Caro/a amico/a,
la Flai Cgil, il tuo sindacato, t’informa dei diritti che hai come lavoratore immigrato.
Il lavoro come valore: la Costituzione italiana tutela il lavoro in tutte le sue forme e
garantisce una retribuzione proporzionata alla qualità e quantità del lavoro espletato e
sufficiente per vivere dignitosamente.
I diritti fondamentali della persona: la Costituzione italiana garantisce a TUTTI,
anche ai lavoratori stranieri sprovvisti del Permesso di Soggiorno, i diritti fondamentali
riconosciuti anche dalle convenzioni internazionali: diritto alla vita, diritto alla libertà
individuale, diritto alla sicurezza, diritto alla salute, diritto all’istruzione (obbligatoria),
diritto alla libertà di coscienza e di religione, etc.
Lavorare con Permesso di Soggiorno: l’Italia garantisce la piena uguaglianza di
diritti a tutti i lavoratori stranieri con regolare Permesso di Soggiorno e alle loro famiglie.
Lavorare senza Permesso di Soggiorno: se non hai il Permesso di Soggiorno e il tuo
datore di lavoro ti sfrutta, puoi denunciarlo: a norma del decreto legislativo 105/2012
(che recepisce la Direttiva Ue 52 contro lo sfruttamento dei lavoratori immigrati), puoi
essere tutelato dalla legge ed accedere al permesso di soggiorno. Se sei un
lavoratore irregolare, puoi rivolgerti alla CGIL che tutelerà i tuoi diritti.
Il lavoro in nero: se lavori in nero, non puoi rinnovare il Permesso di Soggiorno perché
non puoi dimostrare di essere in possesso di un reddito necessario al tuo mantenimento.
Rivolgiti alla Cgil per essere tutelato da ogni forma di sfruttamento.
Se lavori specificamente in agricoltura, rivolgiti alla FLAI- CGIL: ti aspetta un mondo
di opportunità: disoccupazione agricola, Fondo sanitario (fislaf) assegni
familiari, controllo paghe......
Gli sportelli della CGIL e della FLAI sono a tua disposizione anche per il
rinnovo del Permesso di Soggiorno, il ricongiungimento familiare, la
prenotazione del test di lingua italiana, etc.

Dear Worker,
Flai Cgil (the Federation of Agro-industry workers by
the CGIL), your labour-union, wishes to inform you about
your rights as a migrant worker.
Work as a value: the Italian Constitution protects work in
all its forms and guarantees a remuneration in line with the
quality and quantity of the job and enough to live decently.
The fundamental rights of the person: the Italian
Constitution guarantees to EVERYONE, including foreign
workers without a residence permit, the fundamental rights
recognised by international conventions: the right to life, the
right to individual freedom, the right to security, the right to
health, the right to (obligatory) education, the right to the
freedom of conscience and religion, etc.
Working with a Residence Permit: Italy guarantees full
equality of rights to all foreign workers with a Residence
Permit and to their families.
Working without a Residence Permit: if you don't have a
Residence Permit, you might denounce those who exploit you
on the labour field and you will be protected by the law. If
you are an undocumented worker, get in touch with CGIL: we
will protect your rights. Moreover, if you are undocumented
and you feel that you are being exploited by your employer,
you can denounce hom/her. You will be protected by the law.
In fact, legislative bill 105/2012 (that implements the EU
directive 52) says that an undocumented migrant worker, in
a situation of rough exploitation by his/her employer, might
be granted a permit-of-stay assuming that he takes action by
denouncing. Cgil is ready to help.
Black work: if you do black work, it might be hard to renew
your Residence Permit since you cannot prove that you have
the necessary income for your welfaring. .Any question on
your working conditions?

campagna), get in touch with Flai Cgil: you will have a
gateway to opportunites you probably didn't know about.

tant que travailleur immigré.
Le travail comme valeur: la Constitution italienne défend
le travail dans toutes ses formes et garantit une rétribution
proportionnelle à la qualité et à la quantité du travail afin
qu'il soit suffisant pour te permettre de vivre dignement.
Les droits fondamentaux de la personne: la Constitution
italienne garantit à TOUS, y compris les travailleurs immigrés
sans de Permis de Séjour, les droits fondamentaux reconnus
par les conventions internationales: le droit à la vie, le droit à
la liberté individuelle, le droit à la sécurité, le droit à la santé,
le droit à l’instruction (obligatoire), le droit à la liberté de
conscience et de religion, etc.
Travailler avec le Permis de Séjour: l’Italie garantit la
pleine égalité de droits à tous les travailleurs étrangers qui
possèdent un Permis de Séjour régulier et à leur famille.
Travailler sans un Permis de Séjour: si tu n’as pas de
Permis de Séjour, tu peux dénoncer celui ou celle qui te
contraint à l'exploitation et demander d’être protégé par la
loi. En effet, le décret normatif 105/2012 (par lequel l'Italie
transpose dans la législation nationale la directive
européenne 52) prévoit des mécanismes de protection du
travail immigré sans papier qui dénonce son bourreau [dans
le travail]. Si tu es en situation irrégulière, tu peux t'adresser
à la CGIL qui saura défendre tes droits.
Le travail au noir: si tu travailles au noir, il te sera difficile
de renouveler ton Permis de Séjour parce que tu ne pourras
pas prouver d’avoir le revenu nécessaire à ta subsistance.
Adresses- toi à la CGIL pour être protégé contre toute forme
d’exploitation.
Par ailleurs, si tu travailles spécifiquement dans le secteur de
l'agriculture, adresses à la Flai- Cgil: tu auras accès à de
vastes opportunités dont tu n'es probablement pas informé.
Si tu as besoin de de plus amples informations ou
d'éclaircissements concernant par rapport à ton travail,
