Tenant Responsibilities Tenants should pay their rent on time (most Tenancy st Agreements require payment on the 1 of the month) Tenants should obtain clear information about rent payment including: o Due date of rent payments o Amount of rent and acceptable methods of payment (note the Landlord cannot require payment by post-dated cheque or automatic withdrawal) o Tenants should never refrain from paying rent. If there are problems with the unit the Tenant should seek advice from the Landlord and Tenant Board or their local Legal Aid Clinic on how best to proceed. Tenants are responsible for the day-to-day upkeep of the apartment, however, the Landlord is responsible for most repairs and maintenance Tenants are responsible for repairing any damage they or their guests cause Tenants should respect the terms in their Tenancy Agreement, follow the law as set out in the Residential Tenancies Act. Les locataires doivent réparer les dommages qu’ils ont causés eux-mêmes ou qui ont été causés par leurs invités. Les locataires doivent respecter les conditions de leur convention de location et respecter la loi telle qu’énoncée dans la Loi sur la location à usage d’habitation. Tenants’ Rights Access to Vital Services o The Landlord cannot shut off the supply of vital services these includes: heat, electricity and gas, hot and cold water o If this happens contact your Landlord immediately, if they are not responsive telephone your local Property Standards Office or the Police Privacy & Security o Landlord’s must provide Tenants with 24 hours’ notice before entering the apartment, except in cases of emergency o Even with notice, the Landlord may only enter between 8 am and 8 pm, again with the exception of an emergency o Two other exceptions to the 24 hour notice requirement o The Tenant consents to the entry o The tenancy agreement is ending and the Landlord wants to show the apartment to a prospective Tenant (this may only be done between 8am-8pm, and reasonable effort must be made to notify the current Tenant) To rent a safe and clean property. Tenants and Landlords Responsibilities and Rights - French Landlord Responsibilities Landlords must treat Tenants with respect, and address all reported complaints, including issues of conflict, harassment and discrimination from other Tenants Landlords must maintain the apartment unit and building in a good state of repair, in accordance with applicable laws and by-laws Landlords must make all repairs that are promised verbally or in the lease Landlords must act on reported maintenance and repair issues in a timely and effective manner Landlords must reimburse the Tenant for the cost of emergency repairs made by Tenant (receipts provided) Landlords are required to pay Tenants interest on the last month’s rent deposit every year, as required by the Residential Tenancies Act. Landlords must follow the proper procedures for evicting Tenants. A Tenant can only be evicted in accordance with the Residential Tenancies Act. Landlords are required to provide the Tenant with a copy of a written Tenancy Agreement within 21 days of signing. If the Tenancy Agreement is not in writing, the Landlord must give written notice of the landlord’s legal name and address within 21 days after tenancy begins The Landlord must provide the Tenant with 24-hours’ notice prior to entering the apartment. The landlord is only permitted to enter the unit between 8 am and 8 pm with a 24 hours’ notice except in the case of an emergency. Les propriétaires doivent respecter les procédures appropriées pour expulser des locataires. Un locataire peut être expulsé uniquement selon les dispositions de la Loi sur la location à usage d’habitation. Les propriétaires doivent remettre au locataire une copie de la convention de location écrite dans les 21 jours suivant la signature. The notice must include the new amount of rent and must be in a form approved by the Board. A Landlord may refuse to or refuse to sublet or an assignment by the Tenant, however, the Landlord shall not unreasonably refuse consent To end the tenancy and evict a Tenant, only for reasons listed in the Residential Tenancies Act. Un propriétaire peut mettre fin à la location et expulser un locataire uniquement pour les raisons énumérées à la Loi sur la location à usage d’habitation.
