This report offers an interesting overview of the current prison park in France and focuses more particularly on how this latter is given progressively to the private sector to overcome the defects of the French prison administration. This study can be a reference to scheme planners, architects, urban planners, investors and constructors. La population carcérale en France a fortement augmenté ces dernières décennies plaçant la France parmi les élèves les plus mauvais d’Europe. De ce constat, le Ministère de la Justice et l'Agence Publique pour l'Immobilier de la Justice (APIJ) ont décidé d’engager une politique de renouvellement du parc pénitentiaire et d’amélioration de leur gestion en utilisant notamment de nouveaux procédés à savoir les contrats de PPP (partenariat public-privé). Aujourd'hui, l'APIJ est reconnue pour son expertise dans les contrats de PPP, en raison, en premier lieu, des contrats de délégation de gestion lancés dans les années 70 puis des contrats de partenariat pour la construction lancés depuis 2000. Dans cette perspective, n’y a-t-il pas un risque de voir à terme une des fonctions régaliennes de l’Etat tomber intégralement entre les mains du secteur privé et plus particulièrement se fondre dans une activité dédiée uniquement à l’immobilier ? The prison population in France has been rising steeply since few decades, which places France among the most ineffective managers of prison in Europe. In that perspective, a policy submitted by the Ministry of the Justice has been undertaken by the Agency for the Real Estate of the Justice, APIJ, to solve this substantial problem. Its role is to renew the prison park, the quickest possible, and ensure a good management of each site and of the prisoners by new processes. Today the APIJ is recognised for its huge expertise in the PPP contracts (public private partnership), to a large extent due to the services agreements for the management of prison, which have been experimented in the 70 years. These past few years this practice has being extended to their built at the risk of seeing the prison falling in the hands of the private sector. In fact, this document shows that government services can not be totally independent of the private sector which covers a range of skills, even in the security field, necessary to reach the urgent prison needs. It also underlines the advantages and the risks of this new combination Ce document montre que les services de l’Etat, en l’occurrence l’Administration Pénitentiaire, ne peuvent pas avancer indépendamment du secteur privé doté de compétences, même dans le domaine de la sécurité, nécessaires pour atteindre les besoins urgents en places de prison. Il souligne également les avantages et les risques de ce nouveau type de partenariat pour un bien aussi complexe que la prison. En outre, le Ministère de la Justice semble tirer profit de la concurrence pour mettre en place de nouveaux concepts architecturaux et judiciaires actuellement à l'étude comme la «prison ouverte», autre aspect de la prison abordé dans cette étude. Ce rapport met enfin en exergue un fait nouveau, la prison étant promise à une seconde vie à la grande joie des investisseurs. En effet, dans le cadre de la réforme de modernisation de l’Etat, une discipline jusqu’ici réservée aux investisseurs privés a rejoint la politique de l’Etat: l’asset management. Les récentes mises en ventes de prisons laissent alors entrevoir des reconversions pour le moins surprenantes comme l’illustre le futur hôtel de luxe d’Avignon. Mais l'hôtel est-il le produit le plus approprié pour une reconversion de prison ? Et quel est le devenir le plus approprié pour ce type de bien dans un contexte où le foncier se fait rare de surcroit ? À la lumière de ces observations, comment les prisons sont-elles aujourd’hui pensées, construites, gérées et valorisées en France? Ces questions sont traitées dans ce document. Moreover, the Ministry of the Justice seems to take advantage of the competition so that it can put in place new architectural and judicial concepts which are being at the study such as the "opened jail". This study raises finally a new vocation of the prison to say the least unexpected, indeed, they are now promised to a second life in many forms to the great delight of the investors. Indeed, the French government undertook a big reform by including the State patrimony as a strategy to reduce its debt by the way of an asset management policy. In doing so, hard negotiations between the State and the private investors have occurred and valuable properties, even the old prisons, are nowadays at the center of the debates at the Ministry. That point raises the question of their protection or of their reconversion. Prisons are in most of the cases well located in the cities and can represent some valuable and unequalled opportunities for investors, in a context where lands are rare, but also, an architectural asset for its environment. We can see then in Avignon, a very touristic city of France, a conserved jail which is being converted into a luxury hotel as well as many others all around the world. But is the hotel the most appropriate product for a reconversion of a prison? Prisons are, as this report raises it, as much a public service, a complex property and a pure financial asset. This is all the interest of its complexity and so of this report. In light of these observations, how are the prisons, nowadays, thought, built, managed and valorised in France? These questions are answered in this document.
