Councillor Barnes requested that the April 19, 2004 minutes be changed to reflect the
following corrections:
Page 14 – Item 6.18 to be changed to read: That City Council supports the City of Moncton
hosting the Acadiana Cup International Golf Tournament, from July 22 – 29, 2004, and that
$6,848.00 plus HST for bus transportation and $750.00 for gift baskets be charged to the
contingency account.
Page 9 – Councillor LeBlanc registered a Nay Vote on the Private Session of April 19, 2004
relative to the Savonnerie Olivier Soapery.

PUBLIC PRESENTATIONS/PETITIONS/APPEARANCES
1.1
Presentation of National Public Works Week – Limited Edition Poster
J. G. Greenough introduced the subject and noted that the National Public Works Week
will take place the week of May 16 – 22, 2004. The week seeks to enhance the prestige of the
often unsung heroes of our society and professionals who serve the public everyday with quiet
dedication. A short video taken from New York in the aftermath of 911 was shown to
demonstrate the quiet dedication of those professionals . He presented a framed poster to
Deputy Mayor Mitton for inclusion in the City Hall collection.
As Liaison Councillor for the Engineering Department, Councillor Crossman thanked
the Engineering & Public Works Departments for their dedication.
Deputy Mayor Mitton thanked Mr. Greenough for his presentation

Presentation – Victoria Park Upgrade
Jim Scott reviewed the conceptual plan of the Victoria Park upgrade, noting that some
work was undertaken in 2003 and work on the first phase should commence within the next
two months. It was noted that this year’s work will be concentrated on the lower section of the
park, being the Park and Weldon Streets area.
Peter Sawyer advised that on May 21, 2004, from 12:30 p.m.–1:00 p.m., an event is
being organized at Victoria Park where details of some of the new elements for the next phase
of the park will be revealed . To obtain more details about this event, he invited Councillors to
join them on May 21, 2004 at Victoria Park.
Deputy Mayor thanked Messrs. Scott and Sawyer for their presentations.

ZONING MATTERS
2.1
Report from GMPDC – to rezone the property located at 212 Waverley
Avenue (PID 00762724)
Motion:
That the rezoning request received from Kevin MacSweyn, to rezone the property
located at 212 Waverley Avenue (PID 00762724), from Residential to SC-1 be advertised and
set over for a public hearing to be held at the City Council meeting of June 7, 2004.

STATEMENTS BY MEMBERS OF COUNCIL
Councillor LeBlanc
Panhandling – Noted that the adoption of the new by- law relating to panhandling has
helped tremendously in the downtown area. A more visible police presence in the downtown
area has been noticeable and in order to ensure that the downtown area is safe and secure,
continued assistance from the RCMP will be necessary.
Bicycle Patrols – Read with some interest that the RCMP has decided to cut-back on
its bicycle patrols. Bicycle patrol is an important asset and hopes that the RCMP will
reconsider their decision and reinstate the bicycle patrols within the City.
Councillor Cyr
Parking problem on MacBeath – Thanked Council for the prompt attention given to the
parking problem on MacBeath Avenue by placing No Parking restrictions on both sides of
MacBeath Avenue between 10:00 a.m. and 11:00 a.m., Monday to Friday.
Upcoming Election - Congratulated the candidates who have been elected by
acclamation and extended best wishes to the candidates who are re-offering.
Acknowledged the recent passing of two great individuals: Father Anselme Chiasson
and Ms. Léone Boudreau-Nelson. He extended his sympathies to the families, especially to
Colette McLaughlin of the Corporate Communications Department who was related to Father
Chiasson.
Councillor Gillespie
Street Markings – Raised the deterioration of street markings within the City and asked
the Engineering Department to attend to this matter.
Winter damage – Referred to complaints about properties being damaged from this
year’s snow removal. He enquired if one City employee could be designated to attend to these
complaints.
Thanked the residents for electing him as Councillor and giving him the opportunity to
represent them and be part of the transition that has taken place in the City over the years. He
also thanked the Members of Council for their contributions and urged them to continue with
their professional approach to handling the affairs of the community.
Councillor Barnes
Active Transportation Network – Mentioned that the City was currently planning the
launch of its Active Transportation Network. She noted that she will provide additional
information at the next Council meeting.
Congratulated everybody who were involved in the literacy programs, particularly, the
dedication of teachers, students and sponsoring groups within the community on promoting
literacy.

Noted that she attended the closing service of Proclamation 2004 at the Assumption
Cathedral. She congratulated everyone who were involved in organizing this successful event.
Councillor Boyce
Upcoming election – Congratulated the candidates of Ward IV who were elected by
acclamation. Extended best wished to Councillors Gillespie and Cyr who are not re-offering.
He also congratulated the Councillors of Ward II with respect to their acclamatio n.
Visit of Robert Kennedy Jr. – Acknowledged the recent visit of Robert Kennedy Jr. to
the City of Moncton in support of the restoration of the Petitcodiac River.
Water – Noted that he plans to attend a meeting in Edmonton on May 28, 2004 on the
subject of water. The Federation of Canadian Municipalities and the Department of Foreign
Affairs and International Trade have a sub-committee on which he is a member. The purpose
of this meeting will be very crucial to discussions of the issue of water that will be brought to
the World Trade Organization for discussion at their future meeting.

He also acknowledged the passing of Léone Boudreau-Nelson.
Councillor Crossman
Congratulated Councillors Henderson and Robertson on being elected by acclamation.
He wished Councillor Gillespie a happy and prosperous retirement and wished Councillor Cyr
good luck in his future endeavors.

Patching – Advised that the patching program has commenced.
Congratulated the Keep the Kay Committee on their recent event held at the Kay
Arena to promote the new project.
Wet/Dry Program - Announced that the Westmorland/Albert Solid Waste Corporation
was celebrating its 5th year of waste separation. The current separation rate stands at
approximately 85% and the compliance rate reached approximately 50% on residential
properties. As Chairperson of the Westmorland/Albert Solid Waste Corporation, he thanked
Council and City staff for their initiatives and cooperation.
Councillor Henderson
Advised his constituency that although he was elected by acclamation it will not lessen
his commitment to the citizens of Ward II, in that, he will continue to work hard on their
behalf.
Wished Councillor Gillespie a happy retirement and extended best wishes to
Councillor Cyr on his future endeavors. To the other councillors who are re-offering he
wished them the best of luck in their campaign. He also thanked City staff for their
cooperation and looks forward to working with them during the next four years.
Advised the residents of Salisbury Road that the resurfacing of Salisbury Road, from
Jackson to Rosewood Trailer Park, will be undertaken in 2004.
Advised that on April 29, 2004, he had an opportunity to attend the official opening of
the Salvation Army Correctional and Justice Services Greenfield house on Cameron Street.
He congratulated the organizers for a successful event.
Councillor Robertson
City Hall School – Read a letter from C. Lavigne, District 1 congratulating the City of
Moncton for the creation of the City Hall school. They extended a special thank you to
Maribeth Casey and Gyslain Chiasson for their assistance.

Also extended best wishes to all candidates in the forthcoming elections. He extended
best wishes to Councillors Gillespie & Cyr in their future endeavors.
He too advised that being elected by acclamation will not lessen his commitment to his
constituency. He will continue to work hard to advance the interest and represent the issues of
Ward II. In order to help facilitate the consultation and the input, a meeting has been
scheduled for Saturday, May 8, 2004, at the Lions Senior Citizen Center from 1:30 p.m. – 3:30
p.m. Citizens are encouraged to attend this meeting to provide their input.

Congratulated the other acclaimed candidates of Ward IV.
Congratulated Councillor Henderson on his re-election to Council and noted that he
looks forward to working with him for the next four years.
Councillor Hicks
Panhandling – Commented that he received positive feedback from one downtown
merchant that the panhandling situation in the downtown area has been greatly improved. He
thanked the RCMP for their efforts. He believes that Council will have to continue monitoring
the situation for the next few months to ascertain that the problem does not resurface.
Mapleton Place Subdivision – Remarked that on May 2, 2004, the Mapleton Place
Subdivision held their grand re-opening of their well.
PSAC 2004 Grants – Advised that the Public Safety Advisory Committee’s 2004 grant
applications are currently available at 637 Elmwood Drive or by contacting Robert Gallant at
855-1762. Forms are also available in the City Clerk’s Office. The application deadline is
May 28, 2004.
Mother’s Day – Announced that Sunday, May 9, 2004, was Mother’s Day and wished
mothers a Happy Mother’s Day.

REPORTS FROM CITY MANAGER
6.1
Guidelines for Sidewalk Cafés – 2004
K. Kelly, General Manager, DMCI, introduced the subject and noted that only minor
clarity changes have been made to the conditions of operation. The licensing fee for
restaurants and bars have not changed, being, $10 per square meter of $1 per square foot, with
the fee for cafés at $5 per square meter or approximately 50 cents per square foot.
Councillor Boyce voiced the importance of pedestrian rights-of-ways not being
blocked.
Councillor Barnes alluded to the Cafés Patio Platform and believes that these operators
should not only pay an amount equal to the city’s anticipated lost reve nue, but they should also
pay the appropriate rental fee. She requested a summary of fees paid by the different Sidewalk
Cafés.
Councillor Barnes voiced the importance of adding a visual appeal to these sidewalk
cafés by installing potted flowers and plants, hanging baskets and landscaping. K. Kelly
informed that they were currently working on an education program
In response to Councillor Hicks, K. Kelly indicated that operators are strongly
encouraged to use wrought iron or decorative ironwork throughout the downtown.
Deputy Mayor Mitton raised the poor condition of the subway, and asked K. Kelly to
follow up on this matter.

That Council approve the Sidewalk Café Standards of Operation for 2004,
which outline design parameters, terms of operation, and fee schedule.

That Roadway Systems Ltd. be awarded the Victoria Park Construction –
Concrete Work, QP03-146, at the total quoted price of $116,998.70 including HST.

Supply and Installation of Artificial Turf Surface – Rocky Stone Field
Motion:
That Turf Masters Landscaping Ltd. & Golf Construction be awarded the
Supply and Installation of Artificial Turf – Rocky Stone Field, RFP04-049, at the total
negotiated price of $897,700.00 plus $134,655.00 H.S.T. = $1,032,355.00.
That Council approve the trans fer of funds from the Capital Works Accounts W03N-18BN
($200,000), W02N-17FN ($100,000) and W04N-17FN ($28,480.00) to Capital Works
Account W04N-17EN.

2004 Designated Highway Program
That the following recommendations be adopted:
the City accept the funding proposed by the Province, being $300,000;
continue the asphalt resurfacing on the Salisbury Road, from Jackson Avenue to
Rosewood
Trailer Park, at an estimated cost of $350,000; and
widen and install storm sewer and sidewalks on the Gorge Road, from the Trans
Canada Highway to the Atlantic Baptist University, at a cost of $250,000.

Motion:
That the $350,000 allotted for the widening and resurfacing of the Shediac Road,
from Greenwich to the Trans Canada Highway, be included in the 2005 Capital Works
Budget. Whereas sewers are scheduled to be installed on this section of the road this summer,
that the Engineering Department explore ways to install the water line in 2004 and report back
to Council.

BE IT ENACTED by the City Council of the City of
Moncton as follows:

A By-Law Relating to the Regulation of Traffic,
Parking and the Use of Streets in the City of Moncton,
being By-Law # T-102, ordained and passed on the 2nd
day of December, 2002, is hereby amended as follows:
L’Arrêté réglementant la circulation, le stationnement et
l'utilisation des rues dans la ville de Moncton, soit l'arrêté
no T-102, fait et adopté le 2 décembre 2002, est modifié ainsi qu’il
suit :
1. Section 1, Definitions, is amended by adding the
words “or his or her designate” immediately following
the definition for “City Engineer”, and adding the
following new definitions:

within 48 hours, and to effect the repairs within

issued under subsection (2), the City Engineer may
cause the necessary work to be done and to
recover the cost thereof in an action of debt against
the owner.

of any person travelling or entering onto any street.

(5) Where the City Engineer is satisfied that
conditions described in subsection (4) exist, the
City Engineer may issue an order requiring the
owner to trim the said trees, hedges, bushes or
shrubbery within a time specified in the order, and
where the owner fails to comply with such notice
then the City Engineer may cause the same to be
done and to recover the cost thereof in an action of
debt against the owner thereof.

Utility Permit

13.1 (1) No person shall construct a facility in or upon
any street without first having obtained a Utility
Permit from the City Engineer for each street
affected.

(2) An application for a Utility Permit shall be
made in writing to the City Engineer and shall
include detailed scaled plans showing the
proposed location of such facility and any and all
existing municipal and utility infrastructure,
including public trees and such other information or
plans deemed necessary by the City Engineer.

fee of two hundred and fifty dollars ($250.00) or the

complete application referred to in subsection (2)

constructed at a depth of less than 0.9 meters
from the existing or planned finished grade;

Services Permit shall be subject to the following

5. (1) Proof of the giving of notice in either manner
provided for in subsection 4(f) may be by a certificate or
an affidavit purporting to be signed by the officer
referred to in section 4, naming the person to whom
notice was given and specifying the time, place and
manner in which notice was given.
(2) A document purporting to be a certificate
under subsection (1) shall be
(a) admissible in evidence without proof of
signature, and
(b) conclusive proof that the person named in
the certificate received notice of the matters
referred to in the certificate.
(3) In any prosecution for a violation of any
provision of this by-law, where proof of the giving of
notice is made as prescribed under subsection (1), the
burden of proving that one is not the person named in
the certificate or affidavit shall be upon the person
charged.
(4) A notice given under section 4 and purporting
to be signed by an officer appointed by council shall be

6. (1) A person who fails to comply with the terms of
a notice under section 4 commits an offence punishable
under Part II of the Provincial Offences Procedure Act
as a category E offence and notwithstanding the
provisions of any Act to the contrary, no judge of the
Provincial Court may suspend the imposition of any
penalty under this section.

7. If a notice has been given under section 4 and the
owner or occupier does not comply with the notice
within the time allowed, the municipality may, rather
than commencing proceedings in respect of the
violation or in addition to doing so, cause the work set
out in the notice given under section 4 to comply with
the Code to be carried out, and the cost of carrying out
such work, including any related charge or fee, is
chargeable to the owner or occupier and becomes a
debt due to the municipality.

9. (1) The cost of carrying out work under section 7
and all reasonable costs and charges attendant upon
the filing, entering and recording of a certificate under
section 8 shall, notwithstanding subsection 72(2) of the
Workers’ Compensation Act and until paid, form a lien
upon the real property in respect of which the work is
carried out in priority to every claim, privilege, lien or
other encumbrance, whenever created, subject only to
taxes levied under the Real Property Tax Act and a
special lien under subsection 189(10).

begun and does not require registration or
filing of any document or the giving of notice
to any person to create or preserve it, and
(b) follows the real property to which it
attaches into whosever hands the real
property comes.
(3) Any mortgagee, judgment creditor or other
person having any claim, privilege, lien or other
encumbrance upon or against the real property to which
is attached a lien under subsection (1)
(a) may pay the amount of the lien,
(b) may add the amount to the person’s
mortgage, judgment or other security, and
(c) has the same rights and remedies for the
amount as are contained in the person’s
security.

10. A municipality shall not proceed to act under
section 7 unless it has a report from an architect, an
engineer, a building inspector or the Fire Marshal that
the building or structure is dilapidated or structurally
unsound and such report is proof in the absence of
evidence to the contrary that the building or structure is
dilapidated or structurally unsound.

11. A by-law entitled “A BY-LAW RELATING TO
MAINTENANCE AND OCCUPANCY OF RESIDENTIAL
PROPERTIES IN THE CITY OF MONCTON”, being bylaw # Z-502, ordained and passed on the 2nd day of
July, A. D., 2002, and all amendments thereto, is
hereby repealed.
11. L’arrêté intitulé « ARRÊTÉ CONCERNANT L’ENTRETIEN ET
L’OCCUPATION DES RÉSIDENCES DE LA VILLE DE
