THE REGULATIONS The regulations were developed by the Lands Advisory Board and the Minister The Regulations provide a legislative basis for the registration of documents affecting interests and licences in First Nation land The Regulations create a registration system for all First Nations with Land Codes, not a land titles system which guarantees title 3 2/16/2016 THE REGISTRY Paperless Instant Priority based Developed with the input of financial institutions Public Available to anyone Viewing Registration applications EFFECT OF REGISTRATION The Regulations establish rules to determine priority among and between registered or unregistered documents. Readers are cautioned that the explanation does not necessarily reflect the views or opinions of the Department of Indian Affairs and Northern Development, the Lands Advisory Board or the Lands Advisory Board Resource Centre Inc. It is prepared for convenience only and users should obtain legal advice for any interpretation that may be required. These Regulations came into force on November 5, 2007 EXPLANATORY VERSION NO. 1 – October 17, 2007 (Note: Current to January 6, 2016. These regulations were last amended on September 5, 2008) FIRST NATION LAND REGISTRY REGULATIONS EXPLANATORY VERSION INTERPRETATION Definitions 1. The following definitions apply in these Regulations. “Act” means the First Nations Land Management Act. (Loi) “applicant” means a person who submits an application for registration or recording. (demandeur) Any person may submit an application to register or record a document including the First Nation land manager or other employee, the individual or developer holding the interest or the lawyer for the individual. A First Nation may make a law that requires First Nation certification and / or approval of any document to be registered and that a document that is registered without the First Nation certification and / or approval is not valid. “First Nations Land Registry” means the office referred to in section 2. (bureau d’enregistrement) “general abstract” in respect of a reserve, means an electronic abstract of registered interests – or, in Quebec, registered rights - and recorded documents that affect all lands on the reserve. (répertoire général) The general abstract contains a listing of documents in chronological order which are the basis of title to the whole reserve and may include, Treaties, Orders in Council and deeds. It may also contain documents such as easements, road allowances, utility permits and surrenders. “official plan” means a graphical description of boundaries of land prepared from field notes of a survey confirmed under section 29 of the Canada Lands Surveys Act. (plan official) Official plans are the surveys most often used to determine the exterior boundaries of First Nation land and the quantity of reserve lands recognized by Canada. See section 18. “parcel abstract” means an electronic abstract of registered interests – or, in Quebec, registered rights - and recorded documents that affect an individual parcel of first nation lands. (répertoire de lot) 2 The parcel abstract contains a listing of documents in chronological order concerning the title to a lot of first nation land which may be held as Certificate of Possession, a leasehold interest, leasehold mortgage. “Register” means the First Nations Land Register established by the Minister under subsection 25(1) of the Act. (registre) The Register is the name of the electronic data base maintained by INAC. It only contains documents from First Nations who have ratified a land code. The First Nations Land Registry is the office in which the Register and the Registrar are located in Gatineau, Quebec at INAC headquarters. “Registrar” means the officer in the Department of Indian Affairs and Northern Development responsible for the management of the First Nations Land Registry. (registraire) “registration plan” means a graphical description of the boundaries of land prepared by the Surveyor General under section 31 of the Canada Lands Surveys Act. (plan d’enregistrement) Registration plans are less detailed than official plans and are surveys used to set out the boundaries of parcels or lots of land within First Nation lands which have been leased. “textual description” means a metes and bounds description of first nation lands, or any other description of first nation lands that does not refer exclusively to one or more complete parcels on a registration plan or official plan. (description textuelle) A textual description is a written description and not a survey plan. It may only be used if the interest granted is not encumbered (by a mortgage, for example), or for a utility company to provide services to residents of the First Nation. 3 OPERATION OF REGISTRY Registry location 2. The Register shall be maintained in an office located in the National Capital Region and known as the First Nations Land Registry. The Ottawa – Gatineau area is the National Capital Region. Officer hours 3. (1) The First Nations Land Registry shall be open to the public from Monday to Friday, except on holidays, from 8:30 a.m. to 4:00 p.m. EST or E DST, as applicable. The Registry and the Register are open to the public. The basis of any government operated land registry or land titles office is that the records and information the offices contain can be viewed by members of the public. In a land registry system the registration of a document gives notice to the public of the document and the claimed interest. The Registry office is open for longer hours than noted, but not to do business with the public. However, registration or recording of documents in person cannot take place outside these hours. Holidays are statutory holidays recognized by Canada and on which most, if not all, federal, provincial, first nation and municipal government offices and banks are closed. Electronic registration or recording (2) Despite subsection (1), a document may be transmitted for registration or recording in accordance with section 12 at any time. Documents can be recorded or registered electronically under section 12 and for electronic registration the Registry is “open” for business 365 days of the year 24/7. While it is technically possible for a First Nation to use a combination of electronic and mail or courier registration, First Nations are encouraged to make use of one or the other method but not both. Limitation on activities 4. Neither the Registrar nor any employee of the First Nations Land Registry shall express an opinion about any interest or licence in first nation land, including whether: a) a document submitted for registration or recording is validly made; b) a document has been registered, as opposed to having been recorded. Registry employees are prohibited from expressing any opinions on the validity or legal effect of a document. The role of the Registrar and staff is to apply these regulations. While they are employees of INAC, they must act independently of INAC, the First Nation or any person claiming to have an interest in First Nation 4 lands. Examination of Register 5. Any person may, during the hours referred to in subsection 3(1), inspect at the First Nations Land Registry the electronic image of any document that is registered or recorded in the Register. As noted the Register is open to the public. Since it is also an electronic Register, it may be accessed on the internet at any time, provided the user has a password obtained from the Registry. Copies 6. On request, the Registrar shall provide a certified copy of a document registered or recorded in the Register. A certified copy has the same legal effect as the original document. Certified copies of documents may be required by lenders, title insurers or the courts as to establish that a document has been registered or recorded. All documents which are registered or recorded in the Register may be viewed on the internet site and may be printed electronically. However, these documents are not certified by the Registrar. Registrar’s certificate 7. On request, the Registrar shall issue a certificate indicating all the interests registered – or, in Quebec, all the rights registered – and other documents recorded on the abstract of a specified parcel of first nation land. The Registrar may also certify copies of the documents for a parcel of land taken from the parcel abstract. Lenders, title insurers may require certified copies of the abstract to review the title to a parcel of land. In a dispute, courts and other tribunals will accept the use of certified copies of documents and abstracts as evidence. ABSTRACTS Abstracts 8. The following abstracts shall be included in the Register: a) for each reserve of a first nation, a general abstract; and, b) for each parcel of first nation land, a parcel abstract. Restriction 9. The Registrar shall not create a parcel abstract unless it is based on an official plan or registration plan. 5 Survey requirements are set out in sections 17, 18 and 19. It is noted that a parcel abstract cannot be based on a textual description. The survey requirements are consistent with survey requirements established by NRCan and INAC which applied prior to these Regulations coming into force. APPLICATION TO REGISTER OR RECORD DOCUMENTS Application to register or record documents 10. (1) Any person may apply for the registration or recording in the Register of a document that affects first nation land: a) in person, by submitting the document and a completed application for registration or recording to the Registrar at the address set out in section 11; b) by mail, by submitting the document and a completed application for registration or recording to the Registrar at the address set out in section 11; or c) electronically, in the manner set out in section 12. Information (2) An application for registration or recording shall contain the following information, taken from the document submitted for registration or recording: a) the names and addresses of all parties to the document; b) the name and address of the person who completed the application; c) the type of document; d) if applicable, the date the document was executed – or, in Quebec, signed according to all the required formalities for its validity – or, if there is more than one date indicated, the most recent date; e) the province where the land is located; f) the name of the first nation, the name of the reserve and the lot number, if any, associated with the land; g) the land description; h) a list of any supporting documents accompanying the document submitted for registration or recording; and i) if two or more documents that are to be registered or recorded are submitted together by mail, directions regarding the order to be respected in registering or recording each document relative to each other. Only one completed application and the actual document accompanying the application is required. It is noted that the application to register or record may be completed by any person – a land manager, a lawyer acting for a party to a transaction or a party to a document. The intention is that most documents will be registered by the First Nation concerned with the document. First Nations have authority to make laws requiring that documents be certified or 6 approved by the First Nation before registration. The First Nation law would provide that the document will have no effect if it is not certified or approved by the First Nation prior to being registered or recorded. However, there are many documents which do not require First Nation certification or approval, particularly those noted in section 15. In some cases these documents do not have any effect on the title, for example, a change of name, while in other cases, such as an Order in Council, the documents will affect title. See also sections 15 and 23. Submission by mail or in person 11. A document to be registered or recorded and a completed application for registration or recording may be submitted by mail to the Registrar at: Registrar o First Nations Land Registry o 10 Wellington Street o Gatineau, Quebec o K1A 0H4 Mail or courier can be used. Note that registration by mail requires that the documents physically arrive at the Registry before review and registration or recording by Registry staff. Every effort should be made to send all documents concerning a particular grant to the Registrar at the same time to make sure documents are registered in the desired order. Electronic transmission 12. (1) A document to be registered or recorded may be submitted electronically to the Registrar: a) by completing an application for registration or recording online at the Registry Internet website at www.ainc-inac.gc.ca; and b) attaching the document as an electronic file in a form referred to in subsection(2). File format (2) A document transmitted electronically to the Registrar must be in the form of one or more images contained in a single file, scanned from the original document at a resolution of at least 200 dpi, in Adobe Acrobat (.pdf) format or tagged image file (.tif) format. Fax transmission 13. A document shall not be transmitted for registration or recording by fax. Tracking number 14. (1) On receipt of an application and document that were transmitted 7 electronically in accordance with section 12, the Registrar shall transmit to the applicant by e-mail an acknowledgment of receipt and a tracking number and provide a copy of the acknowledgement and tracking number to the first nation whose lands are affected. Electronic registration or recording occurs immediately on transmission of a document. The tracking number becomes the registration number if the document complies with the regulation. Tracking number (2) On receipt of an application and document that were submitted for registration or recording by mail, the Registrar shall mail an acknowledgment of receipt and a tracking number to the applicant and provide a copy of the acknowledgement and tracking number to the first nation whose lands are affected. Documents sent by mail or courier are only recorded on receipt by the Registry. Original Documents 15. The following documents may be submitted for registration or recording instead of an original document: a) a copy of a judgement or court order, certified by the court; b) a copy of a document registered in a provincial registry or land titles system, certified by the appropriate provincial registrar; c) a copy of a birth certificate, marriage certificate, name change certificate, power of attorney, will, approval or probate of will or appointment of administrator, certified by the person who has custody of the original; d) a copy of a certificate of amalgamation or change of name of a corporation, certified by the agency responsible for recording the amalgamation or change of name; e) a copy of an order in council, certified by the Clerk of the Privy Council; f) a copy of a ministerial order; and g) a copy of a document issued by a first nation, certified by the person who has custody of the original. Some of the documents referred to in this section do not grant or transfer interests in land but are concerned with clarifying some aspect of title. Name changes and amalgamations are examples of these kinds of documents. There are also documents such as Orders in Council or court orders which will generally concern the title to land. With the exception of subsection g), the documents are issued and certified by provincial or federal government departments and institutions or the courts. Section 23 requires the Registrar to notify the First Nation when a document in section 15 is registered or recorded. 8 GROUNDS FOR REFUSING REGISTRATION OR RECORDING Grounds for refusing registration or recording 16. The Registrar shall not register or record a document if: a) it is not dated; b) it is not legible; c) it does not identify each party to the document; d) the information contained in the application for registration or recording conflicts with the information contained in the document; or, e) the land description does not meet the requirements of subsection 17(1) or section 18 or 19. The Register will examine each document submitted electronically or by mail to make certain that it complies with the requirements of this Regulation before registering or recording the document. The Registrar has no power to make a change, addition or correction to a document. Survey requirements 17. (1) No document that purports to: a) grant an interest – or, in Quebec, a right - in first nation land or a licence for a term of 10 or more years, other than an interest, right or licence granted to a member of a first nation; b) grant a strata title, a condominium interest – or, in Quebec, a divided co-ownership right - or any similar interest or right; A strata title is title to a floor, or portion of a floor, in a building of more than one floor. c) allocate or transfer lawful possession of first nation land to a first nation member; or d) expropriate an interest – or, in Quebec, a right - for a community work or other first nation community purposes under section 28 of the Act, shall be registered or recorded unless the land description contained in the document consists exclusively of a reference to one or more complete parcels on a registration plan or official plan. Renewal or extension (2) The term of a document in paragraph 1(a) includes the period of any right of renewal or extension of the document. A grant of a lease of land for five (5) years may be registered using a textual description. However, if the grant of a lease is for five (5) years with a right of renewal for an additional five years (i.e. ten years), then a registration plan or official plan is required for registration. 9 Exception (3) Subsection (1) does not apply to easements or, in Quebec, to servitudes. An easement is usually a right to use land for utility purposes to service the first nation with hydro power, telephone etc. See section 19. Requirements for land descriptions 18. If a document purports to: a) exchange first nation land for land that is to become first nation land in accordance with section 27 of the Act: or b) define the exterior boundaries of first nation land, the Registrar shall not register or record the document unless the land description in the document is derived from an official plan or registration plan. Utilities 19. The Registrar shall not register or record a document that contains a textual description unless the document grants an interest – or, in Quebec, a right - in unencumbered land, or a licence to a utility company in respect of unencumbered land, for the purpose of providing service to residents of a reserve. REGISTRATION OR RECORDING OF DOCUMENTS Order of registration or recording 20. (1) Subject to section 21, the Registrar shall register or record each document submitted for registration or recording that meets the requirements of these Regulations in the order that it is received by the First Nation Land Registry. Time of registration or recording (2) A document is considered to have been registered or recorded: a) if the document was transmitted electronically, at the time indicated on the electronic acknowledgement of receipt; and b) if the document was sent by mail, at the time of receipt stamped on the document by the Registrar. Multiple submissions 21. If two or more documents affecting the same parcel of first nation land are submitted for registration or recording at the same time by the same person and the documents meet the requirements of these Regulations for registration or recording, the Registrar shall register or record them in the order indicated on the application for registration or recording. 10 Registry information 22. (1) If a document submitted for registration or recording meets the requirements of these Regulations, the Registrar shall record the following information in the appropriate abstract: a) the names of all parties to the document; b) the type of document; c) the first nation land affected; d) if applicable, the date the document was executed – or, in Quebec, signed according to all the required formalities for its validity – or, if there is more than one date indicated, the most recent date; e) the tracking number assigned to the document at the time of its receipt; and f) the date and time of registration or recording. General abstract (2) If a document submitted for registration or recording affects a reserve as a whole, the Registrar shall register or record in the general abstract for the reserve the information required under subsection (1). Parcel abstract (3) If a document submitted for registration or recording affects a particular parcel of first nation land, the Registrar shall register or record in the parcel abstract for that parcel the information required under subsection (1). Notification 23. On the registration or recording of a document, the Registrar shall notify the first nation of the registration or recording without delay. Registration or recording refused 24. (1) If a document submitted for registration or recording does not meet the requirements of these Regulations, the Registrar shall return to the applicant the application for registration or recording and all supporting documents accompanying it, and provide written reasons for the refusal to register or record the document. Copy of reasons (2) The Registrar shall provide a copy of the reasons for the refusal to the first nation. Electronic storage 25. The Registrar shall store in electronic form every document registered or recorded under these Regulations. 11 Return of registered document 26. After a document that was submitted to the Registrar in paper form has been registered or recorded, the Registrar shall return the original document to the applicant. Errors in registration or recording 27. If the Registrar becomes aware of an omission or error in the registration or recording of a document, the Registrar shall immediately make the necessary corrections, add a notation to the Register identifying the corrections and notify all persons who may be adversely affected by the corrections. EFFECT OF REGISTRATION Priority 28. (1) Subject to section 31, interests – or, in Quebec, a right - registered under these Regulations that effect the same parcel of first nation land have priority according to the time and date of the registration of the document and not according to the time and date the documents were executed or, in Quebec, signed according to all the required formalities for its validity. No priority to licences and other documents (2) For greater certainty, subsection (1) does not apply to a document that does not grant an interest – or, in Quebec, a right - in first nation land. Example: A CP granted on June 30, 2000 and registered on October 15, 2007, has priority over a CP for the same interest granted on October 1, 2007 and registered on October 21, 2007. Note that the priorities concern only documents granting interests in land and not to other kinds of documents such as a change of name. Unregistered interests or rights 29. A registered interest – or, in Quebec, a registered right - affecting a parcel of first nation land is entitled to priority over an unregistered interest affecting the same parcel. This section sets out a basic principle – courts will recognize a registered interest in preference to an unregistered interest relating to the same parcel if there is a conflict between the interests claimed. Resolving mortgages or hypothecs 30. A registered mortgage or hypothec has priority over a subsequently registered interest – or, in Quebec, a registered right - that affects the same parcel of First Nation land, to the extent of the money actually advanced under the mortgage or hypothec, to a maximum of the amount secured by the mortgage or hypothec, even if all or part of the money was advanced after the registration of the 12 subsequently registered interest or right, unless the mortgagee or hypothecary creditor had actual notice of the registration of the subsequently registered interest or right before making the advance. Many mortgages are granted for the construction of homes on reserve. These mortgages are registered and funds advanced in 3 or 4 stages or advances as the home reaches certain construction targets. This section is intended to protect the mortgagee – the lender, so that the total amount of the first mortgage is secured, even if a second mortgage is registered before all funds have been advanced on the first registered mortgage. Deferred priority 31. (1) In a province other than Quebec, the holder of a registered interest, or a person applying to register an interest, may apply to record a postponement agreement that gives priority over the registered interest to a specified interest that was, or is to be, subsequently registered. In Quebec (2) In Quebec, the holder of a registered right, or a person applying to register a right, may apply to record a postponement agreement that gives priority over the registered right to a specified right that was, or is to be, subsequently registered. Priority on recording (3) On the recording of a postponed agreement, priority shall be accorded to the interests or rights referred to in the agreement in the manner provided for in the agreement. Occasionally, there is a desire or need to change priorities, primarily in respect of mortgages. For example, a parent sells the family home to an adult child and takes back a small mortgage. Several years later, the child who now owns the home wishes to build an addition. The bank lender agrees to the mortgage loan, but only if the parent agrees that the bank mortgage will have priority over the parent’s mortgage. A postponement agreement is signed by the parent agreeing that the bank mortgage to be registered will have priority over the parent mortgage which is already registered. TRANSITION TO PRIORITY SYSTEM Prior registered interest 32. (1) An interest that was registered in the Register before the day on which these Regulations come into force has priority over an interest registered under these regulations on or after that day. Documents already registered in the Indian Affairs Land Registry system whether 13 the before November 5, 2007 have priority over documents registered after these Regulations come into force. No relative priorities (2) Subsection (1) shall not be interpreted to confer a priority on one interest that was registered in the Register before the day on which these Regulations come into force over any other interest that was also registered in the Register before that day. The rule dealing with priorities does not apply to documents that were already registered in the ILRS or the FNLMRS even after the Regulations come into force. The important point to remember is that priority of registration ONLY applies to documents registered under these Regulations after November 5, 2007. Indian land registry records 33. Prior to the 2013/2014 fiscal year, this contract management was done by NRCan (through their Edmonton and Regional offices), with the funds being allocated by AANDC. However, AANDC was finding it more difficult to secure the necessary funding from their normal operating budget. This combined with the restrictions surrounding the use of operating dollars in any given fiscal year, they turned to contribution funding as a more flexible funding approach for surveys. Contribution funding cannot be used by a Government Department to establish 3rd party contracts, therefore the authority for the management of the survey contracts was given to the Resource Centre starting in the 2013/2014 Fiscal year. 10 These contracts managed by the Resource Centre are only related to the surveys that are done on First Nation land to support the a description of lands being transferred to the First Nation’s administration and control pursuant to the Framework Agreement. As these contracts are managed by a non‐Government Department, the current Government contracting requirements are not applicable. The Resource Centre contracts are not bound by the Government Fiscal Year end of March 31st. Contracts with the Resource Centre can be issued all year with the return dates being selected by the milestones set out in the Implementation Document. The survey instructions, statement of work, sketches, etc. still are prepared by NRCan. An NRCan project is opened, and the surveyor still uses MyCLSS to submit the returns. With the Resource Centre issuing the contracts, First Nations have more input and involvement in the process. When the Resource Centre is issuing a contract, we try to ensure that the funds are spent responsibly. Therefore in the majority of cases, multiple estimates are requested. However, the First Nation is always asked to confirm that they have no issues with any of the survey companies that we are proposing to approach for estimates. The First Nation is made aware of the survey timeframes and is notified where adjustments to timeframes may be required. Boundaries defined by the monuments shown on the Official Plan become the true boundary lines “Confirmed” under Section 29 of the Canada Lands Surveys Act The plan is registered in the applicable land titles or land registry office. As an Official plan still involves INAC in the review and approval process, this process has not been outlined in this presentation. May be necessary when a Land Description is being prepared where the complexity of a land description report becomes cumbersome and difficult as it refers to multiple plans and documents to describe the extent of the Reserve boundaries. Location: further away from major centre increases costs (mobilization to work site, accommodations, etc.) Timing: busy survey season, winter surveys (more time to locate evidence), rush/high priority contract, amount of field time required (days vs. weeks or months) Availability of evidence: how hard will it be to tie to existing survey evidence (older surveys vs. newer surveys, type of monumentation) Type of survey: field work required, size/type of survey (single lot vs. subdivision), natural boundary (field work vs. mapping), survey equipment used (GPS, total station, etc.), mobilization (truck, helicopter, quad, etc.) Experience: familiarity with Canada Lands Surveys requirements and processes and the area of the survey 18 2016‐02‐12 Questions 19 Interdepartmental Letter of Agreement related to the COOPERATION IN THE AREA OF SURVEYS AND THE SPECIFICATIONS FOR DESCRIPTIONS OF LAND FOR TRANSACTIONS ON RESERVE LANDS 1.0 DEFINITIONS “Administrative Plan” refers to a survey plan which is approved pursuant to Section 31 of the CLSA. As a general rule, Administrative Plans will be used for all new internal subdivisions or other surveys related to internal interests in Reserve Lands. “Agreement” refers to this Interdepartmental Letter of Agreement. “CLSA” refers to the Canada Lands Surveys Act [R.S.C. 1985, c. L-6]. “CLSR” refers to the Canada Lands Surveys Records in Ottawa “Exclusive Use” refers to an interest in land of an exclusive nature such as a Band allotment, or lease and sub-leases. “Exclusive Use Parcel” is a closed polygon of land, with a unique descriptor, used or intended to be used to describe the extent and location of an Exclusive Use interest in the land. Generally, these parcels are shown on a Plan of Survey. “Non-exclusive Use” refers to an interest in land for a limited purpose such as an access right-of-way or permit for a specific use. A Non-exclusive Use interest does not sever or subdivide the Exclusive Use Parcel on which it is situated. “Non-exclusive Use Parcel” is a closed polygon of land used to describe a Nonexclusive Use interest in land such as a right-of-way, easement, permit, or any other limited interest. A Non-exclusive Use Parcel does not sever or subdivide the Exclusive Use Parcel on which it is situated. Generally these parcels are shown on an Explanatory Plan. “Official Plan” refers to a survey plan which is confirmed pursuant to Section 29 of the CLSA. As a general rule, Official Plans will be used for the survey of jurisdictional boundaries of Reserve Lands or parcels which will create a jurisdictional boundary once a land transaction has been completed. “Registry” includes the Indian Lands Registry System, the First Nations Lands Registry System and the Self-Government Lands Registry System as applicable. “Reserve Lands” refers to surrendered lands or a reserve, as those expressions are defined in the Indian Act [R.S.C. 1985, c.I-5], other than reserve lands described in 1|Page regulations made under section 4.1 of the First Nations Commercial and Industrial Development Act [S.C. 2005, c.53] . “Textual Description” refers to a word description of land prepared under the guidelines of the Indian Lands Registry Manual or the First Nations Land Registry System (FNLRS) User Guide. Textual Descriptions are prepared without survey instructions, are not based upon a field survey, and are not recorded in the CLSR. Textual Descriptions are suitable only for the description of limited and short term interests. 2.0 PURPOSE AND SCOPE 2.1 This Agreement was prepared in collaboration between the Department of Aboriginal Affairs and Northern Development (hereinafter "AANDC") through the Lands and Economic Development Sector, and the Department of Natural Resources (hereinafter "NRCan") through the Surveyor General Branch (SGB) (hereinafter collectively the "Participants") to: a. Establish a framework for cooperation between the Participants in the area of land surveys and land management for Reserve Lands, and; b. Identify appropriate methods of describing lands when land descriptions are required for executing and/or registering land transactions in the Registry. This Agreement prescribes which survey plan products to use for specific types of land transactions involving Reserve Lands. It also sets out the basic principles on which the standards for the products and methods of describing land are based. 2.2 This Agreement applies to Reserve Lands and any other lands held and administered by AANDC for the use and benefit of First Nations. 2.3 This Agreement also applies to land descriptions of provincial lands which will be considered for additions to Reserve Lands. 2.4 The Indian Act and the Canada Lands Surveys Act set out the responsibilities for surveys on reserve lands. The Minister of Natural Resources conducts surveys of reserve lands on the request of the Minister of Aboriginal Affairs and Northern Development or in any case in which he/she deems it to be expedient. 2.5 The requirements for land descriptions for Reserve Lands, as detailed in this Agreement, are the minimum required to provide a definition of the extent of interests to be registered. The Participants, surveyors and land managers, when advising clients, should carefully consider whether the minimum requirements outlined in this Agreement will provide adequate protection to the Crown, the parties to the proposed transaction and to any third parties that the transaction may affect. 2.6 Given advances in land management tools, land administrators expect and rely upon accurate parcel mapping for their research and decision making. Whereas survey plans are reflected on the parcel mapping and textual descriptions are not, survey plans are recommended for all land descriptions. 2|Page 2.7 This Agreement is a transitional document to coordinate land description and Registry requirements with the new “National Standards for the Survey of Canada Lands” and the companion document “Getting a Survey Done” on Canada Lands. The format and requirements for surveys outlined in the National Standards are intended to align with provincial land management practices which typically surround Reserve Lands. This alignment of survey practices is intended to streamline and simplify survey requirements for the industry and land administrators. 3.0 INTERDEPARTMENTAL COOPERATION 3.1 It is understood that the ability of each Participant to undertake forms of cooperation under this Agreement is subject to the availability of funds and resources (including facilities and personnel). The form of cooperation shall be negotiated, agreed upon and ratified at the appropriate management level, within the scope of their respective mandates, responsibilities and capacities. Nothing in this Agreement prevents the Participants from entering into tripartite agreements. 3.2 Services requested by AANDC and provided by NRCan that are considered to be over and above those related to mandated NRCan activities noted in Section 3.4 will be funded on an incremental cost recovery basis as per Treasury Board policies. The terms of financing will be established and approved by the Participants as part of an Interdepartmental Letter of Agreement ("ILOA"), prior to the commencement of any cooperative activity. No cost incurred by one Participant shall be assumed by the other Participant unless otherwise agreed to in writing under an ILOA. All costs or estimated costs will be detailed in the ILOA. 3.3 Mandated Activities/Responsibilities of AANDC AANDC employees support the registration of legal interests (First Nations and nonFirst Nations) in the three lands registries administered by AANDC, and ensure registration is carried out in accordance with the Indian Act by: a. ensuring that surveys of First Nation lands match the information about interests in land recorded in the land registries managed by AANDC; b. setting criteria for survey project funding, with NRCan and individual First Nations; c. allocating survey funds to regions and tracking funded surveying projects/activities; d. reviewing legal land descriptions to ensure that they meet registry requirements and are compatible with previously registered interests; e. reviewing land description reports prepared under the First Nations Land Management Act defining the extent of reserve lands; providing advisory and research services to departmental officials and external parties resulting from interpretations of land descriptions and titles found in historical records; f. providing ministerial approval for official survey plans undertaken pursuant to s.29 of the Canada Lands Survey Act focusing on external reserve boundaries. 3|Page 3.4 Mandated Activities of NRCan For existing Canada Lands, the mandated responsibilities managed and funded by NRCan include: a. setting survey standards for Canada Lands; b. providing specific survey instructions; c. confirmation and approval processes, examination of plans and survey returns deemed necessary by SGB; d. field inspections deemed necessary by SGB; e. boundary monitoring deemed necessary by SGB; f. custody and maintenance of survey records; g. providing public access to survey records, and; h. providing advice on the Canada Lands Surveys System including processes and applications for accessing records. 3.5 Cost Recovery Activities of NRCan Survey and mapping products and services requested by AANDC shall be funded by AANDC through an ILOA. These items include but are not limited to: a. researching and providing advice on boundary and survey issues and survey requirements; b. preparing work specifications and support materials for proposed surveys to support a request for specific survey instruction; c. project and contract management of surveys; d. conduct field surveys for boundary investigations and surveys by SGB staff; e. research, review and / or preparation of land descriptions by SGB staff; f. preparation of expert reports or custom mapping products including photo map overlays, and; g. training for AANDC staff and for First Nations. 4.0 DESCRIPTIONS TO SUPPORT REGISTRATION OF LAND TRANSACTION DOCUMENTS 4.1 AANDC is responsible for managing land transaction records for Reserve Lands in the Indian Lands Registry System (ILRS). New transaction documents will not be accepted into the ILRS unless the extent of lands affected by the document contains an adequate land description. This agreement sets out what is considered adequate for this purpose. 4.2 To describe the location and extent of lands subject to a land transaction that will be registered in the Registry, only the following land description products shall be used: a. Official Plan prepared under Section 29 of the CLSA, or b. Administrative Plan prepared under Section 31 of the CLSA, or c. Surveys prepared under provincial jurisdiction and recorded in a provincial lands registry with a copy recorded in the CLSR, or d. Textual Description. 4|Page 4.3 The minimum land description requirement for any new interests to be recorded in the Registry is identified in Chart A, Section 10.0 of this Agreement. 4.4 A survey plan that was authorized by Specific Survey Instructions issued prior to the signing of this Agreement may be used for the transaction that was intended in the original request for instructions. Older survey plans may be used provided the survey is technically equivalent to a survey plan required by this Agreement. 4.5 If specific circumstances warrant it or in cases where it is not clear which product should be used, the Manager of the Regional Office, Surveyor General Branch (SGB) of NRCan and the AANDC Regional Lands Manager, will jointly identify the product to use. 4.6 General plan suitability criteria for the Registry: a. When an entire interest in land is being returned to a First Nation, the original land description used to create that interest in the transaction document, is acceptable for use in the transaction document returning the interest to the First Nation, if approved by SGB (see Section 6.3); b. All Exclusive Use Parcels created by a plan, including roads to be set aside for band purposes, will be identified by a distinct lot number consistent with the records of the Registry. Non-exclusive Use Parcels, such as those that will be subject to a permit, access right of way, or easement shall not be identified with a distinct lot number; c. If the parcels created by a plan are not compatible with current registered interests, any request for registration using the plan will be rejected until the underlying interests are dealt with and the plan will not be publicized in the Registry abstracts until the plan is modified or until the individual interests are dealt with. d. A description used in a transaction document currently in the Registry, may continue to be used on subsequent transactions of that parcel as long as there are no changes to the parcel. 4.7 Existing Exclusive Use Parcels which are shown on a recorded survey plan prepared from a field survey, or which are described by reference to Township Sections, may be subdivided without surveying the entire parcel. A remainder parcel is created when an Exclusive Use Parcel has a smaller parcel subdivided and removed from the original or parent parcel. Subject to Section 4.8, a remainder parcel may be permitted by the Registry as long as the remainder parcel can be described by reference to two or more survey plans (For example Lot 1 on Plan X, except Lot 2 on Plan Y). 4.8 Remainder parcels described in Section 4.7 must be dealt with by a new survey, either as part of a fully surveyed Plan of Survey or on a separate Compiled Plan of Survey, and assigned a distinct parcel designator, in the following cases: a. Where the parent parcel being subdivided is not shown on a recorded plan of survey which is based upon a field survey; b. Where the subdivision of a parcel creates two disjointed or unconnected remainder parcels, and these remainder parcels define an interest recorded in the Registry; 5|Page c. Where, due to the complexity of the parcel description or the potential for conflict or conflicting claims, the Registry has placed a note on the Parcel Abstract for the parcel being subdivided indicating that “Any further subdivision of the parcel will required the entire parcel to be surveyed leaving no remainder parcels.” d. Where the remainder parcel is created by the survey of a road or other right-of-way intended as an Exclusive Use Parcel, which severs a portion of the parent parcel. 4.9 Surveyors are encouraged to deal with remainder parcels as part of their survey whenever practical to do so. Persons requesting a survey still have the option of having the remainder parcel included in the survey and assigned a distinct parcel designator if they wish. Such a request should be indicated in the request for survey instructions. 4.10 Transactions recorded in the First Nations Land Registry or a registry created by Self-Government Land Registry will contain an adequate land description as specified in regulations specific to those registries. In the absence of an agreement specifying survey requirements for transactions filed in these registries, Chart A in Section 10.0 will be applied. 5.0 DESCRIPTIONS TO SUPPORT FIRST NATIONS LAND MANAGEMENT ACT IMPLEMENTATION 5.1 In accordance with the First Nations Land Management Act [S.C. 1999 c.24], The Surveyor General of Canada Lands has the mandate to approve a land description of Reserve Lands or First Nation lands that will be subject to a First Nation Land Code under the Act. The Surveyor General has the sole authority to determine if a land description is adequate for this purpose. 5.2 Land descriptions will be prepared by SGB in accordance with guidelines prepared for this purpose. In general, land descriptions will reference survey documents recorded in the Canada Lands Surveys Records or other public land registries. 6.0 DESCRIPTIONS TO SUPPORT AN ADDITION TO RESERVE 6.1 Land descriptions for a proposed Addition to Reserve will be prepared by SGB at the request of AANDC. SGB will review existing survey records and advise AANDC on the suitability of these documents or the need for additional survey work. In general, the description of proposed Addition to Reserve lands will be based upon Plans recorded in the CLSR. 6.2 Plans depicting surveys carried out under provincial legislation and approved by provincial authorities, that define boundaries of land that may subsequently become reserve lands, may be used in a land description for a proposed Addition to Reserve after a copy of the provincial plan is recorded in the CLSR. The Manager of the Regional Office, SGB must be consulted to decide if the existing provincial plan is satisfactory and suitable for recording in the CLSR. 6|Page 6.3 Where former reserve lands are being returned to Canada for proposed Addition to Reserve, the land description used to remove the lands from the reserve may be used, if approved by SGB. 7.0 SURVEY PLAN TYPES The National Standards for the Survey of Canada Lands sets out standards for survey products referenced in this Agreement. The following are only general descriptions of the various survey plan products. “Plan of Survey of…” is a plan prepared from a full field survey with official survey monuments placed to reference all corners of the parcels or boundary. “Compiled Plan of…” is a plan prepared or compiled entirely from information found on plans and field notes recorded in the CLSR or provincial registry. A Compiled Plan may be used to create a new parcel where all the corners of the new parcel have been previously defined by surveys; it may be used to describe a Remainder Parcel (see Section 4.7); or it may be used to consolidate existing surveyed parcels. “Explanatory Plan of…” is graphical description of a parcel, prepared without a full field survey of the boundaries. Parcel boundaries are defined by, or in relation to, existing boundaries or monuments shown on plans and field notes recorded in the CLSR. Explanatory Plans are suitable for short-term Exclusive Use Parcels or for Non-Exclusive Use Parcels, or for a Band Vote for Designation. “Plan of Building Unit(s)…” is a plan prepared to show separate units within a constructed building. “Plan of Air Space Parcel(s)…” is a plan prepared to show parcels with an upper and lower vertical limit and may be used for exclusive use interests and nonexclusive use interests. 8.0 REQUESTING SURVEY INSTRUCTIONS 8.1 Surveyors submitting a request for Survey Instructions to SGB, will include: a. Authorization to enter onto Reserve Lands to conduct the survey; b. Information on the nature and term of the land transaction for which the survey is intended; c. A sketch of the proposed parcels to be created, and; d. Any other information pertinent to the survey, such as unsurveyed registered interests which appear on the Registry eRIP mapping, or un-documented encumbrances identified by the First Nation or evident on site, which may affect the proposed survey. 8.2 It remains the surveyor’s responsibility to be aware of all registered interests affecting the survey and to ensure he or she has the authorization from registered interest holders to carry out the survey. Where the surveyor does not feel comfortable researching the status of lands being surveyed, or where questions or 7|Page issues arise, the surveyor should request a land status review by AANDC or the First Nation having land management responsibilities over the lands being surveyed. 8.3 SGB will, upon receipt of a complete request, issue Survey Instructions for a survey under this agreement. SGB will strive to issue Instructions within 2 business days. 9.0 PLAN APPROVAL AND PROCESS 9.1 Any survey plans used to create new parcels, including easements, rights-ofway and permit areas, within Reserve Lands must be approved by the First Nation Council prior to being submitted to SGB for recording. This approval is for the creation of the new parcels shown on the plan; that the plan is suitable for the intended transaction, and; that the plan meets with any planning or land use requirements of the First Nation. The approval can be in any format as long as it clearly documents the name(s) and title(s) of the person(s) approving the survey on behalf of the First Nation Council. It is the surveyor who will be responsible for obtaining approval prior to submitting it with his or her survey returns to SGB. AANDC regional personnel may assist First Nations in confirming survey plans are satisfactory. 9.2 AANDC retains the right to approve a survey plan on behalf of a First Nation Council under Section 9.1 for Reserve Lands managed under the Indian Act. If approval required by Section 9.1 is not obtainable after 30 days, the surveyor may submit the survey plan to SGB along with a request that AANDC seek approval or approve the survey on behalf of the First Nation Council. The surveyor must include evidence of his or her attempts to obtain approval of the plan and any documented concerns from the First Nation Council. AANDC will review such requests and the circumstances around the request before considering whether or not to seek or issue such approval. 9.3 Pursuant to Section 29 of the CLSA, an Official Plan of Survey will not be confirmed unless it is considered satisfactory to the Minister of AANDC or by the authorities given in the legislation for Self Governing First Nations. Surveys under this section, for parcels to be removed from Reserve Lands, will create a jurisdictional boundary once the lands are removed and therefore require an Official Plan under Section 29 of the CLSA. 4. This Plan is intended for Section 35 Indian Act transfers or equivalent. 5. This includes Section 20 Indian Act allotments, Section 24, 49 and 50 Indian Act transfers, Section 18(2) Welfare of the First Nation interests, and equivalent. 6. “Lease” includes a head-lease or a sub-lease. The terms of the lease include any renewal or extension provisions contained in the lease. 7. A lease, permit, or license for 10 years or less may be described by textual description if the Registry feels it is in the best interests of the First Nation, given the circumstances, to do so. Generally an Explanatory Plan is required. Land Administrators should be aware that textually described parcels do not appear on the SGB parcel mapping or eRIP. 9|Page 11.0 AMENDMENT 11.1 This Interdepartmental Letter of Agreement may be amended at any time by the mutual written agreement of the Participants. 12.0 EFFECTIVE DATE, REVIEW, AND DURATION OF AGREEMENT 12.1 This Interdepartmental Letter of Agreement becomes effective on January 5th, 2015. 12.2 The Participants agree to review this Agreement every four years from the implementation date. 12.3 This Agreement ends ten years from the implementation date or upon 90 days written notice by either Participant to the other Participant.
