CONFIDENTIALITY TODAY: CAN THIS FUNDAMENTAL RIGHT,
WHICH MUST BE PROTECTED, BECOME A DECEPTUVE ILLUSION ?
- Confidentiality, which is the foundation on which attorney-client trust is built, frequently comes under
attack:
• By the public authorities, for example, through wiretaps, searches and police records;
• By lawyers themselves, through insidious practices, such as sub-contracting certain work or
services to outside professionals (outsourcing).
- Confidentiality, which protects the right to privacy to which all citizens are entitled, is continually
threatened:
• By the public authorities, with the proliferation of security techniques such as geolocation or
surveillance cameras;
• By citizens themselves, through the widespread development and use of social media (Facebook,
Twitter, etc.).
• Problems of confidentiality in connection with marketing / advertising by lawyers with the names of their clients
Are there contradictions between this demand for confidentiality and the quest to adopt a different
lifestyle, as well as a new way of practising our profession?
Six speakers will take the floor to debate these questions (see programme next page).
