RCS Nanterre B 442 178 786, with its head office locatedat 43 rue Camille
Desmoulins, 92130 ISSY LES MOULINEAUX, France (ThereaUer « the Organiser»)
regularly organises contests (ThereaUer «Contests» on its website at: h[p://
www.virtualrega[a.com(ThereaUerthe«Website»).
The Contests are governed by this present set of rules (ThereaUer the «Common
Rules») that defines them. The Common Rules will be complemented by specific
terms for each Contest, in paracular, implementaaon, applicable dates and
premiums that will be described on the Contests’ Website area (ThereaUer the
«SpecificTerms»).
By excepaon, some Contests may be governed by specific rules. In that case, the
Organiser will refer to these specific rules on the Website’s area dedicated to the
Contestinquesaon.
TheseCommonrulesshallapplyasfrom6July2016,foranunlimitedperiod.
The player acknowledges that the present Common Rules govern the Contest he is
taking part in, unless otherwise specified Rules stated in a specific set of rules of
whichhewillbeinformed.
Ar8cle2:AcceptanceoftheCommonRules
The paracipaaon intheContestsimplies unrestrictedand uncondiaonalacceptance
ofthepresentCommonRules,asawhole,bytheplayer.
The Common Rules canbe viewed and downloaded on the Website. It can also be
addressed, freeof charge inMetropolitan France, to any person on wri[en request
tothefollowingaddress:

Postalfeeswillberefundedonsimplewri[enrequest,onthebasisofeconomyrate
inforceforslowdelivery-lessthan20gr-“le[er”.
Ar8cle3:Par8cipa8on
The paracipaaon in the Contests is free, with no obligaaon to buy. It is open to
individualsmeeangcumulaavelythefollowingcriteria:
• AnypersonhavingauseraccountontheWebsite.
• Any natural person residing in all the countries where the
paracipaaoninContestsislegal.
• For the Contests expressly opening paracipaaon to minors, this
paracipaaon is made under the responsibility and authorisaaon of the legal
guardianabletojusafyparentalauthority.TheOrganisermayasktheuserto
bring the legal guardian(s) authorisaaon. In the absence of authorisaaon’s
jusaficaaon, the Organiser may cancel the minor’s paracipaaon in the
Contest.
The paracipaaon in the Contests will take place on the Internet and the eventual
communicaaons will be done by e-mails: to be able to paracipate, the user must
haveane-mailaddressandanInternetaccess.
TheemployeesandrepresentaavesoftheOrganiser,itspartners,itsmoderatorsor
betatestersandsubcontractorsarenotallowedtotakepartintheContests.
Mayleadtocontest’sexclusionand/orparacipaaon’scancellaaon:
1. 1. Any unwillingnesstodisclose or provide supporangdocumentaaon asked by
the Organiser (idenaty, age, place of residence, payments regarding
chargeableopaons…)
2. 2. Any infringement of the rights of third paraes, paracularly in the online
community tools(defamaaon, messages contravening common decency,
plagiarism…);
3. 3. Any computer negligence or malicious act (virus, hacking, automated data
import or export into - or out of - the game) likely to affect the Contests’
smoothfuncaoningorpronetocausedamagestopersonsorgoodsandmore
paracularlyanya[empt,byanymeanwhatsoever,tomodifythecontestsor
theirresults;
4. 4. Ingeneral,anyinfringementoftheFrenchlawsand
regulaaons.
Any paracipaaon entering in the context of the precedent exclusions or made in
violaaon of the present Common Rules will be suscepable to cancelaaon of the
points earned in the Contests or, if andwhenappropriate, the cancelaaon of the
allocatedprizeswithoutopeninganyrightofcompensaaonfortheplayerinquesaon
andwithouttheorganiser'sliabilitybeingabletobeengaged.
Furthermore,anyparacipaaonenteringinthecontextoftheprecedentexclusionsor
made in violaaon of the present Common Rules can induce to the suspension or
cancellaaonoftheplayer’suseraccount.
The organiser reservesall itsright of any legal proceedings against players having
actedinviolaaonofthesepresentCommonRules.
Ar8cle4:Terms&Condi8ons
In order to take part in the Contests proposed by the Organiser, the player must
connecttotheWebsite’sareadedicatedtotheContestsandrespecttheprocedure
indicatedintheSpecificRules.
Theparacipaaonineachcontestwillbeopenduringalimitedperiodofamespecific
toeachcontest.
The player agrees to respect the Specific Rules that he/she will have accepted
beforehand.
The contests are virtual sailing races created and edited by the Organiser during
whichtheplayercompetesagainstothergamers.
TheracecoursewillbedescribedintheSpecificRules.
In case of course or race program change, the changes will be announced on the
WebsiteareadedicatedtoContestsandbyemail.
The purchased opaons are only valid for the Contest for which they have been
boughtandcannotinanycasebeusedbytheplayerforanotherContest.
Apilotboatwillstarteveryraceatthesameameastherealcompeators.
TheplayersenteringaContestaUeraracestartwillstarteitherfromtheofficial
race’sstarangplaceoratthepilotboat’sposiaon.

Thewinners’designaaonmodaliaeswillbestatedintheSpecificRules.
UnlessotherwisesapulatedintheSpecificRules,thelistofthewinnerswillbe
publishedontheWebsiteaUertheContests.
Ar8cle6:Awards&prizes
TheawardsofferedinthecontextoftheContests,theirnumberandnature,willbe
detailedforeachContestintheSpecificRules.

données que le gagnant aura transmises en paracipant au Concours pourront être

In the case where the prize should be awarded by a partner of the Organiser, the
data transmi[ed by the winner by taking part in the Contest may be forwarded to
thepartnerforhimtobeabletohandtheprizetotheplayer.
Ifthewinnerisaminor(whenthecontestisexpresslyopentominors),his/herprize
willbedeliveredtohis(her)legalguardian(s).
AcopyofIDmaybeaskedbytheOrganisertochecktheplayer’smajority.
Theprizes cannot be reimbursed for cashor in anyway exchanged nor arethey
transferable.Theycannotbesold.
Only one prize per person and household (samename and address) may be
awardedinthecontextoftheContests.
Inthecasewhereaplayerwouldwinseveralprizes,onlytheprizewiththehighest
valuewillbeawarded.
TheOrganiserreservesitsrighttosubsatutetheannouncedprizesbyprizesofequal
value.
Incaseofwinner’stravelimpossibilityforprizesimplyinghis/herphysicalpresence
or in case of impossibility to contact the winner as a result of incorrect contact
informaaonhewillhaveprovided,theprizemaybeawardedtoanotherplayer.
Inordertoreceivehis/herPrize,thewinnermust:
• Be reachable at the email address submi[ed in the Contest’s
registraaon.
• Have confirmed his/her user account by clicking on the confirmaaon
emailsentbytheOrganiser.
• Have completed all the registraaon requested fields of his/her user
account.
• Be reachable on the phone at the number indicated in the user
account.Theplayermustusetheplaceofresidencemenaonedontheuser
account for his/her prizes to be despatched to. The winner authorizes all
verificaaonsconcerninghis/heridenatyandplaceofresidence(Postaland/or
Internetaddress).

TheOrganisershouldnotbeheldliableforthedelays,losses,damages,lack
of visibility of stamps dueto postal services and occurring on delivering
theprizes.Theprizesnotclaimedorreturnedwithin30daysfollowingtheir
shippingwillbelostfortheuserandremainthepropertyoftheOrganiser.

The winners authorize in advance the Organizertouse theirpictures, surname,
firstname, age, postal or Internet addresses for any promoaonal and
adverasingacaonrelatedwiththecontestswithoutthisusagecouldgiverisetoany
consideraaonorremuneraaonotherthantheprizeawarded,andthisforamaximal
duraaonof2years.

The paracipaaon intheContests implies fullknowledge and acceptanceof
the Internet’s characterisacs, the lack of protecaonofsome data against
possiblemisappropriaaonorpiracyandtherisksofcontaminaaonbypossible
virusescirculaangonthenetwork.Theorganizerdeclinesanyresponsibilityin
case of misuse or incidents linked to theuse of thecomputer,accesstothe
Internet,maintenanceormalfuncaon of the Contests’ servers,
telephonelineoranyothertechnicalconnecaon.Furthermore,theOrganiser
declines any liability in case of “bugs” due to large numbers of Contests’
players,unforeseeablecircumstances,forcemajeureeventoractofGod.
Inanycase,iftheContestssmoothadministraaveand/ortechnicalprocessis
disrupted by serious malfuncaons as well as by a virus, computer bug,
unauthorizedhumanintervenaonoranyothercausesbeyondthecontrolof
theOrganizer,hereservesitsrighttosuspend,cancel,defer,orpostponethe
Contest.
Finally,thepurchaseofchargeableopaonsisundertheplayer’ssoleandtotal
responsibility. The total or paraal impossibility to use of such opaons,
paracularly dueto incompaable hardware, cannot result in any
compensaaon,refundorclaimfortheorganiser’sliability.

TheseCommonRulescanbemodifiedatanymomentbytheorganiserintheformof
anamendment.

AnyamendmentwillberegisteredatSCPEricChapuisetDavidBuzy,

It will enter intoeffect as soon as put online and any user will be deemed to have
accepted it dueto his/her registraaon to the Contests from the date the change
comesintoeffect.

Entering any Contest implies the fulland unreserved acceptance
ofthe Common Rules in their whole. If oneormoreofthe present Common Rules’
provisions were declared null or inapplicable,the remaining otherprovisionswould
retaintheir full force and effect. No replywillbegiventoanyphone call or wriang
requestconcerningthe interpretaaonorapplicaaonofthe present Common Rules,
themechanismsortermsoftheContests,orconcerningthelistofwinners.

Ar8cle11:Rightofwithdrawal
•

Being reminded that the Contests are free and that the chargeable
opaons are opaonal and only allow a be[er playing comfort, the user has a 14
workingdayswithdrawalperiod,starangfromthedayofpurchase,inthecaseofthe
purchaseofthesaidopaons.

By way ofexcepaon, in compliancewith the provisions of theFrench
Codede la Consommaaon, the user acknowledges and accepts that the right of
withdrawal will not be exercised as soon as the chargeable opaon will have been
usedwithintheContestsandwillhaveconsequently,bythesimplefactthattheuser
connects to the Contests, allow the player to benefit from an immediately
implementedimmaterialservice.

The user expressivelyagrees to the immediateavailabilityof the
elementsand,therefore,consentstothenon-applicaaonoftherightofwithdrawal.

In accordance with the laws governingliterary and arasac propertyrights, the
reproducaon and representaaon of allor partofthe Contests’ elements are strictly
forbidden.Allmenaonedtrademarksarethepropertyoftheirrespecaveowners.
Aracle14:RefundrequestofContestrelatedexpenses
Incaseofdisbursements,anyusermayrequesttherefundingofthecostsrelatedto
the contest duraaon from a landline, based on France Telecom’s 20 minutes
connecaon per day at reduced rate, i.e. 1,50 € to obtain refunding of the incurred
expenses.
Therefundingrequestmustbesendbypostwithin30daysofthecontest’sclosing
date, (bythe dateas postmarked), together with user’s IBAN (bank details: branch
and account number), telephone operator’s invoice in user’s name indicaang the
connecaons‘dates,hoursandduraaon,accompaniedbyale[erindicaangtheuser’s
contactdetails.
Thepostalfeespaidbytheuserforthisrequestwillberefundedonsimplerequest,
onthebasisofeconomyrate inforce for slowdelivery - less than 20 gr -
“le[er”.OnlyonerefundrequestperuserregisteredintheContestsandbyenvelope
(samename,sameaddress).Incompleterequestswillnotbeconsidered.
Giventhatincurrentstateofservicesandtechnicaloffers,someInternetproviders
offertheircustomersfreeorall-inclusiveInternetservices,itisexpresslyagreedthat
anyaccesstotheContestmadeonafreeorall-inclusivebasis(suchas,inparacular,
cable, broadband (ADSL) or dedicated connecaon) is not eligiblefor
reimbursement,asinthiscase thesubscripaon to the Internetprovider's services
hasbeencontractedbytheInternetuserforhis/hergeneralInternetusage,andthus
the player does not incur any addiaonal expense in connecang to the Organiser’s
WebsiteandenteringtheContest.

PlayersaregovernedbyFrenchregulaaonsongamesandContests.Anydisputethat
couldnotbesolved amicably shall be submi[ed to the appropriatecourt in
accordancewiththeFrenchCodeofCivilProcedure.
