An Act to amend The Education Act, 1995
(Assented to July 3, 2002)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of
Saskatchewan, enacts as follows:
Short title
1 This Act may be cited as The Education Amendment Act, 2002.
S.S. 1995, c.E-0.2 amended
2 The Education Act, 1995 is amended in the manner set forth in this Act.
New section 4.1
3 The following section is added after section 4:
“Prince of Wales Scholarship Fund
4.1(1) In this section:
‘fiscal year’ means the fiscal year of the fund; (« exercice »)
‘fund’ means the Prince of Wales Scholarship Fund established pursuant
to this section. (« fonds »)
(2)
The Prince of Wales Scholarship Fund is established.
(3) The minister shall administer the fund in accordance with this Act and
the regulations.
(4)
The fund consists of:
(a) all moneys appropriated by the Legislature for the purposes of the
fund;
(b) all earnings on investments of the fund; and
(c) all other moneys received by the minister by way of grant, bequest,
donation or otherwise for the purposes of the fund.
(5) Subject to the terms of any trust pursuant to which money to be invested
is held by the minister, the minister may:
(a) invest any moneys in the fund in any security or class of securities
authorized for investment of moneys in the general revenue fund
pursuant to The Financial Administration Act, 1993; and
(b) dispose of any investment made pursuant to clause (a), subject to
the terms of the investment, in any manner, on any terms and in any
amount that the minister considers advisable.

Titre abrégé

2 La Loi de 1995 sur l’éducation est modifiée de la manière énoncée dans la
présente loi.
Nouvel article 4.1
3 L’article suivant est inséré après l’article 4:
« Fonds de bourses d’études Prince de Galles
4.1(1)
Les définitions qui suivent s’appliquent au présent article.
“exercice” L’exercice du fonds. (“fiscal year ”)
“fonds” Le Fonds de bourses d’études Prince de Galles créé en
application du présent article. (“fund ”)
(2) Est créé le Fonds de bourses d’études Prince de Galles.
(3) Le ministre administre le fonds conformément à la présente loi et
aux règlements.
(4) Le fonds est constitué des sommes suivantes :
a) toutes les sommes affectées par la Législature aux besoins du fonds;
b) tous les revenus provenant des placements du fonds;
c) toutes les autres sommes que reçoit le ministre, par voie notamment
de cession, de legs ou de donation, pour les besoins du fonds.
(5) Sous réserve des clauses d’une fiducie au titre de laquelle les sommes à
placer sont détenues par le ministre, celui-ci peut :
a) placer toutes sommes du fonds dans toute valeur mobilière ou toute
catégorie de valeurs mobilières dans laquelle la loi intitulée The Financial
Administration Act, 1993 autorise le placement d’argent du Trésor;
b) aliéner tout placement effectué en application de l’alinéa a), sous
réserve des conditions du placement, de la manière, selon les modalités
et au montant qu’il estime indiqués.

(6) Subject to the provisions of this Act, the regulations, and any orders that
may be made and any directives that may be issued by Treasury Board, the
minister may make disbursements from the fund for:
(a)
making payments by way of scholarships to pupils; and
(b)
paying the expenses of administering the fund.
(7) The minister may enter into any agreement with any person, government,
agency, organization, association, institution or body that the minister
considers advisable with respect to any matter concerning the administration
of the fund.
(8) When providing scholarships pursuant to the fund, the minister shall
consider the directions of the persons who have made gifts to the fund, but
the minister is not bound by those directions.
(9) The fiscal year of the fund is the period commencing on April 1 in one
year and ending on March 31 in the following year.
(10) The Provincial Auditor or any other auditor or firm of auditors that the
Lieutenant Governor in Council may appoint shall audit the accounts and
financial statements of the fund:
(a)
annually; and
(b) at any other times that the Lieutenant Governor in Council may
require.
(11) In each fiscal year, the department, in accordance with The Tabling of
Documents Act, 1991, shall prepare and submit to the minister:
(a) a report on the activities of the fund for the preceding fiscal
year; and
(b) a financial statement showing the business of the fund for the
preceding fiscal year, in any form that may be required by Treasury
Board.
(12) In accordance with The Tabling of Documents Act, 1991, the minister
shall lay before the Legislative Assembly each report and financial statement
received by the minister pursuant to subsection (11)”.
New section 285.1

The following section is added after section 285:
“Restructured school divisions
285.1 Notwithstanding any other provision of this Part, if, on or after the
coming into force of this section, a school division is disestablished and the
area of the disestablished school division is included in the area of another
school division, for the first year, or for the first and second years, following
the year in which the one school division was disestablished, the board of
education of the other school division may set:
(a) one tax rate for the year in the area of the disestablished school
division; and
(b) a different tax rate for the year in the balance of the area of the
school division”.

(6) Sous réserve tant des autres dispositions de la présente loi que des
règlements ainsi que de tous arrêtés que peut prendre et de toutes directives
que peut émettre le Conseil du Trésor, le ministre peut opérer des
décaissements sur le fonds aux fins suivantes:
a) effectuer des paiements sous forme de bourses d’études accordées à
des élèves;
b) payer les dépenses entraînées par l’administration du fonds.
(7) Le ministre peut conclure des ententes avec une personne, un
gouvernement, un organisme public, une organisation, une association, une
institution ou un organisme qu’il estime indiqué relativement à toute
question se rapportant à l’administration du fonds.
(8) Quand il attribue des bourses d’études dans le cadre du fonds, le ministre
tient compte des directives des personnes qui ont fait des dons au fonds, mais
il n’est pas lié par ces directives.
(9) L’exercice du fonds commence le 1er avril d’une année et se termine le 31
mars de l’année suivante.
(10) Le vérificateur provincial ou tout autre vérificateur ou cabinet de
vérificateurs que nomme le lieutenant-gouverneur en conseil vérifie les
comptes et les états financiers du fonds:
a) chaque année;
b) à tous autres moments qu’exige le lieutenant-gouverneur en conseil.
(11) Au cours de chaque exercice, le ministère, en conformité avec la loi
intitulée The Tabling of Documents Act, 1991, établit puis remet au ministre :
a) un rapport sur les activités du fonds au cours de l’exercice précédent;
b) un état financier rendant compte des activités du fonds au cours de
l’exercice précédent, en la forme qu’exige le Conseil du Trésor.
(12) En conformité avec la loi intitulée The Tabling of Documents Act, 1991,
le ministre dépose devant l’Assemblée législative chaque rapport et chaque
état financier qu’il reçoit en application du paragraphe (11) ».
Nouvel article 285.1
4 L’article qui suit est inséré après l’article 285 :
« Divisions scolaires restructurées
285.1 Par dérogation aux autres dispositions de la présente partie, si, à
compter de l’entrée en vigueur du présent article, une division scolaire est
dissoute et le secteur de la division scolaire dissoute est intégrée dans le
secteur d’une autre division scolaire, pendant la première année, ou pendant
la première et la deuxième années, après l’année au cours de laquelle la
division scolaire en question a été dissoute, la commission scolaire de l’autre
division scolaire peut fixer:
a) un seul taux d’imposition pour l’année à l’égard du secteur de la
division scolaire dissoute;
b) un taux d’imposition différent pour l’année à l’égard du reste du
secteur de la division scolaire ».

Section 313 amended

Subsection 313(2) is repealed and the following substituted:
“(2) The minister shall determine the recognized local expenditure for the
conseil scolaire and, in so doing, shall take into consideration the number of
pupils enrolled in the fransaskois schools in the division scolaire francophone”.
Section 370 amended

The following clause is added after clause 370(c):
“(c.01) for the purposes of the Prince of Wales Scholarship Fund established
pursuant to section 4.1:
(i) respecting the payment of scholarships from the fund, including the
number of scholarships that the minister may make from the fund each
year and the amount of the scholarships;
(ii) respecting the administrative expenses that may be deducted from
the fund”.
Coming into force

(2)
Subject to subsection (2), this Act comes into force on assent.
Sections 3 and 6 of this Act come into force on proclamation.

Modification de l’article 313
5 Le paragraphe 313(2) est abrogé et remplacé par ce qui suit:
« (2) Le ministre détermine les dépenses locales reconnues du conseil
scolaire et, à cette occasion, est tenu de prendre en considération le nombre
d’élèves inscrits dans les écoles fransaskoises de la division scolaire
francophone ».
Modification de l’article 370
6 L’alinéa suivant est inséré après l’alinéa 370 c):
« (c.01) aux fins du Fonds de bourses d’études Prince de Galles créé en
application de l’article 4.1:
(i) prévoir le paiement des bourses d’études sur le fonds, y compris le
nombre de bourses d’études que le ministre peut prélever sur le fonds
chaque année et leur montant,
(ii) prévoir les dépenses administratives qui peuvent être déduites du
fonds ».
Entrée en vigueur
7(1) Sous réserve du paragraphe (2), la présente loi entre en vigueur sur sanction.
(2) Les articles 3 et 6 de la présente loi entrent en vigueur sur proclamation.
