Law at the Crossroads: Was wird aus
dem Recht im 21. Jahrhundert?
Das Recht dient traditionell dazu, die
Gesellschaft und den Staat zu steuern.
Im Zentrum der Alpbacher Rechtsgespräche 2014 steht die Frage, inwiefern
sich diese Funktion wandelt. Welche Auswirkungen haben globale Entwicklungen
auf die Wahrnehmung und Wirkung von
Recht? Endet das Rechtsstaatsmodell im
internationalen Kontext? Verliert das
Recht durch die Dominanz der Wirtschaft
seine Steuerungsfunktion? Kommt es zur
Auflösung der rechtssetzenden Funktion
des nationalen Rechtsstaats zugunsten
einer bloßen Mediationsfunktion? Wie
viel Steuerungsfähigkeit hat das Völkerrecht vor allem in internationalen Konflikten? Und welche Herausforderungen
bringt Big Data für Rechtssetzung und
Rechtsdurchsetzung mit sich?
Traditionally, law has served to guide
society and the state. At the Alpbach
Legal Symposium 2014, we will ask to
which extent this function is changing.
What impact do global developments
have on the perception and effect of law?
Does the rule of law end in an international context? Is legislation losing its
control function due to the dominance
of the economy? Is the legislative function of national law changing into a mere
mediating function? To which extent can
international law exercise power and
control – in particular in international
conflicts? And what are the challenges
legislation and law enforcement are
facing in connection with BigData?
Experts from the fields of science, law
and politics will discuss these and other
questions at the Alpbach Legal Symposium 2014. Because of the high number
of participants in the last two years, this
year’s Legal Symposium will for the first
time be held in the large plenary room.

What kind of controlling function does international law actually have in international conflicts? Is it possible and desirable to establish a body of public international law for an entire
world society or are different legal cultures developing parallel to each other? In our multi-religious, multi-cultural world, does law rather foster integration and unification or separation?
Wie viel Steuerungsfähigkeit hat das Völkerrecht bei internationalen Konflikten tatsächlich? Kann und soll es ein Völkerrecht für eine Welt-Gesellschaft geben oder entwickeln sich

What are the risks and opportunities associated with the use of Big Data? How are we
supposed to deal with the protection of data and fundamental rights in our information
society and on the Internet? Is it possible to regulate the Internet, and if so, how? Is the
communication which takes place via the Internet undermining the legal system?
Welche Chancen und Risken ergeben sich durch die Nutzung von Big Data? Wie geht man
mit Datenschutz bzw. Grundrechtsschutz in unserer Informationsgesellschaft und dem

Especially during the Obama administration the US has started to increasingly use
drones against identified enemies. These decisions to kill are made without any formal
procedures to comply with constitutional guarantees. Which repercussions does that
have on the Western democratic understanding of a constitutional state?
Die USA sind insbesondere seit der Präsidentschaft von Obama vermehrt dazu übergegangen,
Drohnen gegen identifizierte Feinde einzusetzen. Der Entscheidung zu töten geht kein formelles
Verfahren voraus, in dem rechtsstaatliche Garantien eingehalten würden. Welche Rückwirkungen auf das westlich demokratische Rechtsstaatsverständnis ergeben sich durch diese Praxis?

Football is more than sport. Football has always fired people‘s imaginations. The sport
unites people from all different walks of life, and thus it was always more than just
running after a ball. Football has many economic and legal aspects: just one of these is
the question of how the biggest sports organisation in the world can overrule national
law in favour of lucrative business dealings.
Fußball ist mehr als ein Sport. Fußball hat seit jeher die Menschen beflügelt. Indem dieser
Sport Intellektuellendiskurs und Stammtisch verbindet, war er immer mehr als die Jagd
nach einem Lederball. Fußball hat zahlreiche wirtschaftliche und rechtliche Aspekte: Nur
einer davon ist die Frage, wie der weltgrößte Sportverband nationale Gesetze zugunsten
von lukrativen Geschäften außer Kraft setzt.
