Der Präsident des Europäischen
Patentamts, gestützt auf Artikel 10
EPÜ, Artikel 3 und 6 (4) GebO sowie
Artikel 8 der Vereinbarung zwischen der
EPO und WIPO nach dem PCT
(ABl. EPA 1998, 85), beschließt:
Having regard to Article 10 EPC,
Articles 3 and 6(4) RFees and Article 8
of the Agreement between the EPO and
WIPO under the PCT (OJ EPO 1998,
85), the President of the European
Patent Office has decided as follows:

Das Europäische Patentamt führt in
seiner Eigenschaft als Internationale
Recherchenbehörde nach dem PCT
eine Recherche internationaler Art
(Artikel 15 PCT) zu einer nationalen
Patentanmeldung durch, sofern diese
Anmeldung bei der Patentbehörde
eines Vertragsstaats des Europäischen
Patentübereinkommens eingereicht
wird und das nationale Recht dieses
Staates eine Recherche internationaler
Art vorsieht.
The European Patent Office shall, in its
capacity as an International Searching
Authority under the PCT, carry out an
international-type search (Article 15
PCT) on a national patent application if
the application is filed with the patent
authority of a contracting state to the
European Patent Convention and the
national law of that state provides for an
international-type search.
L'Office européen des brevets effectue,
en sa qualité d'administration chargée
de la recherche internationale au titre
du PCT, une recherche de type
international pour une demande de
brevet national (article 15 PCT), dans la
mesure où cette demande a été
déposée auprès du service de la
propriété industrielle d'un État partie à
la Convention sur le brevet européen et
où le droit national de cet État prévoit
une recherche de type international.

Taxes prévues pour les recherches
de type international
(1) Vorbehaltlich abweichender Vereinbarungen zwischen der Europäischen
Patentorganisation und den nationalen
Patentbehörden der Vertragsstaaten,
wird die Gebühr für eine Recherche
internationaler Art nach Abschnitt 2.2
Nr. 1 des Gebührenverzeichnisses wie
folgt festgesetzt:1
(1) Unless different terms have been
agreed between the European Patent
Organisation and the national patent
authorities of the contracting states, the
fee for an international-type search
under Section 2.2, No. 1 of the fees
schedule shall be as follows:1
1) Sous réserve d'accords dérogatoires
entre l'Organisation européenne des
brevets et les services nationaux de la
propriété industrielle des États
contractants, la taxe prévue pour une
recherche de type international au titre
de la section 2.2, n° 1 du barème des
taxes est fixée comme suit :1

Dieser Beschluss tritt am 1. Juli
1999 in Kraft und gilt für Patentanmeldungen, die ab 1. Juli 1999 eingereicht werden.
This decision shall enter into force on
1 July 1999 and shall apply to patent
applications filed on or after 1 July
1999.
La présente décision entre en vigueur
le 1er juillet 1999 et s'applique aux
demandes de brevets déposées à
compter du 1er juillet 1999.
