Geoffrey Kubrick is a partner in the International Trade Law

Geoff is one of Canada's leading practitioners in the field of
international trade law, and has appeared in more than one
hundred trade-related cases before the Canadian courts and
tribunals. Combining his economic and legal experience in the
area of international trade, particularly in anti-dumping and
countervail investigations, Geoff undertakes detailed analysis of
source data, prosecutes appeals against decisions of the
Canada Border Services Agency ("CBSA"), and provides related
opinions and submissions. Before the Canadian International
Trade Tribunal ("CITT"), he has frequently represented both
foreign exporters/ importers and Canadian producers in customs
appeals, injury inquiries and reviews. He has also been involved
in a number of leading trade cases in litigation before the Federal
Court of Canada and Supreme Court of Canada.
Geoff has frequently appeared as counsel before NAFTA
Binational Dispute Resolution Panels, as well as panels under
the earlier Canada-United States Free Trade Agreement . He
acted as assistant to the NAFTA Binational Dispute Resolution
Panel in one of the first cases heard in the United States under
the Canada-United States Free Trade Agreement. In addition, he
advises clients on provisions of the WTO, CETA and NAFTA, as
well as on bilateral trade agreements.
In commercial law, he has been involved in the drafting and
negotiation of international technology licensing agreements, for
products as diverse as radio-isotopes and computer software,
and he advises clients regularly in other matters pertaining to
corporate law.

of Canada. He advised on economic issues during negotiation of
the Canada-United States Free Trade Agreement. He has also
acted as an Economist for Statistics Canada, focusing on data
collection and analysis and the development of computer
systems.

Geoffrey Kubrick has been the lead and/or part of teams on the
following cases:

Federal Court of Appeal upholds decision of the Canadian
International Trade Tribunal ("CITT") - represented
successful respondent The Court confirmed the validity of
the causation analysis employed by the CITT in finding that
dumping was a cause of material injury to Canadian
production of mattress innerspring units. (October 2010)

CITT finds injury caused by Dutch greenhouse bell peppers
– represented the Ontario Greenhouse Vegetable Growers
in the Canadian International Trade Tribunal (CITT) injury
inquiry. The finding will require price floors for greenhouse
bell peppers imported from the Netherlands for up to five
years. (October 2010)

CITT finds no injury caused by imports of American polyiso
insulation board – represented the American producer Johns
Manville International in the Canadian International Trade
Tribunal (CITT) injury inquiry. The CITT found that imports
of American polyiso insulation board were not causing, and
did not threaten to cause, injury to production in Canada of
like goods. (May 2010)

CITT finds injury caused by Chinese oil country tubular
goods – represented the complainants TenarisAlgomaTubes
and TenarisPrudential Steel in the Canadian International
Trade Tribunal (CITT) injury inquiry – the CITT finding
extends anti-dumping and anti-subsidy protection against a
wide range of oil country tubular goods (OCTG) imported
from China. The CITT ruled that unfairly priced Chinese
OCTG caused injury to Canadian producers including
TenarisPrudential Steel, ArcelorMital and Lakeside Steel.
(March 2010)

CITT finds injury threatened by Chinese mattress innerspring
units – represented the complainant Globe Spring & Cushion
Company in the Canadian International Trade Tribunal

(CITT) injury inquiry. The CITT finding means that importers
of dumped Chinese mattress innerspring units will not have
access to unfair pricing from China for at least 5 years.
Mattress innerspring units are used in the production of
mattresses by over 100manufacturers in the Canadian
market. The CITT ruled that unfairly priced Chinese
mattress innerspring units threatened to cause injury to
production in Canada, including by Globe Spring & Cushion
Company and Simmons Canada Inc. (November 2009)

Federal Court of Appeal upholds decision of the Canada
Border Services Agency ("CBSA") - represented successful
respondent The Court upheld the discretion accorded to the
CBSA in determining whether a Chinese industry is
operating under free market principles. (May 2009)

CITT finds injury caused by Chinese aluminum extrusions –
represented an American vendor of electronic products, and
obtained an exclusion from the Canadian International Trade
Tribunal (CITT) finding for goods sold by our client. The
exclusion means that certain electronic products sold by our
client that may contain Chinese inputs will not be subject to
the CITT injury finding. (March 2009)

Federal Court of Appeal upholds decision of the Canada
Border Services Agency ("CBSA") - represented successful
respondent The Court ruled that the CBSA had the authority
to offset undumped goods against the amount of dumping
found for individual exporters. (December 2006)
Geoff has undertaken numerous significant representations in
the areas of international trade prior to joining the firm, including
the following:

Advised the Government of Newfoundland and Labrador in
the high-profile issue of bulk removal and export of water,
the related legislation, and its implications under
international trade rules.

Successfully initiated first China Safeguard (Market
Disruption) Inquiry in Canada.

Acted as assistant to the Binational Dispute Resolution
Panel in one of the first cases heard in the United States
under the Canada-United States Free Trade Agreement.

Negotiated and drafted international technology licensing
agreements for products as diverse as radio-isotopes and
computer software.
