On instructions from my Govemment, l have the
honour to "tate the follo,v:ïng.
At the l071st meeting of the Seeurity Couneil
ùuring which the Coundl electeè. five members of
the International Court of Justice, the procedure
followed in accordance with paragraph 14 of the
memorandum by the Secretary General. 2ft is in the
opinion oi the Government of Lebanon incorrect,
unjust and undemocratic. This prûr.ednre is based
on a precedent that took place in tr_e Security Council
at its 567th meeting on 6 December 1951. It is neither
justifie::1 by the Statute cf the International Court of
Justice nor by the provisional rules of procedure of
the Security iCounciL In the first ballot four candidates received 7 or more votes, as follows; ML Luis
Padillo NeIva (Mexico), 9 votes, Mr. André Gros
(France), 8 votes, Mr. Fouad Arr.mouo (Lebanon),
7 votes, and Sir Gerald Fitzmauù:e (United K:ngdom), 7 votes. Two other !candidates, namely,
Mr. Isaac Forster (Senegal) and Mr. Muhammad
Zafrulla Khan (Pakistan) reccived 6 vote" ea.ch. The

déclarer ce qui suit:
A la [071~ séance du Cons<!il dc sécurité, au cours de
laquelle le Conseil a élu cinq membres de la Cour
intematioucie de justice, la procédure suivie conformément all paragraphe 14 du mémor çlJ1durn du
Secrétaire général 26 est, de l'avis du Gouvernement
libanais, incorrecte, injuste et non démocratique.
Cette procédure est fonùée :sur un 'précédent qui s'est
produit au Conseil de sécurité à sa 567 e séance, le
6 décembre 1951. Elle n'est justifiée ni par le Statut
de la Cour internationale de Justice, ni. par le règlement intérieur provisoire du Conseil de sécurité. Au
premier tour de scrutin, quatre candidats ont obtenu
7 voix ou davantage, à savoir: M. Luis Padillo Nervo
(Mexique), {I voix; M. André Gros (France), 8 voix;
.M. Fouad Ammoun (Liban) 7 voix; sir Gerald Fitzmaurice (RoyauT'!le-Uni), 7 voix. Deux autres candidats, M. Isaac Forster (Sénégal) et M. Muhammad
Zafnùla Khan (Pakistan) ont obtenu f3 voix chacun

Coundl held a second ballot on aIl candidates basing
itself on the Secretary-GeneraJ's memorandum.
The logical democratic procedure wOLÙd have been
ta consider the tirst four candidates who received
7 wlies or more in that first ballot as clected by the
Security Conneil and theo hold a ~conù ballot for
electing the ftfth member of the Court fram the
two candidates who received equally 6 votes, which
is the n:quired majority. The procedure adually
fol1owed, whic.h is based on one precedent ouly, is
neither lagicai nor democratic and led to a surprising
result. As n consequence, MT. Fouad Ammoun (Leba-
non), the candidate who received a dear majority
in both the Secllrity Council and the General
Assembly, that is, 7 votes on the tirst ballot in the
Security Coundl and 62 votes on the first ballot in
the General Assembly, was not elected, while the
two candidates were nnallv elected who received less
votes than Mr, Ammoun bath the Security CQuneil
and the General Assembly, that is, 6 votes each on
the first ballot in the Security Cannetl, and 58 and
42 votes on the first ballot in lhe General Asscmbly,

The Govemmen1 of Lebanon wishcs to put on

its opinion that tbis result proves that this

procedure is illogical, unjust and undern.ocratic. The
Governmcnt of Lcbanon therefore prote'>ts ilgainst
it and considers that tbis procedure should be revised
in the future in the interests of justice and of
maintaining confidence in the democratic procedures
and rues of the United Nations, and particularly
the confidence of the small nations.

pour tous les candidats en se fondant sur le mémorandum du Secrétaire général.
La pl-océdure démocratique logique aurait été de
considérer comme élus par le Conseil de sécurité les
1 quatre premiers candidats qui avaient obtenu 7 voix
ou davantage au premier tonT r1F. sCTIltin et de procéder à un deuxième tour de scrutin entre les deux
candidats qui avaient obtenu chacun {j voix, soit la
majorité requise, pour l'élection du cinquième
membre de la Cour. La procédure qui a été suivie en
fait, qui est fondée sur un unique précédent, n'est ni
logique ni démocratique et a abouti à un résultat
surprenant. M. Fouad Ammoun (Liban), canùiùat
qui avait obtenu une nette maj()rité tant au C()nsei1
de sécurité qu'à l'Assemblée générale, soit 7 voL'\( au
premier tour de scrutin, au Conseil de sécurité et
62 voix au prenùer tour de scrutin à l'Assemblée
générale, n'a pas été élu, tandis que les deux candidats qui ont été nnalement élus avaient obtF.nu moins
de voix que M. Ammoun tant au Conseil de sécurité
qu'à l'Assemblée générale, à savoir 6 voix chacun
au premier tour dl". scrutin au Conseil de sécurité et
58 et 42 voix respectivement au premier tour de
scrutin à l'Assemblée générale.
Le GOllVemf';ment libanais tient à ce qu'il soit pris
acte de son opinion que ce résultat démontre que cette
procédure est illogique, injuste et non démocratique,
En conséquence, le Gouvernement libanais proteste
contre cette procédure et estîme qu'elle doit être
revisée à. l'avenir dans l'intérêt de la justice et pour
maintenir la confiance dans les procédures et les
rëgles de l'Organisation des Nalions Unies, en particulier la confiance des petites nations.
Je vous serais reconnaissant de bien vouloir faire
distribuer la présente lettre à. tous les Membres de
l'Organisation des Nations Unies en tant que document officiel.
