Engl. of ratification deposited on In accordance with Article 40 and Article 2 of the Convention, the Republic of Turkey declares that it requires that the offences be commited by infringing security measures, with the intention of obtaining computer data or other dishonest intent, or in relation to a computer system that is connected to another computer system. In accordance with Article 40 and Article 7 of the Convention, the Republic of Turkey declares that the offence set forth in Article 7 regarding computer-related forgery requires an intent to defraud or similar dishonest intent under Turkish Law. In accordance with Article 42 and Article 14, paragraph 3(b), of the Convention, the Repubic of Turkey reserves the right not to apply the measures referred in Article 20 and Article 21 to communications being transmitted within a computer system if the system is being operated for the benefit of a closed groupe of users and does not employ public communications networks and is not connected with any other public or private computer system. In accordance with Article 42 and Article 22 of the Convention, the Repubic of Turkey reserves the right to establish jurisdiction within the scope of Article 11 and 13 of the Turkish Criminal Law when the offence is committed by a Turkish national outside its sovereign territory. In accordance with Article 42 and Article 29, paragraph 4, of the Convention, the Republic of Turkey reserves the right to decline the request for preservation of data under this article in cases where it has reasons to believe that at the time of the disclosure of stored computer data the condition of dual criminality cannot be fulfilled. In accordance with Article 24, paragraph 7(a), of the Convention, the Republic of Turkey designates the Ministry of Justice as the authority responsible for making or receiving requests for extradition or provisional arrest, in the absence of an extradition treaty. In accordance with Article 27, paragraph 2(c), of the Convention, the Republic of Turkey designates the Ministry of Justice as the central authority responsible for sending and answering requests for mutual assistance, the execution of such requests or their transmission to the authorities competent for their execution. ../.. –2– In accordance with Article 35, paragraph 1, of the Convention, the Republic of Turkey designates as point of contact available on a twenty-four hour, seven-days-a-week basis: Turkish National Police Department of Cybercrime Kιzιlιrmak Mah. Conformément à l’article 40 et à l’article 7 de la Convention, la République de Turquie déclare que l’infraction prévue à l’article 7 en ce qui concerne la falsification informatique nécessite une intention frauduleuse ou une intention délictueuse similaire en vertu de la loi turque. Conformément à l’article 42 et à l’article 14, paragraphe 3(b), de la Convention, la République de Turquie se réserve le droit de ne pas appliquer les mesures visées aux articles 20 et 21 aux communications transmises dans un système informatique si le système est mis en œuvre pour le bénéfice d’un groupe d’utilisateurs fermé et n’emploie pas les réseaux publics de télécommunication et n’est pas connecté à un autre système informatique, qu’il soit public ou privé. Conformément à l’article 42 et à l’article 22 de la Convention, la République de Turquie se réserve le droit d’établir sa compétence dans le cadre des articles 11 et 13 de la loi pénale turque lorsque l’infraction est commise par un ressortissant turc en dehors de son territoire souverain. Conformément à l’article 42 et à l’article 29, paragraphe 4, de la Convention, la République de Turquie se réserve le droit de refuser la demande de conservation au titre de cet article dans le cas où elle a des raisons de penser que, au moment de la divulgation de données informatiques stockées, la condition de double incrimination ne pourra pas être remplie. Conformément à l’article 24, paragraphe 7(a), de la Convention, la République de Turquie désigne le Ministère de la Justice en tant qu’autorité responsable de l’envoi ou de la réception d’une demande d’extradition ou d’arrestation provisoire, en l’absence de traité d’extradition. Conformément à l’article 27, paragraphe 2(c), de la Convention, la République de Turquie désigne le Ministère de la Justice en tant qu’autorité centrale chargée d'envoyer les demandes d'entraide ou d'y répondre, de les exécuter ou de les transmettre aux autorités compétentes pour leur exécution. Conformément à l’article 35, paragraphe 1, de la Convention, la République de Turquie désigne comme point de contact joignable vingt-quatre heures sur vingt-quatre, sept jours sur sept : Police Nationale Turque Département de Cybercriminalité Kιzιlιrmak Mah.
