1 RÈGLEMENT DE SÉCURITÉ PUBLIQUE NUMÉRO RM 410-A CONCERNANT LA GARDE DE CHIENS– SÛRÉTÉ DU QUÉBEC BY LAW ON PUBLIC SAFETY NUMBER ON RM 410-A CONCERNING THE CUSTODY OF DOGS - SÛRÉTÉ DU QUÉBEC ATTENDU que la Sûreté du Québec, dans le cadre d’une entente relative à la fourniture de services de police sur le territoire de la M.R.C. d’Argenteuil, est autorisée à voir à l’application, en tout ou en partie, de la réglementation municipale; WHEREAS within the framework of an agreement relating to the supply of police services on the territory of the M.R.C. d’Argenteuil, the Sûreté du Québec will be authorised to oversee the application, in total or in part, of municipal regulations; ATTENDU que le conseil désire réglementer la chiens sur le territoire de la municipalité ; garde de WHEREAS the Council wishes to regulate the control of dogs on the territory of the Municipality; ATTENDU que le conseil désire interdire les chiens errants, nuisibles ou sans gardien et en autoriser, si besoin est, la mise à l’enclos public et la vente, de même que l’élimination de manière sommaire ; WHEREAS the Council wishes to prohibit stray dogs, harmful or vicious dogs or dogs without guardians, and to authorize if necessary, to place them in an enclosure or to proceed with the sale or elimination of such dogs; ATTENDU qu’avis de motion du présent règlement a été donné au préalable le 7 juin 2010; WHEREAS notice of motion of the present by-law was given at the regular sitting of June 7th 2010; EN CONSÉQUENCE, il est proposé par madame la conseillère Joan Field, appuyé par madame la conseillère Randy Watson et résolu unanimement; THEREFORE, it is moved by councillor Joan Field, seconded by councillor Randy Watson and resolved unanimously; QUE le présent règlement soit adopté et qu’il décrète ce qui suit : statue et THAT the present by-law be adopted and to legislate and enact as follows: ARTICLE 1 Le préambule ainsi que les annexes font partie intégrante du présent règlement. ARTICLE 1 The preamble is an integral part of the present by-law. ARTICLE 2 Le présent règlement abroge le règlement numéro 410 et ses amendements. ARTICLE 2 The present by-law rescinds by-law no. 410 and its amendments 2 ARTICLE 3 Le Conseil municipal déclare avoir adopté ce règlement parti par partie, article par article, alinéa par alinéa, de sorte que si l'une quelconque de ces parties devait être déclarée nulle par un tribunal compétent, les autres parties du règlement continuent de s'appliquer. ARTICLE 3 The Municipal Council declares that it has adopted this bylaw, section by section, article by article, paragraph by paragraph, so that if any one of these sections should be declared null by a competent court of law, the other sections of the by-law continue to apply. ARTICLE 4 - Définitions Chaque fois qu'ils sont employés dans ce règlement, les expressions et mots suivants signifient: ARTICLE 4 – Definitions For the purposes of the present by-law, the following words and expressions mean: Autorité compétente : Un agent de la paix, un contrôleur, un représentant de la Sûreté du Québec, ou toute autre personne nommée par le conseil. Competent Authority: A peace officer, controller, Sûreté du Québec representative or all other persons named by the Council. Chien guide : Un chien dressé pour pallier un handicap visuel ou tout autre handicap physique. Guide dog: A dog trained to aid the visually handicapped or all other physically handicapped persons. Contrôleur : La ou les personnes physiques ou morales, sociétés ou organismes que le conseil de la municipalité a, par résolution, chargé d'appliquer la totalité ou partie du présent règlement. Controller: The person(s), entities, companies or organizations that the Council has mandated to apply part or all of this ByLaw. Dépendance : Un bâtiment accessoire à une unité d'occupation ou un terrain sur lequel est situé l'unité d'occupation, ou qui y est contigu. Outbuildings: An accessory building to a residence or land which is located on the unit of occupation or which is contiguous. 3 Gardien : Est réputé gardien, le propriétaire d'un chien ou une personne qui donne refuge à un animal, ou le nourrit, ou l'accompagne, ou qui agit comme si elle en était le maître, ou une personne qui fait la demande de licence tel que prévu au présent règlement. Est aussi réputé gardien, le propriétaire, l'occupant ou le locataire de l'unité d'occupation où l’animal vit. Guardian: The guardian is deemed the owner of a dog or a person who gives shelter to an animal, feeds it, accompanies it or who acts as if he were the master, or a person applying for a licence provided for in this By-Law. Also deemed as guardian, the owner, the occupant or the tenant of the residence where the animal lives. Parc : Les parcs situés sur le territoire de la municipalité et qui sont sous sa juridiction et comprend tous les espaces publics, gazonnés ou non, où le public a accès à des fins de repos ou de détente, de jeu ou de sport ou pour toute autre fin similaire. Park Parks situated on the territory of the municipality and under its jurisdiction and encompasses all public areas, whether there is grass or not, where the public has access for rest or relaxation, sports or play for any other similar purpose. Personne : Désigne autant les personnes physiques que les personnes morales. Person: Refers to all persons or legal entities. Terrain de jeux: La partie d’un terrain, accessible au public, occupée par des équipements destinés à l’amusement des enfants, tels que balançoire, glissoire, trapèze, carré de sable, piscine, pataugeoire ou patinoire. Playground: The portion of land, accessible to the public, occupied by equipment for the amusement of children, such as swing, slide, trapeze, sandbox, swimming pool, wading pool or skating rink. Unité d'occupation: Une ou plusieurs pièces situées utilisées principalement à des commerciales ou industrielles. dans un immeuble et fins résidentielles, Unit of occupation: One or more rooms within a building used primarily for residential, commercial or industrial use 4 ARTICLE 5 - Aire de retenue Un chien doit être porté ou conduit par son gardien au moyen d'une laisse dont la longueur ne peut excéder deux (2) mètres, sauf lorsque le chien se trouve dans les limites de l'unité d'occupation de son propriétaire ou ses dépendances. L’accès à l’entrée principale du bâtiment ne doit en aucun cas être obstrué par la présence d’un chien. Il est défendu de laisser en tout temps un animal errer dans une rue, ruelle, place publique ou sur une propriété privée autre que l'unité d'occupation et les dépendances du gardien ou propriétaire de l'animal. ARTICLE 5 - Restraining Area A dog must be carried or led by his keeper by a leash whose length does not exceed two (2) metres, except when the dog is within the residence of its owner or its outbuildings. Access to the main entrance of the building shall in no way be obstructed by the presence of a dog. It is forbidden to leave at any time an animal wandering through a street, alley, public place or on private property other than the residence and outbuildings of its guardian or pet owner ARTICLE 6 - Soins a) Le gardien a l’obligation de fournir à l’animal sous sa garde les aliments, l’eau, l’abri ainsi que les soins nécessaires et appropriés à son espèce et à son âge et ne doit, en aucun cas, l’abandonner en détresse. b) Le gardien doit tenir en bon état sanitaire l’endroit où est gardé un animal. c) Il est défendu pour quiconque de faire des cruautés aux animaux, les maltraiter, les molester, les harceler ou les provoquer. d) Aucune personne ne peut organiser ou assister à une ou des batailles entre chiens ou entre animaux, à titre de parieur ou simple spectateur. ARTICLE 6 - Care a) The guardian has an obligation to provide the animal in its custody with food, water, shelter and care necessary and appropriate to their species and age and must not, in any case, leave the animal in distress. b) The custodian shall keep the area where an animal is kept in good sanitary condition. c) It shall be unlawful for any person to be cruel, to mistreat, to molest, to harass or to provoke animals. d) No person shall organize or attend one or several fights between animals or between dogs, as a bettor or spectator. ARTICLE 7 - Nuisances causées par les chiens Les faits, circonstances, actes et gestes suivants sont des nuisances et sont, à ce titre, interdits et toute personne elle-même auteur d’une telle nuisance ou dont l’animal dont elle est gardien agit de façon à constituer une telle nuisance, contrevient au présent règlement ; a) Le fait pour un animal d’aboyer, de hurler, de crier, de chanter ou d’émettre un autre son de façon à troubler la paix ou d’être un ennui pour le voisinage ; b) Le fait pour un animal de blesser, de tenter de blesser une personne ou un autre animal ou d’endommager, de salir ou de souiller la propriété publique ou privée ; 5 c) La présence d’un animal sans gardien hors des limites de la propriété de celui-ci ; d) La présence d’un animal non tenu en laisse par son gardien, hors de la propriété de celui-ci ; e) L’omission pour le gardien d’un chien, sauf d’un chienguide, d’enlever et de nettoyer immédiatement par tous les moyens appropriés les matières fécales de son animal, sur une propriété publique ou privée. f) L’introduction ou la garde d’un animal excepté un chienguide, dans un restaurant ou dans un autre endroit où l’on sert au public des repas ou des consommations, ainsi que dans un établissement où l’on vend des produits alimentaires. g) Le fait, pour un chien, de se trouver sur une place publique où une enseigne indique que la présence du chien est interdite. Cette disposition ne s’applique pas au chien guide. h) Le fait, pour un propriétaire, de laisser un animal seul sans la présence d’un gardien ou des soins appropriés pour une période de plus de 24 heures. ARTICLE 7 - Nuisance caused by dogs The facts, circumstances, actions and gestures following are nuisances and are, as such, prohibited and any person who is the custodian of an animal who acts in such a way constitutes such a nuisance and contravenes this by-law; a) The action of an animal to bark, howl, shout, sing or make another sound in a manner as to disturb the peace or be a nuisance to the neighbourhood; b) The action of an animal to injure, attempt to injure a person or another animal to damage, dirty or soil public or private property; c) The presence of an animal without a guardian outside the boundaries of his property thereof; d) The presence of an animal not on a leash with his guardian, outside of his property; e) The failure of the guardian of a dog, except a guide dog, to remove and clean up immediately by all appropriate means his animal’s feces on public or private property. f) The presence of an animal, except a guide dog, in a restaurant or other place where meals or drinks are served to the public, as well as an establishment where food is sold. g) The presence of a dog is in a public place where a sign indicates that the presence of dogs is prohibited. This provision does not apply to guide dogs. h) The fact that an owner leaves a pet alone without appropriate care or a guardian for a period of more than 24 hours. ARTICLE 8 - Animal dangereux Il est interdit de garder un chien qui met en danger la sécurité des citoyens, qu’il s’agisse d’un chien enragé ou autrement dangereux. Lorsqu’il paraît à l’autorité compétente que la sécurité des citoyens est, ou peut être, en danger à cause de la présence dans la municipalité, d’un animal enragé ou autrement dangereux, elle peut donner un avis enjoignant à toute personne qui est gardien de cet animal, de l’enfermer ou de le museler de manière à ce qu’il soit incapable de mordre et ce, pour la période mentionnée dans l’avis. 6 Si un chien mord ou tente de mordre une personne ou un autre animal ou donne des signes d’être vicieux ou dangereux, le contrôleur ou le fonctionnaire désigné peut, soit ordonner à son gardien de le museler dans un délai qu’il fixe, soit ordonner à son gardien de fournir dans un délai de cinq (5) jours d’un avis écrit à cet effet, un certificat signé par un médecin vétérinaire attestant de la bonne santé de ce chien. ARTICLE 8 - Dangerous Animal It is forbidden to keep a dog that endangers the safety of citizens, whether it is a rabid dog or otherwise dangerous. When it appears that the security of citizens is or may be in danger because of the presence in the municipality of a rabid animal or otherwise dangerous animal the competent authority may give notice requiring any person who is custodian of the animal, to confine or muzzle it so it is unable to bite and this, for the period specified in the notice. If a dog bites or attempts to bite a person or another animal or shows signs of being vicious or dangerous, the controller or the designated officer may either order the custodian to confine or muzzle the animal in a specified time limit or order the guardian to provide within five (5) days written notice, a certificate signed by a veterinarian attesting to the good health of this dog. ARTICLE 9 - Capture et disposition L’autorité compétente peut s’emparer de tout animal non muselé, errant, dangereux ou jugé dangereux, ou constituant une nuisance, le garder dans un enclos public ou dans un autre endroit, ou le confier à une personne désignée par elle; Il est défendu d’utiliser ou de permettre que soit utilisés des pièges ou poisons à l’extérieur d’un bâtiment pour la capture ou l’élimination d’animaux à l’exception de la cage trappe. En cas d’urgence, l’autorité compétente est autorisée, suivant la loi, à abattre ou à faire abattre, immédiatement un animal errant jugé vicieux ou dangereux, sans souci de conformité aux paragraphes précédents. Ni la municipalité, ni le service de contrôle des animaux, ni le contrôleur ne peuvent être tenus responsables des dommages ou blessures causés à un chien à la suite de sa capture et de sa mise en fourrière. L’autorité compétente qui, en vertu du présent règlement, abat un chien ne peut être tenue responsable du fait d’un tel acte. 7 ARTICLE 9 - Capture and disposal The competent authority may take possession of any animal not muzzled, wandering, dangerous or considered dangerous or a nuisance, keep it in a pen or other public place, or entrust it to a designated person; It is forbidden to use or permit the use of traps or poisons outside a building in order to capture or eliminate an animal with the exception of a cage trap. In an emergency, the competent authority is authorized by law, to shoot or have shot down immediately a stray, vicious or dangerous dog, regardless of compliance with the preceding paragraphs. Neither the municipality nor the service of animal control or the controller can be held responsible for damage or injury caused to a dog following his capture and impound. The competent authority whom, under this regulation who eliminates a dog cannot be held liable for such an act. DISPOSITIONS PÉNALES PENAL PROVISIONS ARTICLE 10 Le conseil autorise les agents de la paix et/ou l’inspecteur municipal et/ou toute autre personne désignée par le conseil à appliquer le présent règlement, à émettre les constats d’infractions (avis d’infractions ou billets d’infractions ou autres) et à entreprendre les procédures pénales suivantes : Toute personne qui contrevient à l’une ou l’autre des dispositions du présent règlement commet une infraction et est passible d’une amende, avec ou sans les frais ; Pour une première infraction, le montant de l’amende est fixé à cent dollars (100$) si le contrevenant est une personne physique et au double de ce montant si le contrevenant est une personne morale ; Pour une récidive, le montant de cette amende est le double de celui fixé pour une première infraction. Si l’infraction est continue, cette continuité constitue, jour par jour, une offense séparée et le contrevenant est passible de l’amende, avec ou sans les frais, pour chaque jour durant lequel l’infraction se continue. Dans tous les cas, les frais de la poursuite sont en sus. Les délais pour le paiement des amendes et des frais imposés en vertu du présent article, et les conséquences du défaut de payer lesdites amendes et les frais dans les délais prescrits, sont établis conformément au Code de procédure pénale du Québec (L.R.Q., c. C-25.1). L’autorité compétente peut utiliser tous les recours judiciaires, pénaux et/ou civils, qui s’imposent contre toute personne qui contrevient au présent règlement, de façon alternative ou cumulative le cas échéant. ARTICLE 10 The Council authorizes peace officers and / or the municipal inspector and /or any other person designated by the council to implement this by-law, to issue findings of offences (notices of offences or tickets or other offenses) and undertake criminal proceedings as follows: 8 ▀ Any person who contravenes to any provision of this regulation commits an offense and is liable to a fine, with or without fees; ▀ For a first offense, the fine shall be one hundred dollars ($ 100) if the offender is an individual and double that amount if the offender is a corporation; ▀ For a second offense, the amount of the fine is double the limit for a first offense; ▀ If the violation continues each day is a separate offense and the offender is liable to a fine, with or without costs, for each day during which the contravention continues; ▀ In all cases, the costs of prosecution are not included; ▀ The deadlines for the payment of fines and costs imposed under this section, and the consequences of failure to pay those fines and fees on time, are prepared in accordance with the Code of Criminal Procedure of Québec (RSQ, c. C-25.1). The competent authority may use all legal remedies, criminal and / or civil action against any person who contravenes these regulations either alternative or cumulative as appropriate. ARTICLE 11 - Entrée en vigueur Le présent règlement entrera en vigueur conformément à la loi. ARTICLE 11 - Effective date The present by-law comes into effect in accordance with the law.
