not only caused liberalisation but also massive
privatisation.
Those privatised companies would very much like to have the same info as the universal service providers.
So, we cannot speak of reliable data. Roughly speaking, the number of workers in the letter post has
diminished by 40 %. When this has not caused a social massacre, this is due to the responsible position
taken by the employers and workers of the universal service providers.

The postal suppliers of the private sector conclude little or no collective agreements and speak only of
flexibility. Here the rapporteur referred to the need for concluding collective agreements to avoid stress and
overtime and precarious employment. Finally, he underlined the need for training, continuous training.
During the debate, most interventions were made to add something or put emphasis on certain things. Thus
abuses in the field of driving times and rest periods, digitisation and the use of drones.
One Parliament Member who has been following this dossier for many years, frankly said that the fears of the
past have become true. Employment, social conditions, the closing down of postal offices and services.
An Italian female speaker said that things have got out of hand. Today, the Italian Post is part of Alitalia and
sells sweets. Once a week (1x) they deliver mail in rural areas.
A delegate from the UK blamed private operators for picking the cherries from the cake and leaving the rest
to the universal service providers.
A Polish delegate asked that a stronger language would be used in the proposal. A Greek delegate, who has
been working in the Post for 30 years, does not recognise his company anymore. He used to work with 8
persons in his service, now there are only 3. They have to work when they are sick and cannot take up
vacations. The Post has a network; one should use and further develop this network.
The chairman supported the remarks made and asked that the colleagues would send them to him in writing
before 3th May.
The MEP responsible for drawing up the draft opinion of the Committee TRAN (Transport and Tourism) is
Markus Ferber (EPP, Germany). He was already rapporteur 14 years ago, but at that time he was rapporteur
of the social committee. Many of us pointed the finger at him then, to denounce the situation in the Deutsche
Post. Fortunately, this has later resulted in the conviction of Deutsche Post. There are evil tongues who say
that the penalty imposed by the Commission was only a small fraction of what the company won through its
monopoly status in Germany. But don’t say just Deutsche Post, also think DHL.

VORSCHLÄGE
Der Ausschuss für Beschäftigung und soziale Angelegenheiten ersucht den federführenden
Ausschuss für Verkehr und Fremdenverkehr, folgende Vorschläge in seinen
Entschließungsantrag zu übernehmen:
1.
stellt fest, dass sich der Postdienstsektor in den vergangenen Jahren durch den
technologischen Fortschritt und die Digitalisierung stark gewandelt hat und dass die
Modernisierung und Diversifizierung der Postdienste starke Auswirkungen auf die
Beschäftigung hat;
2.
stellt fest, dass die Zahl der Teilzeitbeschäftigten, Leiharbeiter und
Scheinselbstständigen angestiegen ist und dass die Entwicklung allgemein hin zu
flexibleren Arbeitsverträgen geht;
3.
stellt fest, dass es bei den Arbeitsbedingungen große Unterschiede zwischen
Universaldienstanbietern und konkurrierenden Postanbietern gibt;
4.
begrüßt die Rolle der Sozialpartner, die in vielen Mitgliedstaaten in Zusammenarbeit
mit den Universaldienstanbietern versucht haben, den Wandel im Postdienstsektor in
sozial verträglicher Weise zu handhaben;
5.
gibt zu bedenken, dass es mitunter zu unfairem Wettbewerb kommt, der auf Kosten
der Arbeitnehmer geht;
6.
weist darauf hin, dass durch die Restrukturierungen und neuen Aktivitäten im
Postdienstsektor Arbeitsplätze geschaffen werden und dass die Kompetenzen der
Arbeitnehmer an die neuen Gegebenheiten angepasst werden müssen; weist auf die
Bedeutung von Aus- und Weiterbildung und von Umschulungen hin;
7.
begrüßt die Arbeit des Ausschusses für den sozialen Dialog im Postdienstsektor;
8.
fordert die Kommission und die Mitgliedstaaten auf, mehr Daten zu den
Beschäftigungszahlen und -bedingungen zu sammeln, um auf Entwicklungen und
mögliche Probleme effizient reagieren zu können;
9.
begrüßt, dass für Universaldienste in den Mitgliedstaaten in der Regel
Kollektivverträge gelten; ist der Auffassung, dass die Sozialpartner gemäß der
nationalen Praxis auch für andere Postdienste Tarifverträge aushandeln sollten;
10.
fordert die Mitgliedstaaten auf, allen Arbeitnehmern im Postdienstsektor angemessene
Arbeitsbedingungen zu garantieren;

SUGGESTIONS
The Committee on Employment and Social Affairs calls on the Committee on Transport and
Tourism, as the committee responsible, to incorporate the following suggestions into its
motion for a resolution:
1.
Notes that in recent years technological advances and digitalisation have transformed
the postal services sector and that the modernisation and diversification of postal
services has had a major impact on employment in the sector;
2.
Notes that the number of part-time workers, agency workers and bogus self-employed
persons in the sector has increased and that the general trend is towards more flexible
employment contracts;
3.
Notes that there are substantial differences in working conditions between universal
service providers and competing companies providing specific postal services;
4.
Welcomes the role played by the social partners, who in many Member States have
worked together with universal service providers in an effort to make the
transformation of the postal services sector socially sustainable;
5.
Draws attention to a number of instances of unfair competition, the casualties of which
have been workers in the sector;
6.
Points out that jobs have been created as a result of restructuring and the introduction
of new activities in the postal services sector and that, in keeping with these new
circumstances, workers need to learn new skills; draws attention to the importance of
training, further training and retraining;
7.
Applauds the work of the Social Dialogue Committee for the Postal Sector;
8.
Calls on the Commission and the Member States to compile more data on workforce
size and working conditions so that they can respond promptly to developments and
potential problems;
9.
Welcomes the fact that most of the universal service providers in the Member States
have concluded collective agreements; takes the view that, in keeping with national
practice, the social partners should negotiate collective wage agreements for other
companies providing postal services;
10.
Calls on the Member States to guarantee all workers in the postal services sector
appropriate working conditions.

SUGGESTIONS
La commission de l'emploi et des affaires sociales invite la commission des transports et du
tourisme, compétente au fond, à incorporer dans la proposition de résolution qu'elle adoptera
les suggestions suivantes:
1.
constate que, ces dernières années, le secteur des services postaux a connu des
changements majeurs insufflés par les avancées technologiques et la numérisation et
que la modernisation et la diversification des services postaux ont des retombées
importante sur l'emploi;
2.
constate l'augmentation du nombre de salariés à temps partiel, de travailleurs
intérimaires et de faux indépendants ainsi que l'évolution générale vers des contrats de
travail flexibles;
3.
constate l'existence de différences notables dans les conditions de travail entre
prestataires de services universels et services postaux concurrents;
4.
salue le rôle des partenaires sociaux qui, dans de nombreux États membres, ont tenté,
en collaboration avec les prestataires de services universels, de gérer cette évolution
du secteur des services postaux de manière socialement acceptable;
5.
signale que cette situation entraîne parfois une concurrence déloyale, et ce aux dépens
des employés;
6.
souligne que les restructurations et les nouvelles activités du secteur des services
postaux entraîneront la création de nouveaux emplois et que les compétences des
travailleurs devront être adaptées aux nouvelles réalités; souligne l'importance de
l'enseignement, de la formation continue ainsi que du recyclage;
7.
salue le travail du comité du dialogue social dans le secteur des services postaux;
8.
invite la Commission et les États membres à rassembler davantage d'informations sur
les chiffres de l'emploi et les conditions de travail afin de pouvoir réagir plus
efficacement aux évolutions et aux éventuels problèmes;
9.
salue le fait que, généralement, les services universels des États membres disposent de
conventions collectives; estime que les partenaires sociaux devraient également
négocier des conventions collectives pour d'autres services postaux conformément aux
pratiques nationales;
10.
invite les États membres à garantir des conditions de travail adéquates à tous les
travailleurs du secteur des services postaux.

SUGGESTIES
De Commissie werkgelegenheid en sociale zaken verzoekt de ten principale bevoegde
Commissie vervoer en toerisme onderstaande suggesties in haar ontwerpresolutie op te
nemen:
1.
stelt vast dat de postdienstensector in de afgelopen jaren door de technologische
vooruitgang en de digitalisering ingrijpend veranderd is en dat de modernisering en de
diversifiëring van de postdiensten grote gevolgen heeft voor de werkgelegenheid;
2.
stelt vast dat het aantal deeltijdwerknemers, uitzendkrachten en schijnzelfstandigen is
gestegen en dat de ontwikkeling in het algemeen in de richting van flexibeler
arbeidscontracten gaat;
3.
stelt vast dat er bij de arbeidsvoorwaarden grote verschillen bestaan tussen de
aanbieders van universele diensten en concurrerende aanbieders van postdiensten;
4.
is verheugd over de rol van de sociale partners, die in vele lidstaten in samenwerking
met de aanbieders van universele diensten hebben geprobeerd de veranderingen in de
postdienstensector op sociaal aanvaardbare wijze op te vangen;
5.
wijst erop dat er inmiddels sprake is van oneerlijke concurrentie, die ten koste van de
werknemers gaat;
6.
wijst erop dat door de herstructureringen en nieuwe activiteiten in de
postdienstensector arbeidsplaatsen gecreëerd worden en dat de vaardigheden van de
werknemers moeten worden aangepast aan de nieuwe omstandigheden; wijst op het
belang van scholing, nascholing en omscholing;
7.
is verheugd over de werkzaamheden van het comité voor sociale dialoog in de
postdienstensector;
8.
dringt er bij de Commissie en de lidstaten op aan meer gegevens over het aantal
arbeidsplaatsen en de arbeidsvoorwaarden te verzamelen, om efficiënt te kunnen
reageren op ontwikkelingen en eventuele problemen;
9.
is verheugd dat voor universele diensten in de lidstaten in de regel collectieve
arbeidsovereenkomsten gelden; is van mening dat de sociale partners volgens de
nationale praktijk ook voor andere postdiensten moeten onderhandelen over
arbeidsovereenkomsten;
10.
dringt er bij de lidstaten op aan te garanderen dat voor alle werknemers in de
postdienstensector passende arbeidsvoorwaarden gelden;
