ORDER for Weight Restriction on Provincial Highway No. 219
Reference: Provincial Highway No. 219 from 1.6 km east of the junction with Provincial Highway No. 44
to the junction with Rural Road No. 764 located at the north-east corner of Section 32, Township 30, Range 6,
West of the 3rd Meridian.

Pursuant to section 35.1 of The Highways and Transportation Act, 1997, the Minister hereby orders:
Effective from Midnight on the last day of February to Midnight on November 30 each year until further
notice,
Reference: Provincial Highway No. 219 from 1.6 km east of the junction with Provincial Highway No. 44
to the junction with Rural Road No. 764 located at the north-east corner of Section 32, Township 30, Range 6,
West of the 3rd Meridian;
Shall be restricted as follows:
• The maximum gross vehicle weight not to exceed 8 000 kg (17 600 lbs);
• The maximum gross weight on any axle not to exceed 5 500 kg (12 100 lbs).
The restriction does not apply to:
• Emergency vehicles;
• Ministry of Highways and Infrastructure vehicles and municipal maintenance equipment when
conducting maintenance or accessing sites on or along the restricted highway;
• SaskPower, SaskEnergy and SaskTel vehicles when accessing sites along the restricted route;
• Recreational vehicles;
• Buses;
• Farm Equipment operated or towed;
• Vehicles directly crossing Provincial Highway No. 219 at an intersecting public highway or private
road.
This Order is issued on a permanent basis and should not be confused with Spring Road Restriction
Orders.

Saskatchewan Real Estate Commission — Bylaw Amendments
THAT the Saskatchewan Real Estate Commission approves Bylaws 115.2, 302.1, 304, 308 and 313
be amended as follows:
“115.2 A salesperson’s pre-registration education for trades in residential, commercial and farm real estate
shall consist of the successful completion of the Commission approved examination for each of the following
courses: Real Estate as a Professional Career; Residential Real Estate as a Professional Career; Commercial
Real Estate as a Professional Career; and Farm Real Estate as a Professional Career”.
“302.1 An applicant for registration as a salesperson, except for property management, meets the educational
requirements if the applicant successfully completes the applicable salesperson’s education pursuant to
Bylaw 115.2 or has equivalent education approved by the Commission”.
“304 An applicant has two (2) years after the date of successfully completing the salesperson’s education
pursuant to Bylaw 115.2 or 115.3 to apply for registration. In the opinion of the Commission, when appropriate,
this date may be extended. Upon receipt of a registrant’s written application and payment of a fee pursuant to
Bylaw 409.1, the Commission may grant 30-day extensions”.
“308 An applicant for registration as a salesperson, associate broker, branch manager or broker meets the
applicable education requirements, if he/she:
(a) has been registered within the preceding two years from the date of application to trade in an equivalent
registration; and

(b) has completed the applicable Continuing Professional Development education during the period of
absence stated in clause (a); or
(c) has equivalent education approved by the Commission”.
“313 An applicant for registration from another jurisdiction meets the educational requirements in
Saskatchewan if the applicant has successfully completed the applicable Saskatchewan reciprocity education
pursuant to Bylaw 118, subject to the following:
(a) is currently registered in another jurisdiction to trade in an equivalent registration area;
(b) was registered in another jurisdiction within the preceding two years from the date of application to
trade in an equivalent registration area; or
(c) has equivalent education approved by the Commission”.
THAT the Saskatchewan Real Estate Commission approves Bylaws 115.3 and 302.1.1 to read as
follows:
“115.3 A salesperson’s pre-registration education for Property Management shall consist of the successful

Court of Queen’s Bench for Saskatchewan
The Rules of the Court of Queen’s Bench for Saskatchewan are amended, effective the 13th day
of January, 2012, in the manner set out below:
1 Rule 745 is repealed and the following substituted:
“Fees and costs
745(1) In this Rule and in Schedule I ‘C’ of the Tariff:
‘core services’ means:
(a) receiving instructions from the personal representative;
(b) reviewing a will or The Intestate Succession Act, 1996 with the personal representative;
(c) providing a copy of the will to each beneficiary;
(d) obtaining details about the deceased and the deceased’s property and debts;

(e) attending to obtaining the grant from the court;
(f) advertising for creditors;
(g) transmitting all estate assets to the personal representative and subsequently transferring
them to each beneficiary;
(h) dealing with the Public Guardian and Trustee if required;
(i) generally advising the personal representative about estate matters;
(j) dealing with ordinary attendances and correspondence for the core services;
‘non-core services or other services’ includes but is not limited to the following:
(a) with respect to estate administration, doing all or any of the following:
(i) determining who will apply for a grant in intestate estates;
(ii) locating beneficiaries;
(iii) locating assets in an intestacy or testate situation;
(iv) obtaining a bond for the purposes of Rule 719;
(v) determining whether joint property is an estate asset;
(vi) making court applications, including for matters such as substantial compliance,
interpretation or contentious business;
(vii) dealing with distribution issues respecting personal belongings;
(viii) paying bills and dealing with creditors;
(ix) dealing with property in joint tenancy;
(x) dealing with life insurance claims where the beneficiary is not the estate;
(xi) dealing with pensions and investments where the beneficiary is not the estate;
(xii) handling receipts and disbursements through trust accounts;
(xiii) dealing with property management;
(xiv) acting for the estate in the sale of estate property;
(xv) gathering information and dealing with accounts respecting terminal income tax
returns, trust returns and goods and services taxes;
(xvi) attending to preparation or filing of tax returns;
(xvii) obtaining tax clearance certificates;
(xviii) corresponding with and attending on beneficiaries;
(xix) preparing personal representative accounts for approval by the beneficiaries;
(xx) preparing and obtaining beneficiaries’ releases;
(b) with respect to passing of accounts:
(i) preparing an affidavit of the personal representative;
(ii) applying ex parte for an appointment for passing accounts and serving the
appointment;
(iii) appearing on appointment date to speak to the application;
(iv) attending before the examining officer;

(v) setting and serving the appointment date;
(vi) appearing on the appointment date to speak to matters in dispute and to the order
allowing and passing accounts;
(vii) issuing and serving the order allowing and passing accounts.
(2) The lawyer retained by the personal representative is entitled to payment for providing core services
to the personal representative or the estate as follows:
(a) as a percentage as set out in Schedule I ‘C’ of the tariff; or
(b) any lesser fee than that provided for in clause (a) that is agreed to by the lawyer and the
personal representative.
(3) Before being retained by the personal representative, the lawyer shall advise the personal representative
in writing of the lawyer’s method of billing for non-core services or other services to the personal representative
or the estate, based on one or more of the following:
(a) a percentage of the value of the estate;
(b) at a specified hourly rate;
(c) as a fixed fee;
(d) a combination of the methods set out in clauses (a), (b) and (c).
(4) When presented with the lawyer’s bill of fees and disbursements, a personal representative may proceed
to have the account assessed pursuant to The Legal Profession Act, 1990 and these rules”.
2 Schedule I “C” of the Tariff of Costs is repealed and the following substituted:
“SCHEDULE I
‘C’
IN THE COURT OF QUEEN’S BENCH
IN PROBATE AND ADMINISTRATION OF ESTATES MATTERS
1 For the purposes of this Schedule, the value of the estate is the total of all assets of the estate being
administered. Property not handled by the personal representative, such as joint property, insurance,
annuities and pensions not payable to the estate, is not included in the value of the estate and the lawyer
shall charge separately for services respecting that property.
2 For all necessary core services rendered, the fee allowed to the lawyer is:
(a) $1,500 plus 1% of the first $500,000 of the value of the estate;
(b) 3/4% on the next $500,000 of the value of the estate; and
(c) 1/2% on the remaining value of the estate.
3 For non-core services or other services rendered for the estate and for the passing of accounts, the
additional fee allowed to the lawyer is the fee provided for in Rule 745(3)”.

(e) faire le nécessaire pour obtenir les lettres successorales du tribunal;
(f) faire la publicité destinée aux créanciers;
(g) transmettre les biens de la succession au représentant successoral et les transférer plus
tard à chaque bénéficiaire;
(h) faire affaire au besoin avec le tuteur et curateur public;
(i) conseiller le représentant successoral, de façon générale, en matière de successions;
(j) faire les comparutions et la correspondance ordinaires liées aux services essentiels.
‘services non essentiels ou autres’ Entre autres, les actes suivants :
(a) s’agissant de l’administration de la succession :
(i) déterminer qui demandera les lettres de successions ab intestat,
(ii) trouver les bénéficiaires,
(iii) repérer les biens d’une succession testamentaire ou ab intestat,
(iv) obtenir un cautionnement pour l’application de la règle 719,
(v) déterminer si une propriété conjointe constitue un bien de la succession,
(vi) comparaître en cour notamment pour régler des questions de conformité substantielle,
d’interprétation ou d’affaires contentieuses,
(vii) s’occuper des problèmes de partage des effets personnels,
(viii) payer les factures et s’occuper des créanciers,
(ix) s’occuper des biens détenus en tenance conjointe,
(x) s’occuper des demandes d’indemnité d’assurance vie dont le bénéficiaire n’est pas la
succession,
(xi) s’occuper des pensions et des placements dont le bénéficiaire n’est pas la succession,
(xii) manier les rentrées et sorties de fonds au moyen de comptes de fiducie,
(xiii) s’occuper de la gestion des immeubles,
(xiv) représenter la succession dans la vente de biens de la succession,

(xv) recueillir les renseignements nécessaires et s’occuper des comptes relativement aux
dernières déclarations d’impôt sur le revenu, aux déclarations de fiducies et aux taxes sur
les biens et services,
(xvi) s’occuper de la préparation ou du dépôt des déclarations des taxes et impôts,
(xvii) obtenir des certificats d’acquittement des taxes et impôts,
(xviii) correspondre avec les bénéficiaires et les rencontrer,
(xix) préparer les comptes du représentant successoral pour l’approbation des
bénéficiaires,
(xx) préparer et obtenir les libérations des bénéficiaires;
(b) s’agissant de la reddition de comptes :
(i) préparer l’affidavit du représentant successoral,
(ii) présenter une requête ex parte en fixation d’une date pour la reddition des comptes et
signifier l’information,
(iii) comparaître à la date convenue au sujet de la requête,
(iv) comparaître devant l’auditeur,
(v) régler et signifier la convocation,
(vi) comparaître à la date convenue pour parler des questions en litige et de l’ordonnance
prononçant l’acceptation et la reddition des comptes,
(vii) délivrer et signifier l’ordonnance prononçant l’acceptation et la reddition des
comptes.
(2) L’avocat engagé par le représentant successoral a le droit d’être rémunéré à un des taux suivants pour
les services essentiels destinés au représentant successoral ou à la succession :
(a) le pourcentage prévu à l’annexe I “C” du tarif;
(b) les honoraires-inférieurs à ceux prévus à l’alinéa a)-convenus entre l’avocat et le représentant
successoral.
(3) L’avocat ne peut accepter un mandat du représentant successoral sans au préalable l’avoir avisé par
écrit de son tarif pour les services non essentiels ou autres destinés au représentant successoral ou à la
succession, tarif établi en fonction d’un ou plusieurs des taux suivants :
(a) un certain pourcentage de la valeur de la succession;
(b) un taux horaire précis;
(c) un prix forfaitaire;
(d) une combinaison des taux indiqués au alinéas a), b) et c).
(4) Lorsqu’il reçoit la note des honoraires et débours de l’avocat, le représentant successoral peut la faire
liquider en vertu de la loi intitulée The Legal Profession Act, 1990 et les présentes règles ».

SACHEZ QUE: La date de tombée pour les soumissions à la Gazette de la Saskatchewan est le lundi
à 5 p.m., la semaine de la parution. En cas de jour férié à l’intérieur de la semaine de parution, la date de
tombée sera remise un jour avant, soit le vendredi à 5 p.m. Pour les envois de soumissions à la Gazette
par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera
remise au numéro de la semaine suivante.
Tous les documents qui paraîtront dans la Gazette de la Saskatchewan doivent être soumis électroniquement
(MS Word ou WordPerfect) et accompagnés d’une copie papier signée et envoyée au bureau de l’Imprimeur
de la Reine, ministère de la Justice de la Saskatchewan, B19-3085, rue Albert, Regina SK S4S 0B1,
tél. 306-787-2367, ou par courriel: [email protected].
Chaque document ou disquette doit être complet, conformément aux normes de parution, et doit être séparé
de la lettre d’accompagnement. Les signatures sur les documents doivent être dactylographiées ou écrites
lisiblement en lettres moulées et doivent apparaître immédiatement en dessous de la signature écrite.
Le paiement d’avance est exigé pour TOUS les avis placés dans la Gazette de la Saskatchewan par les clients
non gouvernementaux. Les chèques ou les mandats doivent être établis à l’ordre du fonds renouvelable de
l’Imprimeur de la Reine. Veuillez y inclure la TPS en plus des tarifs réguliers au taux de 5 % pour chaque article
cité ci-dessous dans la catégorie « soumis à la TPS ».
