INTERNATIONAL LAW RESEARCH PROGRAM
INTELLECTUAL PROPERTY LAW
One of the initial areas of focus for the Centre for International Governance Innovation’s (CIGI)
International Law Research Program (ILRP) is international intellectual property (IIP) law. The ILRP’s
study of IIP law will focus on four key aspects, but will evolve with the pace of innovation and related
international law governance challenges. Within each aspect there are many potential avenues to explore:
Green / Climate Change Technology Innovation

Investigating how technology innovation and its transfer play a fundamental role in addressing climate change, adapting to it and mitigating its harmful effects
Examining how IIP, trade and investment, and environmental law should be reconciled to respond to the global challenge of climate change and sustainable development
Adaptation of Legal Frameworks for Innovation

Assessing whether IIP law is well-adapted to support innovation
Studying emerging, experimental and effective vehicles, tools or models to overcome intellectual property law obstacles and accelerate innovation
Examining how international and domestic legal frameworks should be modified to support new vehicles, tools or models of innovation
Advantages & Disadvantages of Multilateral Versus Regional Intellectual
Property Instruments

Investigating the impact and efficacy of IIP legal regimes on innovation, sustainability, and development nationally through multidisciplinary methodology and case analysis
Evaluating the advantages and disadvantages of multilateral versus like-minded or regional international intellectual property law rules through multi-disciplinary case studies, considering historical, geographic and developmental perspectives
Management of Intellectual Property in the Global Market
• Exploring how national, international, and transnational intellectual property law frameworks and
practices can be shaped to serve as a tool for enhancing innovation, stimulating the development of new markets and disseminating knowledge to the public

DROIT INTERNATIONAL DE LA PROPRIÉTÉ INTELLECTUELLE (PI)
Comptant parmi les principaux champs d’intérêt du Programme de recherche en droit international
(PRDI) du Centre pour l’innovation dans la gouvernance internationale (CIGI), le droit international de la
propriété intellectuelle (PI) sera examiné sous quatre aspects clés qui évolueront au gré des innovations
et des défis de gouvernance du droit international. Chacun de ces aspects comporte une série d’éléments
à explorer :
Innovations technologiques en matière d’environnement et de changement
climatique
• Déterminer comment les innovations technologiques et leur transfert jouent un rôle fondamental dans le traitement du changement climatique, l’adaptation à ses conséquences et l’atténuation de ses effets nuisibles
• Examiner comment concilier le droit international de la PI, le droit du commerce et de l’investissement international et le droit de l’environnement pour mieux répondre aux défis planétaires du changement climatique et du développement durable
Adaptation des cadres juridiques au profit de l’innovation

Évaluer l’adaptation du droit international de la PI au soutien à l’innovation
Étudier quels outils, modèles et véhicules émergents, efficaces et expérimentaux permettraient de surmonter les obstacles au droit de la PI et d’accélérer l’innovation
Examiner comment modifier les cadres juridiques nationaux et internationaux en appui aux nouveaux outils, modèles et véhicules d’innovation
Avantages et inconvénients des instruments de PI multilatéraux par rapport
aux instruments régionaux

Examiner l’impact et l’efficacité des régimes juridiques internationaux de PI en matière d’innovation, de durabilité et de développement national à l’aide d’une méthodologie multidisciplinaire et d’études de cas
Évaluer les avantages et inconvénients des règlements de PI multilatéraux par rapport aux règlements régionaux ou similaires à l’aide d’études de cas et selon une perspective historique, géographique et développementale.
Gestion de la propriété intellectuelle dans un marché mondialisé
• Explorer comment adapter les pratiques et cadres nationaux, internationaux et transnationaux du droit de la PI pour favoriser l’innovation, le développement de nouveaux marchés et la diffusion du savoir auprès du public
