Nécessité urgente de protéger et de promouvoir le droit à l'eau dans les Objectifs de Développement
Durable (ODD).
Cher Ambassadeur,
Nous, les organisations soussignées, exhortons le Groupe de Travail Ouvert (GTO) de l'Assemblée Générale
des Nations Unies sur les Objectifs de Développement Durable (ODD) d'affirmer explicitement son
engagement à protéger et à promouvoir le droit à l'eau et à l'assainissement dans le cadre des Objectifs de
Développement Durable et de leur mise en oeuvre. Nous nous associons aux appels réitérés et insistants de la
société civile dans le monde entier pour que les ODD soient explicitement alignés sur les normes relatives
aux droits de l’homme.
Beaucoup d'entre nous sont activement engagés dans le processus Rio + 20. Nous avons soigneusement suivi
et nous sommes intervenus dans le Groupe de Travail Ouvert de l'Assemblée Générale sur les Objectifs de
Développement Durable depuis mars 2013. Nous sommes profondément troublés par le fait que, malgré
notre appel clair et urgent en mai 2014, le projet « Zero Draft » (2 juin 2014) n'a pas inclus une référence
explicite au droit à l'eau et à l’assainissement.
Pour que l'Agenda de développement post 2015 atteigne son objectif d'être juste, durable et axé sur les gens,
les objectifs doivent donner priorité - pour les générations présentes et futures — au droit à l'eau pour la
santé, la vie, la nourriture et la culture et à toutes les questions concernant les ressources hydriques. Cet
avenir est encore plus critique, étant donné le rôle clé qui revient à l'eau dans la réalisation d’autres objectifs
de développement, tels que la production durable énergétique et alimentaire, l'égalité des sexes et
l'atténuation du changement climatique.
Les ODD doivent être conçus pour catalyser une majeure capacité et volonté politique des États à accomplir
leurs obligations juridiques de respecter, protéger et promouvoir le droit à l'eau et à l'assainissement. En
2010, l'Assemblée générale de l'ONU a reconnu que « le droit à l'eau potable et à l'assainissement est un
droit de l’homme, essentiel à la pleine jouissance de la vie et à l’exercice de tous les droits de l'homme ».
(Résolution 64/292, par. 1). Cette importante reconnaissance par les États membres de l'ONU réaffirme le
droit international en vigueur tel qu'il est interprété par les traités des organismes des Nations Unies.
La Convention sur l'élimination de toutes les formes de discrimination à l'égard des femmes prévoit que les
Etats assurent aux femmes le droit de « jouir de conditions de vie convenables, notamment en ce qui
concerne [...] l’approvisionnement [...] en eau » (Article 14.2). La Convention relative aux droits de l'enfant
oblige les membres à lutter contre la maladie et la malnutrition « à travers la fourniture des aliments nutritifs
et d'eau potable » (Article 24(2)). De façon persuasive, le Comité sur les droits économiques, sociaux et
culturels a conclu que le droit à l'eau est essentiel pour assurer un standard de vie adéquat et «
inextricablement liée au droit de jouir du meilleur état de santé » (observation générale no 15, al. 3)
Cependant, nos organisations craignent que le droit à l'eau et à l'assainissement continue à être contesté dans
le cadre d'une compétition mondiale pour l’accès aux ressources hydriques limitées. Nous sommes très
préoccupés par le fait qu’une agenda de développement, qui ne s’engage pas explicitement dans le respect de
ce droit humain vital, pourrait le miner gravement.
Le fait de ne pas citer ce droit dans l'Agenda des ODD serait un revers du progrès que les États membres des
Nations Unies ont fait dans l'amélioration de la reconnaissance et de la protection de ce droit humain
fondamental.
Donc, nous vous demandons respectueusement de faire preuve de leadership et engagement dans la
promotion du droit à l'eau lors des prochaines sessions du Groupe de Travail Ouvert de l'Assemblée
Générale sur les Objectifs de Développement Durable
Nous vous exhortons à insister sur une approche axée sur les droits de l’homme et donc de :
a) nommer explicitement le droit à l'eau et à l'assainissement dans l'objectif relatif à l'eau et à
l'assainissement ;
b) aligner les objectifs sur les droits humains et garantir la non-discrimination, la responsabilisation et la
participation du public au processus décisionnel.

pouvoir poursuivre ce dialogue au cours de la 12ème session du Groupe de Travail Ouvert.
