Dear friend,
As an organization which advocates for the human rights
of trans persons in Greece, and with the conviction that
human rights are universal and undivided, we welcome
you to our country.
This short guide, is at your disposal, in case you need to
apply for international protection of asylum in Greece, so
that you are aware of your rights. Therefore, you should
know that:
A. According to the Guide of the Greek Obdusman:
“The gender identity must be respected, as well as selfdetermination of one’s identity, regardless of personal
credentials on identification card or any other
identification documents. When a case such as this
comes to attention, the same procedures which apply to
all citizens, must be followed.”
Consequently, according to the directions of the Greek
Obdusman, regardless of the information found on one’s
identification papers (in this case, the applicant’s form
for asylum), the person must be treated with respect and
treated according to the gender he/she identifies as;
(female if you are a trans woman, male if you are a trans
man), and pronounced according to the name he/she
utilizes, according to his/her gender identity.
B. Furthermore, according to the Presidential Decree
141/2013, paragraph d, which is also enforced by the
law:
“a group shall be considered to form a particular social
group where in particular:
Depending on the circumstances in the country of origin,
a particular social group might include a group based on
a common characteristic of sexual orientation. Sexual
orientation cannot be understood to include acts
considered to be criminal in accordance with national
law of the Member States. Gender related aspects,
including gender identity, shall be given due
consideration for the purposes of determining
membership of a particular social group or identifying a
characteristic of such a group;”
Therefore, according to the legislation mentioned above,
you have the right to apply for international protection
of asylum, based on you gender identity, if in your native
country, your life is endangered, your well-being, your
freedom, or if you are in danger of being physically
harmed or mistreated due to being a trans individual.
We note that the aforementioned article referring to the
Presidential Decree, is applicable to gay, lesbians or
bisexual individuals, who apply for international
protection due to their identity.
In closing, if you are gay, lesbian, bisexual or gender
fluid, you may call upon this law at the examination
services for asylum and request international protection.
We hope all your expectations are satisfied, and have a
safe life with the dignity and respect you and all people
deserve.

En tant qu’association qui lutte pour les droits des
personnes trans en Grèce, et avec la conviction que les
droits humains sont universels et indivisibles, nous te
souhaitons la bienvenue dans notre pays.
Ce petit guide est à ta disposition, au cas où tu souhaites
demander un asile international en Grèce, afin que tu
saches quels sont tes droits.
Tu dois donc savoir que:
Α. Selon le Guide de Diversité pour Fonctionnaires rédigé
par le Défenseur du Citoyen :
«Il faut que la notion d’identité de genre soit claire et
que la perception de chacun-e de son propre genre soit
respectée, indépendamment de son état civil. Dès lors
que l’on est face à un cas pareil, il faut respecter les
mêmes procédés que pour n’importe quel citoyen ou
citoyenne.»
Par conséquent, selon les consignes du Défenseur du
Citoyen, indépendamment de son état civil (en
l’occurrence la demande d’asile), toute personne doit
être traitée et respectée selon le genre que cette
personne choisit pour s’autodéfinir (féminin si c’est une
femme trans, masculin si c’est un homme trans) et
désignée par le nom de son autodéfinition, en accord
avec l’identité de genre.
Β. En outre, selon le Décret Présidentiel141/2013,
«d) un groupe est considéré comme groupe social
sensible dès lors que, entre autres :
ii) […] Selon les conditions du pays d’origine, un groupe
social sensible peut se constituer sur la base de
paramètres de genre, d’âge, d’handicap, de santé ou

d’orientation sexuelle. L’orientation sexuelle ne peut
être prise en compte si elle comporte des actes
considéres illégaux selon la législation en vigueur. Lors
de la détermination d’appartenance à un groupe social
sensible ou de la définition de ce groupe, l’on tient
particulièrement compte des aspects qui ont trait au
genre, y compris l’identité de genre.
Par conséquent, selon le Décret Présidentiel
susmentionné, tu as droit à une protection et un asile
internationaux, sur la base de ton identité de genre, si
dans ton pays d’origine, ta vie, ton intégrité physique et
ta liberté sont en danger ou si tu risques des violences ou
de la maltraitance parce que tu es une personne trans.
Il convient de noter que l’article du Décret Présidentiel
susmentionné s’applique également pour des personnes
gay, lesbiennes ou bisexuelles qui demandent asile sur la
base de leur orientation sexuelle.
Ainsi, dans le cas où tu es gay, lesbienne, bi, trans ou
intersexe, tu as le droit de citer cette loi devant les
autorités responsables de l’examen de demande d’asile,
et de solliciter une protection internationale.
Nous souhaitons que toutes tes aspirations soient
satisfaites et que tu puisses bénéficier d’une vie sûre
avec la dignité et le respect que tous les êtres humains
méritent.
