What’s the purpose of the By-law? Moncton City Council adopted By-law Z-410, effective March 1, 2010, to address lot grading and drainage plans by providing more detail on site and foundation elevations, and to implement a system of mandatory inspections. To whom does it apply? The new requirements under the By-law apply to the construction of single, two-unit and semi-detached dwellings within the City of Moncton. What does it mean in terms of changes and new requirements? Among the major changes will be the requirement to produce a Site Plan showing various elevations upon permit application, as well as a Foundation Report Form at the foundation stage, and a Surveyor’s Real Property Report once the lot grading is completed, in order to confirm compliance with the Registered Drainage Plan. Also, inspections are to be carried out at the following stages of construction: 1. a “pre-backfill inspection” consisting of a foundation inspection prior to any backfilling 2. a “framing inspection” on structural components prior to the installation of insulation and vapour barrier and after completion of plumbing, ventilation and electrical rough-ins 3. a “pre-drywall inspection” prior to the installation of drywall 4. a final “pre-occupancy inspection” Why post a notice on the Land Gazette? The By-law states that certain conditions must be met within a specified amount of time after the issuance of a building permit. If a Notice has been issued affecting a property, this means that there are requirements under the By-law that have not yet been fulfilled. Please contact the Building Inspection Department for more information. When is the notice removed? The Land Gazette notice is removed from Service NB website once the final preoccupancy inspection and the Surveyor’s Real Property Report are approved. Voici l’avis de la Gazette foncière de Service Nouveau-Brunswick en vertu de l’arrêté Z-410 de la Ville de Moncton qui est publié lors de la construction d’un nouveau logement unifamilial, bifamilial ou jumelé. Quel est le but de l’arrêté? Le Conseil municipal de Moncton a adopté l’arrêté Z410, entrant en vigueur le 1er mars 2010, afin de traiter des plans de terrassement et de drainage en fournissant plus de renseignements détaillés sur le site et la hauteur des fondations et afin de mettre en œuvre un système d’inspections obligatoires. Quels sont les changements et nouvelles exigences? Parmi les changements figure l’exigence de fournir un plan de site lors de la demande de permis de construction, démontrant certaines hauteurs et élévations. De plus, un état des fondations sera requis au stade de construction de la fondation, ainsi qu’un rapport d’arpentage lorsque le terrassement sera complété, afin d’assurer la conformité au plan de drainage enregistré. De plus, une inspection doit avoir lieu à chaque stade de construction qui suit : 1. une « inspection avant le remblayage », soit l’inspection des fondations avant le remblayage; 2. une « inspection de la charpente » sur les composants structurels de la charpente avant la pose de l’isolant et du pare-vent et après les travaux préliminaires de plomberie, de ventilation et d’électricité; 3. une « inspection avant l’installation de la cloison sèche » avant l’installation de placoplâtre; 4. une dernière « inspection avant usage » Pourquoi publier un avis sur la Gazette foncière? L’arrêté prévoit que certaines conditions doivent être respectées dans un délai précisé suivant la délivrance d’un permis de construction. Si un Avis a été émis concernant une propriété, cela signifie que certaines exigences de l’arrêté n’ont pas encore été satisfaites. Prière de communiquer avec le Service d’inspection des bâtiments afin d’obtenir des renseignements supplémentaires. Quand enlève-t-on l’Avis? On enlève l’Avis de la Gazette foncière du site Web de Services NB après l’approbation de l’inspection « avant occupation » et après que le rapport immobilier de l’arpenteur soit soumis et approuvé.
