HAS DECIDED AS FOLLOWS:

folgende Fassung:
Article 11 of the Rules relating to Fees
shall read as follows:

taxes est remplacé par le texte suivant :

Die Prüfungsgebühr nach Artikel 94
Absatz 1 des Übereinkommens wird
The examination fee provided for in
Article 94, paragraph 1, of the
Convention shall be refunded:
La taxe d'examen prévue à l'article 94,
paragraphe 1 de la convention est
remboursée :
a) in voller Höhe zurückerstattet, wenn
die europäische Patentanmeldung
zurückgenommen oder zurückgewiesen
wird oder als zurückgenommen gilt,
bevor die Sachprüfung begonnen hat;
(a) in full if the European patent
application is withdrawn, refused or
deemed to be withdrawn before
substantive examination has begun;
a) intégralement si la demande de
brevet européen est retirée, rejetée ou
réputée retirée avant que l'examen
quant au fond n'ait commencé ;
b) zu 50 % zurückerstattet, wenn die
europäische Patentanmeldung
zurückgenommen wird, nachdem die
Sachprüfung begonnen hat und
(b) at a rate of 50% if the European
patent application is withdrawn after
substantive examination has begun and
b) à 50 % si la demande de brevet
européen est retirée après que
l'examen quant au fond a commencé et
- bevor die Frist für die Erwiderung auf
die erste von der Prüfungsabteilung
selbst erlassene Aufforderung nach
Artikel 94 Absatz 3 des Übereinkommens abgelaufen ist oder,
- before expiry of the time limit for
replying to the first invitation under
Article 94, paragraph 3, of the
Convention issued by the Examining
Division proper or,
- avant l'expiration du délai de réponse
à la première invitation émise,
conformément à l'article 94,
paragraphe 3 de la convention, par la
division d'examen proprement dite, ou,
- falls die Prüfungsabteilung keine
solche Aufforderung erlassen hat, vor
dem Datum der Mitteilung nach
Regel 71 Absatz 3 des Übereinkommens."

date of the communication under
Rule 71, paragraph 3, of the

1. Dieser Beschluss tritt am 1. Juli 2016
in Kraft.

2. Der mit diesem Beschluss geänderte
Artikel 11 a) der Gebührenordnung
findet auf alle europäischen Patentanmeldungen Anwendung, die ab dem
1. Juli 2016 zurückgenommen oder
zurückgewiesen werden oder als
zurückgenommen gelten.
2. Article 11(a) of the Rules relating to
Fees as amended by this decision shall
apply to all European patent
applications which are withdrawn,
refused or deemed to be withdrawn on
or after 1 July 2016.
2. L'article 11a) du règlement relatif aux
taxes, tel que modifié par la présente
décision, est applicable à toutes les
demandes de brevet européen qui sont
retirées, rejetées ou réputées retirées à
compter du 1er juillet 2016.

3. Der mit diesem Beschluss geänderte
Artikel 11 b) der Gebührenordnung
findet auf alle europäischen Patentanmeldungen Anwendung, für die die
Sachprüfung ab dem 1. November
2016 beginnt.
3. Article 11(b) of the Rules relating to
Fees as amended by this decision shall
apply to all European patent
applications for which substantive
examination starts on or after
1 November 2016.
3. L'article 11b) du règlement relatif aux
taxes, tel que modifié par la présente
décision, est applicable à toutes les
demandes de brevet européen pour
lesquelles l'examen quant au fond
commence à compter du
1er novembre 2016.
