APPEAL FOR SEVEN TUNISIAN FISHERMEN
On Wednesday August 4th, in the sea-reach between Tunis and Lampedusa, two Tunisian fishing
boats, regularly enrolled to the maritime department of Monastir, rescued 44 immigrants, of whom 11
women and 2 children, few minutes before their rubber-dinghy sank, moving them to the closer and
safer port, the island of Lampedusa.
Seven fishermen of the two boats crew have been arrested with the indictment of aiding and abetting
to the illegal migration and of human being traffic.
It's clearly evident that the indictment is the result of a rough error as of a bad interpretation of the law.
Those seven fishermen should had received honours for have saved 44 castaways' lives instead of a
penal course, started on August 14th.
Although various witness and the interest of Tunis Embassy, the fishermen keep on staying in jail and
the trial could end with a sentence up to 15 years of detention.
Moreover, as a consequence of this event, many boats' crews, avoiding the risk of being jailed, had
refused to rescue overloaded boats of immigrants almost sinking, despite of all elementary sea rules.
We appeal to the Attorneys of Agrigento to point out clearly on the case to avoid the judgement of the
seven Tunisian fishermen; otherwise this could create a dangerous precedent that could compromise
the principle of solidarity at sea.
Moreover, we appeal to the European Commission and to the Italian Government in order to modify
immediately the laws in force to prevent the criminalization of those who proceed with a sea rescue of
all castaways, included those called "illegal immigrants".
We warmly invite you all to take part to the manifestation that will be held on 7th September in
Agrigento as a sign of solidarity to the 7 Tunisian fishermen.

APPELLO PER I SETTE PESCATORI TUNISINI
Mercoledi 7 agosto, nel tratto di mare tra Tunisi e Lampedusa, due pescherecci tunisini, regolarmente
iscritti al compartimento marittimo di Monastir, hanno soccorso 44 immigrati, tra cui 11 donne e due
bambini, poco prima che il loro gommone affondasse, trasferendoli nel porto più vicino e sicuro, l’isola
di Lampedusa.
I sette pescatori che componevano l’equipaggio delle due imbarcazioni sono stati arrestati con
l’accusa di favoreggiamento all’immigrazione clandestina e tratta di esseri umani.
È evidente che l’accusa è frutto di un grossolano errore e di una cattiva interpretazione della legge.
I sette pescatori tunisini avrebbero meritato onori per aver salvato la vita a 44 naufraghi piuttosto che
un procedimento penale, iniziato il 14 Agosto.
Malgrado le numerose testimonianze e l’interessamento dell’ambasciata tunisina, i pescatori
continuano a restare in carcere e il processo potrebbe concludersi con una condanna fino a 15 anni di
detenzione.
Inoltre, a seguito di questa vicenda, nel Mediterraneo si sono ripetuti casi di imbarcazioni che, pur di
non rischiare il carcere dell’equipaggio, hanno omesso il soccorso a barche cariche migranti che
stavano affondando, in spregio alle più elementari regole del mare.
Facciamo appello ai Giudici di Agrigento di fare piena luce sul caso al fine di evitare la condanna dei 7
pescatori tunisini; in caso contrario ciò rischierebbe di rappresentare un precedente pericoloso che
comprometterebbe il principio di solidarietà in mare.
Inoltre, facciamo appello alla Commissione Europea e al Governo italiano affinché si modifichino
immediatamente le leggi in vigore al fine di evitare la criminalizzazione di tutti coloro che procedono al
salvataggio in mare di tutti i naufraghi, anche di quelli chiamati “immigrati clandestini”.
Invitiamo tutti a partecipare alla manifestazione di venerdi' 7 settembre ad Agrigento come segno di
solidarietà ai 7 pescatori tunisini.
Vi chiediamo di sottoscrivere questo appello.
APPEL POUR LES SEPT PECHEURS TUNISIENS
Mercredi 4 août, dans le trait de mer entre Tunis et Lampedusa, deux bateaux de pêche tunisiens,
régulièrement inscrits au département maritime de Monastir, ont sauvé 44 immigrés, dont 11 femmes
et 2 enfants, peu de minutes avant que leurs canot coulaient, en les transférant dans le port plus près
et sûr, l'île de Lampedusa.
Les sept pêcheurs qui composaient l'équipage des deux bateaux ont été arrêtés avec l'accusation de
recel à l'immigration clandestine et à la traite d'êtres humains.
Il est clairement évident que l'acte d'accusation est le résultat d'une erreur approximative due à une
mauvaise interprétation de la loi.
Les sept pêcheurs tunisiens auraient mérité des honneurs pour avoir sauvé la vie à 44 naufrages
plutôt que une procédure pénale, entamé le 14 Août.
Malgré les nombreux témoignages et l'intérêt de l'ambassade tunisienne, les pêcheurs continuent à
rester en prison et le procès pourrait se conclure avec une condamnation jusqu'à 15 ans de détention.
En outre, suite à cet événement, dans la Méditerranée on a eu des cas répétés de bateaux qui, pour
ne pas risquer la prison de l'équipage, ont omis de secourir des bateaux chargés des migrants qui
coulaient, malgré toutes les règles élémentaires de mer.
Nous faisons appel aux Juges d'Agrigento à préciser clairement sur le cas, afin d'éviter la
condamnation des 7 pêcheurs tunisien ; en cas contraire cela risquerait de représenter un précédent
dangereux qu'il compromettrait le principe de solidarité en mer.
Nous faisons aussi appel à la Commission européenne et au gouvernement italien, afin de modifier
immédiatement les lois en vigueur pour empêcher la criminalisation de ceux qui procèdent à un
sauvetage en mer de tous les naufragés, inclus ceux qu'on appelle "immigrés illégaux".
Nous vous invitons tous à participer à la manifestation, prevue pour vendredi 7 septembre à
Agrigente, en signe de solidarité aux sept pêcheurs tunisiens.
