THE LUDOVIC TRARIEUX AWARD 2008 Prix International des droits de l'homme Ludovic-Trarieux 2008 Ludovic-Trarieux International Human Rights Prize 2008 Premio Internacional de Derechos Humanos Ludovic Trarieux 2008 Internationalen Ludovic-Trarieux-Menschenrechtspreis 2008 Prêmio Internacional de Direitos Humanos Ludovic Trarieux 2008 Premio Internazionale per i Diritti Umani Ludovic Trarieux 2008 Ludovic Trarieux Internationale Mensenrechtenprijs 2008 Since 1984 "The International tribute from Lawyers to a Lawyer" U Aye Myint (BURMA) Ludovic-Trarieux International Human Rights Prize 2008 In a meeting on May 17th 2008 in Luxemburg, the Jury of 21 european lawyers* awarded the 13th International Human Rights Prize "Ludovic Trarieux" 2008 ("The award given by lawyers to a lawyer") to burmese labour lawyer (Myanmar) U Aye Myint The award will be presented to Prize winner in next October 2008 in Roma (Italia). Lawyer U Aye Myint (alias Aye Myint Maung) and eight other persons were arrested on 17 July 2003 by members of the Military Intelligence and charged under section 122 of the Penal Code for High Treason for their antigovernment activities. On 28 November, a Yangoon Martial Court held inside Insein prison convicted and sentenced to death U Aye Myint (alias Aye Myint Maung) and eight other persons. They were convincted on 28 November 2003 by a under article 122/1 of the law for high treason for supposedly trying to murder the leaders of the SDPC. The nine were also accused of having contacts with political organizations in exile partly on the basis that he had communicated with the ILO. The others were Zaw Thet Htwe, Zaw Zaw, Zar Naing Htun (a student), Ne Win, Naing Yekkha (a political activist from New Mon State Party, also known as Shwe Mann), Than Htun, Myo Htway and Nai Min Kyi. Than Htun was released without explanation in December. His family said he was arrested by mistake. One of the group died in detention after also being sent to Insein prison. After pressure by International Labour Organisation (ILO), the death sentence was commuted to three years’ imprisonment, for treason. U Aye Myint was released in January 2005. But two New Mon State Party members Naing Yakkha and Naing Kyin Kaung are today serving life sentences in Rangoon’s Insein prison after being arrested for allegedly reporting military abuse to the International Labour Organization and for planting a bomb. In 2005, Aye Myint, a labour lawyer, had brought to the attention of the ILO the complaints of residents in Phanungdawthi village tract who claimed their land had been seized by the military. Authorities alleged that he provided incorrect and false information in the complaint and arrested him on 27 August 2005. He was charged with violating section 5 (e) of the catch-all Emergency Provisions Act Lawyer U Aye Myint was sentenced to seven years' imprisonment allegedly for helping farmers report to the authorities and the ILO that local officials had confiscated their land. Because of his conviction, government authorities acted on 13 May 2006 to strip him of his licence to practice law and ensured his dismissal from the Bar Council, in contravention to Council regulations.The ILO made the release of Aye Myint an explicit condition of continued cooperation with Burma, and set a deadline for his release. The ILO had given the authorities in Burma until the end of July to release Aye Myint, who had helped lodge a complaint to ILO staff, or face strong international legal action. Aye Myint has said that he will continue to take up rights-related cases, but it is unclear at this stage whether his licence to practice law will be returned to him or not. The SPDC finally released Aye Myint on 8 july 2006 from prison after serving 11 months of a seven year sentence after strenuous international pressure and attention. But at year’s end, his licence had still not been returned to him. Before being released Aye Myint was required to sign a document that if he commits any further offence in the remaining period of his sentence (six years and one month) then he will be returned to prison and required to serve out the full term. On May 10, 2007 U Aye Myint, provides legal aid to more than 100 Naypyidaw construction workers planning to file a complaint with the International Labour Organization, claiming the In Arr Htet company failed to pay them more than 3.6 million kyats-worth of wages. The In Arr Htet company hired engineer Ko Moe Kyaw Latt to head the construction of three buildings in Burma's new capital. After hiring more than 100 workers and starting construction, the company called off the project and refused to pay any wages to Ko Moe Kyaw Latt or the hired construction workers. U Aye Myint said the workers responded by occupying the former construction site in protest. "If grassroots people in Burma, such as the workers and farmers are insulted, they shouldn;t just feel dejected. They should report it... We won't just stand by," U Aye Myint said. Recently, on January 15, 2008, U Aye Myint, as a leader of the Guiding Star legal aid group, is handling complaints from a group of farmers in Baw Ne village who claim they were forced to cultivate an area of scrubland along the Rangoon-Mandalay road. Villagers cultivated land promised to them by local officials and after they had worked the land during the rainy season, they were informed that the land was owned by a relative of junta leader senior general Than Shwe. They were charged under section 447 of the penal code for criminal trespass in a hearing at Dike Oo township court on 28 December 2007 and now face imprisonment. U Aye Myint is now finding witnesses and preparing evidence from the jailed villagers’ family members in order to help the villagers bring a forced labour complaint to the International Labour Organisation and report the matter to senior general Than Shwe. Created in 1984, the "International Human Rights Prize Ludovic Trarieux” is awarded to " a lawyer, regardless of nationality or Bar, who thoroughout his career has illustrated, by his activity or his suffering, the defence of human rights, the promotion of defence rights, the supremacy of law, and the struggle against racism and intolerance in any form ". It is the oldest and most prestigious award given to a lawyer in the world, commemorating the memory of the French lawyer, Ludovic Trarieux (1840-1904), who in the midst of the Dreyfus Affair, in France, in 1898, founded the " League for the Defence of Human Rights and the Citizen ", because, he said: " It was not only the single cause of a man which was to be defended, but behind this cause, law, justice, humanity ". The first Prize was awarded on March 29th, 1985 to Nelson Mandela then in jail. It was officially presented to his daughter, Zenani Mandela Dlamini, on April 27th 1985, in front of forty presidents of Bars and Law Societies from Europe and Africa. It was the first award given to Mandela in France and the first around the world given by lawyers. On February 11th 1990, Nelson Mandela was released. Since then, it was decided that the Prize would be awarded again. Since 2003, the Prize is awarded every year in partnership by the Human Rights Institute of The Bar of Bordeaux, the Human Rights Institute of the Bar of Paris, the Human Rights Institute of The Bar of Brussels, l'Unione forense per la tutela dei diritti dell'uomo (Roma) and the European Bar Human Rights Institute (IDHAE) whose members are the biggest european law societies fighting for human rights such as The Law Society of England and Wales, Rechtsanwaltskamme Berlin, Ordre français des Avocats du barreau de Bruxelles, barreau de Luxembourg or Polish National Council of the Bar (Warsaw). U Aye Myint (alias Aye Myint Maung), avocat de la Division de Pegu, membre de la National League for Democracy (NLD) d'Aung San Suu Kyi, est spécialisé dans le droit du travail. En raison de ses fonctions, U Aye Myint, avocat d’une cinquantaine d’années, est une cible permanente de la junte militaire au pouvoir. En juillet 2003, U Aye Myint a été arrêté en même temps que huit autres personnes (Zaw Thet Htwe, Zaw Zaw, l’étudiant Zar Naing Htun, Ne Win, le militant du Parti de l’Etat Mon Naing Yekkha (alias Shwe Mann), Than Htun, Myo Htway et Nai Min Kyi) . Le 28 novembre 2003, ils ont été condamnés à mort pour haute trahison par un tribunal militaire, en application de l’article 122 §1 du Code pénal accusés d’avoir transmis des informations à l’Organisation internationale du travail (OIT). Ils étaient accusés de complot en vue de l’assassinat de plusieurs responsables du SPDC et de planifier d’autres actes terroristes. Parmi les pièces à conviction présentées lors de l’audience figuraient divers documents attestant de contacts avec la FTUB, un exemplaire en langue birmane du Rapport de 1998 de la Commission d’enquête du BIT sur le travail forcé en Birmanie et la carte de visite du responsable de liaison provisoire du BIT à Rangoun. En réalité, leur seul « crime » a été de transmettre des informations concernant le recours continu au travail forcé en Birmanie. La peine de mort prononcée contre U Aye Myint a été commuée en janvier 2005 en peine de trois années d’emprisonnement pour trahison, en partie pour avoir communiqué avec l’OIT. Libéré en en janvier 2005, U Aye Myint a de nouveau été arrêté le 27 août 2005 pour avoir porté à la connaissance de l’OIT les plaintes d’habitants du village de Phanungdawthi qui affirmaient avoir été dépossédés de leurs terres par l’armée. Les autorités l’avaient accusé d’avoir falsifié les informations accompagnant la plainte et l’avaient arrêté en vertu de la loi de 1950 sur l’état d’urgence, pour «propagation de fausses informations». Il a été emprisonnée, en même temps que la militante que Su Su Nway qui en même temps que d'autres habitants de son village près de Rangoun étaient contraints à participer à des travaux non rémunérés sur le chantier de construction d'une route. Su Su Nway et les autres villageois ont engagé des poursuites contre l’administration de leur village pour les avoir obligés à travailler sans rémunération. Su Su Nway et l'avocat U Aye Myint ont été emprisonnés pour avoir dénoncé certains agissements abusifs des autorités locales, notamment des cas de travail forcé et des confiscations de terres. En janvier 2005, la justice s’est prononcée en leur faveur. Après cette victoire, Su Su Nway aurait été menacée et harcelée par les dirigeants du village. Neuf mois plus tard, elle a été condamnée à dix-huit mois de prison : les nouvelles autorités du village l’ont poursuivie en justice pour diffamation parce qu’elle les aurait insultées. U Aye Myint a été inculpé d'infraction à la section 5(e) de la loi «fourre-tout» sur les dispositions d'urgence. Le 31 octobre 2005, la Cour du canton de Daik-U, dans le département de Pegu, l'a reconnu coupable de «diffusion d’informations mensongères» et condamné à sept ans de prison en vertu de la loi de 1950 sur les dispositions d’urgence réprimant la diffusion d’informations mensongères. Il a été condamné le mois suivant à sept années d’emprisonnement au titre de la législation d’exception qui rend passible d’emprisonnement quiconque diffuse intentionnellement de fausses nouvelles tout en sachant qu'elles sont erronées ou en ayant des raisons de croire qu’elles le sont, en raison des troubles que cela pourrait occasionner. Aucun des paysans qu’il représentait n’aurait été poursuivi et tous auraient témoigné lors du procès de U Aye Myint qu’il avait transmis leurs plaintes légitimes en sa qualité d’avocat. C’est ainsi la deuxième fois qu’il était condamné après avoir tenté de prendre contact avec l’OIT. Ses appels interjetés devant les tribunaux de district et de division ont été rejetés par procédure sommaire les 2 janvier 2006 et 7 mars 2006 respectivement. Invoquant sa condamnation, le 13 mai 2006, les autorités lui ont retiré sa licence d’avocat et l’ont fait rayer du barreau, en violation à ses règles. L’OIT a fait de la libération de Aye Mint dans un délai donné une condition de la poursuite de sa coopération avec la Birmanie. La junte l’a finalement fait libérer Su Su Nway, le 6 juin, et Aye Mint , le 8 juillet 2006 grâce à une forte pression de l'Organisation international du travail (OIT). Mais à la fin de l’année 2006, sa licence ne lui avait toujours pas été restituée. A l'occasion de la protestation des moines de septembre 2007, U Aye Myint, a été arrêté le 25 septembre à Pegu.Il a libéré le 31 octobre. Récemment, le 15 janvier 2008, U Aye Myint, au nom de Guiding Star legal aid group, a déposé des plaintes d'un groupe de fermiers du village de Baw Ne qui soutiennent qu'ils ont été forcés à cultiver des terres le long de la route Rangoon-Mandalay dont la propriété leur avait été promise en échange par les fonctionnaires locaux. Après qu'ils eussent travaillé la terre pendant la saison des pluies, ils ont voulu occuper les terres lorsqu'ion leur a révélé qu'elles étaient la propriété d'un parent de chef de la junte, le général Than Shwe. Le 28 décembre 2007, ils ont été inculpés en vertu de la section 447 du code pénal et encourent un emprisonnement. U Aye Myint s'occupe actuellement de rechercher des témoins et de réunir les témoignages des membres de la famille des villageois emprisonnés pour déposer une plainte pour travail forcé à l'OIT. Créé en 1984, le « Prix International des Droits de l'Homme – Ludovic Trarieux » est décerné à « un avocat sans distinction de nationalité ou de barreau, qui aura illustré par son œuvre, son activité ou ses souffrances, la défense du respect des droits de l'Homme, des droits de la défense, la suprématie du droit, la lutte contre les racismes et l'intolérance sous toutes leurs formes ». Il est la plus ancienne et la plus prestigieuse des récompenses réservées à un avocat puisque son origine remonte au message de Ludovic Trarieux (1840-1904), fondateur, en 1898, au moment de l'Affaire Dreyfus, de la « Ligue des Droits de l'Homme et du Citoyen » : « Ce n'était pas seulement d'ailleurs la cause isolée d'un homme qui était à défendre, c'était, derrière cette cause, le droit, la justice, l'humanité ». Un an après sa création, le Premier Prix a été attribué le 27 mars 1985 à Nelson Mandela alors emprisonné depuis 23 ans en Afrique du Sud. Il a été remis officiellement à sa fille, le 27 avril 1985, en présence de quarante bâtonniers venus d’Europe et d’Afrique. C’était alors le premier prix qui lui était décerné en France et le premier dans le monde par des confrères avocats. Cinq ans plus tard, le 11 février 1990, Nelson Mandela était libéré. A partir de cette date, le prix a été de nouveau attribué. Depuis 2003, le prix est devenu l’Hommage désormais annuel des avocats à un avocat du monde. Il est décerné conjointement par l’Institut des Droits de l’Homme du Barreau de Bordeaux, l’Institut de Formation en Droits de l’Homme du Barreau de Paris, l’Institut des Droits de l’Homme du Barreau de Bruxelles, l'Unione forense per la tutela dei diritti dell'uomo (Rome) et l’Institut des Droits de l’Homme des Avocats Européens (IDHAE)), dont sont membres de grands barreaux européens investis dans les droits de l'homme au nombre desquels la Rechtsanwaltskammer de Berlin, l’Ordre français des Avocats du barreau de Bruxelles, le barreau de Luxembourg ou le Conseil National des barreaux de Pologne (Varsovie). Dal 1984 “L'omaggio internazionale degli avvocati ad uno avvocato” U Aye Myint (BIRMANIA) Premio Internazionale per i Diritti Umani Ludovic Trarieux 2008 Il 13° premio Ludovic-Trarieux per i diritti dell'uomo 2008 è stato assegnato a U Aye Myint (BIRMANIA) Il premio che viene assegnato dal 1985 gli è stato riconosciuto per il suo lavoro a difesa dei diritti umani. U Aye Myint, avvocato della Divisione di Pegu specializzato in diritto del lavoro, è membro della National League for Democracy (NLD) di Aung San Suu Kyi. A causa delle sue funzioni U Aye Myint è un bersaglio permanente della giunta militare al potere. In luglio 2003, U Aye Myint è stato arrestato insieme ad altre otto persone. Il 28 novembre 2003 sono stati condannati a morte per alto tradimento da un tribunale militare, in applicazione dell’articolo 122§1 del Codice penale, accusati di aver trasmesso informazioni all’Organizzazione Internazionale del Lavoro (OIL). Sono stati accusati inoltre di complotto nell’assassinio di diversi responsabili del SPDC e di pianificare altri atti terroristi. Tra le prove presentate nell’udienza c’erano diversi documenti che attestavano i contatti con la FTUB, un esemplare in lingua birmana del Rapporto della Commissione d’investigazione del BIT realizzato nel 1998 sul lavoro forzato in Birmania. In realtà il loro “crimine” era quello di aver trasmesso informazioni riguardanti le prattiche continue di lavoro forzato in Birmania. La pena di morte pronunciata contro U Aye Myint è stata commutata in gennaio 2005 a tre anni di detenzione per tradimento, in parte per aver comunicato con l’OIL. Liberato in gennaio 2005, U Aye Myint è stato nuovamente arrestato il 27 agosto 2005 per aver fatto conoscere all’OIL le denunce degli abitanti della città di Phanungdawthi che affirmavano essere stati espropriati dai loro terreni dall’esercito. Le autorità lo hanno accusato di aver falsificato le informazioni e, in applicazione della legge di 1950 sullo stato di urgenza, è stato condannato a sette anni di prigione per “propagazione di false informazioni”. Nessuno dei cittadini rappresentati da U Aye Myint è stato imputato e tutti loro hanno testimoniato che le informazione trasmesse erano delle denunce legittime. I ricorsi presentati dinanzi i tribunali sono stati rifiutati. Invocando la condanna di U Aye Myint, il 13 maggio 2006 le autorità gli hanno tolto la licenza d’avvocato e lo hanno fatto radiare dall’ordine degli avvocati. L’8 luglio 2006 è stato liberato grazie alla forte pressione dell’OIL, ma alla fine dell’anno 2006 la sua licenza d’avvocato non gli era stata ancora restituita. In settembre 2007, si era tenuta una manifestazione di protesta dai monaci a Pegu, al termine della quale U Aye Myint è stato nuovamente arrestato dal 25 settembre fino il 31 ottobre. Creato nel 1948, il “Premio Internazionale dei Diritti dell’Uomo – Ludovic Trarieux” è attribuito a “un avvocato senza distinzione di nazionalità o di foro d’appartenenza, che avrà illustrato grazie alla sua opera, alla sua attività o alle sue sofferenze, la difesa del rispetto dei diritti dell’Uomo, dei diritti della difesa, la supremazia del diritto, la lotta contro il razzismo e l’intolleranza in tutte le loro forme ". È il più antico e prestigioso riconoscimento riservato a un avvocato; ha, infatti, avuto origine nel messaggio di Ludovic Trarieux (18401940), fondatore, nel 1898, al momento del caso Dreyfus, della “Lega dei Diritti dell’Uomo e del Cittadino”: “non si trattava del resto della causa isolata di un solo uomo che doveva essere difesa, ma vi era, dietro questa causa, il diritto, la giustizia, l’umanità”. Un anno dopo la sua creazione, il Premio è stato attribuito, il 27 marzo 1985, a Nelson Mandela, allora in prigione da 23 anni in Sud Africa. Il premio è stato ufficialmente consegnato a sua figlia, il 27 aprile 1985, in presenza di 40 presidenti di consigli di avvocati, venuti dall’Europa e dall’Africa. Era allora il primo premio che veniva consegnato in Francia - e il primo del resto nel mondo - da parte di colleghi avvocati. Cinque anni più tardi, l’11 febbraio 1990, Nelson Mandela fu liberato. A partire da tale data, il premio è stato attribuito altre volte. Dal 2003, il premio è divenuto un omaggio ormai annuale a un avvocato nel mondo. È stato conferito congiuntamente dall’Istituto dei diritti dell’Uomo dell’Ordine degli avvocati di Bordeaux, dall’Istituto di formazione sui diritti dell’Uomo dell’Ordine degli avvocati di Parigi, dall’Istituto dei diritti dell’Uomo dell’Ordine degli avvocati di Bruxelles, dall’Ordine degli avvocati del Lussemburgo o dal Consiglio Nazionale forense della Polonia (Varsavia).
