Fawcett La Communauté européenne a développé une corps de règles relatives à la responsabilité du fait des produits qui n’a pas d’équivalent dans le monde. Le droit européen de la responsabilité du fait des produits de consommation est l’objet du cours de J.J. Fawcett, professeur à l’Université de Leicester. L’auteur présente tout d’abord le droit matériel communautaire et la signification de ce droit matériel pour le droit international privé. Le Professeur Fawcett s’intéresse ensuite aux problèmes de compétence juridictionnelle en la matière et aux solutions possibles, au forum shopping, ainsi qu’aux questions de conflits de lois en matière de responsabilité non contractuelle. Products Liability in Private International Law: A European Perspective: J.J. Fawcett The European Community has developed a set of rules relating to products liability that is unique in the world. The European consumer product liability law is the object of this course by J.J. Fawcett, Professor at the University of Leicester. The author first of all presents the substantive law background in Europe and its significance for private international law. Professor Fawcett then pays attention to problems of jurisdictional competence and possible solutions in this matter and to forum shopping, before looking into the question of conflicting laws with regard to noncontractual liability. Le Statut personnel dans le Droit international: des Pays africains au sud du Sahara: Conceptions et Solutions des Conflits de Lois: Le poids de la Tradition négro-africaine personnaliste: Abd-El-Kader Boye Abd-El-Kader Boye, professeur à l’Université Cheikh Anta Diop de Dakar, souligne en introduction de son cours que le moment est venu de se poser, à propos du statut personnel et des conflits de lois, certaines questions dont les réponses peuvent préfigurer ce que seront dans le futur les contours d’un apport africain au droit international privé : quelle conception se font ces États du statut personnel? Quelles réponses ont été apportées ou seraient susceptibles d’être apportées aux problèmes soulevés par les relations privées internationales dans ce domaine Pour répondre à ces questions, le Professeur Boye présente tout d’abord les repères historiques de l’évolution du droit des conflits en Afrique noire. Il expose ensuite le poids de la tradition négro-africaine personnaliste dans les solutions des conflits internationaux de lois sur le statut personnel. Il présente enfin des solutions qui constituent des entorses à la tradition négroafricaine personnaliste. Personal Status in International Law: in African Countries in the South of the Sahara: Notions and Solutions in Conflicts of Laws: The Influence of the Black-African Personalistic Tradition: Abd-El-Kader Boye Abd-El-Kader Boye, Professor at the University Sheik Anta Diop of Dakar, underlines in the introduction to his course that the moment has come to ask certain questions with respect to personal status and conflicts of laws. Answers to questions such as "How do African states perceive personal status?" could well be the precursors of a future African contribution to private international law. What solutions have been applied or are likely to be applied to the problems raised by the international private relationships in this area? To reply to these questions, Professor Boye first of all presents some landmarks in the history of the evolution of the conflicts of laws in Black Africa. He then explains the influence of the Black-African personalistic tradition on solutions to international conflict of laws concerning personal status. Finally he proposes solutions that constitute encroachments upon the BlackAfrican personalistic tradition.
