Dan Hays Ottawa, K1A 0A4 The Honourable Dan Hays, Speaker of the Senate of Canada, and a parliamentary delegation travelled to Germany from January 24-27, 2004. This working visit followed the official visit of a delegation from the Bundesrat to Canada in September 2003. The aim of the visit was to enhance interparliamentary relations between the two countries, and to explore the relationship between the Bundesrat and the länders and the relationship between Germany and the EU, among other things. Dans le cadre du processus d’élargissement de l’Union européenne (UE), divers pays comme l’Allemagne réfléchissent actuellement à certaines questions qui ont une résonance au Canada, comme : la réforme constitutionnelle, le fédéralisme ou le multiculturalisme. The visit also took place in the context of the 100th anniversary of the completion of the Bundesrat building. Patrice Martin, secrétaire de la délégation 1 Meetings Réunions While in Berlin, the delegation met with: the President of the Bundesrat, Mr. Dieter Althaus; the Vice-President of the Bundestag, Dr. Norbert Lammert; the Minister-President of Saxony-Anhalt at the Reichstag, Prof. Dr. Wolfgang Boehmer; the Chairman of the Bundestag Defence Committee, Mr. Reinhold Robbe; and the Director of the Institute for European Policy, Dr. Mathias Jopp. À Berlin, la délégation a rencontré : le Président du Bundesrat, M. Dieter Althaus President Althaus greeted the delegation and invited it to join other guests in the Chamber for a special evening commemorating the 100th anniversary of the former Preußisches Herrenhaus, the seat of the Bundesrat since 2000. This historical building is more than just a well-restored monument. In the past 100 years, the Herrenhaus has weathered Germany’s dramatic history, thus acquiring a symbolic significance. President Althaus met with the delegation after the ceremony. President Althaus and Speaker Hays agreed that relations between Germany and Canada were very good on both the diplomatic and economic fronts. Both men also agreed that, in the next few years, as both the EU and the Free Trade Area of the Americas (FTAA) grow to include more member states, one of the challenges for individual countries will be to continue to develop bilateral relations with countries that are part of a larger political and economic entity. Meeting with the Vice-President of the Bundestag, Dr. Norbert Lammert Rencontre avec le vice-président du Bundestag, M. Norbert Lammert Vice-President Lammert welcomed the delegation after it had had the opportunity to visit the Reichstag. Dr. Lammert noted that there was no problem with Canada-Germany relations and that he was happy to have the opportunity to exchange with delegates from a country that is both a friend and an ally. Speaker Hays emphasized the importance of bilateral relations and reminded Dr. Lammert that Canada had welcomed a German delegation a few months earlier and that the Hon. Peter Milliken, Speaker of the House of Commons, had been to Germany recently, albeit not in his capacity as Speaker. It was suggested that while both countries were “old” countries, they had undergone institutional change at a different pace. Speaker Hays inquired about the Joint Commission of the Bundestag and Bundesrat for the modernization of the federal system (Stoiber Commission). Dr. Lammert explained that the Commission’s task was to make clearer the respective responsibilities of each body within the federal system and to enable both the federal government and the Länder to interact more effectively. The Commission is expected to table its report later this year. Suit une discussion sur quelques similitudes et différences entre les deux systèmes politiques. The meeting also allowed for exchanges on concurrent powers versus a clearer division of powers between different levels of government, on redistribution of taxing powers versus the ability to withdraw from certain programs with financial compensation, on the importance of bicameral systems and on the public perception of upper houses. In the end, delegates agreed that, however centralized or decentralized a system, citizens have to be clear on who is in charge of what. Des échanges de vues ont eu lieu sur le chevauchement des compétences par opposition au partage clair des pouvoirs entre les paliers de gouvernement, la répartition des pouvoirs fiscaux par opposition à la capacité de se retirer de certains programmes avec compensation financière, l’importance du bicamérisme, et ce que pense le public des Chambres hautes. Les délégués ont convenu que, quel que soit le niveau de centralisation du système, les citoyens doivent bien savoir qui est responsable de quoi. Meeting with the Minister-President of Saxony-Anhalt at the Reichstag, Prof. Dr. Wolfgang Boehmer Rencontre avec le ministre-président de Saxe-Anhalt au Reichstag, le professeur Wolfgang Boehmer Minister-President Boehmer thanked Speaker Hays for the program organized by the Canadian Parliament when he took a German delegation to Canada on an official visit in September 2003. Speaker Hays replied that he was committed to increasing bilateral relations between Germany and Canada. As a Member of the Stoiber Commission, Dr. Boehmer was in a position to expand on its work and mandate. As such, he elaborated on the process necessary to amend the German Constitution (two-thirds majority in both houses), on the type of public participation and expert advice envisaged by the Commission and on some of the issues that have led to the creation of the Commission. These include the rise in the number of areas of joint federal/land jurisdiction since the 1960’s; the need for the Bundesrat to approve 60% of proposed legislation; the länders’ inability to levy taxes; and the länder leaders’ and Federal government dissatisfaction with the present En tant que membre de la Commission Stoiber, M. Members of the Canadian delegation pointed out that the Canadian Parliament is now examining similar issues. Over the last century, some of the jurisdictions that had resolutely been within the purview of the provinces (education, health) now preoccupy the federal government as well. They also drew parallels between the discussions taking place in Germany and Canada over the financing of municipalities. The discussion then moved to economic relations between Canada and Germany. Dr. Boehmer noted there were few Canadian companies present in a new länder and that an eventual visit to a new länder might help Canadian parliamentarians understand the potential for investment in those regions. Reinhold Robbe The delegation met with the Chairman of the Bundestag Defence Committee, Mr. Reinhold Robbe, at the Paul-Loebe Haus. Mr. Robbe, who had just returned from a ceremony commemorating the German Day of Remembrance, noted that the presence of Speaker Hays could not be more opportune in that it gave him the opportunity to thank Canada for its effort in liberating the German people from the Nazis. Speaker Hays, who had visited Auschwitz the previous year, said he understood how moved Mr. Robbe must have been on this special day and added that it was also a sad day for Canada as he had just learned that a Canadian soldier had been killed in Afghanistan earlier. Robbe en cette journée particulière et a ajouté qu’il s’agissait aussi d’un jour de tristesse pour le Canada car il vient d’apprendre qu’un soldat canadien a été tué en Afghanistan quelques heures plus tôt. The discussion focused on issues of global security and the presence of both Canada and Germany in Afghanistan. Mr. Robbe noted that the war on terrorism had forced countries such as Germany to review their defence policy. The stated goal of the German government is to create a smaller yet more effective military able to respond quickly to international situations. Other topics addressed during the meeting included: the ability of NATO to respond quickly to armed conflicts; the military strength of the United States compared to that of all NATO countries combined and the ability of NATO to act without the leadership of the United States; concerns about European Security and Defence Identity (ESDI) within NATO; missile defence systems as they relate to both countries; the level of public interest in military spending versus the need for the military to invest in new technologies; the need to look at security and defence as one and the same in the context of international terrorism; and the need for bilateral relations to continue between member countries of the EU and the United States. In closing, Speaker Hays suggested Mr. Robbe come to Canada to visit the military facilities where so many German soldiers have trained in the past and continue to train to this day. Mathias Jopp Dr. Jopp welcomed the Canadian delegation to the Institute for European Policy, then proceeded to explain the organization’s work. The Institute, one of Germany’s leading foreign and European policy research institutes, has been a non-profit organization active in the field of European integration since 1959. The Institute has four main functions: research; publishing books and papers; providing a forum for dialogue and training; and consulting. M. As far as research is concerned, the Institute studies trends in governance and constitutional structures, as well as foreign and European policy. Its publications include: Integration, a quarterly which provides a theory-based, politics-oriented, interdisciplinary forum on European integration; Europa von A bis Z, a comprehensive reference on key terms and aspects of European unification; and papers on many aspects of EU enlargement. Following Dr. Jopp’s presentation, the discussion turned to some of the challenges facing both new countries to the EU and old European countries. Speaker Hays explained that the Canadian delegation was on its way to Slovenia and that he felt meetings with parliamentarians and experts from both Germany and Slovenia would provide them with a better understanding of the different perspectives at play between new and old member states of the EU. Dr. Jopp also discussed the European Constitution, the electoral calendar of individual member countries, and some of the problems relating to the voting question and the technical aspects of integration such as the seven-year transitional period where some border restrictions will still apply. He also discussed the public perception of the EU and monetary integration. Dr. Jopp then asked about Canada. Speaker Hays described the domestic electoral situation, Canada’s relationship with the U.S. and some of the differences between Canadian federal-provincial relations and German federal-länders relations. M.
