Pursuant to section 30 of The Oil and Gas Conservation Act, the separately owned interests within the drainage unit comprised of the following lands: Section 26, Township 37, Range 25, West of the Third Meridian in Saskatchewan; shall be pooled for the development and operation of the drainage unit for the Mannville Formation, in accordance with the following pooling plan effective on the date of this order. Dated at Regina, Saskatchewan, June 9, 2002. Larry Spannier, Deputy Minister, Saskatchewan Industry and Resources. Pooling Plan 1 Profico Energy Management Ltd. shall be the Operator of the gas well (hereinafter referred to as “the well”) in the drainage unit and shall conduct the operation thereof in a reasonable, prudent and workmanlike manner for and on behalf of all owners in the drainage unit and shall have exclusive control of all drilling (which term shall hereafter be deemed to include drilling, testing, abandoning or completing), equipping for production and production operations conducted thereon. 706 THE SASKATCHEWAN GAZETTE, JUNE 21, 2002 2 Each separately owned interest in the drainage unit shall be assigned a tract factor equal to the fraction that such separately owned interest is of the total of the entire interests in the drainage unit and the costs of drilling, equipping and operating the well and all production from the well, shall be allocated to the separately owned interests in accordance with their respective tract factors. The production allocated to each separately owned interest shall be subject to all royalties and taxes burdening any lease or other contract pursuant to which such interest is held. All such royalties and taxes shall be paid and borne solely by the holder of such interest and shall not affect production from the pooled area allocated to others. 3 Every lessee and every owner of unleased oil and gas rights in the drainage unit shall pay his share of the costs of drilling, equipping and operating the well in the manner set forth in Exhibits “A” and “B”. 4 In the event that any lessee or owner referred to in clause 3 fails to pay its share of the costs of drilling the well (hereinafter referred to as a “non-participant”), the Operator shall advance such non-participant’s share of such costs and shall be entitled to recover the non-participant’s share of such costs and a surcharge equal to fifty per cent of such costs out of the proceeds remaining from the sale of production attributable to the non-participant’s interest after deducting the non-participant’s share of the costs of equipping the well for production, the costs of operating the well and all royalties and taxes which otherwise would have been borne by the non-participant with respect to the said production. 5 Within thirty days after the effective date, all owners in the drainage unit, whether lessees of or owners of unleased oil and gas rights, shall submit to the Operator proof of title to their respective interests in the drainage unit. 6 In the event of any dispute as to ownership of any interest in the drainage unit or failure to establish such ownership to the satisfaction of the Operator, the Operator shall be entitled to sell the production allocated to such interest and impound in a trust account the proceeds of such sale after deducting the proportionate part of the cost of drilling, equipping and operating the well in addition to any royalties and/or taxes attributable to such interest until such time as the dispute is settled or ownership of the interest is established to the satisfaction of the Operator. 7 The Operator shall account to all working interest owners in the drainage unit for the costs and expenses incurred in drilling, equipping and operating the well, and shall follow the accounting procedure as recommended by the Petroleum Accountants Society of Canada (1996 Accounting Procedure) which is attached hereto and marked as Exhibit “A” and shall incur only those direct and indirect costs resulting from prudent and workmanlike operation and management of the drainage unit. 8 The following insertion shall, for the purposes of this pooling order, be deemed to be made in the respective blank spaces in the accounting procedure mentioned in clause 7: (a) in the title, insert the letter “A” in the blank space following the word “Exhibit”; (b) in the blank space following the words “Attached to and a part of”, insert the words “the Minister’s Order under The Oil and Gas Conservation Act pooling the separately owned interests in Section 26, in Township 37, in Range 25, West of the Third Meridian in Saskatchewan”; (c) in section 105, insert the word “ten” in the blank space after the words “proportionate share of” and the number “10” in the blank space after the word “per cent”; (d) in section 110, leave the blank space after the word “Clause” blank and insert the word and number “one (1)” in the blank spaces after the words “in writing from” and the word “sixty” in the blank space after the words “Joint Property totalling” and the number “60” in the blank space after the word “per cent”; I La partie 6 est modifiée par insertion, après la règle 75, de la nouvelle section suivante: XI: RECOURS COLLECTIFS Définitions 76 Les définitions qui suivent s’appliquent à la présente section. «juge désigné» Le juge désigné par le juge en chef pour entendre la demande de certification d’une action comme recours collectif et de nomination d’un représentant des demandeurs. (“designated judge”) «Loi» La Loi sur les recours collectifs. (“Act”) Champ d’application 77(1) Les règles de la présente section s’appliquent aux actions intentées et aux requêtes présentées sous le régime de la Loi. (2) Sauf disposition contraire de la Loi ou des autres règles de la présente section, la procédure et la pratique générales du tribunal s’appliquent aux actions intentées et aux requêtes présentées sous le régime de la Loi. Intitulé de la cause 78(1) L’intitulé de la cause doit contenir, immédiatement après les noms des parties, les mots «Action intentée sous le régime de la Loi sur les recours collectifs», si, selon le cas : a) l’intention est de demander une ordonnance de certification sous le régime de la Loi au début de l’action; b) dans tous les autres cas, une ordonnance de certification est accordée par la suite à l’égard de l’action. (2) En cas de rejet de la demande de certification ou d’annulation de l’ordonnance de certification, les mots «Action intentée sous le régime de la Loi sur les recours collectifs» sont supprimés de l’intitulé de la cause. Demande présentée au juge en chef 79 La demande de nomination d’un juge désigné adressée au juge en chef peut être faite ex parte et doit être présentée : a) dans les 30 jours de la plus tardive des dates suivantes : 716 THE SASKATCHEWAN GAZETTE, JUNE 21, 2002 (i) la date de remise de l’exposé de la défense, (ii) la date d’expiration du délai prescrit pour la remise de l’exposé de la défense sans que celui-ci n’ait été remis; b) à tout autre moment, avec l’autorisation du tribunal. Conférences 80(1) À tout moment après sa désignation, le juge désigné peut, de sa propre initiative, ordonner la tenue d’une conférence relativement à la conduite de l’action, y compris la demande de certification. (2) Les règles qui s’appliquent aux conférences préparatoires au procès ne s’appliquent pas à la conférence prévue à la présente règle, sauf ordonnance contraire du juge désigné. Demande présentée par le défendeur 81(1) Si le défendeur demande une ordonnance certifiant qu’une action est un recours collectif sous le régime de l’article 5 de la Loi : a) il demande au juge en chef du tribunal de désigner un juge pour entendre la demande; b) le juge désigné ordonne la tenue d’une conférence relativement à la conduite de l’action. (2) Le tribunal qui certifie que plusieurs actions sont des recours collectifs en vertu de l’article 5 de la Loi peut : a) ordonner la jonction, la radiation ou la substitution des parties; b) ordonner la modification des plaidoiries; c) rendre toute autre ordonnance qu’il estime indiquée. Demande de certification 82(1) L’avis de motion en vue de la certification présenté sous le régime de l’alinéa 4(2)b) ou de l’article 5 de la Loi est établi selon la formule 5D. (2) La demande de certification présentée sous le régime de l’article 4 de la Loi doit être appuyée d’un affidavit du représentant des demandeurs proposé : a) confirmant son acceptation d’être nommé représentant des demandeurs; b) indiquant le fondement de sa demande personnelle, le cas échéant, et les motifs qui l’amènent à croire qu’il existe des questions communes aux autres membres du groupe; c) énonçant des critères objectifs pour déterminer qui sont les membres du groupe proposé et, au mieux de sa connaissance, le nombre de membres du groupe proposé; d) donnant suffisamment de renseignements pour établir qu’il représenterait de façon équitable et appropriée les intérêts du groupe et qu’il est au fait des responsabilités à assumer; e) produisant un plan pour le recours collectif qui propose une méthode efficace : (i) de faire avancer le recours au nom du groupe, (ii) d’en aviser les membres du groupe; f) donnant suffisamment de renseignements pour établir qu’il n’a pas de conflit d’intérêts avec d’autres membres du groupe au sujet des questions communes au groupe. (3) La demande de certification présentée sous le régime de l’article 5 de la Loi est appuyée d’un affidavit du défendeur qui présente la demande énonçant : a) le motif qui l’amène à croire qu’il existe des questions communes aux membres du groupe proposé; b) des critères objectifs pour déterminer qui sont les membres du groupe proposé; c) au mieux de sa connaissance, le nombre de membres du groupe proposé. (4) L’avis de motion en vue de la certification et les documents à l’appui doivent être déposés et copie signifiée à toutes les parties à l’action. (5) Sauf ordonnance contraire, il doit s’écouler un délai d’au moins 14 jours entre : a) la signification de l’avis de motion en vue de la certification et les documents à l’appui; b) la date fixée pour l’audience. (6) Sauf ordonnance contraire, la partie qui s’oppose à la demande de certification doit : a) déposer un affidavit en réponse; b) signifier copie de l’affidavit à toutes les parties à l’action au moins 7 jours avant la date fixée pour l’audience. (7) La partie qui dépose un affidavit en vertu du paragraphe (6) doit indiquer, au mieux de sa connaissance, le nombre de membres du groupe proposé. Modification des plaidoiries 83 Après qu’une ordonnance de certification a été rendue, une partie ne peut modifier les plaidoiries qu’elle a déposées qu’avec l’autorisation du tribunal. Enquête préalable 84(1) Lorsqu’un membre du groupe est interrogé au préalable sous le régime du paragraphe 19(2) de la Loi : a) la règle 222A ne s’applique pas à lui; b) sauf ordonnance contraire, la preuve qu’il produit ne peut être présentée au procès sur les questions communes. (2) Le tribunal peut : a) exiger que les parties proposent quels membres du groupe devraient être interrogés au préalable en vertu du paragraphe 19(2) de la Loi; b) limiter l’objet et la portée de l’interrogatoire préalable d’un membre du groupe; c) déterminer l’utilisation qui peut être faite de la preuve obtenue à l’interrogatoire préalable d’un membre du groupe. Avis 85(1) Lorsque l’avis donné aux membres du groupe contient le résumé d’une entente relative aux honoraires et aux débours, avis que l’entente n’est exécutoire qu’avec l’approbation du tribunal conformément à l’article 41 doit aussi être donné. (2) En cas de dépôt d’une motion en vue d’un règlement ou d’approbation d’un règlement, sauf ordonnance contraire, le représentant des demandeurs doit en donner avis aux membres du groupe conformément aux paragraphes 21(3) à (5) de la Loi. (3) L’avis donné conformément à l’article 23 de la Loi peut : a) indiquer que des questions communes ont été définies; b) énoncer les questions communes qui ont été définies et les expliquer : (i) indiquer que certains membres du groupe ou du sousgroupe pourraient avoir droit à des mesures de redressement individuelles, (ii) décrire les mesures à prendre pour formuler une demande individuelle, (iii) indiquer que si un membre du groupe ou du sousgroupe omet de prendre ces mesures, il perdra le droit de faire valoir sa demande individuelle, sauf avec l’autorisation du tribunal; d) donner une adresse à laquelle les membres du groupe ou du sous-groupe peuvent diriger toutes questions relatives à l’instance; e) donner tous autres renseignements que le tribunal estime indiqués. (4) Le tribunal peut ordonner que l’avis soit donné selon tout mode approprié, conformément à l’alinéa 21(4)e) de la Loi, notamment par la création et le tenue d’un site internet. (5) Dans les cas où la Loi ou les présentes règles exigent qu’avis soit donné aux membres du groupe, cet avis doit être donné aux autres parties intéressées, notamment aux avocats d’un sous-groupe, conformément aux directives du tribunal. Ententes relatives au honoraires et aux débours 86(1) La demande présentée en vue de l’approbation d’une entente relative aux honoraires et aux débours doit être présentée, selon le cas : a) après l’obtention d’un jugement sur les questions communes; b) après l’approbation d’un règlement, d’un désistement ou d’un abandon du recours collectif. THE SASKATCHEWAN GAZETTE, JUNE 21, 2002 717 (2) La demande visée au paragraphe (1) : a) est présentée au juge qui a présidé l’instruction des questions communes, ou qui a approuvé le règlement, le désistement ou l’abandon, selon le cas; b) est présentée moyennant l’avis aux membres du groupe que le tribunal estime indiqué. (3) Sur demande présentée en vertu du paragraphe (1), le tribunal peut modifier les modalités de l’entente, s’il estime qu’elle ne devrait pas être respectée. II Les alinéas 477(1)a) et b) sont abrogés et remplacés par ce qui suit: a) aux instances en matière familiale qui ne sont pas des actions relatives aux biens familiaux dans lesquelles le seul redressement sollicité est la répartition des biens familiaux; b) aux actions intentées sous le régime de la loi intitulée The Builders’ Lien Act; c) aux recours collectifs.
