OFFENCES AND PUNISHMENT IN GENERAL Title 1. PRELIMINARY Chapter 1. THE OFFENCE IN GENERAL Item: 1 The offense is an act or omission which is manifested as an attack on social order and that the law punishes by a penalty. No offense can be punished with the penalties were not imposed by law, before it was committed. However, in the contest of two criminal statutes, the old one under the influence of which the offense was committed and the other passed since the offense and before a final judgment is rendered, the new law should only be enforced if it enacts a lesser sentence. Unless otherwise provided, the first book of this Code shall apply to offenses under the laws and regulations. However this application will not if it would reduce the penalties established to enforce the collection of revenue duties or civil damages for injury caused to the state or other legal entity of public law. Article: 2 The Act does not apply to offenses committed during its validity, if it is revoked before the trial of such offenses is final, unless the new law not otherwise disposed. Article: 3 The penal provisions can not be extended and must be interpreted restrictively; it is not for the courts to rule accordingly. Article: 4 When several criminal provisions governing the same subject, the special provision derogates from the general provision, unless it is otherwise enacted Article: 5 No one shall be punished twice in the head of the same offense. Chapter 2. TERRITORIALITY THE CRIMINAL LAW Article: 6 Any offense committed on Rwandan territory by Rwandans and foreigners shall be punishable under Rwandan law, subject to diplomatic immunity enshrined in the conventions and international practices. Article: 7 Shall be deemed committed on Rwandan territory any offense an act comprising one of its components has been achieved in Rwanda. Article: 8 Rwandan territory, means the area of land, river, lake, air, even within the borders of the Republic. Shall be deemed committed on Rwandan territory of any offense committed by or against a Rwandan citizen in a place not subject to the sovereignty of a State, or any person or on board a ship flying the flag of Rwanda and located outside waters subject to the sovereignty of a State or on board an aircraft registered in Rwanda, it is in flight or outside the territories under the sovereignty of a State. Article: 9 Any Rwandan citizen who, outside the territory of the Republic is guilty of an act qualified as crime punishable by law in Rwanda, can be prosecuted and tried by Rwandan courts. Article: 10 Every Rwandan who, outside the territory of the Republic is guilty of an offense is qualified by Rwandan law may be prosecuted and tried by Rwandan courts if the act is punishable by the laws of the country where he been committed. Article: 11 The provisions of Articles 6 to 10 shall apply to those who have acquired the Rwandan nationality until after the fact imputed to them. Article: 12 Whoever was in the territory of the Republic accomplice of a crime or offense committed abroad can be prosecuted and tried by Rwandan courts if the act is punishable by both the foreign law and Rwandan law, provided that the fact qualified crime or offense has been found by a final decision of a foreign jurisdiction. Article: 13 Every Rwandan or foreign, outside the territory of the Republic, is guilty of a crime or offense detrimental to state security or counterfeit the seal of the state or national currencies, can be prosecuted under the provisions of Rwandan law as if the crime or offense had been committed in the territory. Article: 14 The prosecution of crimes and offenses committed abroad shall be brought at the request of the prosecution. No prosecution will take place, if the defendant proves that he has been finally judged abroad, and, if convicted, he suffered his sentence or prescribed or obtained a pardon. Article: 15 Extradition is regulated by Rwandan law in accordance with the conventions and international practices. She is allowed only if the event giving rise to the claim is a crime under Rwandan law and foreign law. It is not granted for political offenses or if requested in a political purpose. Article: 16 The extradition of a Rwandan citizen is never granted the citizenship being appreciated at the time of the offense for which extradition is requested. Article: 17 Foreign criminal sentence may on application by the prosecutor or the victim of the offense, be recognized in Rwanda, if it decides that the civil judgments to be executed in the territory of the Republic. Chapter 3. CLASSIFICATION OF OFFENSES Article: 18 The offense that the laws punish as a principal of imprisonment not exceeding two months and a fine not exceeding two thousand francs or to both, is a violation. Violations of laws, decrees, administrative orders and police, for which the law does not determine individual sentences are fines. Article: 19 The offense that the laws punish as a principal of a sentence of imprisonment exceeding two months and not exceeding five years and a fine of more than two thousand francs, or one of those penalties, is an offense. Article: 20 The offense that the laws punish as a principal of the death penalty or imprisonment exceeding five years, is a crime. Chapter 4. THE ATTEMPT Article: 21 There are punishable attempt when the resolution to commit an offense has been manifested by conduct, unequivocal, forming the beginning of execution, and who, before having to direct and immediate consequence of consuming the offense, have been suspended or failed to attain the effect that by circumstances beyond the control of the author. Article: 22 The attempt is punishable even if the goal could be achieved due to a circumstance unknown by the author. Article: 23 If the author has voluntarily surrendered to the action, he incurs the penalties if the acts already committed by themselves constitute an offense. Article: 24 Attempted crime and crime are seen as the crime or offense itself. Attempts to breach is not punishable. Title 2. PENALTIES IN GENERAL Article: 25 The court applies the law to the extent it determines, and must state the reasons for its decision. Chapter 1. CLASSIFICATION OF SENTENCES Article: 26 The main penalties are: 1. death; 2. imprisonment; 3. the fine. Article: 27 The accessory penalties are: 1. special confiscation; 2. travel ban and an obligation to stay; 3. available to the government; 4. civic degradation. Chapter 2. VARIOUS CATEGORIES OF PUNISHMENT Section 1. Of the death penalty Article: 28 Anyone sentenced to death shall be executed by firing squad. Article: 29 The venue and other details of implementation are determined by order of Minister of Justice who has within its remit. The convict, accompanied by a minister of his choice, will be transported to the place of execution and executed immediately. Article: 30 No sentence may be enforced on public holidays. Article: 31 If it is verified that a woman sentenced to death is pregnant, she shall suffer the penalty after it is issued. Article: 32 The bodies of the executed will be returned to their families if they ask for them to load them to be buried without any device. Article: 33 The minutes of execution will be erected on the spot by the Clerk. It will be signed by the president of the court which imposed the sentence or by his substitute, the district attorney and the clerk. The minutes will be transcribed by the clerk at the foot of the judgment. Section 2. Of imprisonment Of imprisonment Article: 34 The term of imprisonment is either perpetual or temporary basis. Article: 35 The duration of the imprisonment time is at least a day and a maximum of twenty years, according to the cases specified by law, and except in cases of recurrence or other law which would have identified other limitations. It is calculated as all temporary punishment, by day, month and year of the Gregorian calendar. The sentence of one day is twenty four hours. That one month is thirty days. Article: 36 The duration of any deprivation of liberty account the day where the person is detained under the conviction becomes final the sentencing. Article: 37 Preventive detention will still be deducted from the length of the sentence imposed by the judgment or decree of condemnation. Article: 38 In calculating the temporary serving of sentences is not taken into account the time during which the convicted person has been submitted through administrative channels to a security measure involving deprivation of liberty, nor the time during which it has voluntarily withdrawn its execution. Article: 39 The custodial sentences run in prisons. Each convict shall be employed at work that will be imposed. Article: 40 Women and minors perform the custodial sentences in special prisons. Article: 41 The implementing rules of custodial sentences are determined by order of the Minister having Justice in his duties. Section 3. Of the fine Article: 42 The fine is at least a frank and it accrues to the state. The rate of criminal fines provided by this Code shall, notwithstanding any previous provision, net of all tithes. Article: 43 ' The fine is imposed within statutory limits, individually against each row because of the same offense, taking into account the seriousness of the offense. Article: 44 The court shall fix the time within which the fine must be paid, this period shall not exceed one year. The court may decide that the fine be paid in installments or replaced by the provision of services for the benefit of the state or municipality. In the absence of a determination by the court, the time for payment of the fine is one month. Article: 45 Any criminal conviction shall be without prejudice to refunds and damages which may be due to the parties. Article: 46 In case of competition of the fine with refunds and damages the property of the condemned insufficient, these convictions will get preference. Article: 47 All persons sentenced for the same offense are jointly liable for fines, restitution, damages and costs. However, the court may, for good cause, waive all or part of some of solidarity condemned. Article: 48 Where a conviction to the fine, fees, any payment to the Treasury and for restitution or damages to a plaintiff has been pronounced by a criminal court, it, in case sentence remain outstanding, shall determine the length of imprisonment for debt. This measure, which is imprisonment of the debtor to make him pay his debt, not to be confused with punishment but can not exceed one year. When imprisonment for debt guarantees the recovery of several claims, the maximum of one year may be applied as many times as there are separate convictions. Article: 49 A convicted person who has suffered an attachment is not discharged by the amount of convictions for which it was exercised. Article: 50 Civil imprisonment may be imposed against individuals or aged under 16 years of age at the time of the events that led to the prosecution, nor against those who started their sixty-fifth year at the time of sentencing. Nor can it be imposed against persons civilly liable. It can not be executed simultaneously against husband and wife, even for the recovery of sums relating to different sentences. Article: 51 Persons against whom the constraint has been imposed may prevent or stop the effects, either by paying or depositing a sum sufficient to extinguish their debt, either by providing a good and valid bond recognized by the presiding judge. The bond shall be released to the month, otherwise it may be levied against its property. i full payment is not made, the attachment may be performed again for the amount due. Section 4. Of special confiscation Article: 52 If a crime or offense, special confiscation of goods that form the body of the offense, or who have served or were intended to commit, or have been produced by the offense, may be ordered as an incident to the principal penalty, when ownership of the property belongs to the offender. When ownership of the property described above is not the condemned, as well as in contravention, special confiscation can be imposed only in cases provided by law. Article: 53 General confiscation, on the entire present and future assets of the convicted is prohibited. Section 5. The travel ban and an obligation to stay Article: 54 The travel ban is to defend against a convicted person to appear in some places. The residence requirement consists in the requirement that a convicted residing in certain places. Article: 55 The duration of the travel ban and an obligation to stay is two to ten years. Article: 56 The banishment or the residence requirement may be imposed in addition to the cases expressly determined by law: 1. against any person sentenced to a term exceeding one year's imprisonment; 2. against anyone who, having been sentenced to less than six months imprisonment, shall, within ten years after the expiration of the sentence or the prescription, was sentenced again to a term of not less than six months' imprisonment. Article: 57 The sentence of banishment or obligation to stay starts on the date on which the convicted person has served his prison sentence. If he is paroled, the starting point of the sentence enhancement is the release. Reincarceration of the offender, for any reason whatsoever, does not extend the duration of both. Article: 58 The conditions of application of Articles 54 to 57 are determined by presidential decree. Section 6. Of making available to the Government Article: 59 Any repeat offender who, within an interval of ten years, excluding imprisonment suffered incurred three convictions of at least six months' imprisonment, may, by the judgment or the judgment of conviction, be made available government for a period of five to ten years commencing on the expiry of the period of the last sentence. Before taking the decision, the warden must seek the advice of department at the court which imposed the sentence. The condemned may refer the decision of the prefect to the Minister having Justice in his duties. Article: 64 When the prisoner receives parole for imprisonment, the penalty available to the government is run from this release. Execution is suspended, from the arrest, on revocation of parole and for the duration of detention. It is the same if the offender is arrested, even preemptively, under a court order. Article: 65 The convicted available to the Government may at any time ask to be relieved of the effects of conviction. Article: 67 Loss of civil rights imposed by the court to deprive the convicted of one or more rights enumerated in the preceding article, and it can not cover all of these rights; duration, fixed by the court, not exceed twenty years. However, in cases specifically provided by law, the loss of civil rights may be total and perpetual. It can be suspended running under the same conditions as imprisonment. It can be reduced or deleted by the procedure of rehabilitation after an end and fulfillment of conditions at the discretion of the court of appeal. Loss of civil rights may be exercised particularly if the offender has committed an act of good citizenship or if he is highly devoted to social work. Article: 68 The death penalty or life imprisonment automatically entail the loss of civil perpetual and total. Article: 69 Loss of civil rights may be imposed as an incident of imprisonment of not less than one year, for an offense prejudicial to public affairs. Title 3. PEOPLE PUNISHABLE Chapter 1. GENERAL PROVISIONS Article: 70 There is no criminal liability where the defendant was insane at the time of the offense or has been compelled by a force which he could not resist, or if the act was ordered by the law and ordered by the authority. However, one who has voluntarily deprived of the use of his mental faculties at the time of the offense, remains criminally liable, even if such deprivation was not induced to commit the offense. Article: 71 The exemption from criminal responsibility for the causes set forth in the preceding article shall not extend to the conspirators or accomplices of criminal offenses. Article: 76 The aggravating circumstances of the offense only worsen the responsibility of those officers who were aware or should have foreseen .. Chapter 2. APOLOGY: Section 1. Section 2. Of provocation Article: 78 For crimes and misdemeanors, the judge is in the facts of the case, if applicable, the elements that constitute the provocation of the victim and make the offense excusable. Article: 79 The crimes are excusable if they were caused by severe blows or violence toward people. Article: 80 Parricide is never excusable. Article: 81 Where their excuse will be proved: - If it is a crime carrying the death penalty or life imprisonment, the sentence will be reduced to a term of imprisonment of one to five years; - In the case of any other crime, the penalty shall be reduced to imprisonment for six months to two years; - If it is an offense, the penalty is reduced to an imprisonment of eight days to six months. Chapter 3. MITIGATING CIRCUMSTANCES Article: 82 The judge discretion to assess the circumstances, preceding, accompanying or following the offense, mitigates the guilt of the perpetrator. The decision acknowledges that mitigating circumstances must be substantiated. Article: 83 If there are extenuating circumstances, the penalties will be reduced or modified as follows: - The death penalty will be replaced by a term of imprisonment which shall not be less than five years; - The sentence of life imprisonment will be replaced by a sentence of temporary emprissonnement that will not be less than two years; - The temporary imprisonment of five to twenty years or more than twenty years may be reduced to the imprisonment of one year. In all these cases, a fine of one hundred thousand francs at most be Assistant imprisonment and loss of civil rights and the prohibition of residence or the residence requirement. Article: 84 The term of imprisonment not exceeding five years and the fine, provided for the punishment of offenses and fines can be reduced to a minimum of both, even for repeat offenders. The court may also order separately one or other of these sentences, and even substitute the fine to imprisonment. In the event the fine is substituted for imprisonment if the sentence of imprisonment is only provided for the article is applied, the maximum fine that is ten thousand francs. Chapter 4. THE RELAPSE Article: 85 Anyone who has been convicted by a final decision, to a term of imprisonment exceeding two months, will, within ten years after the expiration of that sentence or prescription, committed a crime or a crime that is punishable through the trouble of temporary imprisonment, will be sentenced to the maximum term of imprisonment imposed by the law, and this penalty may be elevated up to twofold. If the first sentence was life imprisonment and the second offense is punishable by the same penalty, the death penalty will be incurred. Article: 86 There is no recurrence when the sentence imposed for the first offense was erased by an amnesty or if the offender has been rehabilitated irrevocably. Article: 87 He who has been convicted by a military court will, if a felony or misdemeanor posterior, subject to the penalties of recurrence if the first conviction was for an offense punishable by the ordinary criminal laws. Article: 88 In the event of multiple aggravating circumstances, excuses, and recurrence of extenuating circumstances the courts will apply the sentence by taking account of these elements in the order stated in this article. Chapter 5. PARTICIPATION OF CRIMINAL Article: 89 Accomplices to an offense is the same penalties as the authors themselves of the offense, except in cases where the law provides otherwise. They can be prosecuted even if the prosecution can not be brought against the author for reasons that are personal to it, such as res judicata, death, dementia, not identification. Article: 90 Authors are considered those who have perpetrated the offense or aid and abet directly in its execution. Article: 91 Are considered accomplices: 1. those who by gifts, promises, threats, abuse of authority or power, machinations or culpable artifice, directly incited to this action or have given instructions to commit it; 2. those who procured weapons, instruments or other means which will be used to the action, knowing they were there to serve; 3. those who, knowingly aided or abetted the perpetrator or perpetrators of the action in practice which have facilitated or prepared or in those who have consumed; 4. those who, either through speeches, shouting or threats uttered in public places or meetings, or by written or printed material sold or distributed, sold or exhibited in public places or meetings, or by placards or posters, presentations to public view, directly incited the perpetrator or perpetrators to commit this action, without prejudice to the penalties against perpetrators of incitement to offenses even if these provocations would not be implemented; 5. those who helped or harbored criminals in accordance with Article 257 of this code. Chapter 6. CONTEST OF OFFENCES Article: 92 There are concurrent offenses when multiple offenses were committed by the same author without a final conviction has been reached between the offenses. Article: 93 There are contests ideal: 1. In this case, the judge pronounce sentences for each offense and will combine the sentences, subject to the following provisions: 1. the death penalty and life imprisonment absorb any right of imprisonment; 2. the total cumulative sentences of imprisonment and temporary fine may not exceed twice the maximum punishment provided for the largest one or the other offenses charged against the prisoner; 3. the total sentence of banishment and obligation to stay may not exceed twenty years; 4. total sentences available to the Government may not exceed ten years, and any penalty available to the government absorbs right sentences of banishment and obligation to stay; 5. total temporary loss of civil penalties may not exceed twenty years. Article: 95 The severest penalty is the one whose maximum is the highest. If two sentences have the same maximum, the severest penalty that is the minimum being the highest. If two sentences have the same maximum and minimum even the severest penalty is one that is accompanied by a fine. Article: 96 A fine is always weaker than imprisonment. Chapter 7. SUSPENDED Article: 97 If the convicted person has not been the subject of prior convictions to a prison term longer than two months, the courts may order by the same judgment and reasoned decision, it will suspend the operation of all or part sentences they pronounce principal or accessory, provided however that the main prison sentence not exceeding five years. Article: 98 The suspended sentence imposed will be considered void if during the period fixed by the decision and may not be less than one nor more than five years, the offender incurs no prosecution followed a conviction for a felony or to imprisonment for a term longer than two months for a crime or offense committed after the date the decision granting the suspension becomes final. Otherwise, the penalties for which the stay was granted and those that are the subject of the new sentence will be cumulative. Article: 99 The suspension of the sentence does not extend to the payment of trial costs and damages, it does not extend to more disabilities resulting from the conviction, however, they cease to have effect from the day, by application of Article 98, the conviction was considered void. Title 4. EXTINCTION OF VIOLATIONS AND PENALTIES Chapter 1. GENERAL PROVISIONS Section: 100 Public action for the purpose of punishment is extinguished by the death of the accused, the repeal of the penal law, res judicata, amnesty and prescription. Public policy may also be extinguished by transaction and withdrawal of complaint, when the law expressly provides. Section: 101 The penalty is extinguished by performance, by the death of the condemned, amnesty and prescription. The sentence can also be modified or deleted by the grace, parole and rehabilitation. Section: 102 The amnesty off the offense. If there was a conviction, it removes the criminal conviction with all its penal consequences. In case of concurrent offenses, the offender if the offense is pardoned by the amnesty law has the severest penalty or a sentence equal to the punishment for other offenses prosecuted, even though the judges, after giving the extenuating circumstances for the offense, would have borrowed repression to a statute providing for a lower sentence. Section: 103 The amnesty may be subject to conditions or special obligations. Section: 104 The death of the offender and amnesty are without prejudice the civil action for compensation for damage caused by the offense. They have no retroactive effect in respect of rights legitimately acquired by third parties. Chapter 2. WITHDRAWAL OF A COMPLAINT Section: 105 For offenses that can not be prosecuted on the complaint of the injured party, the withdrawal thereof extinguishes the public. The withdrawal shall be admissible only if it extends to all who participated in the commission of the offense. Section: 106 The withdrawal is judicial or extrajudicial. The alternative is withdrawal or acquiescence, it is implied when the plaintiff has engaged in conduct inconsistent with the will to persist in its complaint. Section: 107 The waiver, express or implied, can not be removed. Section: 108 To take effect, the withdrawal shall, except in cases where the law decides otherwise, intervene before the conviction becomes final. Section: 109 If the complaint was filed by several victims during the same offense, the prosecution shall be extinguished only if all the plaintiffs voluntarily dismissed. The discontinuance of a complainant can not prejudice the rights of other complaints. : 110 The withdrawal is personal to the victim, it is extinguished by the death of the latter. Chapter 3. PRESCRIPTION Section 1. The requirement of public action Section: 111 Public action resulting from an offense shall be barred: 1. For ten years have elapsed for the crimes; 2. Three completed years for misdemeanors; 3. For a full year for tickets. Section: 112 In terms of instant offenses, prescription runs from the day when all the elements constituting the offense are met. In terms of continuing infringements, the limitation period runs from the day when the state stopped offending. When several facts constitute execution of the same criminal intent, prescription runs from the date the last offense was committed. Section: 113 The requirement of public action is interrupted by any act of investigation or prosecution timely made under section 111. If this was done in this interval, the prescription begins to be fulfilled from the last act and the same dates. This is true even for persons who are not involved in this act of investigation or prosecution. : 114 The requirement of public action is suspended whenever the exercise of the action is prevented by an absolute bar from either the law or of an event of force majeure. Section: 115 If proceedings leading to the conviction revealed the falsity of the decision which declared extinct public action, it can be resumed. The prescription must be considered as having been suspended from the day the decision became final and the day when its falsity is discovered. Section: 116 The civil action arising from an offense prescribed by the rules of the Civil Code. However, if the prescription of the civil action was gained while that of public action is not yet completed, the civil action does not prescribe that under the rules relating to public action. Section 2. The lapsing of sanctions Section: 117 The fines of less than five hundred francs time within two completed years and the sentences of five hundred francs or more shall be three completed years. Section: 118 A sentence of imprisonment at or below five years are barred by a period twice the length of the sentence, without this period is less than three years. A sentence of imprisonment exceeding five years and the death penalty but within twenty years of age. If the convicted person serving out his sentence managed to escape, the prescription begins to accomplish the day of his escape. Section: 122 The prescription of the sentence is suspended whenever the performance is prevented by circumstances set out in section 114. Section: 123 The civil judgments delivered by the criminal courts are barred under the rules of the Civil Code. Chapter 4. OF GRACE Section: 124 Through the collective or individual is exercised, discretion and for the general good, by the President of the Republic. It consists in the partial or total remission of the execution of sentences or in switching to other less serious penalties prescribed by law. Section: 125 It can apply to all principal penalties, or additional accessories. It does not apply to the stress exerted by the body for the collection of fines or legal expenses, or civil damages, or security measures lack of a criminal nature. Section: 126 Can only be a measure of grace and enforceable penalties resulting from a final judgment. If the sentence has been partially fulfilled, grace may apply, in whole or in part, to the remainder of the sentence to be executed. The suspended sentence can not be a grace as the suspension is not revoked. Section: 127 Grace can be conditional or unconditional or conditional on the completion of a condition set by the decision gracefully. If this condition is not achieved, the revocation of grace takes place automatically, and the conviction is reduced to execution. In this case, the prescription of the sentence is suspended between the notification and revocation of grace. Section: 128 Anyone sentenced to life imprisonment who obtains commutation or remission of sentence is, unless otherwise provided by the gracious decision, as of right to residence ban or obligation to stay for ten years . Section: 129 Grace does not extinguish the accessory penalties not covered by the gracious decision, nor the effects of the conviction, including those related to recidivism, to put at the disposal of the Government, the application of relief in the event of subsequent prosecution and to civil judgments such as restitution and damages. Section: 130 The clemency petition shall be heard by the public prosecutor or the court which imposed the sentence or the applicant's residence or place of detention. For general pardons, proposals are made at the behest of the Minister having Justice in his duties. In all cases, the prosecution of the court which pronounced the sentence will be asked to advise on the application or proposal through. Section: 131 Thanks for the individual, the application is made, the person under sentence or on its behalf by any person. It states the reasons seem to justify the request. Section: 132 After instruction, files are sent by the Minister having Justice in his duties, which, after obtaining, where applicable, the notice of ministers concerned and are expressed personal opinion, presented a report to the President of the Republic for decision. Section: 133 The execution of fines or that, if it has not begun, prison sentences or less than three months, is suspended during the investigation of the case until a decision on grace. Chapter 5. OF PAROLE Section: 134 Convicts who have to undergo one or more sentences or made available to government are eligible for parole if they have given sufficient proof of good conduct and they present serious guarantees of social rehabilitation . Article: 135 (DL No. 23/81 of 13.10.1981) Parole is for offenders who completed two months of their sentence if the sentence is less than six months and one quarter of their sentence otherwise. For those sentenced to life imprisonment period of ineligibility is ten years. Section: 136 The release was ordered by decree of the Minister having Justice in his duties after consultation with the prosecutor and the prison director. The Minister shall determine the conditions to which the release may be subject, and the mode of parole supervision. Section: 137 The Minister may, after consulting the prosecutor, revoke release due to a new sentencing, disorderly conduct or violation of the conditions set out in the decision to parole. In an emergency, the arrest of the parolee may be ordered by the prosecutor in charge of giving immediate notice to the Minister having Justice in his duties. Section: 138 After revocation, the offender must undergo all or part of the sentence he had left to serve when his parole, if applicable cumulatively with any new sentence it would have incurred. Section: 139 If the revocation is not made before the expiry of a period equal to the time of incarceration that the prisoner had to stand still during his parole, the final release is acquired. In this case the sentence is deemed terminated on the date of parole. Section: 140 The lapsing of sanctions does not run while the convicted person is in custody under an order of release has not been revoked. Chapter 6. REHABILITATION Section: 141 A convicted for a felony or misdemeanor may be rehabilitated. Section: 142 Rehabilitation may be granted when a period of five years has elapsed during this period and if the convicted person has not ceased to give real evidence of good conduct. Section: 143 This time share, for fined, the day when the conviction becomes final, and, for those sentenced to imprisonment, the final day of their release or parole date if the n ' was not followed for revocation. Section: 146 If the injured party can not be found or refuses to receive the amount due, it is recorded in a public fund. If the party fails to appear within five years to be awarded the money paid, this sum is returned to the applicant upon request. Section: 147 The convicted address the pardon application to the officer of the Crown to his residence. The application shall specify the date of conviction and the places where the convicted person has resided since his release. The officer of the public prosecutor is investigating the morality of the condemned. He obtains an expedition of sentences, an extract from the register of places of detention where the sentence has been served and noting what was the conduct of the convict and a criminal record bulletin. It transmits the pieces, with its recommendation, the prosecutor. Section: 148 The court is seized by the prosecutor. She decides within two months on the findings of the prosecutor, the party or his counsel heard or duly summoned. The judgment may be referred to the Court of Cassation, in accordance with Article 112 of the Code of Criminal Procedure. Section: 149 In case of rejection of the application, no new application may be filed before the expiration of two years, unless the dismissal of the first has been motivated by the lack of time trials; in this case, the application may be renewed upon expiration of that period. Section: 150 Rehabilitation erases the conviction and to stop all future resulting disabilities. However, rehabilitation is automatically revoked if the offender commits rehabilitated within five years, punishable by imprisonment not less than five years, and followed by a sentence of imprisonment and to this end the Ministry public about the court which pronounced the sentence of imprisonment must inform the prosecutor, which itself will seize the appellate court for a declaration of revocation of a pardon, the party or his counsel being duly summoned . In case of dismissal, rehabilitation is considered as never having been granted. Book 2. OFFENCES AND PUNISHMENT IN THEIR PARTICULAR Title 1. OF CRIMES AGAINST THE PUBLIC THING Chapter 1. OF CRIMES AGAINST THE SAFETY OF THE STATE Section 1. Damage to the external security of the State, Section: 151 Shall be guilty of treason, and punished, in time of war, the death penalty in peacetime, to life imprisonment, while Rwandans who: 1. by terrorism, subversion, military force or threat of violence, undertake to incorporate the territory or part of the national territory to that of a foreign power; 2. undertake to place wholly or partly, the Republic of Rwanda under foreign rule; 3. in general, have borne arms contra la Nation. Section: 152 Practice to publish or intentionally engage in any form or by any means whatsoever, a state secret to a person not entitled to receive, to prejudice the interests of the Republic of Rwanda is a crime of treason against the homeland, if committed by a Rwandan, or espionage, if committed by a stranger. Section: 153 Are state secrets within the meaning of these provisions, all facts, objects or knowledge including writings, drawings, models, designs, formulas or information that is important in the interest of national defense, not to reveal a government or a foreign institution or their agents. Section: 154 Be punished, in time of war, the death penalty in peacetime, to imprisonment for ten to twenty years, the head of treason or espionage, according to the circumstances and conditions set out in two previous articles: 1. any individual who intentionally published or delivered a state secret; 2. any individual who will be afforded a state secret, to deliver it; 3. any individual or allow destroy destroy such a state secret in order to promote a foreign power; 4. any individual who voluntarily transferred to a person not entitled to receive a state secret which he has revealed his duties by his situation or money entrusted to him by a service of the Government of the Republic. However, if the transmission of state secrets by a person described above was made with no intention of treason or espionage, and only by mistake, carelessness or negligence, the penalty shall, in time of war, imprisonment for five to ten years, and, in peacetime, imprisonment of one to five years; 5. any individual who established or maintained with any state, party, association, institution or a foreign person working for them, relations with the aim of communicating state secrets. Section: 155 Be punished, in time of war, the death penalty in peacetime, to imprisonment for ten to twenty years, any individual who, with intent to cause or encourage war, an army or company violent measures against the Republic, will be established or maintained an illicit relationship with a foreign government or institution or with their agents. Section: 156 Be punished, in wartime, to imprisonment for two months to one year, and a fine of 10,000 to 50,000 francs, or one of these penalties, and, in time of peace, imprisonment for a term of eight days to two months and a fine not exceeding two thousand francs, or one of these penalties, any person who, in order to provoke the hostility of international opinion vis-à-vis the Government of Rwanda, propagates false claims. Section: 157 The offenses under sections 151, 154, 155 and 156 will be prosecuted upon complaint or upon authorization of the Government of the Republic. Section: 158 Be punished, in time of war, the death penalty in peacetime, to imprisonment for ten to twenty years, any individual who: 1. deliver to a foreign power or its agents or troops, or territories, cities, fortresses, books, jobs, stores, arsenals, equipment, ammunition, boats, buildings or air navigation equipment, owned by or assigned to the Republic his defense; 2. to harm the national defense, destroy or divert a boat, a device for aerial navigation, a piece of equipment, supply, construction or any facility or who provide poor workmanship such as to damage or cause an accident. Section: 159 Be put to death every individual who, in wartime: 1. cause the military to enter the service of a foreign power, they will facilitate the means or will enlistments for a power at war with the Republic; 2. maintains relations with a foreign power or its agents to promote companies that power against the Republic; 3. has knowingly participated in an attempt to demoralize the army or the nation designed to harm the national defense. Section: 160 Be punished, in wartime, to imprisonment for ten to twenty years, in peacetime, to imprisonment for five to ten years, that person: 1. will, by hostile action not approved by the government, exposed to the Republic of hostilities on the part of a foreign power; 2. will, by acts not approved by the government of Rwanda exposed to reprisals; 3. meet with agents of a foreign power intelligences likely to harm the military or diplomatic situation in the Republic or its core economic interests. Will be punished, in wartime, to imprisonment of eight days to two years and a fine of 1000 to 5000 francs, and in peacetime, to imprisonment of eight days to two months and a fine of 500-2000 francs: 1. the offer or proposal to commit an offense under this section; 2. acceptance of this offer or proposal. Section: 161 Shall be punished by imprisonment of one to five years and a fine of five thousand to ten thousand francs anyone, in war, knowingly perform an act likely to harm the national defense and unchecked by another text. Section: 162 The acts specified above shall be punishable with the same penalties if committed towards the allies of the Republic acting against the common enemy. Section: 163 Shall be punished by imprisonment for five to ten years and a fine of two hundred thousand francs at most, one who, by donations, fees, promises, threats, abuse of authority or power, or will be recruited men created or received commitments of men in favor of an armed force other than the regular armies of states. Shall be punished by imprisonment of one to five years and a fine of one hundred thousand francs at most, anyone who agreed to be hired or recruited in favor of an armed force other than the regular armies of states. The offenses under this section shall be prosecuted only upon complaint or authorization of the Government of the Republic. Section 2. Damage to the internal security of the State Section: 164 Shall be punished by death penalty any individual who: 1. resorts to terrorism, armed force or other violence to undermine the established powers and constitutional principles; 2. will impair the person's head of state for the same purposes. Section: 165 The plot aimed crimes mentioned in the preceding article shall be punished with imprisonment for life if any act has been committed to prepare the execution, and imprisonment of ten to twenty years otherwise. If there was a proposal made by unlicensed, to conspire to get to the crimes mentioned in the preceding article, the one who has made such a proposal will be punished by imprisonment of five to ten years and a fine of 10000-2 hundred thousand francs. Section: 166 Anyone who through speeches delivered at meetings or public places, either by written or printed material, images or emblems of any kind, displayed, distributed, sold, offered for sale or exposed to public view, either knowingly spreading false noise, will be excited or attempted to excite the people against the authorities, either raised or tried to raise citizens against each other, be alarmed populations and thus sought to bring the unrest in the territory of the Republic, will be punished by imprisonment of two to ten years and a fine of 2000 to 100,000 francs or one of these penalties, without prejudice to more severe penalties under other provisions of this code. Section: 167 Whoever, maliciously and publicly attacked the enforceability of laws or caused directly disobey will be punished by imprisonment of two months to five years and a fine of 2000 to 10,000 francs, or one of these penalties. Penalties under the preceding paragraph shall be doubled if the provocation was implemented. Section: 168 The attacks aimed at bringing about devastation, massacre or looting, shall be punished by imprisonment of fifteen to twenty years. The plot aimed crimes mentioned in paragraph one shall be punished by imprisonment for ten to fifteen years if any act has been committed to prepare the execution, and imprisonment of five to ten years in the otherwise. If the attempt or conspiracy caused the loss of lives, the offender shall be punished with the death penalty. Section: 169 Conspiracy under sections 165 and 168 are once the resolution has been concerted action and arrested by two or more persons. Section: 170 Whoever, either to seize the public money or to invade positions, stores, arsenals, ports, aircraft, ships, buildings or other property of the State, either for plunder or share of public properties, either to attack or resistance to the police case against the perpetrators of these offenses will be put at the head of hostile bands will or exercised any function or command, shall be punished with imprisonment from ten to twenty years. Will be punished to the same punishment whoever led the sedition or exercised in the same band a job or any command, even if it has not been seized at the scene. Section: 172 Except when the seditious meeting has had the purpose or result of an offense under section 164, individuals belonging to specific bands and previous articles, there have had no command or employment, have been seized on the premises, shall be punished by imprisonment of ten to twenty years. Section: 173 Those who, knowing the purpose or character of said bands, these bands have provided their divisions or housing, pensions, meeting or any relief, shall be punished as accomplices. Section: 174 It may be pronounced no sentence of the head of sedition against those who, having been part of these bands without engaging in any command or perform any employment or office, is the first warning will be removed or at the first summons of civil or military authorities . It will be the same when they have been seized off the premises of the seditious meeting without resistance and without a weapon. They will nonetheless be punished because of other offenses committed by them personally. Section: 175 Shall be punished with imprisonment from five to twenty years and a fine of 10,000 to 20,000 francs, without prejudice to more severe penalties under other legal provisions, those who, in an insurgency: 1. will, to attack or resistance to the police, carried arms or ammunition, apparent or hidden; 2. will, for the same purpose, invaded or occupied public buildings or houses inhabited or not inhabited, roads, public places or any place; 3. will be placed, is placed or helped place or have placed barricades, trenches, or other obstacles designed to impede or stop the intervention of the police or the movement of people; 4. will be prevented, using violence or threats, the convening of the meeting or the police; 5. have caused or facilitated the gathering of insurgents, either by using violence or threats or by the distribution of orders or proclamations, or by wearing flags or other signs of rallying, or by any other means Appeals; 6. will be seized arms or ammunition, or using violence or threats or by the looting of shops or public institutions or by the disarmament of the police force; 7. will invade a house inhabited or uninhabited, using violence or threats; 8. will, in any other way, neutralized the police or the actions of public authorities. By insurgent movement, means a collective movement which adversely affects the powers or the established order, manifested by attacks against people and property by fire, devastation or pillage. By public force, means all the agents that ensure by force, on behalf of the Republic, the execution of deeds and maintaining public order. Section: 176 The Chiefs, in any capacity, insurgent movements suppressed by the preceding article shall be liable to the death penalty. Section: 177 Penalties under sections 175 and 176 will be made without prejudice to the culprits would have incurred as principals or accessories to any other offenses, except to apply, where applicable, the rules on competition offenses. Section 3. Additional provisions or common to the previous sections Section: 178 Subject to the obligations of professional secrecy shall be punished by imprisonment of ten to twenty years and a fine of twenty thousand francs at most one who, in wartime, with knowledge of projects or acts of treason, espionage or other activities likely to harm national defense, will not make the statement to the military authorities, administrative or judicial from the moment he has known. Section: 179 Fence shall be punished as anyone, other than the perpetrator or accomplice: 1. knowingly will conceal objects or instruments used or to be used to commit the crime or offense, or objects, materials or documents obtained by crime or offense; 2. destroy, subtract, knowingly conceal or alter any documents likely to facilitate the investigation of crime or offense, the discovery of evidence or the punishment of its perpetrators. Section: 180 In the cases provided for in section 179, the court may waive the penalty spouse, parents or relatives of the guilty, to the sixth degree inclusive. Section: 181 Will be free from the penalty who, prior to execution and before the opening of legal proceedings, will be made known to the administrative, judicial or military presence, preparation, names of authors and accomplices of crimes and offenses against state security. The court will reduce the penalty by the set of mitigating circumstances: 1. if termination occurs after the completion of the crime or offense, but before the institution of proceedings; 2. if, after the commencement of proceedings, the culprit gives the arrest of the perpetrators or accomplices of the same offense or other offenses of the same or of equal seriousness. Section: 182 Compensation received by an offense against the State Security, or the amount of its value if the payment could not be seized, will be declared forfeited to the State by the judgment. Section: 183 The court will pronounce the confiscation of the object of the crime or offense, weapons, objects or instruments used to commit it. Section: 184 The Government may, by presidential order, or to extend time of war or to peace-time, or all of the provisions relating to crimes or offenses against state security, acts relating to it, which would committed against allies or friends of the Republic. Section: 185 In terms of crime or crime against state security, the offense committed outside the territory of the Republic is punishable as an offense committed in the territory. Section 4. Acts hostile to the Heads of State and foreign diplomats Section: 186 Whoever violated the person of a foreign leader, a member of a foreign government, a representative, or official of a State or an intergovernmental organization, during the stay in Rwanda that person in respect of those qualities will be punished with imprisonment from five to twenty years, without prejudice to more severe penalties under other legal provisions. Will be punished to the same penalty, whoever violated a family member of one of the aforementioned persons. Will be punished by imprisonment of two months to five years, anyone who violated the official premises, private accommodation or means of transportation from one of the people mentioned in the previous two paragraphs, without prejudice to more severe penalties provided for by other legal provisions. Section: 187 Whoever publicly insulted one of the persons mentioned in the preceding article shall be punished with imprisonment from three months to three years and a fine of five thousand francs at most, or one of these penalties. Section: 188 Anyone who abducts, destroys damaged, or defaced insulted the flag or insignia of sovereignty of a foreign State, hoisted or exposed publicly, shall be punished with imprisonment from three months to two years and a fine of two thousand francs maximum, or one of these penalties. Section: 189 The offenses under this severs will continue on the complaint of the victim or, failing that, on termination of the foreign government or international organization of which depends on the victim, and if the Rwandan government authorizes this lawsuit. Section 5. OFFENCES AGAINST PUBLIC WITNESS Section 1. Counterfeiting, forgery and Section: 193 Shall be punished by imprisonment for five to ten years and a fine of 20,000 to 100,000 francs one who, fraudulently, will be forged, altered or colored metal coins which are legal tender in Rwanda or abroad, and that to be introduced or delivered within the territory of Rwanda, and he knew of counterfeit coins, colored or altered. The same penalties will be one who, knowing wrong will be used, distributed, sold or peddled the seals, stamps, hammers, punches, brands, counterfeit or forged papers. Anyone being unduly procured the genuine seals, stamps or punches, or print, has made a fraudulent application or use, shall be punished by imprisonment of one to five years and a fine of fifty thousand francs at most, or one of these penalties. Section: 199 Shall be punished with imprisonment for two months to a year and a fine of twenty thousand francs at most, or one of those penalties: 1. one who has knowingly made use of postage stamps or stamps previously used mobile; 2. one who has, by any means, altered stamps to remove them from obliteration, and enable reuse; 3. one who has overloaded, by printing, perforation or other means, postage stamps, outdated or issued by the Rwandan government positions; 4. one who has forged or altered stamps, stamps, imprints or postage reply coupons issued by the postal service of a foreign country. The same penalties will be one who, knowing wrong, will be used, distributed, sold or peddled stamps, stickers, prints coupons or counterfeited or falsified. Section: 200 Shall be punished with imprisonment for two months to a year and a fine of twenty thousand francs at most, or one of those penalties: 1. one who has manufactured, sold, hawked, distributed, offered or given in payment or any property used, or printed forms, obtained by any method, which, by their outward form, would present with coins or banknotes that are being Legal in Rwanda or abroad, with titles, labels and stamps of the Rwandan administration positions, stocks, bonds, shares of interest, and dividend coupons, usually with the fiduciary values issued by the State, public bodies, corporations, companies or private companies, a resemblance which may facilitate the acceptance of said objects, printed documents or forms, in lieu of values imitated; 2. one who has manufactured, sold, hawked, distributed or used for printed which, by their size, color, text, layout, typography, or other character, would present papers with letterhead or official forms in use in assemblies established by the Constitution, governments and jurisdictions, a resemblance that might cause a misunderstanding in the minds of the public. Section: 201 In all cases covered by Articles 198 to 200, the court shall order the confiscation of seals, dies, stamps or other marks counterfeit, forged or altered in any way. Section 3. Of forgery Section: 202 Shall be punished by imprisonment for five to ten years and a fine of one hundred thousand francs at most who commits a wrong, or by affixing forged signatures, or by alteration of records or signatures, or by impersonation or by making agreements, arrangements, obligations or discharge or by inserting after their strokes in these acts, either by additions or alterations of clauses or statements made that these acts were intended to receive and note. Section: 203 If the forgery was committed in the exercise of his functions by an officer or person charged with a public service, the maximum imprisonment is increased to twenty one years and a fine of two hundred thousand francs. Section: 204 Whoever, knowing wrong, avails itself of the act of false or counterfeit coin, shall be punished the same penalties as the perpetrator of the forgery. Section: 205 Are excepted from the provisions above, false under sections 206, 207 and 208. Section: 206 Shall be punished with imprisonment from three months to two years and a fine of ten thousand francs or more than one of these penalties: 1. one that will be done improperly issuing permits, certificates, booklets, maps, newsletters, passports, passes or other documents issued by government to establish a right, an identity or status, or to grant permission or by making false statements, or by taking a false name or a false capacity or by providing false information or certificates; 2. whoever has made use of such a document, or obtained under the conditions described in the preceding paragraph, is established under a different name than his. Section: 207 The official, who knowingly deliver or cause to issue a document under section 206 to a person who is no law shall be punished by imprisonment of one to five years and a fine of fifty thousand francs at most, or one of these penalties. Section: 208 Shall be punished with imprisonment for two months to two years and a fine of twenty thousand francs at most, or one of these penalties, any person who: 1. has knowingly made a statement or a certificate stating materially inaccurate facts; 2. will be altered or falsified in any way a certificate or a certificate originally sincere; 3. has knowingly made use of a certificate or certificate inaccurate or falsified. Section 4. Of perjury and false swearing Section: 209 Whoever shall be guilty of perjury in court shall be punished by imprisonment of one to five years and a fine of twenty thousand francs at most, or one of these penalties. Breaches of confidentiality and secrecy of letters Section: 214 Persons vested by their status or profession of the secrets entrusted to them who, except in cases where they are called to give evidence in court or where the law requires them to know these secrets or authorizes them to whistleblowers, the have proved, shall be punished by imprisonment of two months to two years and a fine of fifty thousand francs at most, or one of these penalties. The prohibition to hold public office or employment for up to ten years may be imposed. Article 215 Whoever, except as provided by law and bad faith, opened or deleted letters, postcards or other items entrusted to the post office, or ordered or facilitated the opening or removal of these letters, cards or objects, shall be punished with imprisonment from eight days to three months and a fine of twenty thousand francs at most, or one of these penalties. The fine may be increased to fifty thousand francs, or if the letter was sent registered or insured or contained realizable values. The imprisonment will be increased to two years if the officer is guilty of Posts and Telecommunications or commissioned as such. Section: 216 Any postal employee or person commissioned to ensure that the postal service, except in cases where the law so require, will reveal the existence or content of a letter, a postcard or other mailing entrusted mailed, shall be punished with imprisonment of up to one year and a fine of twenty thousand francs at most, or one of these penalties. Section 6. The same penalties will be one who, without fulfilling the conditions required to wear or use, have worn a suit or a uniform or have used or will be claimed a title attached to a legally regulated profession, a formal degree or quality of whose conditions were determined by allocation of public authority. Section: 219 Shall be punished by a fine of 100-2000 francs one who, in a public act or authentic, or in an administrative document for the public authority has not taken the name that is rightfully hers. Section 7. Hijackings and extortion by public officials Section: 220 Shall be punished with imprisonment from five to twenty years and a fine of fifty thousand francs at most, any public official or officer, any person charged with a public service: 1. to be diverted or removes public or private funds, in lieu of the effects, parts, titles, deeds, chattels that were in his hands or under or in respect of its functions; 2. who will maliciously or fraudulently destroyed or deleted titles or acts of which he was in his capacity as depositary, or who had been sent to because of his duties. Section: 221 Shall be punished with imprisonment from six months to five years and a fine of twenty thousand francs at most, or one of these penalties, all magistrates, civil servants, public officials or other persons responsible for a service public, who are guilty of extortion and ordered to charge, demanding or receiving what they knew or should not be beyond what was due to duties, taxes, contributions, fines or bail, or interest income, wages and salaries. Section: 222 Shall be punished with the penalties in section 221, any public official or officer, any person charged with a public service, in any form and for any reason whatsoever, shall, without authorization by law, granted exemptions or franchise fees, taxes, fines or bail, or has made the issue of free products of state institutions. Section 8. Corruption of public officials, referees or experts appointed by Justice Section: 223 Any magistrate, officer, public officer or other person charged with a public service, any arbitrator or expert appointed to justice, which accepts offers or promises, who has demanded or accepted gifts or presents to an act of his function of his job or mission, but even just not subject to retribution, or to do an act which, apart from his personal powers, was or would have been facilitated by his office or service, shall be punished by imprisonment six months to five years and a fine of five thousand to thirty thousand francs, or one of these penalties. He shall be punished by imprisonment for one year to twenty years and a fine of 10,000 to 100,000 francs or one of those penalties if required or approved donations, gifts, offers or promises, or to the exercise of his duties of his employment or his mission or an unjust act punishable by law, or to refrain from doing any act which falls within the range of his duties. Section: 224 Shall be punished with imprisonment from three months to two years and a fine of fifty thousand francs at most, or one of these penalties, any person who has applied for or accepts offers or promises, solicited or received donations or present, to obtain, obtain or attempt to obtain medals, decorations and awards, places, positions or employment or of favors granted by the public authority, markets, business or other profits arising from contracts with the public authority or administration under the control of public power, or, in general, a favorable decision of such authority or administration, and so will have abused a real or supposed influence. Section: 226 The judge or arbitrator who will be decided by corruption will be punished by imprisonment of five to fifteen years. If, as a result of corruption, there was a sentence greater than fifteen years' imprisonment, the sentence, whatever it is, will the judge appliqée guilty of corruption. Section: 227 Any judge, referee or official who will be decided by a party favor or enmity against it, shall be punished by five to ten years imprisonment and a fine of fifty thousand francs at most, or one of these penalties. Section 9. Chapter 3. OFFENCES AGAINST PUBLIC ORDER Section 1. Of rebellion Section: 230 Attack is described as rebellion, resistance with violence, assault or threats to the trustees or officers of the authority or law enforcement officials acting for the execution of laws, ordinances or orders of public authority, judgments or other enforceable documents. Section: 231 Without prejudice to more severe penalties provided for in respect of State Security, the rebellion will be punished: 1. imprisonment for a term of eight days to six months if it was committed by an unarmed person; 2. by imprisonment of three months to two years if it was committed by a person with weapons; 3. by imprisonment of three months to two years if it was committed by several people unarmed and without prior consultation, if there was previous agreement, the term shall be one year to five years; 4. by imprisonment of one to five years if it was committed by several persons in possession of weapons without prior consultation, if there was previous agreement, the term shall be five to ten years. The maximum sentence will be pronounced if the perpetrators have performed duties in command of the rebellion or provoked. Section: 232 In case of rebellion or gatherings with tape, section 174 of this Code shall apply to the rebels without office or employment in the band, which will be removed at the first warning of the public authority or even since they were seized outside the place of the rebellion, without resistance and without new weapon. Section: 233 Shall be punished with imprisonment of up to two months and a fine of two thousand francs at most, or one of those penalties: 1. one who publicly commit any act or make any gesture, or hold any words likely to mark or cause of contempt for emblems or insignia adopted by the enforcement officers to reveal the existence of a mandate public or in respect of documents or things provided in compliance with applicable laws or regulations; 2. whoever does not provide information requested by the administration officials, judges or officers of the judiciary, the police officers or agents of the police force acting on the execution of their duties, or, knowingly give false response to a request of this nature; 3. one who, except in cases of force majeure, will not respond to a summons service and written his name from a magistrate, an officer, a police officer, an officer of a command or prefectural municipal or any other holder of the authority. Section 2. Section: 240 Violence or assaults to the head of state will be punished with imprisonment from ten to twenty years if they were not the cause of bloodshed, injury or illness. If they were the cause of bloodshed, injury or illness, or whether there was premeditation or ambush, the penalty is life imprisonment. If death ensued or if the violence was committed with intent to murder, the offender shall be punished by death. Section 3. Barriers to implementation of public works Section: 247 Whoever, by assault, will be opposing the execution of work, order or authorization by the competent authority, shall be punished with imprisonment from eight days to three months and a fine of five thousand francs at most, or one of these penalties. Section: 250 Shall be punished with imprisonment for two months to two years and a fine of two hundred thousand francs at most, or one of those penalties: 1. one who, in the auction, has impeded or disturbed the freedom auction or bids, for assault, violence or threats, either before or during the auction or tender; 2. one who, by gifts, promises or agreements fraudulent, has rejected the bid, auction or limited tenders and the one who gets accepted such gifts or promises. Section: 251 Shall be punished with imprisonment for two months to two years and a fine of five hundred thousand francs at most, or one of these penalties, who by any fraudulent means or ways, or exercising, or individually or by meeting a policy on the market in order to obtain a gain that is not the result of natural play of supply and demand, have made the artificial rise or fall in commodity prices or goods or effects of public or private. The prison sentence may be increased to five years and a fine of one million francs, if the rise or fall has been made on food, beverages or fuel. Section: 252 Shall be punished with imprisonment for two months to two years and a fine of five thousand francs at most, or one of these penalties, who, with violence, assault, threats or fraudulent, will be brought or maintained a concerted work stoppage, in order to force up or falling wages or impeding the free exercise of industry and labor. Section: 255 Without prejudice to more severe penalties under other provisions, shall be punished by imprisonment of one to five years and a fine of 10,000 to 50,000 francs, or one of these penalties, the who shall be guilty of kidnapping, deletion, substitution or assumption of child. Section: 286 Any beggar or tramp who has been found carrying weapons or instruments to commit theft or other crimes or to enter homes, or who have used violence against persons, shall be punished with imprisonment for two years to five years, without prejudice to stronger penalties, if any, due to the type and circumstances of violence. Section 3. The escape of prisoners Section: 287 Will be sentenced to a prison term equal to twice the length of the escape, without that penalty to be less than six months: 1. prisoners who will be escaped during a transfer to a health facility or hospital; 2. prisoners who will be escaped while they were employed outside a prison or while in receipt of a temporary absence of a prison. Section: 288 Whoever procures or facilitated the escape of a prisoner shall be punished with imprisonment for two months to a year and a fine of 2000 to 10,000 francs, or one of these penalties. Article: 291 Si l'évasion a eu lieu ou a été tentée avec violence, menaces, ou bris de prison ou si elle a eu lieu en corrompant les gardiens : 1. les peines encourues par les détenus seront égales au triple de celles qui sont prévues par l'article 287; 2. les peines encourues par tous ceux qui l'auront favorisée, soit par leur coopération, soit en fournissant des instruments ou armes propres à l'opérer, seront égales au triple de celles prévues par l'article 288. Section 4. De la rupture de ban Article: 292 Le condamné qui contreviendra à l'obligation de s'éloigner de certains lieux ou d'une certaine région, ou d'habiter dans un lieu déterminé, prévue aux articles 54 à 58 du présent code, se rendra coupable de rupture de ban; il sera puni d'une peine d'emprisonnement d'une durée au moins égale au délai qui restait pour purger sa peine, et qui ne pourra excéder le double de ce délai. Chapitre 5. DES INFRACTIONS CONTRE LES DROITS GARANTIS AUX PARTICULIERS Section 1. Des atteintes à la liberté des cultes Article: 293 Sera puni d'un emprisonnement de huit jours à trois mois et d'une amende de cent à mille francs, ou de l'une de ces peines seulement : 1. celui qui, par des violences, outrages ou menaces, aura contraint ou empêché une ou plusieurs personnes d'exercer un culte, d'assister à l'exercice de ce culte, de célébrer certaines fêtes religieuses ou d'observer certains jours de repos religieux; 2. celui qui, par des troubles ou des désordres, aura empêché, retardé ou interrompu les exercices d'un culte qui se pratique dans les cérémonies publiques de ce culte. Article: 294 Quiconque, par des faits, paroles, gestes, écrits, ou menaces, aura outragé publiquement les rites ou les objets d'un culte soit dans les lieux destinés ou servant habituellement à son exercice, soit dans des cérémonies publiques, sera puni d'un emprisonnement de quinze jours à six mois et d'une amende de cinq cents à deux mille francs ou de l'une de ces peines seulement. Article: 295 Sera puni des mêmes peines celui qui par faits, paroles, gestes ou menaces, aura outragé le ministre d'un culte dans l'exercice de son ministère. S'il l'a frappé, il sera puni d'un emprisonnement de deux mois à deux ans et d'une amende de cinq cents à cinq mille francs ou de l'une de ces peines seulement. Article: 296 Si les coups ont été cause d'effusion de sang, de blessures ou de maladies, le coupable sera puni d'un emprisonnement d'un an à cinq ans et d'une amende de mille à dix mille francs ou de l'une de ces peines seulement. Section 2. Des atteintes portées par des fonctionnaires aux droits garantis aux particuliers Article: 297 Tout fonctionnaire ou officier public, tout dépositaire ou agent de l'autorité ou de la force publique, qui aura illégalement ou arbitrairement arrêté ou fait arrêter, détenu ou fait détenir une ou plusieurs personnes, sera puni d'un emprisonnement de trois mois à cinq ans et d'une amende de cinq mille à dix mille francs, ou de l'une de ces peines seulement. L'emprisonnement sera de six mois à dix ans si la détention illégale ou arbitraire a duré plus d'un mois. Article: 298 Tout fonctionnaire ou dépositaire de l'autorité, tout officier de justice ou de police, tout agent de la force publique, quel qu'en soit le grade, qui, agissant en cette qualité, et hors les cas et les conditions où la loi permet d'entrer dans le domicile des particuliers contre leur volonté, se sera introduit dans une maison, une chambre ou tout autre logement habité par autrui ou leurs dépendances clôturées, sera puni d'un emprisonnement de huit jours à six mois et d'une amende de mille à cinq mille francs. Article: 299 Tout fonctionnaire ou officier public chargé de la police administrative ou judiciaire qui, en ayant le pouvoir, aura négligé ou refusé de faire cesser une détention illégale portée à sa connaissance, sera puni d'un emprisonnement d'un mois à un an et d'une amende de mille à cinq mille francs. Tout fonctionnaire ou officier public chargé de la police administrative ou judiciaire qui, n'ayant pas le pouvoir de faire cesser une détention illégale, aura négligé ou refusé de constater celle qui aura été portée à sa connaissance et de la dénoncer à l'autorité compétente, sera puni d'un emprisonnement de huit jours à six mois et d'une amende de cinq cents à deux mille francs. Article: 300 Tout directeur de prison ou autre agent préposé à la garde des prisons qui aura reçu un prisonnier sans ordre écrit, sans mandat ou sans jugement, sera puni d'un emprisonnement de huit jours à six mois et d'une amende de cinq cents à deux mille francs. Article: 301 Tout fonctionnaire public révoqué, destitué, suspendu ou interdit légalement qui, après en avoir eu la connaissance officielle aura continué l'exercice de ses fonctions ou qui, étant électif ou temporaire, les aura exercées après avoir été remplacé, sera puni d'un emprisonnement de six mois à deux ans et d'une amende de mille à cinq mille francs. Article: 302 Tout autre acte arbitraire et attentatoire aux libertés et aux droits garantis aux particuliers par la Constitution, les lois et les règlements, ordonné ou exécuté par un fonctionnaire ou officier public, par un dépositaire ou agent de l'autorité ou de la force publique, sera puni d'un emprisonnement de trois mois à cinq ans et d'une amende de deux mille à dix mille francs ou de l'une de ces peines seulement, sans préjudice de peines plus fortes édictées par d'autres dispositions légales. Article: 303 Pour les infractions prévues par la présente section, les juges auront la faculté de prononcer en outre les interdictions prévues par l'article 66, 1. et 2.. Section 3. Autres atteintes aux droits des particuliers Article: 304 Sera puni d'un emprisonnement de quinze jours à deux ans et d'une amende de trois mille francs au maximum, ou de l'une de ces peines seulement, celui qui, sans ordre de l'autorité et hors les cas où la loi permet d'entrer dans le domicile des particuliers contre leur volonté, se sera introduit dans une maison, une chambre ou un logement habité par autrui ou leurs dépendances, soit à l'aide de menaces ou de violences contre les personnes, soit au moyen d'effraction, d'escalade ou de fausses clefs. Article: 305 Celui qui pénètre contre la volonté de l'occupant dans une maison, un appartement, une chambre, ou tout autre logement ou leurs dépendances clôturées, sera puni d'un emprisonnement de huit jours à deux mois et d'une amende de deux mille francs au plus, ou de l'une de ces peines seulement. Article: 306 Sera puni d'un emprisonnement de huit jours à deux mois et d'une amende de mille francs au maximum ou de l'une de ces peines seulement, quiconque aura, contre le gré de celui qui en est porteur ou sans motif légitime, retenu, soit une attestation ou autorisation remise par un agent de l'autorité constatant l'exercice d'un droit dans la personne de celui à qui elle a été délivrée, soit un certificat, document ou reçu officiel attestant qu'une personne a satisfait à une obligation légale ou réglementaire envers l'autorité et dont la privation pourrait l'exposer personnellement à des poursuites ou y exposer l'agent de l'autorité qui avait l'obligation de délivrer cette pièce. Article: 307 Sera puni d'un emprisonnement de trois mois à deux ans et d'une amende de cinq mille francs au maximum, tout commis, employé ou préposé, salarié ou rémunéré sous une forme quelconque qui, soit directement, soit par personne interposée, aura, à l'insu et sans le consentement de son patron, soit sollicité ou agréé des offres ou promesses, soit sollicité ou reçu des dons, présents, commissions, escomptes ou primes, pour faire ou s'abstenir d'un acte de son emploi, ou pour faire ou s'abstenir d'un acte qui, bien qu'en dehors de ses attributions, était ou aurait été facilité par sa fonction ou par le service qu'il assurait. Article: 308 Celui qui, pour obtenir l'accomplissement ou l'abstention d'un acte prévu à l'article 307, aura usé de voies de fait ou menaces, de promesses, offres, dons ou présents, sera puni des mêmes peines que la personne corrompue, que la contrainte ou la corruption ait ou non produit son effet. Article: 309 Les dispositions de l'article 223, alinéa 2, sont applicables dans les cas de corruption prévus aux articles 307 et 308. Titre 2. DES INFRACTIONS CONTRE LES PERSONNES Chapitre 1. DE L'HOMICIDE ET DES LESIONS CORPORELLES VOLONTAIRES Article: 310 Sont qualifiés volontaires, l'homicide commis et les lésions causées avec le dessein d'attenter à la personne d'un individu déterminé ou de celui qui sera trouvé ou rencontré, alors même que l'auteur se serait trompé sur la personne de celui qui a été victime de l'attentat ou que son dessein fût dépendant de quelque circonstance ou condition. La préméditation, consiste dans le dessein, formé avant l'action, d'attenter à la personne d'un individu. Le guet-apens consiste à attendre plus ou moins de temps, dans un ou divers lieux, un individu soit pour lui donner la mort, soit pour exercer sur lui des actes de violence. Section 1. Du meurtre et de ses diverses espèces Article: 311 L'homicide commis avec l'intention de donner la mort est qualifié meurtre; il emporte la peine d'emprisonnement à perpétuité. Article: 312 Le meurtre commis avec préméditation ou guet-apens est qualifié assassinat; il emporte la peine de mort. Article: 313 Est qualifié parricide le meurtre des pères ou mères; il emporte la peine de mort. Article: 314 Est qualifié infanticide le meurtre ou l'assassinat commis sur un enfant au moment de sa naissance ou immédiatement après; il sera considéré comme meurtre ou comme assassinat suivant les circonstances. Article: 315 Est qualifié empoisonnement, l'attentat à la vie d'une personne commis par le moyen de substances qui peuvent donner la mort plus ou moins promptement, de quelque manière que ces substances aient été employées ou administrées et quelles qu'en aient été les suites; il emporte la peine de mort. Article: 316 Sera puni comme coupable d'assassinat celui qui, pour l'exécution de son crime, quelle qu'en soit la dénomination, emploie des tortures ou commet des actes de barbarie. Article: 317 Le meurtre emportera la peine de mort, lorsqu'il aura précédé, accompagné ou suivi un autre crime. Il en sera de même lorsqu'il aura eu pour objet, soit de préparer, faciliter ou exécuter une infraction, soit de favoriser la fuite ou d'assurer l'impunité des auteurs ou complices de cette infraction. Section 2. De l'homicide volontaire non qualifié meurtre et des lésions corporelles volontaires Article: 318 Quiconque a volontairement fait des blessures ou porté des coups ou commis toute autre violence grave, sera puni d'un emprisonnement d'un mois à un an et d'une amende de cinq cents à deux mille francs, ou de l'une de ces peines seulement. En cas de préméditation ou de guet-apens, le coupable sera condamné à un emprisonnement de deux mois à deux ans et à une amende de mille à cinq mille francs ou à l'une de ces peines seulement. Article: 319 Si les coups ou les blessures ont causé une maladie ou une incapacité de travail personnel, le coupable sera puni d'un emprisonnement de deux mois à deux ans et d'une amende de cinq cents à deux mille francs. Le coupable sera puni d'un emprisonnement de six mois à trois ans et d'une amende de mille à cinq mille francs s'il a agi avec préméditation ou guet-apens. Article: 320 Les peines seront un emprisonnement de deux ans à cinq ans et une amende de deux mille à cinq mille francs s'il est résulté des coups ou des blessures, soit une maladie paraissant incurable, soit une incapacité permanente de travail personnel, soit la perte de l'usage absolu d'un organe, soit une mutilation grave. Le coupable sera puni d'un emprisonnement de cinq à dix ans s'il a agi avec préméditation ou guet-apens. Article: 321 Lorsque les coups portés ou les blessures faites volontairement mais sans intention de donner la mort, l'ont pourtant causée, le coupable sera puni d'un emprisonnement de cinq à dix ans et d'une amende qui ne pourra excéder dix mille francs. Il sera puni d'un emprisonnement de dix à quinze ans s'il a commis ces actes de violence avec préméditation ou guet-apens. Article: 322 Dans les cas prévus par les articles 318 à 321, si le coupable a commis l'infraction envers ses père et mère légitimes, naturels ou adoptifs, ou envers ses ascendants légitimes, le maximum des peines par ces articles sera prononcé. Article: 323 Sera puni d'un emprisonnement de un à cinq ans et d'une amende qui n'excèdera pas vingt mille francs ou de l'une de ces peines seulement, quiconque aura volontairement porté des coups ou fait des blessures à un enfant âgé de moins de 14 ans ou à une personne qui, à raison de son état physique ou mental, était incapable d'assurer sa défense. Sera puni des mêmes peines, quiconque aura volontairement privé d'aliments ou de soins, au point de compromettre sa santé, un enfant âgé de moins de 14 ans ou une personne qui, à raison de son état physique ou mental, n'était pas à même de pourvoir à son entretien. Le coupable sera puni d'un emprisonnement de cinq à dix ans s'il a agi avec préméditation ou guet-apens ou s'il est résulté des coups ou blessures ou des privations une maladie ou une incapacité de travail personnel de plus d'un mois. Si le coupable est le père ou la mère légitime, naturel ou adoptif, ou un autre ascendant, ou toute autre personne ayant autorité sur l'enfant ou sur l'incapable ou en ayant la garde, l'emprisonnement sera porté à dix ans dans les cas prévus aux alinéas 1er et 2 et à vingt ans dans les cas prévus à l'alinéa 3 cidessus. Article: 324 Si les coups ou blessures ou les privations ont occasionné la mort mais sans intention de la donner, la peine sera celle de l'emprisonnement à perpétuité. Si la mort résulte des coups ou blessures ou des privations infligées avec l'intention de la donner, le coupable sera puni de mort. Article: 325 Celui qui, par aliments, breuvages, médicaments, manœuvres, violences ou tout autre moyen, aura, à dessein, fait avorter une femme enceinte ou supposée enceinte qui n'y aura point consenti, sera puni d'un emprisonnement de cinq à dix ans. Si la femme y a consenti, le coupable sera puni d'un emprisonnement de deux à cinq ans. La femme qui, volontairement, se sera fait ou aura tenté de se faire avorter ou aura consenti à l'usage des moyens administrés à cet effet sera punie d'un emprisonnement de deux à cinq ans. Article: 326 Lorsque les moyens employés en vue de faire avorter la femme auront causé sa mort, celui qui les aura administrés ou fait administrer ou procurés dans ce but sera puni d'un emprisonnement de cinq à dix ans si la femme avait consenti à l'avortement, et à un emprisonnement de dix à vingt ans si la femme n'y avait point consenti. Article: 327 Toutefois, par dérogation aux articles 325 et 326, il n'y a pas de responsabilité pénale pour le médecin qui a pratiqué l'avortement, ni pour la femme qui y a consenti, si les conditions suivantes sont réunies : 1. qu'il soit constaté par deux médecins, après examen et discussion, que la poursuite de la grossesse met en péril grave la santé de la femme; 2. que cette constatation soit faite par écrit, en quatre exemplaires signés par chacun des médecins consultants; 3. que l'un des exemplaires de la consultation soit remis à l'intéressée, et qu'un deuxième exemplaire soit adressé au médecin responsable du secteur médical dans le ressort duquel doit être pratiqué l'avortement, les autres exemplaires étant conservés par les médecins consultants; 4. que l'avortement soit pratiqué par un médecin de l'Etat ou agréé par l'Etat, et qu'il ait lieu dans un établissement d'hospitalisation public ou dans un établissement d'hospitalisation privé agréé par l'Etat. Article: 328 Dans les cas prévus par les articles 325 et 326, si le coupable est médecin, accoucheur, dentiste, pharmacien, vétérinaire, étudiant en médecine ou en pharmacie, herboriste, employé en pharmacie, ou d'une manière générale s'il fait profession de tous actes quelconques relevant de l'ordre médical, vétérinaire, pharmaceutique ou sanitaire, il sera en outre condamné à l'interdiction d'exercer sa profession pendant une durée d'un an à cinq ans. En cas de récidive, cette interdiction sera définitive. S'il contrevient à l'interdiction prononcée en vertu de l'un des alinéas précédents, il sera puni d'un emprisonnement de six mois à deux ans et d'une amende qui ne pourra excéder cinquante mille francs ou de l'une de ces peines seulement. Article: 329 Sera puni d'un emprisonnement de trois mois à cinq ans et d'une amende de mille à dix mille francs ou de l'une de ces peines seulement, quiconque aura causé à autrui une maladie ou une incapacité de travail personnel en lui administrant volontairement, mais sans intention de tuer, des substances qui peuvent donner la mort ou des substances qui, sans être de nature à donner la mort, peuvent cependant gravement altérer la santé. La peine sera un emprisonnement de cinq ans à dix ans lorsque ces substances auront causé soit une maladie paraissant incurable, soit une incapacité permanente de travail personnel, soit la perte de l'usage absolu d'un organe. Si les substances administrées, volontairement, mais sans intention de donner la mort, l'ont pourtant causée, le coupable sera puni d'un emprisonnement de dix ans à vingt ans. Dans les cas prévus par les alinéas précédents, si le coupable a administré ces substances à ses père et mère légitimes, naturels ou adoptifs, ou à ses ascendants légitimes ou à un enfant de moins de 14 ans, le maximum des peines prévues par ces alinéas sera prononcé. Article: 330 Sera puni d'un emprisonnement de sept jours au maximum et d'une amende qui n'excèdera pas deux mille francs ou de l'une de ces peines seulement, l'auteur de voies de fait ou violences légères exercées volontairement, particulièrement celui qui aurait, mais sans intention de la frapper ni de la blesser, lancé sur une personne une chose de nature à l'incommoder ou à la souiller. Article: 331 Quiconque aura, par quelque moyen que ce soit, provoqué un duel, sera puni d'un emprisonnement de quinze jours à deux mois et d'une amende de cent francs à cinq cents francs ou de l'une de ces peines seulement. Article: 332 Celui qui, dans un duel, aura donné la mort à son adversaire ou lui aura porté des coups ou fait des blessures, sera puni conformément aux dispositions précédentes relatives à l'homicide et aux lésions corporelles volontaires. Section 3. De l'homicide, des blessures et des coups excusables Article: 333 L'homicide, les blessures, et les coups ne sont excusables que s'ils ont été immédiatement provoqués par des violences graves envers les personnes. Article: 334 Les crimes et les délits mentionnés à l'article précédent sont encore excusables s'ils ont été commis en repoussant, pendant le jour, l'escalade ou l'effraction des clôtures, murs ou entrées d'une maison ou d'un appartement habité ou de leurs dépendances, à moins qu'il ne soit établi que l'agent n'a pas pu croire à un attentat contre les personnes, soit comme but direct de celui qui tente l'escalade ou l'effraction, soit comme conséquence de la résistance que rencontreraient les desseins de celui-ci. Article: 335 Lorsque le fait d'excuse sera prouvé : - s'il s'agit d'un crime emportant la peine de mort ou celle de l'emprisonnement à perpétuité, la peine sera réduite à un emprisonnement d'un an à cinq ans et à une amende de deux mille à cinq mille francs; - s'il s'agit de tout autre crime, elle sera réduite à un emprisonnement de six mois à deux ans et à une amende de cinq cents à deux mille francs; - s'il s'agit d'un délit, la peine sera réduite à un emprisonnement de huit jours à six mois et à une amende qui n'excèdera pas cinq cents francs. Article: 336 Les excuses énumérées dans la présente Sectionne sont pas admissibles si le coupable a commis le crime ou le délit envers ses père, mère ou autres ascendants légitimes ou envers ses père et mère naturels ou adoptifs. Section 4. De l'homicide, des blessures et des coups justifiés Article: 337 Il n'y a ni crime ni délit, lorsque l'homicide, les blessures et les coups étaient commandés par la nécessité actuelle de la légitime défense de soi-même ou d'autrui. Article: 338 Sont compris, dans les cas de nécessité actuelle de la défense, les deux cas suivants : 1. si l'homicide a été commis, si les blessures ont été faites, si les coups ont été portés en repoussant, pendant la nuit, l'escalade ou l'effraction des clôtures, murs ou entrées d'une maison ou d'un appartement habité ou de leurs dépendances, à moins qu'il ne soit établi que l'agent n'a pas pu croire à un attentat contre les personnes, soit comme but direct de celui qui tente l'escalade ou l'effraction, soit comme conséquence de la résistance que rencontreraient les desseins de celui-ci; 2. si le fait a eu lieu en se défendant contre les auteurs de vol ou de pillage, exécutés avec violence envers les personnes. Chapitre 2. MENACES D'ATTENTAT CONTRE LES PERSONNES OU CONTRE LES PROPRIETES Article: 339 Quiconque, par écrit anonyme ou signé, aura menacé, avec ordre ou sous condition, d'un attentat contre les personnes ou les propriétés, punissable de la peine de mort ou d'un emprisonnement à perpétuité, sera condamné à un emprisonnement de six mois à cinq ans et à une amende qui n'excédera pas dix mille francs ou à l'une de ces peines seulement. Si la menace n'a été accompagnée d'aucun ordre ou condition, la peine sera un emprisonnement de trois mois à deux ans et une amende qui n'excédera pas cinq mille francs ou l'une de ces peines seulement. Article: 340 Si la menace faite avec ordre ou sous condition a été verbale, le coupable sera puni d'un emprisonnement de deux mois à un an et d'une amende qui n'excédera pas deux mille francs ou de l'une de ces peines seulement. Article: 341 La menace par gestes, emblèmes, images ou symboles, d'un attentat contre les personnes ou les propriétés, punissable de la peine de mort ou d'un emprisonnement à perpétuité, sera puni d'un emprisonnement de huit jours à trois mois et d'une amende qui n'excédera pas mille francs ou de l'une de ces peines seulement. Article: 342 Quiconque aura, par l'un des moyens prévus à l'article 339, menacé avec ordre ou sous condition d'un attentat contre les personnes ou les propriétés punissable d'un emprisonnement d'au moins cinq ans, sera puni d'un emprisonnement de deux mois à six mois et d'une amende qui n'excédera pas cinq mille francs ou d'une de ces peines seulement. Chapitre 3. DE L'HOMICIDE ET DES LESIONS CORPORELLES INVOLONTAIRES Article: 343 Est coupable d'homicide ou de lésions involontaires celui qui a causé le mal par maladresse, imprudence, inattention, négligence, inobservation des règlements ou tout autre défaut de prévoyance et de précaution, mais sans intention d'attenter à la personne d'autrui. Article: 344 Quiconque aura involontairement causé la mort d'une personne sera puni d'un emprisonnement de trois mois à deux ans et d'une amende de mille à dix mille francs. Article: 345 S'il n'est résulté du défaut de prévoyance ou de précaution que des coups ou des blessures, le coupable sera puni d'un emprisonnement de huit jours à un an et d'une amende de cinq cents à cinq mille francs, ou de l'une de ces peines seulement. Article: 346 Sera puni des mêmes peines ou de l'une d'elles seulement, celui qui aura involontairement causé à autrui une maladie ou une incapacité de travail personnel en lui administrant des substances qui sont de nature à donner la mort ou à altérer gravement la santé. Article: 347 Sera puni au maximum d'un emprisonnement de huit jours et d'une amende de deux cents francs ou de l'une de ces peines seulement, celui qui aura imprudemment jeté sur une personne une chose quelconque pouvant l'incommoder ou la souiller. Chapitre 4. DE DIVERSES AUTRES PRATIQUES INTERDITES Article: 348 Sera puni d'un emprisonnement de deux mois à deux ans et d'une amende qui n'excédera pas dix mille francs, ou de l'une de ces peines seulement, quiconque a recours à des forces prétendues occultes et soumet, de gré ou de force, une personne à un mal physique, réel ou supposé, ou exploite la crédulité des personnes, soit dans le dessein de nuire à autrui ou de troubler la paix des personnes ou des familles, soit en vue de déterminer si un acte ou un événement doit être imputé à une personne, soit en vue d'en déduire toute autre conclusion. Article: 349 Si les faits prévus à l'article 348 ont causé une maladie ou une incapacité de travall personnel ou s'il en est résulté la perte de l'usage absolu d'un organe ou une mutilation grave, l'emprisonnement sera d'un an à vingt ans, et l'amende de mille à vingt mille francs. La peine de mort sera encourue si les faits prévus par l'article 348 ont causé la mort. Article: 350 Sont auteurs ou complices des faits prévus par l'article 348, ceux qui y ont participé suivant les modes prévus par les articles 90 et 91 du présent code. Sont également considérés comme auteurs ou complices de faits précités, ceux qui, de quelque façon que ce soit, ont à dessein fait naître la résolution de les réclamer, de les ordonner ou de les pratiquer. N'est considérée ni comme auteur, ni comme complice, la personne qui a consenti à subir le mal physique prévu par l'article 348. Article: 351 Quand un des faits prévus par l'article 348, qu'il soit ou non constitutif d'infraction, est la cause directe d'une infraction, ceux qui y ont participé seront punis comme complices de l'infraction consécutive, à moins qu'ils n'aient pas pu prévoir qu'elle serait commise. Article: 352 Sera puni d'un emprisonnement de deux mois à deux ans et d'une amende de mille à cinq mille francs ou de l'une de ces peines seulement, celui qui aura méchamment déterré ou mutilé un cadavre humain ou l'aura outragé de quelque manière que ce soit. Chapitre 5. DES ATTENTATS AUX MOEURS Chapitre 1. De l'adultère et de la bigamie Article: 353 L'adultère est l'union sexuelle d'une personne mariée avec une personne autre que son conjoint. Article: 354 La femme convaincue d'adultère sera puni d'un emprisonnement d'un mois à un an. Le mari convaincu d'adultère sera puni d'un emprisonnement d'un mois à six mois et d'une amende de mille francs ou de l'une de ces peines seulement. Article: 355 En cas d'adultère punissable, les peines portées à l'article précédent seront encourues par le complice. Les seules preuves qui pourront être admises contre ce complice seront, outre le flagrant délit, celles qui résulteront de lettres ou autres pièces écrites par lui. Article: 356 La poursuite pour adultère ne pourra être exercée que sur la plainte de l'époux offensé. Celui-ci pourra, par le retrait de sa plainte, arrêter la procédure en tout état de cause. Il pourra arrêter les effets de la condamnation définitive à l'emprisonnement, à la condition de reprendre la vie commune. Article: 357 Quiconque, étant engagé dans les liens du mariage, en aura contracté un autre, avant la dissolution du précédent, sera puni d'un emprisonnement de trois mois à trois ans et d'une amende de mille à vingt mille francs, ou de l'une de ces peines seulement. L'officier public qui aura prêté son ministère à ce mariage, connaissant l'existence du précédent, sera condamné aux mêmes peines. Section 2. De l'attentat à la pudeur et du viol Article: 358 Tout attentat à la pudeur consommé ou tenté sans violence, ruse ni menace sur la personne d'un enfant de l'un ou l'autre sexe, âgé de moins de seize ans, sera puni d'un emprisonnement de un an à quinze ans. Article: 359 L'attentat à la pudeur commis avec violences, ruses ou menaces sur une personne âgée de seize ans au moins de l'un ou l'autre sexe, sera puni d'un emprisonnement de six mois à cinq ans. Si l'attentat avec violences, ruses ou menaces, a été commis sur une personne âgée de moins de seize ans, la peine sera un emprisonnement de cinq à vingt ans. Si l'attentat a causé la mort de la personne sur laquelle il a été commis, le coupable sera puni de mort. Article: 360 Est puni d'un emprisonnement de cinq à dix ans celui qui aura commis un viol. Est assimilé à la violence le fait d'abuser d'une personne qui, par l'effet d'une maladie, par l'altération de ses facultés ou par toute autre cause accidentelle, a perdu l'usage de ses sens ou en a été privé par quelque artifice. Si le viol a été commis sur la personne d'un enfant âgé de moins de seize ans, le coupable sera puni d'emprisonnement de dix à vingt ans. Si le viol a causé la mort de la personne sur laquelle il a été commis, le coupable sera puni de mort. Article: 361 Le maximum des peines portées par les articles 358 à 360, sera doublé : 1. si les coupables sont les ascendants de la personne sur laquelle l'infraction a été commis; 2. s'ils sont de la classe de ceux qui ont autorité sur elle; 3. s'ils sont ses instituteurs ou ses employés à gages ou les employés des personnes ci-dessus indiquées; 4. si l'infraction a été commise, soit par des fonctionnaires publics, des représentants de l'autorité ou des ministres d'un culte qui ont abusé de leurs fonctions pour la commettre, soit par des médecins, chirurgiens, accoucheurs envers les personnes confiées à leurs soins; 5. si le coupable a été aidé dans l'exécution de l'infraction par une ou plusieurs personnes; 6. si l'infraction a causé à la victime une altération grave de sa santé. Article: 362 Sans préjudice des peines plus graves prévues par d'autres dispositions du présent code, sera puni d'un emprisonnement de deux mois à trois ans et d'une amende de dix mille francs au maximum, ou de l'une de ces peines seulement, quiconque aura commis un acte impudique ou contre nature avec un individu de son sexe âgé de moins de dix-huit ans. Section 3. De la prostitution Article: 363 La prostitution consiste à faire métier de se livrer à tout venant moyennant rémunération. Toute personne qui se livre à la prostitution pourra, par jugement du tribunal de première instance, être astreinte à se soumettre, pour une durée qui ne sera pas supérieure à un an, à une ou plusieurs obligations ci-après énumérées : 1. ne pas sortir des limites territoriales déterminées par le jugement; 2. ne pas se rendre en certains lieux déterminés par le jugement; 3. se soumettre à des mesures d'examen, de traitement ou de soins, même sous le régime de l'hospitalisation; 4. répondre aux convocations de toute autorité ou de toute personne qualifiée désignées par le jugement; 5. se présenter périodiquement aux services ou autorités désignés par le jugement. La violation de l'une des obligations prononcées par le tribunal sera punie d'un emprisonnement de trois à six mois et d'une amende de deux mille à cinq mille francs ou de l'une de ces peines seulement. Sous section 1. Incitation à la prostitution Article: 364 Sera puni de trois mois à cinq ans d'emprisonnement et d'une amende de dix mille à cent mille francs quiconque embauche, entraîne ou détourne en vue de la prostitution une autre personne majeure ou mineure, même consentante. Article: 365 Les peines prévues à l'article précédent sont applicables à quiconque entretient, aux mêmes fins, une personne majeure ou mineure, même consentante. Article: 366 Sera puni de six mois à cinq ans d'emprisonnement et d'une amende de dix mille à cent mille francs quiconque par menace, pression, manœuvre ou tout autre moyen, entrave l'action de prévention, d'assistance ou de rééducation entreprise par des organismes qualifiés en faveur de personnes se livrant à la prostitution ou en danger de prostitution. Article: 367 Sera puni d'un mois à un an d'emprisonnement et d'une amende de mille à dix mille francs quiconque, par un moyen quelconque de publicité, même en dissimulant la nature de son annonce sous des artifices de langage, fait savoir qu'il facilite la prostitution d'autrui ou attire l'attention sur une occasion de prostitution. Sous section 2. Exploitation de la prostitution Article: 368 Sera punie d'un emprisonnement d'un an à cinq ans et d'une amende de vingt mille à cent mille francs quiconque, directement ou par personne interposée, dirige, gère, ou sciemment finance ou contribue à financer une maison de prostitution. Article: 369 Sera punie d'un emprisonnement d'un an à cinq ans et d'une amende de vingt mille à cent mille francs toute personne qui, sous une forme quelconque, partage les produits de la prostitution d'une autre personne majeure ou mineure même si celle-ci est consentante, ou reçoit des subsides d'une personne se livrant habituellement à la prostitution. Article: 370 Sera punie des peines prévues à l'article précédent quiconque, étant en relation habituelle avec une ou plusieurs personnes se livrant à la prostitution, ne peut justifier de ressources correspondant à sont train de vie. Sera punie d'un emprisonnement de deux à six mois et d'une amende de mille à dix mille francs ou de l'une de ces peines seulement, toute personne qui, par attestation, certificat, document fictif ou par toute autre moyen ou manœuvre, aura facilité à une personne visée par le précédent alinéa la justification de ressources qu'elle ne possède pas effectivement. Sous section 3. Facilités en vue de la prostitution Article: 371 Sera punie d'un emprisonnement de trois mois à trois ans et d'une amende de dix mille à cinquante mille francs toute personne qui, d'une manière quelconque, aide, assiste ou protège sciemment la prostitution d'autrui ou le racolage en vue de la prostitution. Article: 372 Les peines prévues à l'article précédent seront applicables à toute personne qui fait office d'intermédiaire, à un titre quelconque, entre les personnes se livrant habituellement à la prostitution et les individus qui exploitent ou rémunèrent la prostitution d'autrui. Article: 373 Quiconque donne ou prend sciemment en location, en tout ou en partie, un immeuble en location, en tout ou en partie, un immeuble ou local quelconque aux fins de la prostitution d'autrui, sera puni d'un emprisonnement d'un an à trois ans et d'une amende de dix mille à cinquante mille francs. Sous section 4. Circonstances aggravantes Article: 374 Les peines prévues aux articles précédents seront portées au double lorsque l'une de circonstances aggravantes ci-après sera établie et la cause : 1. l'infraction a été commise à l'égard d'une personne mineure de moins de 18 ans; 2. l'infraction a été commise à l'égard d'une personne non consentante; 3. l'infraction a été commise à l'égard de plusieurs personnes; 4. la personne à l'égard de qui l'infraction a été commise a été livrée ou incitée à se livrer à la prostitution hors du territoire national, ou l'a été sur ce territoire dès son arrivée en provenance de l'étranger ou à une date proche de cette arrivée; 5. l'infraction a été commise par plusieurs auteurs, coauteurs ou complices; 6. l'auteur de l'infraction était porteur d'une arme apparente ou cachée; 7. l'infraction a été commise par un ascendant de la victime; 8. l'infraction a été commise par une personne qui a autorité sur la victime; 9. l'infraction a été commise par un serviteur de la victime; 10. l'infraction a été commise par un fonctionnaire public ou un ministre du culte. Sous section 5. Dispositions complémentaires Article: 375 Quiconque provoque à l'accomplissement d'une des infractions prévues à la présente Section sera puni d'un emprisonnement de huit jours à trois mois et d'une amende de cinq cents à cinq mille francs. Les mêmes peines seront applicables à toute personne ayant offert ou accepté de participer à la préparation ou à l'exécution de telles infractions, quand bien même celle-ci n'auraient pas été consommés ou tentées. La peine sera élevée au double si le délit a été commis envers un mineur de moins de 18 ans. Article: 376 Au cas où un individu condamné à l'étranger pour des faits incriminés par la présente Section vient à se trouver sur le territoire national, le tribunal de sa résidence pourra déclarer, à la requête du ministère public, qu'il y a lieu à l'application de l'une ou de plusieurs mesures de sûreté ou interdictions, déchéances ou incapacités prévues aux articles 54 à 58 et 66 à 69 du présent code. Section 4. Des outrages publics aux bonnes mœurs Article: 377 Quiconque aura publiquement outragé les mœurs par des actes qui blessent la pudeur, sera puni d'un emprisonnement de huit jours à trois ans et d'une amende de mille à dix mille francs, ou de l'une de ces peines seulement. Article: 378 Quiconque aura produit, exposé, vendu ou distribué des chansons, pamphlets ou autres écrits, imprimés ou non, des figures, images, emblèmes ou autres objets contraires aux bonnes mœurs, sera condamné à un emprisonnement de huit jours à un an et à une amende de mille à dix mille francs, ou à l'une de ces peines seulement. Sera puni des mêmes peines quiconque aura, en vue de la publicité, du commerce ou de la distribution, détenu, importé ou fait importer, transporté ou fait transporter, remis à un agent de transport ou de distribution, annoncé par un moyen quelconque de publicité des chansons, pamphlets, écrits, figures, images, emblèmes ou objets contraires aux bonnes mœurs. Dans le cas prévus par les alinéas précédents, l'auteur de l'écrit, de la figure, de l'image, celui qui les aura imprimés ou reproduits et le fabricant de l'emblème ou de l'objet seront punis d'un emprisonnement d'un mois à un an et d'une amende de deux mille à vingt mille francs, ou de l'une de ces peines seulement. Section 5. De la publicité des moyens abortifs Article: 379 Sera puni d'un emprisonnement de huit jours à un an et d'une amende de mille à dix mille francs, ou de l'une de ces peines seulement : 1. quiconque aura, soit par l'exposition, la vente, ou la distribution d'écrits, imprimés ou non, soit par tout autre moyen de publicité, préconisé l'emploi de moyens quelconques de faire avorter une femme, aura fourni les indications sur la manière de se les procurer ou de s'en servir, ou aura fait connaître, en vue de les recommander, les personnes qui les appliquent; 2. quiconque aura exposé, vendu, distribué, fabriqué ou fait fabriquer, fait importer ou fait transporter, remis à un agent de transport ou de distribution, annoncé par un moyen quelconque de publicité, les drogues ou engins spécialement destinés à faire avorter une femme ou annoncés comme tels. Ne sont pas considérées comme une publicité, la détention, la mise en vente ou la vente de ces produits ou moyens ni celles d'imprimés, lorsque ces faits ne sont accompagnés d'aucune circonstance tendant à en suggérer ou conseiller l'emploi. Chapitre 6. DE L'ABANDON DE FAMILLE, DU DELAISSEMENT ET DE L'EXPOSITION D'ENFANT Article: 380 Sera puni d'un emprisonnement de trois mois à deux ans et d'une amende de deux mille à vingt mille francs ou d'une de ces peines seulement : 1. le père ou la mère de famille qui abandonne sans motifs graves, pendant plus de deux mois, la résidence familiale, et se soustrait à tout ou partie des obligations d'ordre moral ou d'ordre matériel résultant de la puissance paternelle ou de la tutelle légale; le délai de deux mois ne pourra être interrompu que par un retour au foyer impliquant la volonté de reprendre définitivement la vie familiale; 2. le mari, qui, sans motifs graves, abandonne volontairement sa femme pendant plus de deux mois, la sachant enceinte; 3. le père, la mère ou le tuteur qui compromet gravement par des mauvais traitements, par des exemples pernicieux d'ivrognerie habituelle ou d'inconduite notoire, par un défaut de soins ou par un manque de direction nécessaire, soit la santé, soit la sécurité, soit la moralité de ses enfants ou d'un ou plusieurs de ces derniers ou de ceux dont il a la garde. Toutefois les poursuites ou les effets de la condamnation peuvent être arrêtés sur décision du ministère public s'il estime que l'exercice de l'action publique ou l'exécution de la condamnation est préjudiciable aux intérêts des enfants ou de la famille. Article: 381 Sera puni d'un emprisonnement d'un mois à un an et d'une amende de mille à dix mille francs ou d'une de ces peines seulement: 1. celui qui, ayant été condamné, par décision judiciaire ne pouvant plus faire l'objet d'un recours en opposition ou en appel, à fournir une pension alimentaire à son conjoint, à ses descendants ou à ses ascendants, sera volontairement demeuré plus de deux mois sans en acquitter les termes; 2. celui qui se sera rendu coupable, dans les conditions prévues à l'alinéa précédent, d'inexécution des obligations qui font l'objet des articles 159, 210b, 210c, et 231 du livre premier du code civil. Article: 382 Lorsqu'une personne débitrice dans les conditions prévues à l'article précédent est restée plus de deux mois sans s'acquitter, elle sera appelée devant le président du tribunal de première instance, à la requête de toute personne intéressée ou du ministère public, et ce par lettre recommandée avec avis de réception, signée et adressée par le greffier. Le président du tribunal constatera la comparution ou la non-comparution du débiteur, recevra les explications des parties et dressera du tout procès-verbal qu'il transmettra au procureur de la République aux fins qu'il appartiendra. Article: 383 Sera puni d'un emprisonnement d'un mois à un an et d'une amende de cinq cents à mille francs, celui qui aura exposé ou fait exposer, délaissé ou fait délaisser, en un lieu non solitaire, un enfant ou un incapable hors d'état de se protéger lui-même à raison de son état physique ou mental. La peine sera de trois mois à deux ans d'emprisonnement et d'une amende de mille à deux mille francs si les faits prévus à l'alinéa précédent ont été commis par les père et mère légitimes ou naturels, ou par des personnes à qui l'enfant ou l'incapable était confié. Toutefois la peine sera un emprisonnement d'un mois à six mois si ces faits ont été commis par une fille-mère. Article: 384 Sera puni d'un emprisonnement de trois mois à deux ans et d'une amende de mille à deux mille francs : 1. quiconque aura, dans un esprit de lucre, provoqué les parents ou l'un d'eux, à abandonner leur enfant né ou à naître; 2. quiconque aura fait souscrire par les futurs parents ou l'un d'eux l'engagement d'abandonner l'enfant à naître ou qui aura détenu un tel engagement ou en aura fait usage. Article: 385 Sera puni d'un emprisonnement de six mois à trois ans et d'une amende de mille à cinq mille francs celui qui aura délaissé ou fait délaisser, dans un lieu solitaire, un enfant ou un incapable hors d'état de se protéger lui-même à raison de son état physique ou mental. La peine sera d'un an à cinq ans d'emprisonnement et d'une amende de deux mille à dix mille francs si les faits prévus à l'alinéa précédent ont été commis par les père et mère légitimes ou naturels ou par des personnes à qui l'enfant ou l'incapable était confié. Article: 386 Si, par suite de l'exposition ou du délaissement, l'enfant ou l'incapable est demeuré mutilé ou estropié ou s'il a contracté une maladie grave ou subi une infirmité permanente, les coupables seront punis : 1. dans le cas prévu par l'article 383, alinéa premier, d'un emprisonnement de six mois à deux ans et d'une amende de mille à deux mille francs; 2. dans les cas prévus par l'article 383, alinéas 2 et 3, d'un emprisonnement d'un an à trois ans et d'une amende de deux mille à six mille francs; 3. dans les cas prévus par l'article 385, d'un emprisonnement de cinq à dix ans. Article: 387 Si le délaissement ou l'exposition a causé la mort de l'enfant ou de l'incapable, le coupable sera puni: 1. dans le cas prévu par l'article 383, alinéa premier, d'un emprisonnement de trois ans à cinq ans et d'une amende de mille à cinq mille francs; 2. dans les cas prévus par l'article 383, alinéas 2 et 3, d'un emprisonnement de cinq ans à dix ans et d'une amende de cinq mille à dix mille francs; 3. dans les cas prévus par l'article 385, d'un emprisonnement de dix ans à quinze ans. Chapitre 7. DES ATTENTATS A LA LIBERTE INDIVIDUELLE Article: 388 Sera puni d'un emprisonnement de cinq ans à dix ans celui qui, par violences, ruses ou menaces, aura arbitrairement enlevé ou fait enlever, arrêté ou fait arrêter, détenu ou fait détenir une personne quelconque. Si la personne enlevée, arrêtée ou détenue est âgée de moins de 18 ans, le maximum de la peine sera prononcé. Si la détention ou la séquestration a duré plus d'un mois, la peine de l'emprisonnement pourra être portée à vingt ans. Lorsque la personne enlevée, arrêtée ou détenue aura été soumise à des tortures corporelles, le coupable sera puni de l'emprisonnement à perpétuité. Si les tortures ont causé la mort, le coupable sera condamné à mort. Quiconque aura prêté un lieu pour exécuter la détention ou séquestration subira les mêmes peines. Article: 389 Si une femme, enlevée ou détournée sans qu'il y ait détention ni séquestration, a épousé son ravisseur, celui-ci et ses complices ne peuvent être poursuivis que sur la plainte des personnes qui ont le droit de demander la nullité du mariage, et condamnés qu'une fois la nullité prononcée. Le désistement de ces personnes arrête en tout état de cause l'action publique ou les effets de la condamnation définitive. Article: 390 Est puni des peines prévues à l'article 388 et selon les distinctions y établies, celui qui a enlevé ou fait enlever, arrêté ou fait arrêter, détenu ou fait détenir, transporté ou fait transporter, des personnes quelconques pour les réduire en esclavage ou les vendre comme esclaves ou qui a disposé de personnes placées sous son autorité dans le même but. Chapitre 8. DES IMPUTATIONS DOMMAGEABLES ET DES INJURES Article: 391 Celui qui aura méchamment et publiquement imputé à une personne un fait précis qui est de nature à porter atteinte à l'honneur ou à la considération de cette personne, ou à l'exposer au mépris public, sera puni d'un emprisonnement de huit jours à un an et d'une amende de mille à dix mille francs, ou de l'une de ces peines seulement. Article: 392 Quiconque aura publiquement injurié une personne sera puni d'un emprisonnement de huit jours à deux mois et d'une amende n'excédant pas cinq mille francs, ou de l'une de ces peines seulement. Article: 393 Quiconque aura manifesté, par une diffamation ou une injure publique, de l'aversion ou de la haine envers un groupe de personnes appartenant, par leur origine, à une race, ou une religion déterminée, ou commis un acte de nature à provoquer cette aversion ou cette haine, sera puni d'un emprisonnement d'un mois à un an et d'une amende n'excédant pas cinq mille francs, ou de l'une de ces peines seulement. Sera puni des mêmes peines ou de l'une d'elles seulement : 1. tout dépositaire de l'autorité publique ou citoyen chargé d'un ministère de service public qui, à raison de l'origine ou de l'appartenance ou de la non-appartenance d'une personne à une ethnie, une région, une nation, une race ou une religion déterminée, lui aura refusé sciemment le bénéfice d'un droit auquel elle pouvait prétendre; 2. toute personne fournissant ou offrant de fournir un bien ou un service qui, sauf motif légitime, l'aura refusé, soit par elle-même soit par son préposé, à raison de l'origine ou de l'appartenance ou de la non-appartenance à une ethnie, une région, une nation, une race ou une religion déterminée de celui qui le requiert, ou aura soumis son offre à une condition fondée sur l'origine, l'appartenance ou la non-appartenance à une ethnie, une région, une nation, une race ou une religion déterminée; 3. toute personne qui, dans les conditions visées au 2., aura refusé un bien ou un service à une association ou à une société ou à un de ses membres, à raison de l'origine ou de l'appartenance ou de la non-appartenance de ces membres ou d'une partie d'entre eux à une ethnie, une région, une nation, une race, ou une religion déterminée; 4. toute personne, amenée par sa profession ou ses fonctions à employer, pour elle-même ou pour autrui un ou plusieurs préposés, qui, sauf motif légitime, aura refusé d'embaucher ou aura licencié une personne à raison de son origine ou de son appartenance ou de sa non-appartenance à une ethnie, une région, une nation, une race ou une religion déterminée, ou aura soumis une offre à une condition fondée sur l'origine, l'appartenance ou la non-appartenance à une ethnie, une région, une nation, une race ou une religion déterminée. Article: 394 Sera puni d'un emprisonnement de six mois à trois ans et d'une amende de mille à vingt mille francs, ou de l'une de ces peines seulement, celui qui aura, par quelque moyen que ce soit, fait une dénonciation calomnieuse : 1. à une autorité judiciaire ou administrative ou à un fonctionnaire public qui a le pouvoir d'y donner suite ou d'en saisir l'autorité compétente; 2. aux supérieurs hiérarchiques ou aux employeurs de la personne dénoncée. Article: 395 Sera puni d'un emprisonnement de huit jours au maximum et d'une amende de mille francs au maximum ou de l'une de ces peines seulement, celui qui aura diffamé ou injurié une personne dans des circonstances non prévues par les dispositions précédentes. Titre 3. DES INFRACTIONS CONTRE LES PROPRIÉTÉS Chapitre 1. DES VOLS ET DES EXTORSIONS Article: 396 Quiconque a soustrait frauduleusement une chose qui ne lui appartient pas est coupable de vol. Article: 397 Ne donneront lieu qu'à des réparations civils, les vols ou extorsions commis par des époux au préjudice de leurs conjoints, par un veuf ou une veuve, quant aux choses qui avaient appartenu à l'époux décédé, par des descendants au préjudice de leurs ascendants, par des ascendants au préjudice de leurs descendants, ou par des alliés aux mêmes degrés. La présente disposition ne s'applique pas à toute autre personne qui aura participé à ces vols ou recelé tout ou partie des objets volés. Article: 398 Le saisi ou les tiers qui auront détruit ou détourné des objets saisis seront passibles des peines du vol. Les mêmes peines seront applicables à tout débiteur, emprunteur ou tiers donneur de gage qui aura détruit ou détourné les objets par lui donnés à titre de gage. Section 1. Des vols commis sans violence ni menace Des vols commis sans violence ni menace Article: 399 Le vol commis dans violence ni menace est puni d'un emprisonnement de cinq ans au maximum et d'une amende qui ne dépassera pas dix mille francs ou de l'une de ces peines seulement. Article: 400 (L. n. 08/1983 du 10.3.1983) Le maximum de la peine pourra être porté à dix années d'emprisonnement : 1. si le vol a été commis à l'aide d'effraction, d'escalade ou de fausses clefs; 2. s'il a été commis la nuit dans une maison habitée ou servant à l'habitation ou dans ses dépendances; 3. si le vol a été commis par un fonctionnaire ou une personne chargée d'un service public quelconque à l'aide de ses fonctions; 4. si les coupables, ou l'un deux, ont pris le titre ou les insignes d'un fonctionnaire ou d'une personne chargée d'un service public ou ont allégué un faux ordre de l'autorité publique; 5. [...]. Section 2. Des vols commis à l'aide de violences ou menaces Article: 401 Le vol commis à l'aide de violences ou menaces est puni d'un emprisonnement de cinq à dix ans. Article: 402 Si les violences ou les menaces à l'aide desquelles le vol a été commis ont causé une maladie ou une incapacité de travail personnel, le coupable sera puni d'un emprisonnement de dix à quinze ans. Si ces mêmes violences ou menaces ont causé soit une maladie paraissant incurable, soit une incapacité permanente de travail personnel, soit la perte de l'usage absolu d'un organe, soit une mutilation grave, le coupable sera puni d'un emprisonnement de quinze à vingt ans. Si les violences ou les menaces exercées sans intention de donner la mort l'ont pourtant causée, le coupable sera puni de l'emprisonnement à perpétuité. Article: 403 Le vol commis à l'aide de violences ou menaces sera puni d'un emprisonnement de dix à quinze ans : 1. s'il a été commis avec effraction, escalade ou fausses clefs; 2. s'il a été commis par un fonctionnaire public à l'aide de ses fonctions; 3. si les coupables, ou l'un d'eux, ont pris le titre ou les insignes d'un fonctionnaire public ou ont allégué un faux ordre de l'autorité publique; 4. s'il a été commis la nuit par deux ou plusieurs personnes; 5. [...] 6. s'il a été commis sur un chemin public; 7. si le ou les coupables se sont assurés la disposition d'un véhicule en vue de faciliter leur entreprise ou de favoriser leur fuite. Section 2 Bis. Des vols à main armée Article: 403 Bis (L. n. 08/1983 du 10.3.1983): Le vol sera puni de l'emprisonnement de 15 à 20 ans si le coupable était en possession d'une ou plusieurs armes apparentes ou cachées, même s'il n'en était pas porteur et si la ou les armes se trouvaient à proximité du lieu de l'infraction. Si le vol a été commis dans une maison habitée ou ses dépendances, même si l'habitation était temporaire et limitée à l'accomplissement de certains devoirs, à l'exécution de certaines tâches, la peine d'emprisonnement à perpétuité sera encourue. Article: 403 Ter (L. n. 08/1983 du 10.3.1983) Le vol sera puni de la peine de mort si les circonstances décrites ci-après sont réunis : 1. si le vol a été commis par deux ou plusieurs personnes; 2. si les coupables ou l'un de ceux-ci étaient en possession d'une ou plusieurs armes dans les conditions prévues à l'article 403bis; 3. si le vol a été commis dans une maison habitée ou ses dépendances, même si l'habitation était temporaire et limitée à l'accomplissement de certains devoirs ou à l'exécution de certaines tâches. Si seules les conditions reprises au 1 et 2 ci-dessus sont réunies, la peine d'emprisonnement à perpétuité sera encourue. Section 3. Des extorsions Article: 404 Est puni d'un emprisonnement de cinq à vingt ans et d'une amende qui peut être portée à vingt mille francs, celui qui a extorqué, à l'aide de violences ou de contrainte, la signature ou la remise d'un document quelconque contenant ou opérant obligation, disposition ou décharge. Article: 405 Est puni d'un emprisonnement d'un an à cinq ans et d'une amende de dix mille francs au maximum celui qui, à l'aide de la menace, écrite ou verbale, de révélations ou d'imputations diffamatoires, aura extorqué soit la remise de fonds ou valeurs, soit la signature ou la remise d'un écrit opérant obligation, disposition ou décharge. Section 4. De la signification de divers termes employés dans les présents chapitres Article: 406 L'effraction consiste à forcer, rompre, dégrader, démolir ou enlever toute espèce de clôture extérieure ou intérieure d'un édifice, maison, construction quelconque ou de ses dépendances, d'un bateau ou d'une voiture, à forcer des armoires ou tous autres meubles fermés, contenant des effets quelconques, même s'il l'effraction n'a pas été faite sur le lieu. Article: 407 Est qualifiée escalade, toute entrée dans les maisons, bâtiments, cours, basses-cours, édifices quelconques, jardins, parcs et enclos, exécutée par-dessus les murs, portes, toitures ou toute autre clôture. L'entrée par une ouverture souterraine autre que celle qui à été établie pour servir d'entrée, est une circonstance de même gravité que l'escalade. Article: 408 Sont qualifiés fausses clefs, tous crochets, rossignols, passe-partout, clefs imitées, contrefaites, altérées ou qui n'ont pas été destinées par le propriétaire, locataire, aubergiste ou logeur, aux serrures, cadenas ou aux fermetures quelconques auxquelles le coupable les aura employées, ainsi que les clefs perdues, égarées ou soustraites qui auront servi à commettre le vol. Article: 409 Le vol commis pendant la nuit est le vol commis entre le coucher et le lever du soleil. Article: 410 Est réputé maison habitée, tout bâtiment, tout appartement, tout logement, toute cabane, même mobile, ou tout autre lieu servant à l'habitation. Sont réputés dépendances d'une maison habitée, les cours, basses-cours, jardins et tous autres terrains clos, ainsi que tous autres édifices qui y sont enfermés, quel qu'en soit l'usage, quand même ils formeraient un enclos particulier dans l'enclos général. Article: 411 Sont réputés armes, tous instruments, ustensiles ou autres objets tranchants, perçants ou contondants pouvant servir à tuer, blesser ou frapper. Article: 412 Par violences, il faut entendre les actes de contrainte physique exercés sur les personnes. Par menaces, il faut entendre tous les moyens de contrainte morale par la crainte d'un mal imminent. Section 5. Dispositions particulières Article: 413 Quiconque aura frauduleusement contrefait ou altéré des clefs sera condamné à un emprisonnement de trois mois à deux ans et à une amende de dix mille francs au maximum, ou à l'une de ces peines seulement. Si le coupable est serrurier de profession, il sera puni d'un emprisonnement de deux à cinq ans et d'une amende de vingt mille francs au maximum, ou de l'une de ces peines seulement. Chapitre 2. DES FRAUDES Section 1. De la banqueroute Article: 414 Sera coupable de banqueroute frauduleuse et puni d'un emprisonnement de trois mois à cinq ans et d'une amende de mille à cinquante mille francs le commerçant en état de cessation de paiements qui, frauduleusement : 1. aura détourné ou dissimulé tout ou partie de son actif; 2. se sera reconnu débiteur de sommes qu'il ne devait pas; 3. aura soustrait ses livres de comptabilité. Article: 415 Sera coupable de banqueroute simple et puni d'un emprisonnement de huit jours à un an et d'une amende de cinq cents à cinq mille francs ou de l'une de ces peines seulement, le commerçant en état de cessation de paiement qui : 1. aura, pour ses besoins personnels ou ceux de sa maison, fait des dépenses excessives; 2. aura, après cessation de ses paiements, favorisé un créancier au détriment de la masse; 3. aura consommé de fortes sommes au jeu, à des opérations de pur hasard, ou à des opérations fictives; 4. aura, dans l'intention de retarder la constatation de la cessation de ses paiements, fait des achats pour vendre au-dessous du cours, ou, dans la même intention, se sera livré à des emprunts, circulations d'effets ou autres moyens ruineux de se procurer des fonds; 5. aura supposé des dépenses ou des pertes ou ne justifiera pas de l'existence ou de l'emploi de l'actif de son dernier inventaire et des deniers, valeurs, meubles et effets, de quelque nature qu'ils soient, qui lui seraient advenus postérieurement à la date de cessation des paiements. Article: 416 Pourra être déclaré coupable de banqueroute simple et puni des peines prévues à l'article précédent le commerçant en état de cessation de paiements : 1. qui n'aura pas tenu les livres ou fait ses inventaires selon les dispositions prévues par le code de commerce; 2. dont les livres et les inventaires seront incomplets, irréguliers ou rédigés dans une langue autre que celles dont l'emploi, en cette matière, est prescrit par la loi; 3. dont les livres ou les inventaires n'offrent pas sa véritable situation active et passive, sans néanmoins qu'il y ait fraude; 4. qui aura contracté, sans recevoir des valeurs en échange des engagements jugés trop considérables, eu égard à sa situation lorsqu'il les a contractés; 5. qui, sans qu'il soit malheureux et de bonne foi, a déjà été antérieurement déclaré en faillite; 6. qui, à la suite d'une faillite précédente, n'a pas rempli toutes les obligations d'un concordat en cours, ou contre lequel la résolution du concordat a été prononcée; 7. qui n'aura pas fait la déclaration de la cessation de ses paiements dans les conditions et les délais prévus par la législation sur la faillite; 8. qui, sans cause légitime, se sera absenté sans l'autorisation du juge ou ne se sera pas rendu en personne aux convocations qui lui auront été faites par le juge ou le curateur. Section 2. Des cas assimilés à la banqueroute Article: 417 Seront punis des peines prévues à l'article 414, les administrateurs, directeurs, gérants ou liquidateurs, et, généralement, tous mandataires sociaux non commerçants de société en état de cessation de paiement qui, frauduleusement : 1. auront détourné ou dissimulé une partie de l'actif de la société; 2. auront reconnu la société débitrice de sommes qu'elle ne devait pas; 3. auront soustrait les livres de la société; 4. auront omis de publier l'acte de société ou les actes modificatifs de celui-ci dans les formes et délais prévus par la loi; 5. auront, dans ces actes, donné des indications inexactes; 6. auront provoqué la faillite de la société; 7. auront, en l'absence de bilan ou au moyen de bilan frauduleux, opéré entre les membres de la société la répartition de dividendes non prélevés sur les bénéfices réels. Article: 418 Seront punis des peines prévues à l'article 415, les administrateurs, directeurs, gérants ou liquidateurs et, généralement, tous mandataires sociaux non commerçants de société en état de cessation de paiement qui : 1. après cessation des paiements de la société, auront favorisé un créancier au détriment de la masse; 2. auront engagé la société dans des dépenses ou des frais excessifs; 3. auront, pour compte de la société, consommé de fortes sommes au jeu, auront fait ou fait faire pour elle des opérations de pur hasard ou des opérations fictives; 4. auront, dans l'intention de retarder la faillite de la société, fait des achats pour revendre audessous du cours, ou dans la même intention, se seront livrés à des emprunts, circulations d'effets et autres moyens ruineux de se procurer des fonds; 5. auront supposé des dépenses ou des pertes ou ne justifieront pas de l'existence ou de l'emploi de l'actif du dernier inventaire de la société et des deniers, valeurs, meubles et effets, de quelque nature qu'ils soient, qui seraient postérieurement advenus à la société. Article: 419 Pourront être punis des mêmes peines les administrateurs, directeurs, gérants ou liquidateurs et, généralement, tous mandataires sociaux non commerçant de sociétés et état de cessation de paiement, lorsque, par leur faute : 1. les livres prévus par la loi n'auront pas été tenus, les inventaires prescrits par les mêmes dispositions n'auront pas été faits, qu'ils auront été écrits dans une langue autre que celles dont l'emploi, en cette matière, est prescrit par la loi, qu'ils seront incomplets ou irréguliers, que les mêmes livres et inventaires n'offriront pas la véritable situation active en passive de la société, sans néanmoins qu'il ait eu fraude; 2. la déclaration de la cessation des paiements de la société n'aura pas été faite dans les conditions et les délais prévus par la législation sur la faillite. Article: 420 Pourront être punis des mêmes peines les mandataires sociaux qui, si la société a été déclarée en état de cessation de paiement, n'auront pas fourni les renseignements ou auront donné des renseignements inexacts au juge ou au curateur, il en sera de même de ceux qui, sans empêchement légitime, ne se seront pas rendus en personne à la convocation de ces autorités. Seront punis des mêmes peines les mandataires sociaux, les liquidateurs d'une société, quelle qu'en soit la forme, et, d'une manière générale, toute personne ayant directement ou par personne interposée, administré, géré ou liquidé ladite société sous le couvert ou aux lieu et place de ses représentants légaux, qui, en vue de soustraire tout ou partie de leur patrimoine aux poursuites des créanciers sociaux, ont, de mauvaise foi, détourné ou dissimulé, tenté de détourner ou de dissimuler une partie de leurs biens ou qui se sont frauduleusement reconnus débiteurs de sommes qu'ils ne devaient pas. Article: 421 Les dispositions des articles 417 à 420 sont applicables à tout dirigeant de droit ou de fait. Article: 422 Seront punis des peines prévues à l'article 414 : 1. ceux qui, dans l'intérêt du failli, auront soustrait, dissimulé ou recelé tout ou partie de ses biens; 2. ceux qui, frauduleusement, auront présenté dans la faillite soit en leur nom, soit par interposition de personne, des créances supposées; 3. le curateur qui se sera rendu coupable de malversations dans sa gestion. Article: 423 Seront punis des peines prévues à l'article 415 ceux qui auront stipulé, soit avec le failli, soit avec toutes autres personnes, des avantages particuliers à raison de leur vote dans la déclaration de la faillite, ou qui auront fait un traité particulier duquel résulterait en leur faveur un avantage à la charge de la masse. Section 3. Des abus de confiance Article: 424 Quiconque a frauduleusement détourné ou dissipé au préjudice d'autrui des effets, deniers, marchandises, billets, quittances, écrits de toute nature contenant ou opérant obligation ou décharge et qui lui avaient été remis à titre de louage, de dépôt, de mandat, de gage, de prêt à usage, ou pour un travail, salarié ou non salarié, à charge de les rendre ou d'en faire un usage ou un emploi déterminé, sera puni d'un emprisonnement de trois mois à cinq ans et d'une amende de vingt mille francs au maximum, ou de l'une de ces peines seulement. Si l'abus de confiance a été commis par une personne faisant appel au public afin d'obtenir, soit pour son propre compte, soit comme dirigeant ou agent d'une société ou d'une entreprise commerciale ou industrielle, la remise de fonds ou valeurs à titre de dépôt, mandat ou gage, l'emprisonnement pourra être porté à dix ans et l'amende à cent mille francs. Ne donneront lieu qu'à des réparations civiles, les infractions prévues à l'alinéa premier du présent article, si elles ont été commises par l'une des personnes dont question à l'article 397, alinéa 1er. Article: 425 Sera puni des peines portées à l'alinéa premier de l'article précédent, quiconque aura vendu ou donné en nantissement un immeuble ou un bien meuble qu'il savait ne pas lui appartenir. Article: 426 Sera puni d'un emprisonnement d'un mois à un an et d'une amende de vingt mille à deux cent mille francs, ou de l'une de ces peines seulement, celui qui, abusant des faiblesses, des passions, des besoins ou de l'ignorance du débiteur, se sera fait, en raison d'une opération de crédit, d'un contrat de prêt ou de tout autre contrat indiquant une remise de valeur mobilière, quelle que soit la forme apparente du contrat, promettre pour lui-même ou pour autrui un intérêt ou d'autres avantages excédant manifestement l'intérêt normal. Dans le cas prévu au présent article, le juge à la demande de toute partie lésée, réduira ses obligations à l'intérêt normal. Section 4. Du détournement de main-d’œuvre Article: 427 Sera puni des peines portées au premier alinéa de l'article 424 quiconque aura frauduleusement utilisé à son profit ou au profit d'un tiers les services d'engagés mis sous ses ordres par le maître, en vue d'un travail à exécuter pour celui-ci ou pour autrui. Section 5. De l'escroquerie et de la tromperie Article: 428 Quiconque, dans le but de s'approprier une chose appartenant à autrui, se sera fait remettre ou délivrer des fonds, meubles, obligations, quittances, décharges, soit en faisant usage de faux noms ou de fausses qualités, soit en employant des manœuvres frauduleuses pour persuader de l'existence de fausses entreprises, d'un pouvoir ou d'un crédit imaginaire, ou pour faire naître l'espérance, ou la crainte d'un succès, d'un accident ou de tout autre événement chimérique, et aura, par un de ces moyens, escroqué tout ou partie de la fortune d'autrui, sera puni d'un emprisonnement de trois mois à cinq ans et d'une amende de vingt mille francs au maximum, ou de l'une de ces peines seulement. Si le délit a été commis par une personne ayant fait appel au public en vue de l'émission d'actions, obligations, bons, parts ou titres quelconques, soit d'une société, soit d'une entreprise commerciale ou industrielle, l'emprisonnement pourra être porté à dix ans, et l'amende à cent mille francs. Ne donneront lieu qu'à des réparations civiles les infractions prévues à l'alinéa premier du présent article, si elles ont été commises par l'une des personnes dont question à l'article 397, alinéa 1er. Article: 429 Sera puni d'un emprisonnement de trois mois à un an et d'une amende de vingt mille francs au maximum ou de l'une de ces peines seulement, celui qui aura trompé le contractant : 1. soit sur la nature, les qualités substantielles, ou la composition de toutes marchandises; 2. soit sur l'espèce ou l'origine de la chose vendue, lorsque, d'après la convention ou l'usage, la désignation de l'espèce ou de l'origine faussement attribuée aux marchandises était la cause principale de leur livraison; 3. soit sur la quantité des choses livrées ou sur leur identité, en livrant une marchandise autre que la chose déterminée qui a fait l'objet du contrat. Article: 430 Sera puni des peines prévues à l'article précédent ou de l'une de ces peines seulement, celui qui, par des manœuvres frauduleuses, aura trompé les parties engagées dans un contrat le louage d'ouvrage soit sur la quantité, soit sur la qualité de l'ouvrage fourni, lorsque, dans ce second cas, la détermination de la qualité de l'ouvrage doit servir pour fixer le montant du salaire. Section 6. Du recel des objets Article: 431 Celui qui a recelé en tout ou en partie les choses enlevées, détournées ou obtenues à l'aide d'une infraction sera puni d'un emprisonnement de cinq ans au maximum et d'une amende qui ne dépassera pas dix mille francs, ou de l'une de ces peines seulement. L'amende pourra être élevée au-delà de dix mille francs jusqu'à la moitié de la valeur des objets recelés. Dans le cas où une peine criminelle est applicable au fait qui a procuré les choses recelées, le receleur sera puni de la peine attachée par la loi au crime et aux circonstances du crime dont il aura eu connaissance au temps du recel. Néanmoins, la peine de mort sera remplacée à l'égard des receleurs par celle de l'emprisonnement à perpétuité. Sont passibles des mêmes peines tous ceux qui, en connaissance de cause, ont, par un moyen quelconque, bénéficié du produit d'un crime ou d'un délit. Article: 432 Sera puni d'un emprisonnement de huit jours à deux ans et d'une amende de dix mille francs au maximum, ou de l'une de ces peines seulement, celui qui, ayant trouvé une chose mobilière appartenant à autrui ou en ayant obtenu par hasard la possession, l'aura frauduleusement conservée ou livrée à des tiers. Section 7. De la grivèlerie Article: 433 Sera puni d'un emprisonnement de huit jours à six mois et d'une amende de mille à trente mille francs, ou de l'une de ces peines seulement, celui qui, sachant qu'il est dans l'impossibilité de payer, se sera fait servir, dans un établissement à ce destiné, des boissons ou des aliments qu'il y aura consommés en tout ou en partie, ou, se présentant comme voyageur, se sera fait donner un logement dans un hôtel ou une auberge, ou aura pris en location une voiture de place, ou se sera fait servir des carburants ou lubrifiants dont il aura fait remplir, en tout en partie, les réservoirs d'un véhicule par des professionnels de la distribution. Les infractions prévues à l'alinéa précédent ne pourront être poursuivies que sur la plainte de la partie lésée. Le paiement du prix et de frais de justice avancés par la partie plaignante ou le désistement de celle-ci éteindra l'action publique. Section 8. Des effets sans provision Article: 434 Sera puni d'un emprisonnement d'un mois à deux ans et d'une amende de trois cent mille francs au maximum, ou de l'une de ces peines seulement, celui qui se sera frauduleusement procuré des fonds, valeurs ou décharge au moyen d'un effet tiré soit sur une personne qui n'existe pas, soit sur une personne qui ne l'avait pas autorisé à tirer sur elle et qu'il savait n'être pas sa débitrice ou ne pas devoir l'être à l'échéance. Article: 435 Sera puni d'un emprisonnement de trois mois à cinq ans et d'une amende de trois cent mille francs au maximum, ou de l'une de ces peines seulement : 1. celui, qui, de mauvaise foi, émet un chèque sans provision préalable et disponible ou avec une provision inférieure au montant du chèque; 2. celui qui, sauf opposition régulière en cas de perte ou de soustraction frauduleuse du titre, de faillite du porteur ou de son incapacité de recevoir, retire après l'émission tout ou partie de la provision ou fait défense au tiré de payer; 3. celui qui cède un chèque sachant qu'il n'y a pas de provision, ou que la provision est insuffisante ou qu'elle n'est pas disponible; 4. celui, qui, en connaissance de cause, accepte de recevoir un chèque émis dans les conditions prévues aux alinéas précédents. Article: 436 Dans les cas visés aux articles 434 et 435, la peine applicable ne dépassera pas le quart du maximum de l'emprisonnement et de l'amende prévus par ces articles ou d'une de ces peines seulement, si le porteur de bonne foi a été désintéressé avant que le tribunal ait été saisi. Chapitre 3. DES DESTRUCTIONS, DEGRADATIONS ET DOMMAGES Section 1. De l'incendie Article: 437 Sera puni d'un emprisonnement de quinze à vingt ans celui qui aura volontairement mis le feu à des édifices, magasins, navires, ou tous autres bâtiments quelconques habités ou servant à l'habitation, et, généralement, à tous lieux, même inhabités, si, d'après les circonstances, l'auteur a pu présumer qu'il s'y trouvait une ou plusieurs personnes au moment de l'infraction, que ces lieux appartiennent ou non à l'auteur du crime. Article: 438 Sera puni d'un emprisonnement de cinq à vingt ans, celui qui aura volontairement mis le feu à des édifices ou tous bâtiments quelconque appartenant à autrui et construits en matériaux durables, mais inhabités au moment de l'incendie. Si les édifices ne sont pas construits en matériaux durables, le coupable sera puni d'un emprisonnement de trois à cinq ans et d'une amende de cinq mille à vingt mille francs, ou de l'une de ces peines seulement. Article: 439 http://www.jeuneafrique.com/pays/rwanda/gabarit_art_afp.asp?art_cle=PAN60026ungnoriptel0 Article: 440 Sera puni des peines prévues à l'article précédent le propriétaire exclusif des choses désignées aux articles 438 et 439 qui y aura mis le feu dans une intention méchante ou frauduleuse. Article: 441 Celui qui, dans l'intention de commettre l'un des faits prévus aux articles 437 à 440, aura mis le feu à des objets quelconques placés de manière à le communiquer à la chose qu'il voulait détruire, sera puni comme s'il avait directement mis le feu à cette dernière chose. Article: 442 Lorsque l'incendie volontaire a causé la mort d'une ou plusieurs personnes qui, à la connaissance de l'auteur, se trouvaient dans les lieux incendiés au moment de l'infraction, et si la mort devait être considérée comme une conséquence nécessaire ou probable de cet incendie, le coupable sera puni de la peine de mort. Si l'incendie a causé une infirmité permanente grave à ces personnes, la peine de l'emprisonnement à perpétuité sera encourue. Article: 443 Sera puni d'un emprisonnement de sept jours à deux mois et d'une amende de deux cents à cinq mille francs ou de l'une de ces peines seulement, celui qui aura causé l'incendie de propriétés mobilières et immobilières d'autrui par défaut de prévoyance ou de précaution. Section 2. De la destruction des objets et monuments Article: 444 Quiconque aura volontairement détruit, renversé ou dégradé, par quelque moyen que ce soit, en tout ou en partie, des bâtiments, points, digues, chaussées, chemins de fer, machines, appareils télégraphiques ou téléphoniques, installations servant aux télécommunications ou autres constructions appartenant à autrui, sera puni d'emprisonnement de deux à cinq ans et d'une amende de dix mille francs au maximum, ou de l'une de ces peines seulement. Toutefois, si la destruction ou la dégradation a été faite par l'effet d'une mine ou d'une substance explosive, la peine d'emprisonnement sera de dix à vingt ans. La peine sera la mort si la destruction ou la dégradation a entraîné la mort d'une ou plusieurs personnes ou des infirmités permanentes graves. Le dépôt, dans une intention criminelle, sur une voie publique ou privée, d'un engin explosif, est assimilé à la tentative d'assassinat. Article: 445 Sera puni d'un emprisonnement de trois mois à un an et d'une amende de cinq cents à dix mille francs, ou de l'une de ces peines seulement, quiconque aura détruit, abattu, mutilé ou dégradé des monuments, statues ou autres objets qui, destinés à l'utilité ou à la décoration publiques ont été élevés par l'autorité compétente ou avec son autorisation ou ont été placés dans les lieux ou édifices publics. Sera puni des mêmes peines quiconque aura détruit, abattu, mutilé ou dégradé des tombeaux, signes commémoratifs ou pierres sépulcrales ou aura commis une violation de tombeaux ou sépultures. Article: 446 Sera puni des peines prévues à l'article précédent celui qui, sans y être valablement autorisé, aura enlevé ou déplacé des signaux ou repères géodésiques ou topographiques, ou en aura modifié l'aspect, les indications ou les inscriptions. Section 3. De la destruction et de la dégradation d'arbres, récoltes ou autres propriétés Article: 447 Sera puni des peines portées à l'article 445, celui qui, dans les endroits clôturés ou non clôturés, aura méchamment, détruit ou dégradé des arbres, des récoltes, des instruments d'agriculture ou d'autres biens, meubles ou immeubles qu'il savait appartenir à autrui. Sera puni d'un emprisonnement de huit jours à deux mois et d'une amende de deux mille francs au maximum ou de l'une de ces peines seulement, le propriétaire exclusif des biens précités qui les aura méchamment détruits dans l'intention de nuire à autrui, sans préjudice de l'application de l'article 440. Article: 448 Quiconque aura, sans intention méchante, détruit ou dégradé, sans titre ni droit, des arbres, des récoltes, des instruments d'agriculture ou d'autres biens, meubles ou immeubles, sera puni d'un emprisonnement de sept jours au maximum, et d'une amende qui n'excédera pas deux mille francs ou de l'une de ces peines seulement. Section 4. De l'enlèvement ou du déplacement des bornes Article: 449 Sera puni d'un emprisonnement de deux à six mois et d'une amende de dix mille francs au maximum ou de l'une de ces peines seulement, celui qui, sans y être valable¬ment autorisé, aura méchamment enlevé ou déplacé ou dégradé des bornes ou des arbres plantés ou reconnus pour établir les limites entre différents héritages. Article: 450 Sera puni d'un emprisonnement de six mois au maximum et d'une amende de trois mille francs au maximum, ou de l'une de ces peines seulement, quiconque aura, méchamment et sans nécessité, tué ou gravement blessé des bestiaux ou animaux domestiques appartenant à autrui. Titre 4. CODE PÉNAL MILITAIRE Chapitre 1. DISPOSITION GENERALES Section 1. Des infractions et des peines Article: 451 Les juridictions militaires appliquent aux infractions de droit commun les peines édictées par les lois pénales ordinaires. Aux infractions militaires déterminées ci-après, elles appliquent les peines prévues par le code pénal militaire. A toutes les infractions, et sauf exceptions prévues par le code pénal militaire, elles appliquent les dispositions générales du code pénal ordinaire. Article: 452 Les infractions militaires sont : 1. la trahison commise par des militaires et l'espionnage; 2. les atteintes aux devoirs militaires; 3. l'insubordination et la révolte; 4. les violences et les outrages envers un supérieur ou une sentinelle; 5. la désertion; 6. les mutilations volontaires; 7. l'emploi des armes sans ordre d'un supérieur; 8. les détournements, les ventes et les vols d'effets militaires, d'armes ou de munitions appartenant à l'Etat; 9. la violation, par des militaires, de certaines dispositions légales ou réglementaires étrangères. Article: 453 Les peines militaires sont : 1. en matière criminelle; a) la mort par les armes; b) l'emprisonnement d'une durée supérieure à cinq années; 2. en matière correctionnelle : l'emprisonnement d'une durée d'un mois à cinq années; 3. en matière criminelle et correctionnelle : la dégradation militaire. Section 2. De la dégradation militaire Article: 454 La dégradation militaire est une peine accessoire que le tribunal prononce ou peut prononcer, selon les cas déterminés par la loi. Article: 455 La dégradation militaire a pour effet : 1. la privation du grade et du droit d'en porter les insignes et l'uniforme; 2. l'incapacité de servir au sein des Forces Armées Rwandaises, à quelque titre que ce soit; 3. la déchéance du droit d'accès aux emplois publics; 4. la déchéance des droits électoraux pendant une durée de cinq à dix ans; 5. la privation du droit de porter une décoration ou un autre signe d'une distinction honorifique. Article: 456 Le tribunal prononcera la dégradation militaire contre tout officier ou sous-officier qui aura été condamnée : 1. à une peine criminelle en application du code pénal militaire; 2. à une peine principale, quel qu'en soit le taux, pour l'une des infractions suivantes : a) en temps de guerre, avoir capitulé; b) en temps de guerre, avoir abandonné son poste; c) en temps de guerre, n'avoir pas rejoint son poste en cas d'alerte; d) en temps de paix, s'être rendu coupable de refus d'obéissance; e) s'être rendu coupable de violences envers une sentinelle; f) avoir commis des violences envers un supérieur; g) s'être, durant le service, rendu coupable d'outrages envers un supérieur; h) s'être rendu coupable de désertion; i) en temps de guerre, s'être volontairement mutilé; 3. du chef des infractions suivantes prévues par le code pénal : vol, extorsion, abus de confiance, escroquerie, viol, attentat à la pudeur; 4. du chef de détournement ou de vol au préjudice de militaires ou de l'Etat. Article: 457 Le présent article concerne tout militaire autre que ceux mentionnées à l'article 456. Le tribunal prononcera la dégradation militaire si le militaire a, par application du code pénal, encouru une peine égale ou supérieure à dix années d'emprisonnement. Si le militaire a, par application du code pénal militaire, encouru une peine criminelle, le tribunal ne prononcera la dégradation militaire que pour les chefs de : 1. trahison et espionnage; 2. abandon de poste ou de position; 3. violences préméditées ayant entraîné la mort d'un supérieur; 4. meurtre d'un supérieur pendant ou à l'occasion du service; 5. désertion à l'ennemi. Dans tous les cas, le tribunal pourra prononcer la dégradation militaire contre le militaire condamné à plus de trois années d'emprisonnement pour vol, extorsion, abus de confiance, escroquerie, viol ou attentat à la pudeur. Section 3. De l'emprisonnement Article: 358 Les militaires condamnés à l'emprisonnement subiront leur peine dans les prisons déterminées par le gouvernement. La durée de l'emprisonnement ne compte pas comme temps de service. Article: 358 Les militaires condamnés à l'emprisonnement subiront leur peine dans les prisons déterminées par le gouvernement. La durée de l'emprisonnement ne compte pas comme temps de service. Chapitre 2. DES INFRACTIONS MILITAIRES ET DE LEUR REPRESSION Section 1. De la trahison et de l'espionnage Article: 459 Est coupable de trahison tout militaire au service de la République qui aura commis une des infractions prévues par les articles 151 à 155 et 158 à 163 du code pénal; dans ces cas les peines prévues par ces articles seront remplacées : 1. l'emprisonnement dont le maximum ne dépasse pas cinq ans, par l'emprisonnement de cinq à dix ans; 2. l'emprisonnement de cinq à dix ans, par l'emprisonnement de dix à quinze ans; 3. l'emprisonnement de dix à quinze ans, par l'emprisonnement de quinze à vingt ans; 4. l'emprisonnement de quinze à vingt ans, par l'emprisonnement à perpétuité; 5. l'emprisonnement à perpétuité, par la mort. Article: 460 Est également coupable de trahison et sera puni de mort, tout militaire qui se sera introduit dans une place de guerre, dans un poste ou établissement militaire, dans les travaux, camps, bivouacs ou cantonnements d'une armée, pour s'y procurer des renseig¬nements ou documents dans l'intérêt de l'ennemi. Sera coupable d'espionnage et puni d'un emprisonnement de quinze à vingts ans, tout autre individu qui se sera introduit, déguisé en militaire, dans un des lieux désignés et dans le but indiqué à l'alinéa précédent. Section 2. Des atteintes aux devoirs militaires Article: 461 Sera puni de mort tout officier qui, en présence de l'ennemi, aura abandonné ou rendu, sans y être contraint par des forces supérieures, le poste ou la position qui lui était assigné. Article: 462 Tout militaire qui, étant de faction, aura, soit abandonné son poste, soit omis de remplir sa consigne sera puni d'un emprisonnement d'un mois à un an. En temps de guerre, il sera puni d'un emprisonnement de deux à cinq ans. Il sera puni de mort s'il était en présence de l'ennemi. Article: 463 Tout militaire qui, étant de faction, aura été trouvé ivre ou endormi, sera puni : 1. en temps de paix : d'un emprisonnement d'un mois à six mois; 2. en temps de guerre : d'un emprisonnement de deux mois à un an; 3. en temps de guerre, et en présence de l'ennemi, d'un emprisonnement de trois mois à trois ans. Article: 464 Tout militaire qui, sans être de faction, aura abandonné son poste, sera puni : 1. en temps de paix : d'un emprisonnement d'un mois à un an; 2. en temps de guerre : d'un emprisonnement de trois mois à trois ans; Si le coupable est chef de poste, le maximum de la peine sera appliqué. Le coupable, quel qu'il soit, pourra être puni de mort s'il était en présence de l'ennemi. Article: 465 Tout militaire qui, en temps de guerre, et en cas d'alerte, ne se sera pas rendu à son poste, dans le délai imposé, sera puni d'un emprisonnement de deux mois à deux ans. Section 3. De l'insubordination et de la révolte Article: 466 Le militaire qui refusera d'obéir aux ordres d'un supérieur ou s'abstiendra à dessein de les exécuter lorsqu'il est commandé pour un service, sera puni d'un emprison¬nement de trois mois à trois ans. En temps de guerre, l'officier sera puni d'un emprisonnement de cinq à dix ans, tout autre militaire sera puni d'un emprisonnement de deux à cinq ans. Si le fait a eu lieu en présence de l'ennemi, le coupable quel qu'il soit, sera puni de mort. Article: 467 Est qualifiée révolte, toute résistance simultanée aux ordres de leurs chefs par plus de deux militaires réunis lorsque l'ordre est donné pour un service. Article: 468 Si la révolte a eu lieu par suite d'un concert, elle sera punie, en temps de guerre, d'un emprisonnement de cinq à dix ans; en d'autres circonstances, d'un emprisonnement de deux à cinq ans. Si la révolte n'a pas été le résultat d'un concert, les coupables seront condamnés, en temps de guerre, à un emprisonnement de deux à cinq ans, en d'autres circonstances, à un emprisonnement de trois mois à trois ans. Dans tous les cas, le maximum de la peine sera appliqué aux instigateurs ou chefs de la révolte. Article: 469 L'officier qui aura pris part à une révolte sera puni d'un emprisonnement de cinq à dix ans. Il sera puni de mort s'il a pris part à une révolte en temps de guerre. Section 4. Des violences et des outrages envers un supérieur ou une sentinelle Article: 470 Tout militaire coupable de violences envers une sentinelle sera puni d'un emprisonnement de deux mois à deux ans. Dans les cas prévus par l'article 319 du code pénal, le coupable sera puni d'un emprisonnement de six mois à trois ans. Il sera condamné à un emprisonnement de cinq à dix ans dans le cas prévu par l'article 320, et, à un emprisonnement de dix à quinze ans, dans le cas prévu par l'article 321 du code pénal. Article: 471 Les violences commises par un militaire envers un supérieur seront punies d'un emprisonnement de trois mois à trois ans si elles ont été commises pendant le service ou à l'occasion du service, et de deux mois à deux ans, si elles ont été commises en toute autre circonstance. Article: 472 Les violences commises par un militaire envers un supérieur seront punies : 1. d'un emprisonnement de deux à cinq ans dans le cas prévu par l'article 319; 2. d'un emprisonnement de cinq à dix ans dans le cas prévu par l'article 320; 3. d'un emprisonnement de dix à quinze ans dans le cas prévu par l'article 321 du code pénal. Article: 473 Si les violences mentionnées à l'article précédent ont été commises pendant le service ou à l'occasion du service, les peines portées par cet article seront remplacées : 1. l'emprisonnement de deux à cinq ans par l'emprisonnement de cinq à dix ans; 2. l'emprisonnement de cinq à dix ans par l'emprisonnement de dix à quinze ans; 3. l'emprisonnement de dix à quinze ans par l'emprisonnement de quinze à vingt ans. Article: 474 En temps de guerre, tout militaire coupable d'avoir commis des violences envers un supérieur sera puni d'un emprisonnement de cinq à dix ans. Si les violences ont été commises pendant le service ou à l'occasion du service, il sera puni d'un emprisonnement de dix à quinze ans. Article: 475 Lorsque les violences commises en temps de guerre par un militaire envers un supérieur auront causé une maladie ou une incapacité de travall personnel, le coupable sera condamné à un emprisonnement de quinze à vingt ans. Il sera condamné à un emprisonnement à perpétuité dans le cas prévu par l'article 320, alinéa 1er, du code pénal. La peine sera la mort dans les cas prévus par l'article 320, alinéa 2, du code pénal. Article: 476 Le meurtre commis par un inférieur sur un supérieur pendant le service ou à l'occasion du service sera puni de mort. Article: 477 Lorsqu'un militaire aura commis des violences dans la maison où il était logé sur la réquisition de l'autorité publique et contre un habitant de cette maison, le minimum des peines portées par les articles 318 à 321 du code pénal sera doublé s'il s'agit d'un emprisonnement dont le maximum ne dépasse pas cinq ans; il sera élevé de cinq ans s'il s'agit d'un emprisonnement dont le maximum est supérieur à cinq ans. Article: 478 Tout militaire qui aura outragé un supérieur sera puni d'un emprisonnement d'un mois à six mois. Lorsque l'outrage a eu lieu pendant le service ou à l'occasion du service, le coupable sera condamné à un emprisonnement de deux mois à deux ans. Section 5. De la désertion Article: 479 Est réputé déserteur et sera puni d'un emprisonnement d'un an à cinq ans : 1. tout officier qui, en temps de guerre, se sera absenté de son corps ou de sa résidence pendant plus de six jours ou qui aura quitté le territoire de la République sans autorisati¬on; 2. tout officier qui, en temps de paix, se sera absenté de son corps ou de sa résidence pendant plus d'un mois ou qui, ayant quitté le territoire de la République sans autorisation, sera demeuré absent pendant plus de quinze jours. Article: 480 La peine prévue à l'article précédent pourra être infligée à tout officier en congé ou en permission qui ne sera pas rentré à son corps ou à sa résidence en temps de guerre, six jours, en temps de paix, un mois après l'expiration de son congé ou de sa permission, ou après avoir reçu un ordre de rappel. Article: 481 Est également réputé déserteur : 1. tout militaire d'un rang inférieur à celui d'officier qui se sera absenté de son corps ou de son détachement, sans y être autorisé, pendant plus de six jours en temps de guerre, pendant plus de quinze jours en temps de paix; 2. tout militaire d'un rang inférieur à celui d'officier qui, voyageant isolément, ne sera pas arrivé à destination, en temps de guerre, six jours, en temps de paix, quinze jours après celui qui lui aura été fixé; 3. tout militaire d'un rang inférieur à celui d'officier, en permission ou en congé, qui ne sera pas rentré à son corps, en temps de guerre, six jours, en temps de paix, un mois après l'expiration de son congé ou de sa permission ou après l'époque fixée par un ordre de rappel. Article: 482 Tout militaire d'un rang inférieur à celui d'officier, coupable de désertion en temps de paix, sera puni d'un emprisonnement de deux mois à deux ans. La durée de l'emprisonnement sera de trois mois à trois ans : 1. si le coupable a déjà été antérieurement condamné pour désertion; 2. s'il a déserté de concert avec un camarade; 3. s'il a emporté son arme à feu ou s'il s'est saisi d'un véhicule militaire; 4. s'il faisait partie d'une patrouille, d'une garde, d'un poste ou de tout autre service armé au moment de la désertion; 5. s'il a franchi les limites du territoire de la République; 6. s'il a fait usage d'un congé ou permission contrefaits ou falsifiés; 7. si la désertion a duré plus de six mois. Article: 483 Le maximum des peines portées à l'article précédent sera prononcé lorsque la désertion aura eu lieu en temps de guerre. Article: 484 Est réputée désertion avec complot, toute désertion effectuée de concert par plus de deux militaires. Article: 485 Le chef de complot sera puni, en temps de paix, d'un emprisonnement de deux à cinq ans, en temps de guerre, d'un emprisonnement de cinq à dix ans. Les autres coupables seront punis, en temps de paix, d'un emprisonnement de trois mois à trois ans, en temps de guerre, d'un emprisonnement de deux à cinq ans. Article: 486 Tout déserteur en présence de l'ennemi sera puni d'un emprisonnement de dix à quinze ans, s'il est officier, d'un emprisonnement de cinq à dix ans s'il est d'un rang inférieur. Article: 487 Sera puni de mort, tout militaire coupable de désertion à l'ennemi. Section 6. Des mutilations volontaires Article: 488 Tout militaire qui, en temps de guerre, se sera volontairement mutilé, laissé mutiler ou mis par un moyen quelconque dans un état d'invalidité, pour se soustraire, même temporairement, au service, sera puni d'un emprisonnement de cinq à dix ans s'il est officier, et d'un emprisonnement de trois à cinq ans s'il est d'un rang inférieur. Article: 489 Si le fait a eu lieu en présence de l'ennemi, l'officier sera puni d'un emprisonne¬ment de dix à quinze ans, tout autre militaire, d'un emprisonnement de cinq à dix ans. Section 7. De l'emploi des armes sans ordre Article: 490 Tout militaire qui, en service commandé, aura, sans ordre d'un supérieur, fait usage d'une arme, sera puni d'un emprisonnement de trois mois à trois ans. Section 8. Des détournements et des vols d'effets appartenant à l'Etat ou à des militaires Article: 491 Sera puni conformément aux dispositions du code pénal : 1. le militaire qui aura détourné des armes, des munitions, des objets de casernement ou de campement, des deniers ou des effets quelconques qui appartiennent à l'Etat ou à des militaires et dont il était comptable ou qui étaient confiés à sa garde; \ 2. le militaire qui, sans être ni comptable ni préposé à la garde des choses spécifiées à l'alinéa précédent, les aura frauduleusement soustraites. Article: 492 Le vol de chambrée est celui dont l'auteur et la victime font partie de la même chambrée. Il est puni d'un emprisonnement de deux mois à cinq ans. Article: 493 Sera aussi puni conformément aux dispositions du code pénal, sans toutefois que la peine puisse être inférieure à six mois d'emprisonnement, le militaire qui se sera rendu coupable de vol au préjudice ou dans la maison de l'habitant chez lequel il est logé sur la réquisition de l'autorité publique. Article: 494 Tout militaire qui aura vendu, donné, échangé, mis en gage, détruit ou dissipé d'une manière quelconque ses effets d'habillement, d'équipement ou d'armement, sera puni d'un emprisonnement d'un mois à un an. Article: 495 La même peine sera appliquée à celui qui, après une absence de son corps, n'aura pas reproduit les objets mentionnés à l'article précédent, à moins qu'il ne prouve qu'il en a été dépouillé par suite de force majeure. Chapitre 9. De la violation de certaines dispositions légales ou réglementaires étrangères Article: 496 Le militaire qui, sur le territoire d'un Etat étranger où il est en service, contre¬vient à la législation de cet Etat en matière forestière, rurale, de chasse, de pêche, de circulation routière, de douanes, de change ou de réglementation des importations ou exportations, sera puni d'un emprisonnement de huit jours à un an et d'une amende de cinq cents à cinq mille francs ou d'une de ces peines seulement. Article: 497 Lorsque la législation étrangère enfreinte est relative à la circulation routière, la déchéance du droit de conduire sera encourue, dans les conditions prévues par la loi rwandaise, comme s'il y avait eu violation de la réglementation en vigueur sur le territoire de la République. Article: 498 Lorsque la législation étrangère enfreinte est relative à la matière des douanes ou des changes, ou a pour objet la réglementation des importations ou exportations, les règles suivantes seront applicables : 1. l'amende sera toujours prononcée et son maximum est porté à deux cent mille francs; 2. la confiscation ne sera prononcée que dans les conditions prévues par la législation de l'Etat étranger; les choses confisquées seront mises à la disposition de cet Etat; 3. l'action publique ne pourra être exercée que sur la plainte du Ministre ayant les Forces Armées Rwandaises dans ses attributions ou de l'autorité désignée par lui à cette fin; ces autorités pourront transiger aussi longtemps que les juridictions de jugement compétentes en premier ressort n'auront pas été saisie de la cause Article: 499 Les actes de l'autorité étrangère constatant les faits visés aux articles 496 à 498, auront devant la juridiction rwandaise la force probante que leur attache en la matière la législation rwandaise. Chapitre 3. DE L'ETAT DE SIEGE Article: 500 Pour l'application du code pénal militaire, l'état de siège est assimilé au temps de guerre. Les juridictions militaires appliqueront aux infractions commises pendant la période d'état de siège, les peines prévues pour les infractions commises en temps de guerre.
