C-29.01 CONSTITUTIONAL QUESTIONS 2012 PART II Reference Reference to Court of Appeal 2(1) The Lieutenant Governor in Council may refer any matter to the Court of Appeal for hearing and consideration, and the Court of Appeal shall hear and consider the matter. (2) If the Lieutenant Governor in Council includes in the terms of the reference that the opinion and reasons of the Court of Appeal shall be deemed a judgment, the opinion and reasons of the Court of Appeal shall be deemed a judgment. (3) The terms of the reference shall: (a) set out the subject of the reference; and (b) name the parties to the proceedings. Court of Appeal opinion and reasons 3 The Court of Appeal shall certify to the Lieutenant Governor in Council its opinion and reasons on the matter referred in the same manner as in the case of a judgment, and a judge who differs from the opinion or reasons of the majority may dissent in the same manner as a judgment. Attorney General for Saskatchewan 4 The Attorney General for Saskatchewan is a party to any hearing pursuant to section 2 or 10 and any appeal pursuant to section 9. Attorney General of Canada 5(1) If the matter referred to the Court of Appeal relates to the constitutional validity of an enactment within the meaning of The Interpretation Act, 1995 or an enactment within the meaning of the Interpretation Act (Canada), the Attorney General for Saskatchewan shall notify the Attorney General of Canada of the hearing in order that he or she may be heard. (2) The Attorney General of Canada shall give written notice to the Court of Appeal and the Attorney General for Saskatchewan within 30 days after receiving notice pursuant to subsection (1) of his or her intention to intervene. (3) If the Government of Canada is interested in a matter referred to the Court of Appeal pursuant to section 2 other than a matter mentioned in subsection (1), the Attorney General of Canada may intervene in the matter on giving not less than 30 days’ written notice to the Court of Appeal and the Attorney General for Saskatchewan. (4) If the Attorney General of Canada gives written notice of intervention pursuant to subsection (2) or (3), he or she is a party to any hearing pursuant to section 2 or 10 and any appeal pursuant to section 9. Government of other provinces 6 If the government of any other province or territory is interested in a matter referred to the Court of Appeal pursuant to section 2, the Attorney General of that province or territory may intervene in the matter on giving not less than 30 days’ written notice to the Court of Appeal and the Attorney General for Saskatchewan. 4 5 2012 QUESTIONS CONSTITUTIONNELLES ch, C-29,01 PARTIE II Renvoi Renvoi à la Cour d’appel 2(1) Le lieutenant-gouverneur en conseil peut déférer une question à la Cour d’appel, auquel cas la Cour d’appel en est saisie. (3) Le renvoi : a) énonce le sujet du renvoi; b) nomme les parties à l’instance. Avis motivé de la Cour d’appel 3 La Cour d’appel communique au lieutenant-gouverneur en conseil son avis certifié et motivé sur l’objet du renvoi de la même manière que dans le cas d’un jugement, et tout juge dont l’opinion ou les motifs diffèrent de ceux de la majorité peut exprimer sa dissidence tout comme dans un jugement. Procureur général de la Saskatchewan 4 Le procureur général de la Saskatchewan est partie à toute audience tenue en vertu des articles 2 ou 10 et à tout appel interjeté en vertu de l’article 9. Procureur général du Canada 5(1) Si la question déférée à la Cour d’appel porte sur la validité constitutionnelle d’un texte au sens de la Loi d’interprétation de 1995 ou d’un texte au sens de la Loi d’interprétation (Canada), le procureur général de la Saskatchewan avise le procureur général du Canada de l’audience afin qu’il puisse être entendu. (2) Dans les 30 jours suivant réception de l’avis mentionné au paragraphe (1), le procureur général du Canada avise par écrit la Cour d’appel et le procureur général de la Saskatchewan de son intention d’intervenir. C-29.01 2012 Notice to interested persons 7 The Court of Appeal may direct that any person interested, or, if there is a class of persons interested, any one or more persons as representatives of that class, shall be notified of the hearing, and those persons may apply to be heard as intervenors on the matter. Appointment of counsel for unrepresented interests 8(1) If any interest affected is not represented by counsel, the Court of Appeal may request counsel to argue the case in that interest. (2) Counsel mentioned in subsection (1) is entitled to reasonable expenses that shall be paid out of the general revenue fund. Appeal 9 A deemed judgment pursuant to subsection 2(2) or 16(3) may be appealed as in the case of a judgment of the Court of Appeal. Judge in chambers 10(1) A single judge of the Court of Appeal sitting in chambers may hear and dispose of an application or motion that is incidental to a reference pursuant to section 2 and that does not involve the decision of the reference on the merits. (2) An order made by a judge in chambers pursuant to subsection (1) may be discharged or varied by the Court of Appeal. Court of Appeal rules 11 The judges of the Court of Appeal, or a majority of them present at any meeting held for that purpose, may make rules for the purpose of hearing a reference. PART III Notice on Constitutional Questions or Challenge to Regulations Interpretation 12 In this Part: “court” means the Court of Appeal, the Court of Queen’s Bench, the Provincial Court of Saskatchewan or The Traffic Safety Court of Saskatchewan; (« tribunal ») “law” includes: (a) an enactment as defined in The Interpretation Act, 1995; (b) an enactment within the meaning of the Interpretation Act (Canada); (« texte ») “remedy” means a remedy provided pursuant to section 24 of the Canadian Charter of Rights and Freedoms but does not include a remedy of exclusion of evidence or a remedy consequential on exclusion of evidence. (« réparation ») Notice to Attorneys General required for constitutional questions 13 No court shall hold any law to be invalid, inapplicable or inoperable if a constitutional question is raised nor shall it grant any remedy unless notice is served on the Attorney General of Canada and on the Attorney General for Saskatchewan in accordance with this Part. 6 7 2012 QUESTIONS CONSTITUTIONNELLES ch, C-29,01 Avis aux intéressés 7 La Cour d’appel peut ordonner qu’une personne intéressée ou des représentants d’une catégorie de personnes intéressées soient avisés de l’audience, et ces personnes peuvent demander d’être entendues à titre d’intervenants dans le renvoi. Appel 9 Un avis ayant valeur de jugement par application du paragraphe 2(2) ou 16(3) peut être porté en appel comme s’il s’agissait d’un jugement de la Cour d’appel. Juge siégeant en cabinet 10(1) Lorsqu’une demande ou une motion est incidente à un renvoi fait en vertu de l’article 2 et n’a pas d’effets déterminants sur le fond du renvoi, un juge de la Cour d’appel siégeant seul en cabinet peut l’entendre et statuer sur elle. (2) Une ordonnance rendue par un juge siégeant en cabinet conformément au paragraphe (1) peut être annulée ou modifiée par la Cour d’appel. Règles de la Cour d’appel 11 Les juges de la Cour d’appel peuvent, à l’unanimité ou à la majorité des juges présents à une séance tenue à cette fin, établir des règles régissant l’audition d’un renvoi. PARTIE III Avis de questions constitutionnelles ou de contestation de règlements Définitions 12 Les définitions qui suivent s’appliquent à la présente partie. « réparation » Toute réparation prévue par l’article 24 de la Charte canadienne des droits et libertés, sauf l’exclusion d’éléments de preuve ou quelque autre réparation découlant de celle-ci. (“remedy”) « texte » S’entend notamment : a) d’un texte au sens de la Loi d’interprétation de 1995; b) d’un texte au sens de la Loi d’interprétation (Canada). (“law”) « tribunal » La Cour d’appel, la Cour du Banc de la Reine, la Cour provinciale de la Saskatchewan ou le Tribunal de la sécurité routière de la Saskatchewan. (“court”) Préavis obligatoire aux procureurs généraux pour les questions constitutionnelles 13 Lorsqu’est soulevée une question constitutionnelle, le tribunal ne peut tenir un texte pour invalide, inapplicable ou inopérant ni accorder une réparation à moins qu’avis ait été signifié au procureur général du Canada et au procureur général de la Saskatchewan en conformité avec la présente partie. 7 8 CONSTITUTIONAL QUESTIONS c. C-29.01 2012 Notice to Attorney General for Saskatchewan required for a challenge to regulations 14 If, in any court, the validity of a proclamation, regulation or order in council made or purportedly made in the execution of a power given by an Act is brought into question on grounds other than those mentioned in section 13, the court shall not hold the proclamation, regulation or order in council to be invalid unless notice is served on the Attorney General for Saskatchewan in accordance with this Part. Notice requirements 15(1) Subject to subsection (2), a notice mentioned in section 13 or 14 must be served at least 14 days before the day of argument. (2) The court may, on an ex parte application made for the purpose, order an abridgement of the time for service of a notice mentioned in section 13 or 14. (3) A notice mentioned in section 13 or 14 must include: (a) the name of the action, cause, matter or proceeding in which the question arises or application is made; (b) the law or provision in question, if any; (c) the basis for the challenge; (d) the right or freedom alleged to be infringed or denied, if any; (e) the day and place for the argument of the question; and (f) the facts that will be relied on in argument. (4) The Attorney General for Saskatchewan is entitled as of right to be heard in any action, cause, matter or proceeding to which section 13 or 14 applies. (5) The Attorney General of Canada is entitled as of right to be heard in any action, cause, matter or proceeding to which section 13 applies. (6) If the Attorney General of Canada or the Attorney General for Saskatchewan appears in an action, cause, matter or proceeding to which section 13 or 14 applies, he or she is a party for the purposes of appeal from an adjudication respecting the validity, applicability or operability of a law or respecting entitlement to a remedy. (7) If the Attorney General of Canada or the Attorney General for Saskatchewan is not given proper notice pursuant to section 13 or 14 as the case may be, he or she has the right to appeal an adjudication and is a party for the purpose of an appeal. (8) If any administrative tribunal considers it appropriate in any matter, the tribunal may require that notice be given to the Attorney General for Saskatchewan in accordance with this section. PART IV Taxation Agreement Reference Reference pursuant to taxation agreement 16(1) If pursuant to an agreement with the Government of Canada entered into pursuant to The Income Tax Act or The Income Tax Act, 2000, or an agreement of a like nature and having like purposes, a matter is to be referred to the Court of Appeal, it shall be referred to the Court of Appeal and the form and terms of the reference shall be those that may be agreed on by the parties to the agreement, or, if they cannot agree, the form and terms shall be determined by the Chief Justice of Saskatchewan on the application of either party. 8 9 2012 QUESTIONS CONSTITUTIONNELLES ch, C-29,01 Préavis obligatoire au procureur général de la Saskatchewan pour contester un règlement 14 Un tribunal saisi de la remise en question – pour des considérations autres que celles évoquées à l’article 13 – de la validité d’une proclamation, d’un règlement ou d’un décret qui aurait été pris en vertu d’un pouvoir conféré dans une loi ne peut tenir ceux-ci pour invalides à moins qu’avis ait été signifié au procureur général de la Saskatchewan en conformité avec la présente partie. (4) Le procureur général de la Saskatchewan peut de droit se faire entendre dans toute action, cause, affaire ou procédure visée par les articles 13 ou 14. (5) Le procureur général du Canada peut de droit se faire entendre dans toute action, cause, affaire ou procédure visée par l’article 13. (6) Lorsque le procureur général du Canada ou le procureur général de la Saskatchewan comparaît dans une action, une cause, une affaire ou une procédure visée par les articles 13 ou 14, il devient partie à tout appel d’une décision rendue à propos de la validité, de l’applicabilité ou du caractère opérant d’un texte, ou à propos du droit à réparation. (7) Si le procureur général du Canada ou le procureur général de la Saskatchewan ne reçoit pas l’avis prévu aux articles 13 ou 14, selon le cas, il a le droit d’appeler de la décision rendue et devient partie à l’appel. (8) Dans toute affaire, un tribunal administratif peut ordonner, s’il l’estime indiqué, qu’avis soit donné au procureur général de la Saskatchewan en conformité avec le présent article. PARTIE IV Renvoi relatif à un accord fiscal Renvoi consécutif à un accord fiscal 16(1) Lorsqu’un accord conclu avec le gouvernement du Canada sous le régime de la loi intitulée The Income Tax Act ou de la loi intitulée The Income Tax Act, 2000 – ou un accord de nature ou à objet semblables – prévoit la possibilité d’un renvoi à la Cour d’appel, c’est celle-ci qui en est saisie, et la forme du renvoi ainsi que le mandat donné sont ceux convenus entre les parties à l’accord ou, à défaut d’entente, sont fixés par le juge en chef de la Saskatchewan à la demande d’une des parties. 9 10 c. C-29.01 CONSTITUTIONAL QUESTIONS 2012 (2) The Attorney General of Canada and the Attorney General of any other province that entered or enters into an agreement with the Government of Canada of a like nature and having like purposes to an agreement mentioned in subsection (1) may be heard in the Court of Appeal as a party with respect to any matter referred pursuant to this Act under that agreement. (3) The opinion and reasons of the Court of Appeal pursuant to this section shall be deemed a judgment. PART V General Service 17(1) Any notice to be provided to the Attorney General for Saskatchewan pursuant to this Act shall be served by leaving a copy with the Attorney General for Saskatchewan, the Deputy Attorney General for Saskatchewan or any lawyer employed in the Ministry of Justice and Attorney General and designated by the Attorney General for Saskatchewan for the purpose of this section. (2) Any notice to be provided to the Attorney General of Canada pursuant to this Act shall be served by leaving a copy with the Attorney General of Canada, the Deputy Attorney General of Canada or any lawyer employed by the Attorney General of Canada and designated by the Attorney General of Canada for the purpose of this section. R.S.S. 1978, c.C-29 repealed 18 The Constitutional Questions Act is repealed. S.S. 2000, c.C-42.1, section 22 amended 19 Clause 22(d) of The Court of Appeal Act, 2000 is amended by adding “other than The Constitutional Questions Act, 2012 ” after “pursuant to any Act”. Coming into force 20 This Act comes into force on assent. 10 11 2012 QUESTIONS CONSTITUTIONNELLES ch, C-29,01 (2) Lorsqu’une autre province conclut ou a conclu avec le gouvernement du Canada un accord dont la nature et l’objet sont semblables à ceux d’un accord visé au paragraphe (1), le procureur général du Canada et le procureur général de cette province peuvent se constituer parties et se faire entendre par la Cour d’appel dans tout renvoi fait en vertu de cet accord et régi par la présente loi. PARTIE V Dispositions générales Signification 17(1) Tout avis destiné au procureur général de la Saskatchewan conformément à la présente loi est signifié en laissant une copie de l’avis à lui-même, au sousprocureur général de la Saskatchewan ou à un avocat qui travaille au ministère de la Justice et du Procureur général et qui a été désigné par le procureur général de la Saskatchewan pour l’application du présent article. (2) Tout avis destiné au procureur général du Canada conformément à la présente loi est signifié en laissant une copie de l’avis à lui-même, au sousprocureur général du Canada ou à un avocat qui travaille pour le procureur général du Canada et qui a été désigné par lui pour l’application du présent article. Abrogation du ch. C-29 des L.R.S. 1978 18 La loi intitulée The Constitutional Questions Act est abrogée. Modification de l’article 22 du ch. C-42.1 des L.S. 2000 19 L’alinéa 22d) de la Loi de 2000 sur la Cour d’appel est modifié par adjonction de « autre que la Loi de 2012 sur les questions constitutionnelles » après « conformément à une loi ». Entrée en vigueur 20 La présente loi entre en vigueur sur sanction. 11 12 c.
